DNRandPOLST

• PrehospitalDoNotResuscitate(DNR)–astatedocumentthatinstructsemergencymedicalpersonnelregardingapatient'sdecisiontoforgoresuscitativemeasuresintheeventofcardioplumonaryarrest.Theformdoesnotaffecttheprovisionoflifesustainingmeasures.

• Physician’sOrdersforLife-SustainingTreatment(POLST)-amedicalorderthatgivesseriouslyillpatientsmorecontrolovertheircarebyspecifyingthetypeofmedicaltreatmentapatientwishestoreceiveattheendoflife.ThePOLSTformmustbesignedanddatedbyaphysician,oranursepractitioneroraphysicianassistantactingunderthesupervisionofthephysician,andthepatientorlegallyrecognizedhealthcaredecision-maker.

AlawthatbecameeffectiveJanuary1,2016createsaRevocableTransferonDeathDeed(“TODDeed”)asawayforCaliforniaresidentstotransferresidentialpropertytonamedbeneficiaries,effectiveupondeath.Thenewlawrequiresuseofaspecificformwithspecificprovisions,andincludesa“frequentlyaskedquestions”provision.ThestatutorydeedformandrevocationformareintheCaliforniaProbateCode,Sections5642and5644.

TODDAdvantages• AvoidsMedi-Calrecoveryclaims.• Maybesimpletouse,willbelessexpensivethancreatingalivingtrust,andmayeliminatethewaitingandexpenseofaprobate.
