Introduction

Eurofound’s overall mission is to conduct research to provide independent, relevant and timely information for users ofits knowledge, aimed at improving living and working conditions in Europe, in the best spirit of its tripartite andindependent nature.

The European Foundation for the Improvement of Living and Working Conditions (Eurofound) provides knowledge andexpertise to support policies on improving living and working conditions in Europe. It primarily serves trade unions,employer organisations, national governments and European institutions, supporting their efforts to promote quality ofwork and life. It helps these important actors in their anticipation and management of change and in the development ofsustainable competitiveness, social inclusion, social dialogue and partnership. Eurofound uses its expertise in workingconditions, industrial relations, living conditions and anticipation and management of change, and will continue to carryout research in these areas. It communicates the results of its EU-wide comparative surveys, the work of theobservatories, systematic research and qualitative studies in a responsive and effective way to its key information users:employer organisations and trade unions at EU and national levels, Member State governments and European institutions– particularly the European Commission and the European Parliament.

The operational activities of Eurofound are organised within the framework of a four-year rolling programme, 2010being the second year of the 2009-2012 programme ‘Better work, better life’.

1.1 Performance 2010

This programme identifies two specific objectives to be achieved within the timeframe 2009-2012:

� Be a reliable source of high quality information and identify emerging issues for research and debate;

� Strengthen the tripartite character and stakeholder relationships of Eurofound’s activities.

In addition Eurofound strives to operational excellence through efficiency and high productivity.

Eurofound’s Performance Monitoring System (EPMS) is a set of indicators measuring Eurofound’s performance vis-à-vis these objectives. They cover the most important performance drivers of an organisation:

� the user perspective;

� finances;

� internal processes and workflows;

� ‘intangibles’ of the organisation i.e. the capacity to learn and grow.

What progress did Eurofound make during 2010 in fulfilling the four-year objectives?

Analysis

Eurofound’s visibility remains high, as measured through the web user sessions and media reach (and more recently in2010 in increasing access of Eurofound information via social media). The number of web publication downloadsdropped in comparison with the previous year. This may be related to a reduced number of new publications, notablyfrom Eurofound’s surveys. The initial results of the 5th European Working Conditions Survey became available inNovember following fieldwork in the first few months of 2010. As reports based on Eurofound’s surveys are the mostpopular downloads –as continuously evidenced by an analysis of the download statistics–, then the fact that there wasnot a ‘fresh’ overview report and few secondary analysis in 2010 could have a negative impact on Eurofound’s visibilityas measured by the downloads. Visibility measured by the number of speakers or chairpersons at external eventsimproved (125 versus 98 in 2009) despite not meeting the target (150). The quality of our outputs is good, based on theuse of Eurofound’s information in policy and legislative documents, as well as references in academic and professionaljournals. These are indicators that we are achieving our objective to be a reliable source of high quality information.

Eurofound’s capacity to identify emerging issues for research and debate is well developed judged by the number ofhotspots and emerging issues. We should however now look more to the capacity to respond to new issues and ad-hocinformation requests, as we already do in measuring the number of customised reports. These reports are on-requeststudies in response to specific needs expressed by our stakeholders.

During 2010 the Agency also met its commitment to increase its efforts to strengthen the tri-partite character andstakeholder relationships. It showed a specific effort to establish the tools to better reach national level measured throughthe translation of summaries of all reports in all official European languages. At EU-level the contacts with key targetgroups increased significantly after the election of a new European Parliament in 2009 and the renewal of the EuropeanCommission early 2010. The increase in contacts with the employer organisations at EU level is noteworthy (100%increase). Improved data entry did contribute to the increase.

In terms of operational efficiency the approved budget 2010 was fully committed (98%), thereof 82% for the coreactivities of Eurofound (research and dissemenation of knowledge). Performance in respect of timely delivery of outputscontinued to be well below the target of 90%. There are concerns about a mismatch between the available resources andthe agreed projects in the work programme which sets the organisation up to fail in meeting agreed deadlines. Howeverthere is also reason to look into the effectiveness of the internal processes for better internal collaboration. Thepercentage of staff posts filled (91%) has improved significantly again in 2010 compared to 2009 (78%). According tothe staff policy plan, the underlying strategy in 2010 was to further strengthen the ‘core activities’ (Research +Information and Communication + Brussels Laision Office + 50% of Directorate) through recruitment of additionalresearch managers and research officers, who were selected on the basis of specific academic and experience criteria inthe respective areas of activity relating to the work programme. This strategy was successfully implemented, with therecruitment of nine research staff.

In summary

Eurofound’s performance in achieving its objectives for 2009-2012 is overall on course. However there is concern aboutdelays in delivering the outputs of the Annual Work programme. The strength of Eurofound’s intellectual capital is thekey to sustain and further improve performance next year.

Efforts to both increase Eurofound’s profile as a reliable source of high quality information and to strengthen itsrelationships with its tripartite stakeholders were at the core of the organisation’s activities.

The key research topics in 2010 were:

Eurofound:

� carried out comparative research and monitoring activities including the collection of case studies, literature reviewsand the run of comparative analysis;

� worked on developing further its European surveys through 1) the launch of the overview report from the2nd European Company Survey (ECS) on flexibility and social dialogue in March at the European Parliament,2) the completion of secondary analysis reports from the 2nd European Quality of Life Survey (EQLS) and 3) thefieldwork of the 5th European Working Conditions Survey (EWCS) and the launch of first findings at a jointconference with the Belgian Presidency;

� continued to provide up-to-date information and analysis drawing on its European observatories (the EuropeanIndustrial Relations Observatory (EIRO); the European Working Conditions Observatory (EWCO), the EuropeanMonitoring Centre on Change (EMCC) and its European Restructuring Monitor (ERM).

Eurofound continued to communicate its work across a variety of channels. Communication indicators show a consistentlevel of presence and performance which reflects the high activity at all levels to bring Eurofound’s findings to thekey policy makers in trade unions, employer organisations, national governments and EU institutions. One focuswas increasing access to information for key policymakers and decision makers at national level while maintainingEurofound’s core commitment to EU-level stakeholders. Eurofound’s participation in and contribution to events alsocontinued to rise, with a particular focus on collaboration with the different EU Presidencies.

2.1. Overview

The European Foundation for the Improvement of Living and Working Conditions (Eurofound) was established in 1975by Regulation (EEC) No 1365/75 of the Council of 26 May 1975.

In compliance with Article 12, each year the Director prepares a work programme (or Annual Management Plan), whichspecifies the activities for the particular calendar year contributing to the implementation of a (rolling) four-yearprogramme. Also, by virtue of Article 7, the work programme is subject to approval by Eurofound’s Governing Board,which represents the government, employer organisations and trade unions from each Member State as well as theEuropean Commission (DG Employment and Social Affairs and DG Research). Annex 7 and 8 of this report give thecomposition of the Governing Board and Bureau as per 31 December 2010.

The Director is assisted by a Deputy Director and staff. The total number of staff was 91 on the 31st of December 2010.The main tasks of the Agency are research and communication. The research function is organised on five units. Themanagement team consists of the Director, Deputy Director, a Coordinator

1, the Head of the Brussels Liason Office, the

Head of Information and Communication, the five Heads of Research, and four Heads of support units (Administration,Human Resources, ICT and Operational Support). The work of Eurofound is for a substantial part organised in projects,based on guidelines adapted from prfessional project management standards.

During 2010 the following developments took place:

� On the 1st of December a new Director took up his post following the end of term of his predecessor.

� Earlier that year (5 February 2010) the Deputy Director was appointed as Internal Control Coordinator.

� By decision of the 5th of February 2010, the Monitoring and Trends Unit was split into two separate units: Surveysand Trends Unit and the Observatories Unit. The Head of the Observatories Unit reports to the Deputy Director.

� From the 1st of January 2010 the Head of the Research Unit for Living Conditions and Quality of Life, as well asthe Head of Information Communication Technology report to the Deputy Director.

2.2 Planning and reporting

Eurofound has a comprehensive set of procedures and tools to prepare, manage, control and monitor its annual workprogramme and its human and financial resources.

In compliance with Article 12 of Regulation (EEC) No 1365/75 of the Council of 26 May 1975 on the creation of aEuropean Foundation for the Improvement of Living and Working Conditions, each year the Director prepares a workprogramme (or Annual Management Plan), which specifies the activities for the particular calendar year contributing tothe implementation of the four-year programme. Also, by virtue of Article 7, the annual work programme is subject toapproval by Eurofound’s Governing Board, which represents the government, employer organisations and trade unionsfrom each Member State as well as the European Commission (DG Employment and Social Affairs and DG Research).Annex 7 and 8 of this report give the composition of the Governing Board and Bureau as per 31 December 2010.

The management team meets at minimum ten times a year to monitor the implementation of the work programme. Thereare additional ad hoc meetings particularly in relation the the development of the Work programme. Planning andmonitoring tools such as ProjeX (for project management), and Eurofound Performance Monitoring System (EPMS)(organisational performance measures), as well as the Human Resources Development Programme (HRDP) (individualannual objectives and development for each staff member) have been developed and are used to ensure an efficientimplementation of the work programme and to inform management decision processes. General Staff meetings, unitmeetings and project team meetings take place to inform all staff of relevant issues and new developments. Importantdecisions are communicated in Office Notices which are published in the Intranet.

The internal control system is built on the direct supervision from the Deputy Director in the role of Internal Coordinator.The authorising officer (AO) and the authorising officers by delegation (AODs) in their area of responsibility base theirassurance declarations on the results of above described direct management supervision.

2.3 Internal control

In accordance with article 38.4, Eurofound has an Internal Control Coordinator (ICC). Eurofound’s Deputy Directorfullfills this role since 5 February 2010. The annual work plan for internal control is monitored in quarterly meetings ofan Internal Control committee with the Head of Administration, Head of Human Resources and Head of Operations.

2.3.1 Development of Internal control standards

Eurofound continued the implementation and further improvements of its control system based on the Internal controlstandards (October 2007 SEC (2007) 1341). This was guided by the 2010 Annual work plan from the Internal ControlCoordinator, consisting of:

1. Actions following recommendations of audits from the Internal Audit Service (IAS) and Court of Auditors;

2. Activities based on an internal assessment of the internal control standards;

3. Recurring activities, including reporting.

The activities based on the internal assessment of the internal control standards concerned Internal control Standard # 8on Processes and Procedures. An inventory of all Eurofound’s processes indicated where procedures needed to bedocumented or reviewed. Priority was given to the processes identified in the Risk assessment of the Internal Auditservice.

The exceptions register was implemented in on 1 July 2010. An information session for staff about the purpose and theprocedure took place on 6 July.

2.3.2 Ex post verification

Articles 39.3 and 39.4 of the Eurofound Financial Regulations and articles 47.3 and 47.4 of the Implementing Rules referto the ex-post verification of payments related to salaries, pensions, reimbursement of mission expenses and medicalexpenses, based on a sample using risk analysis. Office Notice 2008-02 of 28 February 2008 refers to the ex-postverification of routine transactions of salaries, medical, participants’ and mission expenses on a sample basis using riskanalysis. Following the recommendation from the Internal audit on Financial management in 2009, the procedure forthe ex post verification was reviewed and updated with a risk assessment for the justification of the sample size selection.

During 2010 two ex post verification exercises were carried out: the first covering the 2nd half of 2009 and the periodJanuary-March 2010. The second exercise covered the period April-August 2010. The findings were discussed to addressany weaknesses and actions agreed and followed up.

2.3.3. Risk assessment 2010

The risk register in relation to the 2010 Work progamme was monitored at project and unit level. An end-of-year reviewtook place in the quaterly Internal Control meeting. The review in relation to risk #3 needs to be finalised.

Further to the recommendation from the Internal Audit Service, Eurofound clarified the procedure on identifying criticalrisks. This was applied to the risk assessment process related to the 2011 work programme.

The assurance declaration of the authorising officer (AO) is based on various building blocks:

� Results of management supervision and control which also form the building block for the assurance declarations ofthe authorising officers by delegation (AODs) in their area of responsibility.

� The findings and recommendations of evaluations in so far they indicate weaknesses in the internal control system.

� Results and follow-up of independent audits from the European Court of Auditors and of the Internal Audit Servicerespectively.

� Analysis of the exceptions register.

� Response to the comments from the European Parliament in the context of the discharge of the annual accounts 2009.

� Progress in relation to Data protection.

3.1. Management supervision and control

Management at all levels supervises the activities they are responsible for and keeps track of main issues identified whichare reported in monthly management meetings. Management supervision covers both legality and regularity aspects,operational performance and organisational development. Management monitors the implementation of accepted auditrecommendations and related action plans on the basis of a transparent allocation of roles and responsibilities;

Monthly reporting from the Heads of Unit to the Director continued in monthly bilateral meetings and in meetings ofthe Management Committee. The Director reported on the progress of the work programme’s implementation at eachmeeting of the Governing Board and Bureau. In 2010, this report included a detailed report from the project managementsystem ProjeX with all milestones.

3.1.1 Advisory Committee on Procurement and Contracts (ACPC)

The ACPC gives an opinion on contract proposals of a value of EUR 250,000 and over. The committee met eight timesduring 2010 and examined 11 dossiers in total. All opinions were favourable.

3.2 Evaluation

In 2010 an action plan was developed in response to the recommendations from the ex-post evaluation of Eurofound’s2005-2008 programme. It was discussed in the meeting of the Governing Board in October 2010. The implementationshould be completed by the end of 2011. Three project evaluations were undertaken with internal evaluation capacity:

� European Company Survey (2001-2010)

� Foundation Forum

� Interim evaluation of CLIP (European Network of Cities for Local Integration Policies for Migrants)

The findings and recommendations were discussed at management level, and presented at relevant meetings withstakeholders (CLIP and Foundation Forum). The reports are accessible to all staff and the Governing Board.

3.3 Results and follow-up of independent audits

3.3.1 Follow-up of observations by European Court of Auditors

The European Court of Auditors performed its yearly audits regarding the 2009 exercise in autumn 2009 with a focuson recruitment and procurement and in early 2010 with a focus on the accounts for 2009.

The Court gave a clean statement of assurance with regard to the reliability of the accounts and on the legality andregularity of the transactions underlying the accounts. It also made a number of observations:

� Eurofound should not have committed funds for a project for which assigned revenue was not yet received at the timeof commitment. Although no payments against the commitment in question were done during 2009 and the fundswere received as expected during the course of 2010, Eurofound will pay closer attention that, in future, appoprationsare made only available when the corresponding assigned revenue has been received.

� Delays occurred in the preparation and presentation of the accounts 2009 while at the same time the provisionalaccounts 2009 presented shortcomings pointing to weaknesses in the financial organisation. Although the weaknessesof the provisional accounts were eliminated in the final accounts, Eurofound did commit to substantially improvingthe efforts for the closure of the accounts 2010. Through additional training and resources, it was ensured that alldeadlines were kept with regard to the accounts 2010 and that no major weaknesses were detected in the provisionalaccounts 2010.

� The missing Register of Exceptions was implemented on 1 July 2010.

� For staff selection procedures no evidence was found that thresholds candidates had to meet for invitation tointerviews and for being part of the reserve list were set before examining the applications. Eurofound insists thatthese thresholds were actually set before the selection procedure but accepts that this was not properly documented.In the meantime, the thresholds are included in the reports of the Selection Committee.

� An error was found in the procurement procedure for catering services. It is accepted that this affected the quality ofthe procedure but it did not affect the actual outcome of it. However, measures were taken to further strengthenevaluation and review procedures in an effort to avoid such errors in the future.

3.3.2 Internal audit

This section has been drawn up in accordance with article 72.5 of Eurofound’s Financial Regulation2

which states thatthe Director should send every year, to the authority responsible for discharge and to the Commission, a report relatedto internal audits carried out during the year.

It is in particular based on the annual internal audit report for 20103

received on 10 May 2011 from the Commission’sInternal Audit Service (IAS) who is according to article 71.2 of Eurofound’s Financial Regulation also the internalauditor of Eurofound and Eurofound’s internal follow up on their recommendations during 2010.

3.3. Analysis of exceptions 2010

Exceptions concern cases which deviate from Eurofound’s rules and procedures. In 2010, one exception was recordedin relation to the recording of assigned revenue. The deviation did not concern a material issue which would require areservation to the declaration of assurance.

3.4 Discharge European Parliament

Performance

1. Welcomes the Foundation’s intention to set out, in 2010, in atable to be annexed to the Court of Auditors’ next report, acomparison of the operations that were carried out during the yearfor which discharge is to be granted and during the previousfinancial year, so as to enable the discharge authority to assess moreeffectively its performance from one year to the next

Included in the Annual Activity report 2010 where the 2009that were continuing in 2010 are included in the table withthe overview of activities (see p.6)

2. Notes that the Foundation carried out another ex-post assessmentexercise of its 2005-2008 work programme after the one alreadycompleted in 2007 assessing the Foundation's 2001-2004 workprogramme; considers this exercise extremely useful for theFoundation, giving it helpful lessons and recommendations withregard to the challenges facing its future programming phase

An action plan was proposed to the Governing Board andthis was discussed in early 2011. During 2011 an interimevaluation of the current 2009-2012 programme is beingcarried out.

3. Encourages, nevertheless, the Foundation to further develop its“Eurofound Performance Monitoring System” (EPMS) to ensurethat the results of its performance monitoring are fed back intomanagement decision-making and planning and that periodicsurveys are carried out in order to obtain feedback from targetaudiences;

During 2010 three meetings with all data collectors wereheld in order to analyse the data. The Management teamreceived the figures on a monthly basis. The periodic reviewtakes place annually – in February 2010 and in January2011.

4. Supports the external evaluator’s recommendation to better definethe Foundation's target audiences at a national level (i.e. whether theFoundation should go beyond national authorities and policy-makersand try and reach a broader group of employer bodies and employeebodies) and to set up a network of focal points based on the nationalauthorities represented on its Governing Board;

During 2010 considerable effort has been put into theidentification of contacts at national level based on a writtendefinition of Eurofound’s target groups. Therecommendation from the external evaluators to set up anetwork of focal points has been assessed. The cost wouldnot outweigh the benefit in comparison with the existingNetwok of European Observatories.

Governing Board

5. Notes that the external evaluator of the ex-post assessmentexercise of the Foundation’s 2005-2008 work programme reportedthat, because of its increased size following enlargement of theUnion in 2004, the reduced number of meetings, and the relativelyhigh turnover of members, Foundation's Governing Board was notan effective decision-making body; calls, therefore, on theFoundation to take steps to strengthen the Governing Board's role inproviding overall direction to the Foundation; encourages, inparticular, the Foundation’s Governing Board to make timeavailable for discussion on strategic issues/priorities;

In the view of the Governing Board the proposedrecommendation is based on a specific period which is thepast. On request from the Director the evaluator carried outa separate study on the governance of Eurofound based ondesk research. This was presented to the Bureau of theGoverning Board. No further action is foreseen.

Procurement procedures

6. Notes that the Court of Auditors revealed errors and anomalies inthe evaluation of one open procurement procedure which affectedits quality; calls, therefore, on the Foundation to take steps toimprove its evaluation and review procedure to avoid repetition ofsuch errors in the future;

These steps are taken, see also section 3.3

Budgetary management

Calls on the Foundation to make sure that appropriations are madeavailable only when the corresponding assigned revenue has beenreceived; notes, in fact, that the Court of Auditors reported that,contrary to its Financial Regulation (Article 19), the Foundation'sbudget did not provide for specific headings for variousprogrammes financed from assigned revenue; notes, moreover, thatunder a programme financed by assigned revenue, the Foundationcommitted EUR 184,000, although the assigned revenue actuallyreceived was only EUR 29,000;

This is monitored. However due to the payment schedule ofcertain grant agreements Eurofound is participating in,where final payments are only based on delivery of workcompleted, it will be difficult to reach a full match betweenfinancial and legal commitment

Regrets that the Court of Auditors was compelled to comment onthe budgetary and financial statement of the Foundation, especiallyto the effect that the initial provisional accounts presented by theFoundation contained serious shortcomings, pointing to significantweaknesses in the financial organisation of the Foundation;welcomes the Foundation's confirmation that it will ensure, throughadditional training and resources, that its implementation of year-end procedures and its adherence to the deadlines for thepresentation of its accounts is correct;

This was taken up with a sense of urgency. The weaknessesof the provisional accounts were eliminated in the finalaccounts and Eurofound substantially stepped up its effortsfor the closure of the accounts 2010. Through additionaltraining and resources, it was ensured that all deadlineswere kept with regard to the accounts 2010 and that nomajor weaknesses were detected in the provisional accounts2010.

Human resources

Calls on the Foundation to provide evidence of its staff selectiondecisions (e.g. evidence of candidate thresholds at the beginning ofthe recruitment process) in order to guarantee the transparency ofthe recruitment procedures;

Recommendation implemented. All vacancy notices carrythis information at the time of publication.

Notes, in particular, that weaknesses on recruitment procedures havealready been identified by the discharge authority since 2006; urges,therefore, the Foundation to rapidly redress the situation and informthe discharge authority as to the progress made;

These weaknesses related largely to documentationreporting on the process. This issue has now beenaddressed.

Welcomes nevertheless the Foundation’s confirmation that, in thefuture, it will strengthen the documentation of recruitmentprocedures.

3.5 Data protection

The efforts to reach full compliance in the area of Data Protection in line with Regulation (EC) 45/2001 on the protectionof individuals with regard to the processing of personal data were stepped up during the course of 2010. Following theimplementation of Eurofound’s Implementing Rules in January a dedicated temporary staff member was recruited toaddress the backlog in process notifications to the DPO and the European Data Protection Supervisor (EDPS).

Following guidelines issued by the EDPS, Eurofound undertook a close examination of its rules and proceduresgoverning the video-surveillance using CCTV cameras on its premises. Similarly, Eurofound continued to follow theEDPS’ approach of organising agency-wide ex-post prior checking exercises to increase compliance in all EU agencies.

Based on the already exisiting inventory of personal data processing operations a register of these operations wasdeveloped and put online in early 2011.

In a joint effort between the DPO’s of EU institutions / bodies and the EDPS the celebration of the Fourth European DataProtection Day was prepared and took successfully place on 28 January 2010 raising awareness of staff members for thisincreasingly important area of compliance.

Conclusion

On the basis of the above there are no issues related to the declaration in Part 4.

Internal audit

Welcomes the Foundation’s implementation on 1 July 2010 of asystem for recording and analysing the exceptions to its establishedpolicies and procedures (“register of exceptions”);

At implementation

Acknowledges that, 2 out of the 8 recommendations of the InternalAudit Service (IAS)‘s “follow-up of earlier recommendations” havebeen implemented; notes that the recommendations that areconsidered to be “very important” mainly relate to the effectivenessof the internal control system (i.e. “annual work plan for ensuringinternal control”, “review sensitive posts” and “procedures forcommunicating improprieties”); calls, therefore, on the Foundationto rapidly implement them;

All outstanding actions are dealt with.

Notes also that in 2009 the IAS carried out an audit on FinancialManagement and put forward two “critical” and six “veryimportant” recommendations out of 15; is concerned that the twocritical findings relate to the accounting post (i.e. “position to befilled by a temporary agent or an official”, “powers to be alignedwith recommendations of the Commission’s Accounting Officer”)and the validation of accounting systems, while the six “veryimportant” findings concern the need to better document itsfinancial circuits, procurement design and planning, ex-postcontrols, reimbursement rules and exception reporting; urges,therefore, the Foundation to implement without delay the IAS’srecommendations and to inform the discharge authority on theprogress made in this respect;

With regard to the critical findings related to the post ofaccounting officer, a person covered by the StaffRegulations was recruited during 2009; a proposal forensuring the independency of the Accounting Officer inrelation to his assessment by the Director is with theCommission’s legal service. In the absence of advice on thismatter, a Charter for the Accounting Officer is drafted andwill be put to the Governing Board for endorsement. Thevalidation of accounting systems was done in 2010 and willbe followed up by a systems audit in 2011.

All other IAS recommendations from 2009 were dealt within the meantime.
