Estrada appoints new BOR; de Jesus top pick as new PLM prexy

As Retired Justice Artemio Tuquero leaves the university premises after Manila Mayor Joseph Ejercito Estrada accepted the Board of Regents (BOR) courtesy resignation last Monday, Estrada expressed his desire to the newly appointed BOR to elect Prof. Leonora de Jesus as the new university President. Yesterday afternoon, the new BOR members namely: Prof. Leonora de Jesus, President; Prof. Benjamin Diokno, BOR Chairman; Atty. Ramon Bagatsing, Jr.; Prof. Estrellita P. Bautista; Ms. Adelaida Rodriguez-Magsaysay took oath at the Mayor’s office. On the other hand, Atty. Renato G. Dela Cruz and Dr. Corazon C. Rubio are still members of the board because they didn’t submit their resignations. According to University Legal Counsel Carlos M. Carlos, Atty. Dela Cruz believed that he should not file his courtesy resignation tbecause Mayor Estrada is not his appointing authority. As per Dr. Rubio’s case, as the current Superintendent of DCS-Manila, she is automatically the Ex-officio member of the BOR. Atty. Carlos added that the city council of Manila will confirm the appointments on Thursday. Also, the new President is expected to report on her office on Monday. In the meantime, Atty. Carlos is the Officer-in-Charge of the Office of the President until the new university President assumes office.

College Deans and Administrative Heads of Pamantasan ng Lungsod ng Maynila (PLM) bid farewell to Retired Justice Atty. Artemio G. Tuquero after receiving the acceptance letter of the City Hall on his courtesy resignation as Vice Chairman of the Board of Regents (BOR) last September 12. Last Wednesday, September 17, Atty. Tuquero together with his staff members gathered in the Office of the University President (OPres) to bid their goodbyes to the out-going President. Atty. Tuquero’s courtesy resignation is in connection with the memorandum released by Manila Mayor Joseph Ejercito Estrada, requesting all the Board members to tender their resignation due to the controversy between Atty. Tuquero and BOR Chairman Amado Valdez. Consequently, he also stepped down as the University President in compliance with the University Charter stating that the position is sine qua non which means that in order for one to become a President, he/she must be a member of the Board of Regents first. If he loses membership to the Board, the position for Presidency will automatically follow.

ONE LAST SHOT. College deans and University administrative heads bid farewell to Retired Justice Atty. Artemio G. Tuquero as he steps down to Presidency after resigning as a member of the Board of Regents and consequently, as the University President last September 16.

Amid the administrative conflicts in the Pamantasan ng Lungsod ng Maynila, Mayor Joseph Ejercito Estrada asked all the members of the Board of Regents (BOR) to resign from office due to failure of resolving their internal conflicts within a reasonable period of time. In a memorandum dated September 10, 2014, Estrada stressed that the operation of the university has been seriously damaged by the foregoing “differences and disagreements” among the members of BOR. Thus, in order to ensure that the interest of the entire PLM community is being protected, he asked the board members to tender their courtesy resignation not later than 72 hours after the receipt of the document. Several days prior to that day, it was reported that different resolutions and memoranda were released by the Office of the Board of Regents and the Office of the President. All of which gave rise to a new set of disparities in PLM administration.

Tuquero banned from the campus As stated in the Board Resolution No.3692, Atty Valdez imposed a three-month preventive suspension against Atty. Tuquero, prohibiting him to enter

the university premises and act as the university president for 90 days. Valdez stressed that the board sought the need “to ensure that the Office of the President will not be used to harass, intimidate, and influence witnesses” on the case filed by the former dean of the College of Nursing, Dr. Gilmore G. Solidum, against Tuquero. The day after, Board Secretary and university legal counsel Atty. Carlos M. Carlos released a memorandum advising various offices to only honor directives, memoranda and other documents signed by Tuquero. On September 8, Valdez wrote a memorandum putting Carlos under three-month preventive suspension but copies of such document were not disseminated as the office of the president ordered their confiscation. The following day, Valdez disseminated a directive around the campus banning Tuquero, Carlos and Vice President for External Affairs Roberto Rosales from entering the university. He also relieved Ms. Fe Cawit from performing her duties as the Chief of the University Security Group and put Mr. Hanifredo Balquin in her stead.

In a 10-page letter complaint sent to the Office of the Ombusdman, the faculty association, administration, employees, and the Supreme Student Council of the Pamantasan ng Lungsod ng Maynila (PLM) filed graft charges to the former Board of Regents (BOR) Chairman Amado Valdez and members Adelaida Rodriguez-Magsaysay, Corazon Rubio, and Estrellita Bautista.

The said complaint rooted from the allegedly illegal meeting held by the accused last July 8 withdrawing the election of former

university President Artemio G. Tuquero from his position. It was said that the meeting was held without the other members of the BOR namely Atty. Renato G. de la Cruz, Atty. Ramon Bagatsing and Atty. Tuquero.

Moreover, the said BOR members are also being accused of committing serious dishonesty, grave misconduct, oppression, and violation of Republic Act 6713 or the Code of Conduct and Ethical Standards for Public Officials and Employees.

Former BOR members face graft chargesANNA LORRAINE D. GALURA Former College of Nursing Dean Dr.

Gilmore G. Solidum filed a formal complaint against former President Tuquero due to “grave abuse of authority and discretion, grave misconduct, incapacity, incompetence, and dishonesty” last August 5.

In a letter addressed to the then Board of Regents Chairman Atty. Amado Valdez, Solidum said that he was relieved from his post as dean of the College of Nursing without due process of the law, thus, reasons for the relief remains unknown. According to him, the move was a violation of BOR Resolution No. 3425 or the “Policy Guidelines on Deanship”, wherein a Dean shall have a term of three

years and can only be terminated if found guilty of administrative case and lack of character or capacity for the position.

The designation of Ms. Elena Cernias by Justice Tuquero as Dean of the College of Management and Entrepreneurship and subsequently the Graduate School of Management was also included in the bases of Solidum’s complaint. He pointed out that it was a violation of the Revised Penal Code Article 244 or unlawful appointment of (a) person/s to any public office lacking legal qualifications for Cernias allegedly falsified her academic credentials.

The same scenario is with Tuquero’s designation of Ms. Eloisa Macalinao as

the Dean of the College of Accountancy wherein he failed to comply with the Commission on Higher Education (CHED) Memorandum Order 50 s. 2008. Solidum indicated that Macalinao is “not a registered professional accountant”, instead an Economics graduate, therefore, a non-compliance with the said memo.

Solidum also questioned the ineffectiveness of Justice Tuquero as University President as he cited the different incidents where University Legal Counsel Atty. Carlos M. Carlos signed important orders and memos “by the authority of the President”.

The Pamantasan ng Lungsod ng Maynila (PLM) has been facing administrative issues during the past months. All those problems began from the invalidation of the appointment of the former university President Artemio G. Tuquero on his position which led to power struggle and misunderstanding inside this institution. The university’s image has been wrecked several times because of the unnecessary attention and publicized news about the Pamantasan. Though a little bit late, it is a wise step for Manila Mayor Joseph Ejercito Estrada to take charge with the mounting issue as he appointed the new five members of the Board of Regents of the university including you, Prof. Benjamin Diokno, who is said to be the assumed BOR Chairman, Atty. Ramon Bagatsing, Jr., Prof. Estrellita P. Bautista and Ms. Adelaida Rodriguez-Magsaysay. The scholars of the city of Manila, somehow see the light upon your awaited arrival, expecting that you are deserving to be the new university president. Just in case you might be wondering what the scholars of Manila expect from your arrival, the official student publication of this university made some points that you may or may not consider as you assume your office and face new tasks. The administration prior to this one left a big mark in the academe because of the said issues. Though unfair as it may seem, you are expected to act with utmost care for you are now the face of the university. Each move you will make can either help or further ruin the Pamantasan’s image especially now that it is still in the process of coping with the damage brought about by the recent controversies. Dubbed as the dragon lady, we are hoping that you will carry on the strictness in the style of your management to fix the administr¬ation that you are about to lead. And so we are wondering, will this university experience a 180 degree under with your leadership? Or will the passivity in the administration, transcending to some of the students and faculty members, remain? You are also demanded by the primary stakeholders of this university, the students, to protect their interest above all. It is therefore a must that the decisions to be made by your administration should value the welfare of the majority of the students. Not the interest of the few people. Again, the question of prioritizing things would always matter. Although it would be a cliché, the publication would still say that you should focus on projects that would benefit the university in the long run. Lastly, it might also be helpful if the administration would be student pro-active. Get a chance to know the PLM students. After all, this is what the students are hoping for – to have a leader that they can reach out to. Majority of the students are passive with the issues around the university probably because they cannot relate themselves to the previous leaders. Imagine what PLM would be if the students are cooperative with the aspirations of the administration. Sure, it is a two-way effort but someone has to start reaching out.

Pamantasan ng Lungsod ng Maynila (PLM) faced issues and controversies concerning the administration, specifically with the conflict between the Chairman and Vice Chairman of the Board of Regents (BOR) Atty. Amado D. Valdez and Dr. Artemio G. Tuquero, respectively. The timeline below shows the events happened in the campus on the 3rd week of September.

SEPTEMBER 11

• BOR Chairman Amado D. Valdez takes charge the Office of the Vice President

for Administration (OVPA) as the Board issued a preventive suspension to Dr. Artemio G. Tuquero, Legal Counsel Atty. Carlos Carlos and Executive

Vice President Roberto Rosales dated September 10. Also,

Engr. Marita S.D. Barrientos was also suspended after

allegedly manipulating the flow of communication materials

released by university Board to the offices.

• Later that afternoon, Dr. Tuquero nullified the preventive

suspension, pointing out that the BOR’s move in suspending

the president is illegal.

• Due to the controversy between Atty. Valdez and Dr.

Tuquero, Manila Mayor Joseph Ejercito Estrada released a

memorandum addressed to the members of the Board’s courtesy

resignation.

SEPTEMBER 12

• Dr. Tuquero filed his resignation as the Vice Chairman of the Board.

SEPTEMBER 15

• The Office of the University Secretary and Board of Regents

received a letter from the Office of the Mayor stating the effectivity of the resignation of

the Board members.

SEPTEMBER 16

• Tuquero bid farewell to the PLM Community after receiving the acceptance

letter from the Office of the Mayor, in connection with

the memorandum released by Mayor Estrada that requested

all Board members to resign due to the controversy between him

and Atty. Valdez.

• Along with his resignation, Dr. Tuquero also stepped down as the University President, as it is stated in the PLM Charter

that the position is sine qua non which means in order for one

to become the president, he/she must be a member of the BOR

first. If he/she loses membership to the Board, the position for

presidency shall follow.

• On the same day, Estrada appointed new members of the Board composed of Professor Benjamin Diokno as the BOR

Chairman; Prof. Estrellita P. Bautista; Ms. Adelaida Rodriguez- Magsaysay as

members; Atty. Renato G. Dela Cruz and Dr. Corazon C. Rubio,

who did not offer to resign, were retained in the Board; and Prof. Leonora de Jesus. The latter will

be the new president of PLM, upon the election of the BOR.

• The City Council of Manila will confirm the appointments.

SEPTEMBER 22

• The new PLM President is expected to report on office.

“Because of the conflicts in the university, the students tend to lose some respect to those in authority. another thing, the administration has been very strict even to little things, causing the students to carry heavier loads. instead of going to school and studying comfortably, the administration tend to give the students more problems to solve.”

“Of course it cannot be avoided that these happenings inside the school, reflect the name of the university outside its premises. To my knowledge, this has been a pretty big issue. It actually came out of the newspapers. And being known as a scholar of PLM, I frequently get questioned about the happenings in school. I must say it’s getting annoying every time people throw questions at me, specially because everything is so complex and I have to tell it for like multiple times to different people. Not that I don’t want to get involved in the matter of my beloved school but I just want to say that if they can just speed up the process of whatever they need to do, get to the bottom of it and take the school out of hot waters, then they also save their scholars (who doesn’t need additional stress from the school because their professors are giving them more than enough) from getting bombarded with questions about this.”

MEANWHILE

Under Erap, he focused on the transparency of the Department of Budget and Management in which he initiated the What You See Is What You Get or WYSWIG policy that simplifies the system of fund release for the General Appropriations Act (GAA) for the agency heads to plan and to contract out projects by just looking at the GAA in the DBM website.

He had also started the Government Procurement

System (GPS) for the advancing information and communications

technology and budget reforms that concerns the procedures in

the payment of accounts payable and terminal leave/retirement

gratuity benefits.

However, in his tenure, a growing budget deficit was cited by the National Economic and Development Authority wherein from the 1999 budget deficit of PHP 114 Billion, it increased at the year 2000 with PHP 130 Billion. He had cited

this in his study, The Philippines: Fiscal Behavior In Recent History, published in 2008.

De Jesus was dubbed as the Dragon Lady for her

strict approach during her reign as the Head of the

Presidential Management Staff and concurrently, as a Cabinet Secretary,

under the Ramos and Erap administration.
