Definition Istilah- بيع المنفعة it means 'to give something on rent'. the term 'Ijarah' is used for two different

situationsI. relates to the usufructs of assets and

propertiesII. Services of human beings

Ulama Hanafiyah : ‘aqdun ‘alal manaafi’i bi ‘audhin,”

Ulama Syafi’iyah : “Akad of the benefit that contain a

The right to receive wages musta'jir is as follows:

"Give the employee the wages before the sweat dries." (Narrated by Ibn Majah)

Basic Principles: Ijarah Return If ijarah has ended, musta'jir need to return

the rental items. If can be transferred, it must hand over to the

owner and if the form of rental is' iqar (fixed).

Syari’a Rules In Ijarah• And said one of them (the two women): "O my

father! Hire him! Verily, the best of men for you to hire is the strong, the trustworthy”.

• The Prophet (SAW) said: "Pay the hired worker his wages before his sweat dries off". (Sunan Ibn Majah)

Syari’a Rules In Ijarah • The Prophet (SAW) is reported to have said:

"He who hires a person should inform him of his fee.” (Al-Sunan Al-Kubra li Al-Baihaqi)

• Abdullah ibn Umar narrates, “Allah's Apostle gave the land of Khaibar to the Jews to work on and cultivate and take half of its yield.” Ibn 'Umar added, "The land was used to be rented for a certain portion (of its yield)." (Sahih Al-Bukhari)
