Abstract

Criminal Responsibility for Non legal Acts of Stockbroker

The substance of the matter of punitive for Non legal acts by the financial Stockbroker

function of the topics at this time, especially after the collapse of global stock markets at

the end of 2008, The problems that have taken place in Jordan from the exploitation of the

owners of companies to the global stock markets dealers agents, the relevance of this

collapse in the work of financial Stockbrokers, where the Stockbrokers, as playing a major

role in the protection of customers and clients, therefore, the development in the stock

market.

And the importance of the role played by the Stockbroker and the importance of finding the

necessary protection for the work of the mediator of this study was to address the criminal

responsibility for illegal Acts by the Stockbroker, through the following chapters:

Chapter I: Introduction to the study, this chapter contained to prepare and study the

problem and the elements of this problem and the assumptions underlying this study and

thus the definition of terms and the importance and determinants of research and the

methodology that was followed in this study.

Chapter II: we have talked about what the Stockbroker, through the definition of

Stockbroker and to list the types of Stockbrokers, and the mechanism governing the

Stockbrokers in the stock market of Jordan.

Chapter III: where we dealt with in this chapter, the scope of criminal responsibility for the

Stockbroker, through research on the basis of criminal responsibility for this stockbroker

and then a person of criminal responsibility for the moral and criminal responsibility for an

act of others in the crimes committed by the Stockbroker.

Chapter IV: In which we dealt with the work of the illicit Stockbrokers, where we dealt

with in this chapter, images of the crimes committed by the Stockbroker and the most

important of these crimes ,the crime and the promotion of the rumors spread and the crime

of belonging to the disposition of client securities without authorization, a crime to

manipulate prices of traded securities, and the conclusion of a crime phantom operations in

the Stock market.

Chapter V: which contains the conclusions and recommendations, which dealt with the

most important findings and recommendations that we have come out through this study,

where we have a number of the most important results, the legislator took the idea of the

Jordanian penal moral question of a person at the same time not denying the issue of a

natural person who committed the act However, the project name of the person and the

moral self, in each of the Penal Code and the law on economic crimes, and stock market

law.

The most important recommendations was to add the text emphasizes punishment

committed in the stock market if the perpetrator, Stockbroker, to the importance of the role

played by the mediator in the circulation of securities, and the need to amend the text of

Article (22 / A / 1) of the Securities Act and replaced by the text of Article (110 / a) of the

same law as the court is the best for the imposition of the fine may not be appropriate to

leave a fine view of the relatively large such as the Securities Commission.
