INTRODUCTION

1 . Section 23 (1) (c) of the National Conventional Arms Control Act (Act 41 of2002) provides that the Nati l Conventional Arms Control Committee(NCACC) should provide an an uel report on all conventional arms exportsconducted during the precedin year. In accordance with the legislativerequirement cited above, the N ACC presents the NCACC's 2003 and 2004annual reports .

2. This 2003 and 2004 NCACC annual report (s) provides Information on theconventional arms exports condu ed by South Africa in the two stated calendaryears .

NCACC'S LEGISLATIVE FRAMEWORK AND MANDATE

3. The NCACC is a Committee) established In terms of law to regulate theconventional arms sector in So Africa . Section 3 of the National ConventionalArms Control Act (Act 41 of 200) provides for the object and mandate of theNCACC. Section 4 of this Act provides for the functions of the NCACC, whichcould be summarized as the regulation of development, manufacturing andtransfer of conventional arms in South Africa. The Regulations to the NationalConventional Arms Control Act ct 41 of 2002) dated 28 May 2004 providesdetails on how the regulation of tre conventional arms sector is conducted.

4. Section 5 of the National Conventional Arms Control Act (Act 41 of 2002)provides for the membership of the NCACC, Members of the NCACC areCabinet Ministers and Deputy Ministers appointed by the President. TheChairpersonship and Deputy Chairpersonship positions of the NCACC are held

by Cabinet Ministers who do not have fine function interests in the conventionalarms business. This has been ddne for purposes of ensuring the NCACC'sobjectivity .

5. In order to provide for secrete t support to the NCACC, Section 8 of theNational Conventional Arms Con Act (Act 41 of 2002) provides for theestablishment of the Directorate Conventional Arms Control (OCAC) . ThisDirectorate is located within the rtment of Defence (Defence Secretariat) .This Directorate has a specific function as provided for in the Act Briefly thisfunction is to povide for an administrative mechanism to prepare docurnentatonfor the NCACC and serve as the line of communication between the NCACC, thedefence related industry and all

r relevant stakehotders .

6. Prior to the National Convents I Arms Control Act (Act 41 of 2002) cominginto being in 2003, the conventional arms sector regulation was conducted underthe Armaments Development and rocrmement Act (Act 57 of 1968) . This Acthas since been repealed and re aced by the current National ConventionalArms Control Act (Act 41 of 2002) .

9. jL-enislative Developments ., In May 2003, the National Conventional ArmsControl Act (Act 41 of 2002) came into force thus totally repealing theArmaments Development and Procurement Act (Act 57 of 1968), which hadbecome outdated. The National Conventional Control Act (Act 41 of 2002) thusconstitutes a new regulatory framework under which the NCACC business isconducted. In order to provide for more details to the' provisions of the said newAct, a process was started at this period to draft Regulations to this Act.

10. Promotion of Adminjji alive Justices. The Promotion of AdministrativeJustice Act (Act 3 of 2000) entrenches individuals' rights to be subjected toprocedurally fair administrative actions. in terms of this Act, individuals have legalfights to be furnished with reasons pertaining to administrative decisions takenagainst them.

11 . In the context of conventional arms control, individuals or companies whoseapplications have been turned down by the NCACC have a legal basis to requestreasons for such decisions. Taking into account the sensitivity and confidentialityof some cases that the NCACC deals with, it is not always possible to providereasons for ail permit applications turned down. In view of this, the NCACCdecided to request an exemption from the full application of this Act This requestwas based on Section 1 of the Act, which provides that the Minister of Justice-has the power to exempt administrative institutions from the application of theAct

12.A dment of Cabinnet_.Memorandum No-4-of 1497 . in 1997 a CabinetMemorandum was prepared on the destruction of small arms and ammunition .This Cabinet Memorandum had specific recxomrnendations for Cabinet approval .On the basis of that Cabinet Memorandum, Cabinet took a decision that°disposal l;<ould by , means of destruction, of all redundant, obsolete,unserviceable and confiscated semi-automatic and automatic weapons, artdpurposelint sniper rifles of a caliber smaller than 12,7 (50-inc)) as well as allamrnunilon for them held in stock by the Department of Defence and otherGovernment department andpara_statals " .

13, During the implementation of this decision there was, however, interpretationconfusion. There was confusion on whether the Cabinet decision included smallarms of a 12,7 mm caliber or it excluded such caliber. In order to address thisinterpretation confusion, a need arose for the Cabinet Memorandum on which the

Cabinet decision was based to the amended . The process to amend the saidCabinet Memorandum commenced at this period but was to culminate in 2004 .

14.~tatlonf Fareian Military Assistance . In the period under review, theNCACC considered two applications for rendering military assistance in foreigncountries. These applications were submitted to terms of the Regulation ofForeign Military Assistance Act (Act 15 of 1998). The NCACC denied permits toboth these applications .

15. In the same period, the NCACC referred two cases to the National Director ofPublic Prosecutions for consideration and possible prosecution . This was due tothe fact'that in the view of the NCACC and the South African Police Service, theprovisions of the Regulations of Military Assistance Act (Act 15 of 1998) wereviolated . The National Director of Public Prosecutions, however, Indicated that hecould not prosecute the persons Involved in the case due to difficulties inobtaining the necessary evidence for the cases .

16.Permit Anplicabons. As its primary function, the NCACC considers defenceindustry's permit applications and Issues or denies such permits . In executingthis important function, the NCACC considers aU relevant factors as stipulated inSection 15 of the National Conventional Arms Control Act (Act 41 of 2002) . TheNCACC considers each and every permit application presented to it on't a basisof its awn 'merits. In the period under review, the NCACC considered thefollowing categories of permit applications :

a. Marketing Permit Applications, 47 .

b. Contracting Permit Applications, 3Z6 .

c. Export Permit Applications, 1980 .

d. Import Permit Applications, 978 .

e, Transit Permit Applications, 42 .

17. Details on these applications in terms of approvals, countries and equipmentcategories involved are contained on Appendix 'A and 8 of this report

18.Campllance Matters. Section 9 of the National Conventional arms ControlAct (Act 41 of 2002) provides that a Conventional Arms Control Inspectorate beestablished for purposes of ensuring that the defence industry and all otherrelevant role players comply with the laid down conventional arms controlregulations. In terms of the said section of the Act, the Inspectorate reportsdirectly to the NCACC .

into force of the Conventional Arms Control Regulations refined to In theprevious paragraph, the NCACC decided that the amendment to the 1997Cabinet Memorandum was no longer necessary . This was due to the fact that theIssues addressed In the Draft Amendment were already adequately covered inSection 4 (2) of the new Regulations .

24. R, emulation of Foreign MilitaryAss1stance . In the period under review, theNCACC considered and referred three cases to the National Director of PublicProsecutions for possible prosecution in terms of the Regulations of MilitaryAssistance Act (Act 15 of 1998). The National Director of Public Prosecutionsdeclined to prosecute for reasons of difficulty in obtaining sufficient evidence .

26. Details on these applications In terns of approvals, countries and categoriesof equipment involved are contained on Appendix C and D of this submission .

a . Compliance&Verification Matters. In fine with its statutory function,the Conventional Arms Control Inspectorate conducted complianceand verification exercises both in South AfrI and internationally .

27. Other Matters. The NCACC exercises control over the Arms Control & Non-Prolftration Fund .

CONCLUSION

28, in the period under review, the NCACC conducted all the activities indicatedabove in pursuance of its function as contemplated in the National ConventionalControl Act (Act 41 of 2002) . In conclusion It is important to note that theactivities of the NCACC, over the reporting periods, have contributed significantlyto the strengthening of the country's arms control regime thus position SouthAfrica firmly In the international conventional arms control arena_
