– Identified adjoining and nearby properties as recognized environmental conditions

– Adjoining property current landfill and former United States Navy dumping trench

– Nearby property school bus maintenance yard

• Phase II ESA – Soil samples contained arsenic concentrations in excess of

residential SCTLs

– Pattern of results and concentrations indicated that presence of arsenic did not result from release of contaminant

– Historical data did not identify activity that would lead to release of arsenic at the property

• Technical Argument – Arsenic was naturally occurring

• Correlation between soil impacts and lithology (15-25 ft msl)

• Soil impacts were not encountered at or near ground surface

• Concentrations were relatively low and not continuous

• Groundwater was not impacted

• Undeveloped property with no historic activity identified

• SRCO without conditions received in March 2010
