ARTICAL1-GENERALARCHITECTURALCONTROLINFORMATION

Section a. Duties of the Architectural Review Committee In accordance with the Declarations andBylawsfortheReserveatWestcreekOwnersAssociation, theArchitecturalReviewCommittee(ARC)formerlyreferredtoastheArchitecturalControlCommittee(ACC)shallconsistofthree(3)membersappointedbytheBoardofDirectors. MembersoftheARCshallholdtheir individualpostsonan“atwill”basisandmaybereplacedbytheBoardofDirectorswithoutcause.ShouldaMemberoftheARCwishtoresigntheirpostitisrequestedthattheyprovideatwo-weeknoticetotheBoardofDirectorstoallowpropertimetoconductasearchforareplacementofthatpost.ThepurposeoftheARCistomaintainthearchitecturalstandardsoftheReserveatWestcreekOwnersAssociationand toapproveordisapproveplans for improvementsor changes to theexteriorofanyunitwithinthecommunity.Anypermanentornon-movablechange,modification,oraddition,whichmeetsanyofthefollowingconditionswillbesubjecttoarchitecturalreviewandapproval;a.visiblefromthestreetoradjacentproperty,b.affectsdrainageorsoilabsorption,orc.impactseasementsorutilityaccess.Noresidence,outbuilding,shed,fence,wall,pool,athleticfacilityorotherstructureorimprovementshallbeerected,altered,addedontoanyportionoftheUnitpropertywithoutthepriorwrittenconsentoftheARC.TheARCwillactbysimplemajorityvote,andwillhavetheauthoritytodelegateitsdutiesortoretaintheservicesofaprofessionalengineer,architect,designer, inspectororotherpersontoassist intheperformanceofitsdutiesprovidedthatanyrelatedcostsforsuchservicesaresecuredbymeansofaminimumofthreebidsforsaidservices.ThesebidswouldthenbepresentedtotheBoardofDirectorsforapproval/disapproval.SuchexpensesmaybepassedalongtotheOwner.HomeownersmayappealadecisionfromtheARC,directlytotheboardofdirectorswithawrittenrequest.

Upon reasonablenotice (oralorwritten),anymemberof theARC,Board,Managementcompanyortheir designated representatives,may enter a Lotwithout liability for trespass or otherwise for thespecificpurposeofinspectingworkinprogressand/orastocompletionofanyregulatedmodificationincompliancewiththeapprovedplans,specifications, informationanddocumentationforsame,andastocompliancewithanyapplicableprovisionsoftheGoverningDocuments.

The ARC shallmaintain records of any of theirmeetings. The ARCmust keep andmaintain recordsevidencing their respective final decision(s) regarding all requests for approval and requests forvariancefornotlessthanfouryears.TheARCmustalsomaintainarecordofallcurrentArchitecturalGuidelines,andmustprovidecopiestoOwnersuponrequest.

Section b. Compliance with International Building Code (IBC)/ Travis County Code All buildings,structures, changes in the footprint of Units including hardscape, pergolas, decks, patio enclosures,sunrooms, outbuildings, walls/fencing, pools, athletic facilities or other structures or improvementsshallbe incompliancewithanyandall InternationalBuildingCodes (IBC)andTravisCountyBuildingDepartment Codes or anyMunicipality Building Codes thatmay apply. If permitting of any of theabove listed improvements is required by Travis County Building Department or any MunicipalityBuildingCodesthenitistheobligationoftheUnitOwner(s)tofirstsubmitplansandspecificationstotheARCforreview.UponARCapproval,theownermaythensubmittheproperapplication/planstosaidbuildingdepartment,paypresidingfeesandprovidetheARCwithacopyofanypermitrequiredalongwithasetofplansstampedbythebuildingdepartmentindicatingapproval.

Sectionc.ArchitecturalTheme/PlanReviewArchitecturalstylesmayvarythroughoutourcommunity.Thisispartofwhatmakesourneighborhoodoneofdistinctionincomparisonwithoursurroundings.Designs incorporated were a well thought out design blend of Traditional, Tuscan, Craftsman andContemporary.

UponreceiptbytheARCofalloftheinformationrequiredbytheseArchitecturalDesignGuidelinestheARCwill have thirty-days (30) in which to review said plans. The proposed improvementswill beapprovedif,inthesoleopinionoftheARC:(a)theimprovementswillbeofanarchitecturalstyleandmaterialthatareconsistentwiththeoverallconceptofourcommunity,(b)theimprovementswillnotviolateanyrestrictivecovenantorencroachuponanyeasementorcrossplattedbuildingsetbacklines,(c) the individual or company intended to perform the work is acceptable to the ARC and (d) theimprovementswill be substantially completed, including all cleanupwithin15daysof theprojectedcompletiondateofthesaidprojectwhichmustbepartoftheoriginalapplication.IftheARCfailstoissueitswrittenapprovalwithinthirty-days(30)ofitsreceiptofthelistofthematerialsordocumentsrequiredincompletingtheOwner(s)submission,suchfailurebytheARCtoissueitswrittenapprovalshall be deemed as disapproval. If there results in a significant or material deviation from theapprovedplansthecompletedimprovements,shallbedeemedinviolationofthisSectiontothesameextentasiferectedwithoutpriorapprovaloftheARC.TheARC,theAssociationoranyOwner(s)maymaintainanactionat lawor inequityfortheremovalorcorrectionofthenon-conformingstructureand, ifsuccessful,will recoverfromtheOwner(s) inviolationallcosts,expensesandfees incurred intheprosecutionthereof.Sectiond.ImmunityofARCMembersNoindividualMemberoftheARCwillhaveanypersonalliabilitytoanyOwneroranyotherpersonfor theactsoromissionof theARC ifsuchactsoromissionwerecommittedingoodfaithandwithoutmalice. TheAssociationwilldefendanyactionbroughtagainsttheARCoranyMemberthereofarisingfromactsoromissionoftheARCcommittedingoodfaithandwithoutmalice.TheapprovaloftheARCrequiredherebyshallbeinadditionto,andnotinlieuof,anyapprovals,consentsorpermitsrequiredundertheordinancesorrulesandregulationofanycountyormunicipalityhavingjurisdictionovertheapplicablelotwithintheReserveatWestcreekcommunity.Sectione. ContactInformationTheARCconsistsofthreeMemberswithat leastone(butnotmorethan two) board member and shall serve one year terms. Requests for ARC approval orcorrespondencewith theARC shall be submitted electronically atwww.ReserveAtWestcreek.comorsubmittedtothemanagementcompany.

ARTICLE2-ACCESSORYSTRUCTURES

Sectiona. StorageSheds Storageshedsareapprovedforuse inrearyardsonlyunderthefollowingconditions.Astorageshedisdefinedasastructureusedexclusivelyforstorageanddoesnotexceed80s.f.ofroofarea.Maximumheightofstructureshallnotexceedeight(8)feetorextendmorethantwo (2) feet above the property fence line at the location of the installation, whichever is less.Structureshallnotbepermanentlyattachedtoanywall. Maincolorandaccentcolorsshouldmatchtheresidenceascloseaspossible.Neutralcolorssuchasoffwhiteandtanarealsoacceptable.Colorsshouldbenon-reflective. Materials canbewood,plastic, vinyl cladmetal,orpaintedmetal. Shedsmustbemaintainedinoriginalcondition.TheARCretainstherighttodeterminewhentheshedneedstoberepairedorremovedduetodeterioration.ARCapprovalisnotrequiredforanyshedundersix(6)feetinheightlocatedbehindthefence.Anystructurewithanintendeduseotherthanstorage,or

has a height and/or area greater than the above guidelines will be classified and an “accessorybuilding”.Section b. Accessory Buildings Prior to construction of any accessory building, plans must besubmittedtotheARCandwillbeconsideredonacasebycasebasis.Maximumheightforaccessorybuildings is eight (8) feet. Building and roof structures shall be of the samematerials as themaindwelling. Ten (10) to fifteen (15) feet setbacks may be required, depending on orientation toneighboringproperties.Allaccessorybuildingsmustbebuiltinaprofessionalmannerandmaintainedtothesamestandardsasthemaindwelling.AccessorybuildingsmustcomplywithArticle3,Sectiond.Roofing/Roof Structures and Article 3 Section c. Impervious Ground Cover as set forth in theseArchitecturalDesignGuidelines.TheARCwillrequireanelectroniccopyofplansforreview.Sectionc.Gazebos/Decks/PergolasGazebosandPergolasaredefinedasfreestanding(orattachedtothemainresidence)permanentstructuresthatfunctionasoutdoor“rooms”.PriortoanyconstructionthesestructuresmustbesubmittedtotheARCforapproval.TheARCwillrequireanelectroniccopyof plans submitted with application for review with name and contact information of any and allcontractor(s) doing the work. Approved materials for these types of structures are; Western RedCedar,extrudedvinyl,compositeproducts,redwood,cumaru,redtauari,tigerwood,ipe,Mahogany,precast columns, other hardwoods, and/or powder coated aluminum. Other materials may beapproved by the ARC on a case-by-case basis. It is recommended that unfinished pressure treatedlumberbe reserved foruseon for floor joists,and/orpostswithavinylcladcovering. TheARCwillrequireanelectronic copyofplans for review (neednotbedrawnbya licensedarchitect).TheARCretainstherighttodeterminewhenanyofthesetypesofstructuresareinneedofpainting/stainingorremovalduetodeterioration.Sectiond.Ramadas/PatioCoversPermanent ramadasmaybe freestandingorattached to themainresidence. These types of structuresmust be constructed ofmaterials and colors compatible withexistingstructures.SolidcoversmustcomplywithArticle3Sectionc.ImperviousGroundCoverassetforth intheseArchitecturalDesignGuidelines.Temporaryramadasarefreestandingshadestructuresdesigned foroccasionalor seasonaluse. Temporary ramadasmustnotexceedonehundred twenty(120) s.f.of surfaceareawithamaximumpeakheightofnine (9) feet. Materialmustbecanvasorsimilarmaterial,ofsolid,non-reflectivecolorwhichiscompatiblewithexistingstructures.Sectione. Play StructuresAll playgroundequipment includingbutnot limited toplayhouses, forts,swingsetsandtrampolineenclosuresvisiblefromthegroundlevelofaneighboringpropertymustbesubmittedtotheARCandwillbeconsideredonacasebycasebasis. Suchstructuresmayrequireafive(5)toten(10)feetsetbackfromneighboringpropertiesdependingontheorientation.Colorsandmaterials are subject to ARC review and approval. Maximum height for play structures, includingawnings is twelve (12) feet. Awning made of canvas or similar materials are allowed. The playstructuremustbemaintainedinoriginalcondition.TheARCretainstherighttodeterminewhenaplaystructureoranyofitscomponentsmustberepairedorreplacedduetodeterioration.

ARTICLE3-ADDITIONS,ALTERATIONSANDPAINTING

Sectiona. BuildingMaterials,TypeandSizeAllexteriorbuildingmaterialsmustbeapprovedby theARCpriortoanysubmittalofanapplicationforanyrequiredpermitstoanycountyormunicipalityforanyexterioralteration.Finishedbuildingmaterialsmustbeappliedtoallexteriorsideofbuildingsandstructures. Eachmaterial shall beused toexpress its characteristics in anappropriatemannerwithcolorandtexturescompatiblewiththemaindwellingonanyLot.Permittedexterior finishmaterialsincludestucco,brick,stone,fibercementsidingandroughsawntrim.OtheraccentfeaturesmaybeapprovedbytheARConacase-by-casebasis.Sectionb.Additions,AlterationsAnyadditionoralterationtoanydwellingorLotmustbeapprovedinwriting by the ARC in addition to any submittal to any county ormunicipality building departmenthavingjurisdictionovertheReserveatWestcreekcommunity.Sectionc.ImperviousGroundCoverImperviouscover,alsoreferredtoasimpervioussurface,referstoanythingthatwatercannotpenetrate. Imperviouscoverpreventsrainfromsoaking intotheground,turning it into storm-water runoff. Impervious groundcover shall include walkways, driveway,buildings, concrete, pool/pond surfacewater area for pools which discharge to the roadway stormdrainage system, solid roof area, and other non-permeable construction preventing absorption ofrainwater fromthenatural landsurface.Thetotalcalculatedareaof imperviousgroundcovershouldnotexceed45%ofthetotalLot.Sectiond. Sunrooms/ScreenedPatioCoverSunroomsareallowedonpatioswhichdonothaveandexistingpatiocover.Installationofsuchstructuresmustbeapprovedonacase-by-casebasisandtheARCapplication formmust includecolorsamples ifdifferent fromexistingresidencecoloraswellasroom dimensions andmaterial samples.must comply with Article 3 Section c. Impervious GroundCoverassetforthintheseArchitecturalDesignGuidelines.ScreeninginofexistingpatiocoversdoesnotrequireARCapprovalprovidedthescreenframesarenotvisiblefromthestreetandareofacolorconsistentwiththetrimorbodycolorsofthemainresidence.Sectione.Roofing/RoofStructuresAllreplacementroofingbeitcompleteremovalofoldroofingandanew application or simply an overlaymust be approved by the ARC prior to installation. Since thepredominantsinglemixcurrentlywithintheReserveatWestcreekisabasicthree(3)tabdesignwithaflatprofileanoverlayoftheexistingshingleswouldbemorecosteffective.TheARCwillalloweitherthe three (3) tab profile shingles or a high definition profile shingle provided the color of the newshinglesisconsistentwithexistingcolorscurrentlyusedwithinthecommunity.Shadecoversorpatioroofs shall be constructedofmaterials and colors tomatch theexisting roofof thedwellingonanygivenLot.Allventpipestacksandanyequipmentprotrudingabovetheplaneofanexistingroofmustbepaintedand/orscreenedtomatchthenewroofasapprovedbytheARC.Section f. Driveway Extensions Due to drainage, encroachment and aesthetic concerns drivewayextensionsofanykindareprohibitedwithintheReserveatWestcreek.

Sectiong.ChimneysShouldanOwnerelecttorequestARCapprovalofafireplaceinstallationwithinthemaindwellingoranaddition,anychimneyconstructedmustbeofthesamematerialsandtextureassaidresidence.Sectionh.Gutters/DownspoutsInstallationofguttersonanydwellingwithintheReserveatWestcreekmustbeapprovedbytheARC.Thefinishcolormustbecompatiblewiththetrimcolorsonthemainresidence. Either5”or6”K style gutterswithanominal thicknessof .027”or .032 “. Downspoutsmustbe3X4”insize.Sectioni.Lighting/SecurityCamerasExterior lightingshould be shieldedor indirect. A totaloutput of 2,000lumens shouldadequately light thefront of a typicalresidence in ourcommunity. Thefollowingisahelpfulguideastothetypesof exterior lightingthat is neighborfriendly and yetcompletely capableof lighting up youryardforsecurity.Sectionj.SolarPanels/EquipmentRoof-mountedphotovoltaicsolarpanelsandequipmentmustbeanintegratedpartoftheroofdesignandmounteddirectlytotheroofplane.Solarunitsmustnotbreaktheroofline.Solarelectric systemsmustbe interconnected to theelectricutilitygrid.Roofmountedhotwaterstoragesystemsarenotallowed.Priortoinstallationofanysolarenergydevice,theOwnermustsubmitplansforthedeviceandallappurtenancestheretototheARC.Theplansmustprovideanas-built rendering,anddetail the location, size,materials,andcolorofall solardevices,andprovidecalculationsoftheestimatedenergyproductionoftheproposeddevices.Inthissection,"solarenergydevice"meansasystemorseriesofmechanismsdesignedprimarilytoprovideheatingorcoolingortoproduceelectricalormechanicalpowerbycollectingandtransferringsolar-generatedenergy.Allsolardevicesnotmeetingthisdefinitionareprohibited.Ownersmaynotinstallsolarenergydevicesthat;a.threaten the public health or safety, b. violate a law, b. are located on property owned by theAssociation, are located in an area owned in common by themembers of the Association (i.e., theCommonElements),e.are locatedon theOwner’sdwelling,other than: i.on the roof, if the roof is

partoftheUnitandismaintainedexclusivelybytheOwner;orii.inafencedyardorpatiothatispartoftheUnitandmaintainedexclusivelybytheOwner,f.are installed inamannerthatvoidsmaterialwarranties,g.areinstalledwithoutpriorapprovalbytheARCorh.substantiallyinterferewiththeuseand enjoyment of land by causing unreasonable discomfort or annoyance to persons of ordinarysensibilities.Thisdeterminationmaybemadeatany time,and theARCmay require removalofanydeviceinviolationofthisrequirement.TheARCmayattempttocontacttheOwnersofadjoiningandotherpropertiesincloseproximity(adjoiningpropertieswillincludeallpropertiessharingaboundarylinewiththeapplicant,includingthosethatwouldshareaboundarylinebutforastreet)andprovidethemwith a copy of the plans and determine their opinion as towhether theymight consider thedevice(s) anunreasonable interferencewith theiruseandenjoymentof their property. TheOwnermust complete part 4. Notification of Neighbors - Attach additional page, if necessary: of the ARCapplicationformshowingproofofnoticetoadjoiningneighbors.Sectionk. Windows/WindowTreatments Permanentdraperiesorsuitablewindowtreatmentsshallbe installed on all front-facing dwelling windows within sixty (60) days of occupancy. Newspaper,sheetsor reflectivematerials, includingbutnot limitedto,aluminumfoil, reflectivescreensorglass,mirrors or similar type material shall not be installed or place upon the outside or inside of anywindowsincludinggaragewindows.Sectionl.Security/Screen/StormDoorsSecuritydoorsmustmatchtheoriginalfrontdoorcolororbebrown,tan,charcoalorblackincolor.AllothercolorsmustbesubmittedforapprovalbytheARC.Section m. Rain Barrels and Rainwater Harvesting Systems Owners may install rain barrels orrainwaterharvestingsystemsonlywithpre-approval fromtheARC,andonly inaccordancewith therestrictionsdescribedinthisSection. Ownersareprohibitedfrominstallingrainbarrelsorrainwaterharvesting systems, or any part thereof, in the following locations: a. on property owned by theAssociation,b.onpropertyownedincommonbythemembersoftheAssociation(i.e.,thelimitedorgeneralCommonElements),orc.ifayardareaispartoftheLot,insuchyardareabetweenthefrontoftheOwner’sdwellingandanadjoiningoradjacentstreet.Priortoanyinstallationofanyrainbarrelor rain harvesting system (or any part thereof),written permissionmust be received by theOwnerfromtheARC.OwnerswishingtoinstallsuchsystemsmustsubmitplanstotheARC:(a)showingtheproposedlocation,color(s),material(s),shielding,anddimensionsoftheproposedimprovements;(b)identifying any part of the installation that will be visible from the street, another dwelling, or aCommonElementarea;and(c)indicatinghowfar(infeetandinches)theimprovement(s)willbefromtheside,front,andbackboundarylinesoftheOwner’sLot.Ownersareprohibitedfrominstallingrainbarrelsorrainwaterharvestingsystemsthat: a.areofacolor inconsistentwiththecolorschemeoftheOwner’sdwelling,b.displayanylanguageorothercontentthatisnottypicallydisplayedbysuchabarrelorsystemasitismanufacturedorc.arenotconstructedinaccordancewithplansapprovedbytheARC.IfanypartoftheimprovementisinstalledinasideyardareathatispartofaLotorotherwisewillbevisiblefromthestreet,anotherLotortheCommonElements,theARCmayimposerestrictionsonthesize,type,materials,andshieldingoftheimprovement(s),whetherthroughdenialofplansorconditionalapprovalofplans.

2. Residences – Exterior colors should not be changed.However, theARCmay approve thechange to another color matrix used in the community providing it is not used on anadjacentproperty.

3. Accessory Buildings – Body and trim colors should be consistentwith those on themainresidence.

ARTICLE4-AMPLIFIERS,ANTENNASANDSATELLITEDISHES

Sectiona. Amplifiers Althoughit isnotrequiredthattheARCapproveanyamplifiedsoundsystemincludingbutnotlimitedtotelevisions,stereos,speakersystemsandentertainmentsystemsMembersare advised that the Rules and Regulations consider excessively loud volume of said devices thatpresents a disturbance to adjacent neighbors shall be deemed a nuisance andmay be acted uponaccordinglybyotherOwners,ManagementortheBoardofDirectors.

Section b. Antennas and Satellite Dishes As directed by Congress in Section 207 of theTelecommunicationsActof1996,theFederalCommunicationsCommissionadoptedtheOver-the-AirReception Devices (“OTARD”) rule concerning governmental and nongovernmental restrictions onviewers' ability to receive video programming signals from direct broadcast satellites ("DBS"),broadband radio service providers (formerlymultichannelmultipoint distribution service orMMDS),andtelevisionbroadcaststations("TVBS").Therule(47C.F.R.Section1.4000)hasbeenineffectsinceOctober1996,anditprohibitsrestrictionsthatimpairtheinstallation,maintenanceoruseofantennasused to receive video programming. The rule applies to video antennas including direct-to-homesatellite dishes that are less than onemeter (39.37") in diameter, TV antennas, andwireless cableantennas. The rule prohibits most restrictions that: (1) unreasonably delay or prevent installation,maintenance or use; (2) unreasonably increase the cost of installation, maintenance or use; or (3)precludereceptionofanacceptablequalitysignal.However,theruledoesnotapplytoantennasusedforAM/FMradio,amateur("ham")radio(see47C.F.R.§97.15),Citizen'sBand("CB")radioorDigitalAudioRadioServices("DARS").Thusly,Membersareallowedtoinstallcertainantennasandsatellitedishesbutareaskedtoworkwiththecommunityinfindingsuitablelocationstowardtherearoftheirresidencesoutofviewasmuchaspossiblefromthefrontofsaidresidence.InstallationofanyofthedevicesnotcoveredbythisActmustfirsthavebeensubmittedforreviewandapprovedbytheARC.

ARTICLE7–FENCESANDGATES

No fence, wall or hedge will be erected ormaintainedonanyUnitnearertothestreetthanthebuildingsetbacklinesforthefrontandsideyards,exceptforfenceserectedinconjunctionwithmodelhomesorsalesoffices;andprovidedfurther,nofence shall be less than five feet behind the front of the house on anyUnit. AllUnit fenceswill beconstructedofwoodexcept for retainingwalls installedbyDeclarant.All perimeter fenceswill be6feetinheightunlessanotherheightisapprovedbytheARCbut,inanyevent,nosuchfencewillbelessthan4feetinheightorgreaterthan8feetinheight.Nochainlink,metalclothoragriculturalfencesmaybebuiltormaintainedonanyUnit.NotwithstandingtheforegoingtheARCwillhastherightandauthoritytoapprovevariancesoffencingheight,and/or locationforreasonablecauseortoalleviatehardshipasdeterminedinthesolejudgmentoftheARC;providedhowever,theARCmaynotapproveavariancewhichcontradictsthezoningand/orsubdivisionordinancesoftheCityunlesstheCityhaspreviouslyapprovedthevariance.DecorativefencingmaybeallowedontheUnitsinaccordancewithregulationsestablishedbytheARC.SeeARTICLE3-ADDITIONS,ALTERATIONSANDPAINTING,Sectionm.ExteriorPaintColors–Fencing/Residences/AccessoryBuildingsforapprovedstaincolors.

ARTICLE8-FRONTYARDLANDSCAPEGUIDELINES

Sectiona.Statuary/WaterFeaturesItemssuchasfountains,statuary,etc.,arepermissiblewithintherear yard and do not require submittal to the ARC. Such itemsmust be approved by the ARC forinstallation in any front yard. It is recommended thatwater featuresbe chlorinatedunless stockedwithfish.Sectionb.Grading/MoundingEachlothasbeengradedinsuchamannersoastoallowstormwatertodrainawayeachresidence.Itisimportantthatthisdrainagepatternbemaintainedwhenalteringtheoriginal landscapedesign. Every effort shouldbemadewhenadding anymounding, gradingorberming so it appears natural and does not effect drainage or deflect stormwater runoff from itsintendeddestination.

Sectionc.LandscapeDesignAnapplicationtotheARCisrequiredforanyalteration,enhancementoraddition to existing front yard landscaping and suchworkmustbe approvedby them. All propertylocatedatstreetintersectionsshallbelandscapedsoastopermitsafesightacrossthestreetcorners.Nofence,wall,hedge,orshrubplantingshallbeplacedorpermittedtoremainwhereitwouldcreateatrafficorsightproblem.

Sectiond. WaterRestrictionStagesThenewcityofPflugervillecontingencyplanandadministrativefeestructureareeffectiveasofJune25,2013

Signage/Flags/Decorative Items All front yardexterior signage, flagsordecorative itemsrequire written approval from the ARC prior to placement or installation. This includes, but is notlimited to, ironwork, fountains and statues. Art should be subtle, tasteful, consistent with thecommunityappearanceandadd to thecurbappear rather thandistract from it. Holidaydecorativeitemsdonot requireapproval;however,decorative items shallnotbedisplayedmore than30dayspriortotheactualholidayormorethan30daysaftertheactualholiday.

OwnersmaydisplayAmericanandStateflags.Theseflagsshallbenolargerthan3’X5’anddisplayedinaccordancewiththeFederalFlagCode.ItistheuniversalcustomtodisplaytheAmericanflagfromsunrisetosunset.However,whenapatrioticeffectisdesired,theAmericanflagmaybedisplayed24hoursadayifproperlyilluminated.Properilluminationshallnotdisturbthequietuseandenjoymentofanyneighboringproperty.TheARCmustapproveanylighting.Theheightofaflagpolecanbenogreaterthanthedistancebetweenthepointofplacementofthepoleintheyardandtheclosestpointofeitherofthefollowing:curbs,anycommonarea;oranyneighbor’sproperty line. AllpartsoftheinstallationmustbefullycontainedwithinthoseportionsoftheUnitthataremaintainedsolelybythepropertyOwner(e.g.,aflagorrelatedinstallationmaynotextendoutoveraCommonElementarea).Thelocationandconstructionoftheflagpolemustcomplywithapplicablezoningordinances,maynotbe located in any easements (including drainage easements), and must comply with all setbackrequirements.UnlessotherwiseapprovedbytheARC,thelocationofthepolemustbewithin10feetofoneoftheside-mostbuildinglinesoftheresidenceandwithin10feetofthefront-mostbuildinglineoftheresidence.TheARCmayrequirethepoletobeinstalledonaparticularsideorotherwiserequire

The Board of Directors of the Reserve atWestcreekOwnersAssociationreservestherighttorequireremovalofdecorativeitemsinfrontyardsbasedon size,quantity, color, locationandanyother criteria that theBoardofDirectors,at its solediscretionshallmake itsdeterminationonacasebycasebasis. Flagmountsandflagpolesmustbeconstructed of permanent, long-lastingmaterials, with a finish appropriate to thematerials (at thediscretionof theARC) used in the constructionof themount or flag pole andharmoniouswith thedwelling.NomorethanoneflagpolemaybeinstalledperUnit.Theflagpolemustbefree-standingandinstalledvertically.Theflagpolemustbenogreaterthan20feetinheightmeasuredfromgradelevel.AllfountainsrequirewrittenapprovalfromtheArchitecturalCommitteepriortoplacement.Fountainsmustblendwiththecolorofthehomeandshallnotexceedfour (4) feet (48”) inheight.Decorativeaccentsonthefountainshallnotbeoffensiveinnature.Decorativelandscapeenhancementsshallbepermitted but must blend with the landscape. The Board of Directors retains the authority todetermine if such enhancements are a nuisance to the surrounding neighbors and properties.Enhancementsshallnotexceed24”inheight.Enhancementsshallnotbeoffensivetoneighboringlotsor commonareas. Ifattached to thehome itself, thedecorationshallnotexceed threesquare feet.Statuary(i.e.lions)maynotexceed3.5'inheightandmustbeplacedaminimumof10feetfromthecurb.ForadditionalinformationseeRulesandRegulations.Texas state statutes allow an Owner to install certain religious displays in the Owner’s entry, andfurtherallowstheARCto imposecertain limitationsonsuchentrydisplays.ThisSectionoutlinesthelimitations on religious displays on an Owner’s home. Notwithstanding any other language in thegoverningdocuments to thecontrary, residentsmaydisplayon the resident’sdwellingoneormorereligious items, subject to the restrictions herein as follows. No religious item(s) displayed on theexterior of a residence may: a. threaten the public health or safety, b. violate a law, c. containlanguage, graphics, or any display that is patently offensive to a passerby, d. be located anywhereother than themain entry door ormain entryway of the dwelling orwithin planting beds next toentryway,e.extendpasttheentrywayorf.haveatotalsize(individuallyorincombination)ofgreaterthan25squareinches.Perstatestatute,ifareligiousitemisdisplayedinviolationofthisSection,theAssociationmay remove theoffending itemwithoutpriornotice. This remedy is in addition to anyother remedies the Association may have under its other governing documents or State law.Temporary seasonal religious displays such as Christmas lighting or Christmas wreaths or what isconsideredaSeasonalReligiousholidaydecorationshallbeinthesolediscretionoftheBoard,andtheBoard may impose time limits and other restrictions on the display of Seasonal Religious holidaydecorations in its discretion. Seasonal Religious Holiday decorations must comply with all otherprovisionsofthegoverningdocuments,butarenotsubjecttothisSection.Non-religiousdisplayson

an Owner’s dwelling and all displays (religious or otherwise) visible from the street on an Owner’spropertyaregovernedbyotherapplicablegoverningdocumentprovisionsandtheARCGuidelines.AdditionalguidelinesfortheplacementofflagsmaybefoundintheReserveatWestcreekRulesandRegulationsSection1.Flags.AnysuchconflictsbetweentheARCguidelinesvs.RulesandRegulationsregardingflagsthatmayarise,theRulesandRegulationsshallprevail.Section f. Xeriscaping Xeriscaping is landscapingwhosemain goal is to conservewater. The sevenprinciples of Xeriscaping include: Planning and Design, Soil Analysis, Plant Selection, Practical TurfAreas, Efficient Irrigation, Use of Mulches, and Maintenance. Xeriscaping uses native and adaptiveplants that can grow and sustain themselves with low water requirements and tolerate heat anddroughtconditions.Xeriscapingdoesnotmeanzerowaterandzeromaintenance.TheAssociationwillallow, subject to compliance with these rules, the use of drought-resistant landscaping and waterconservingnaturalturf.Approval for changes, plan submittal: Prior to initiating any change in the front yard landscape, thehomeowners must submit plans and specifications detailing the proposed installation. The requestmust include a to-scale design plan, as well as details on the types of plants, the ground covers(including color and materials), weed barriers, the bordering material(s), the hardscape materials(includingcolor),setbacks,irrigationsystem,anddimensions(dimensionsofbeds,approximatesizeofplants, size of any rocks, and other such details.) The ARC may request additional information orchanges to the plans before final approval. To increase the chance of approval of plans withoutchanges being required it is recommended but not required that plans be drawn by a licensedlandscapearchitect. Installationofanyproposedxeric landscapemaynotbeginuntil theCommitteehasapprovedtherequest.Designrequirements:Colorandtextureoftheplantedareasandinertareasareanimportantdesignaspect.Colorandtextureshouldbeseentoflowneatlyfromoneareaoftheyardtoanother.Extensiveareas of “desert” or “barren” appearance must be avoided in order to preserve the aestheticcompatibility with the neighborhood. Large areas may not be composed of a single material; forexample any areas of bare mulch must be interspersed with plants. The Committee may in itsdiscretion prohibit water features, urns, and other man-made ornamentation. The xeriscapelandscapingmaynotalterdrainagepatternsonaLot,andownersmustensurethatnocrushedgraniteorothersuchrunoffrunsintoaneighboringLotorthestreet.Soils in xeriscape areas should either be altered to fit the plants, or plants selected to fit the soil.Efficientirrigationssystemsmustbeplanned.Irrigationforxeriscapedzonesmustbedifferentthanforturfzones.Ownersshouldselectplantsandzonesinaccordancewiththeamountoflight,windandmoistureintheparticularyardarea.Organicmulches suchasbarkchips shouldbeappliedat least3”deepandmaintainedatalltimesatleast2”deep.Inorganicmulchessuchascrushedrockshouldbeappliedatleast3”deepandmaintainedatalltimesatleast2”deep.Any hardscape areas (e.g. areas of mulch, decomposed granite, or other such ground cover) mustcontainanappropriateweedbarrier.TurfGrass:Decorativegroundcoverrockinthefrontandsideyardmaynotexceed10%ofthetotalareaofthefrontandsideyard(seeDeclaration§5.4(n)).Atleast60%ofthevisiblelawnareaoftheLotmustcontainsomeformofsoddedgrass.Theexactrequirementoftheturfmayvaryfrompropertyto

propertyandisdependentonthespecificplansubmitted.Homeownersshouldconsider replacingany“thirsty” turfgrasses inplacesuchasSt.AugustinewithturfthathaslowerwaterrequirementssuchasHabiturf,Bermuda,Zoysia,Buffalo,BlueGrama,CurleyMesquite,orcomplementarycombinationsofsuch.ArtificialturfisprohibitedabsentavariancefromtheCommittee,whichmaybegrantedordeniedinthesolediscretionoftheCommittee.HowevertheCommitteeshallhavenoauthoritytoapproveartificialturfinanyareabetweenthefrontfencelineofaLotandthestreet.Plants: It is recommended to use plants adapted to the pH soil conditions created by the non-turfmaterials used. i.e., don’t use acid loving plants along with alkaline crushed limestone covering,whereasacidlovingThefollowingarchitecturaldrawingisasampleofthetypeofdrawingthatshouldbesubmittedtotheARCforlandscapingchangestotheexistingLot.

The following are species, which are approved for use in a Xeriscaped Landscape. This list is notintendedtobeacomprehensivelistofacceptableplants,buttobehelpfulinselectingplants.Droughttolerant plants not included on this listmay also be given consideration.
