Who Is An Independent Contractor?

The general rule is that the payer, has the right to control or direct only the result of the work done by an independent contractor

and not the means and methods of accomplishing the result.

WHO IS AN EMPLOYEE?

Employee has their taxes paid by employer paying 50% (7.65).

The other 50% (7.65) of every dollar is taken from employee’s wages.

Type of Relationship

Type of Relationship – Facts that show the type of relationship include:

Written contracts describing the relationship the parties intended to create

Whether the worker is provided with employee-type benefits

Contractor AGREEMENT

You Should Have an Written Independent Contractor Agreement to Protect All Parties Involved.

Should be Written as a Win Win Situation for All Involved

Caution: If you incorrectly classify an employee

as an independent contractor, you can be held liable for employment taxes for that worker, plus penalties and interest.

PLUS BOTH IRS and Dept of Labor, (if I/C is

reassessed as employee) can make you pay back due FUTA, SS & Medicare Taxes and Worker’s Compensation if applicable.
