IDEA DESIGN STUDIO REVEALS WHAT KINDS OF INVENTIONS CAN AND CANNOT BE PATENTED?

At the outset, it helps to realize that some products cannot be patented. Inventors need to arm themselves with this vital information in order to be as efficient as possible with their time and resources.

• In most cases, inventors can think of patents this way: there are three kinds, namely "utility patents," "design patents," and "plant patents." That last category refers to actual living plants, like vegetables and fruits and trees.

• Plant patents are usually obtained by scientists and professional agricultural specialists, and they make up a very small percentage of the total number of patents that are issued each year.

• Utility patents pertain to unique products but must involve a useful and new machine, process, article of manufacture, composition of matter, or an improvement of a machine, process, article or composition of matter. 

The USPO makes it very clear that any new invention or idea, in order to be patentable, must be:• Documented and clearly explained so that a person with

generally equivalent skill could build and use the specific invention in question

• Non-obvious, namely anyone with similar skill in this market segment could not come up with this exact same idea

• Novel
