16. PROPOSITION
Gauri and Raghvendra Singh Shekhawat got married on 1st January, 2013 and
living at village Isarda, District Tonk, Rajasthan, with their joint family. Their
family consist of her father-in-law Bheem Singh Shekhawat, her mother-in-law
Yashodhara Devi, her brother-in-law Dev Singh Shekhawat, one unmarried sister-
in-law Nidhi, and another married sister-in-law Anita w/o Suryadev Singh
Shekhawat living at the same village Isarda with her in-laws. After marriage on 1st
January, 2013 the couple was living a happy life but the things got changed after
the death of Gauri’s father-in-law Bheem Singh Shekhawat due to a heart attack on
1st October, 2013, as now Raghvendra has to take care of entire family and fulfil
all the family responsibilities.
On 20th February, 2015 Gauri’s father Charan Singh Rathore got a call from
Raghvendra at 10:10 pm that Gauri had committed a suicide at 07:00 am of today
morning. Mr. Charan Singh Rathore lives at Jodhpur with his wife Leelawati Devi,
his son Pratap Singh Rathore and his daughter-in-law Tara. Charan Singh
Rathore’s elder daughter Mamta is living at Jaipur with his husband Yuvraj Singh.
After getting this news, when Charan Singh and his entire family reached at
Gauri’s home at next day morning (i.e. 21st February 2015), they found that
Raghvendra and his family is ready to take Gauri’s body for funeral without
informing the police about her suicide. Leelawati, Mamta and Tara also saw the
bruises on the face and hands of Gauri. Thus, Charan Singh Rathore immediately
called police to stop the funeral. On behalf of FIR lodged by deceased father,
Police Officer send the body for post mortem.
Charan Singh made the following statements to the police in his FIR-
1) Charan Singh Stated that at the time of marriage and before the death of
Bheem Singh Shekhawat everything was too good. Both families have
organized the wedding of Gauri and Raghvendra as per hindu rituals, and the
groom’s family did not demand any gift at the time of marriage or even after
that. But the situation got changed after the death of Gauri’s father-in -law.
Gauri never came Jodhpur after the death of Bheem Singh and even she
never sounds happy on the phone calls, but she never complained anything
Page 16 of 23
to anyone. Suddenly one day on 10th December, 2013 Gauri called to
Leelawati and said that her mother-in-law asking her to bring 20 lakhs from
Jodhpur for establishing the electronic products showroom for Dev Singh.
They fulfil this demand by selling their ancestral property of Churu.
2) Then on 10th January, 2014 they again demanded a motor-bike from them
through Gauri, and this demand had also been fulfilled.
3) On the 10th March 2014 Gauri came to Jodhpur for giving birth to a child at
the seventh month of her pregnancy, but their also she was not normal. Her
in-laws never called her, only Raghvendra called her usually once in week
and after every such calls she got highly disturbed. And after asking so many
times she told Tara that her in-laws are pressurizing her to give birth to a
male child, and if she delivers a girl then they will never allow her enter
back to their home. On 15th May 2014 a girl child was born to her daughter
Gauri, but no one from her in-laws had come to see her or take her back.
Gauri also called to her sister-in-law Anita to made a request to take her
back to Isarda but she insulted Gauri and disconnect the call. Charan Singh
himself called many times to her mother-in-law Yashodhara Devi but she
never responded to take back the Gauri and her daughter. Suddenly on the
morning of 15th October 2014 her brother-in-law Dev Singh and her sister-
in-law Nidhi came to Jodhpur and on the same day took back Gauri and
child to their home at Isarda. Charan Singh and his family hopes that
everything will be fine now.
4) Charan Singh further stated that after going back to Isarda it became too
difficult for them to talk to Gauri. Her mobile was always switched off and
whenever they called at some other phone they got a reply that either Gauri
has went somewhere out with Raghvendra or she is too busy and they ask
them to call back her later. Her all social networking accounts like facebook,
watsapp etc. has been deleted. She calls once in a week from Raghvendra
mobile always in the presence of him.
Police has started the investigation and write the statement of following
persons under Section 161 of Criminal Procedure Code, 1973-
1) Charan Singh gave the statement that he got a Raghvendra’s call at 10:10
pm on 20th February, 2015 regarding Gauri’s suicide. Raghvendra said
that Gauri committed suicide at 07:00 am of the same day. But he alleged
Page 17 of 23
that Gauri has been murdered by her in-laws because he is not getting
that why Raghvendra had called him after 14 hrs. inspite of calling him
immediately at the morning only. And why they want to burn the dead
body as early as possible without informing the police or even without
waiting for them to reach at Isarda.
2) Leelawati stated that she and her female family members had seen the
bruises on the body of Gauri.
3) Charan Singh’s elder daughter Mamta told that Gauri called her at 07:45
am on the same day, i.e. 20th February, 2015, with Raghvendra’s mobile
phone. She was sounding tensed and want to tell something to Mamta,
but the call was suddenly disconnected within a minute. So, if she had
died at 07:00 am then how it could be possible that she can call Mamta at
07:45 am (Mamta also shown the call detail to police).
4) The photocopy of the documents regarding the selling of ancestral
property of Churu and buying of bike had also been submitted to the
police by Charan Singh.
During Police investigation Raghvendra’s family members made following
statements-
1) Raghvendra gave the statement, “On 20th February 2015, I went for a
morning walk to the nearby park at 06:00 am and when returned at 07:00 am
I found Gauri’s dead body on the bed and a bottle of sleeping pills in her
hand. Then I called my mother who was taking care of the daughter as Gauri
never take care of daughter, and called Nidhi from the kitchen. My mother
Yashodhara Devi called my younger brother Dev Singh to come home who
was at local akhara at that time, 5km away from our house. Nidhi called
Anita and Suryadev to come home. Then Suryadev and Dev Singh start
doing all the preparation of the required ceremonies. I was under a great
shock at that time and was not in my senses for a long time and when I came
out of shock, I called to Charan Singh at Jodhpur”.
2) Raghvendra stated that at the night of 18th February 2015, he had an
argument with Gauri over the issue of shifting at Tonk separately from the
entire family and when he refused Gauri injured herself with the wall of the
room and get bruises on her body. And again on early morning of 20th
February 2015 she was starting the same argument and threatens him that
Page 18 of 23
she will commit suicide and so he went out of the house for morning walk at
06:00 am.
3) Raghvendra said that their married life was happy only before his father’s
death because he had sufficient time to spend with Gauri and roam around
with her. But after that, she started pressurizing him to shift at Tonk as she
doesn’t want to live in a joint family at the village. She asks him to take her
for outing on every weekend and demands expensive gifts. On non-
fulfilment of her wish she badly behaves with the entire family members and
insults them.
4) Yashodhara Devi gave the statement that one day, after her husband’s death
Gauri demanded to buy a diamond necklace for her to wear at the opening of
the electronic showroom of Dev Singh. And when she refused to do so as
she had invested all their savings in the showroom, Gauri said that she will
take the amount from her father.
5) Nidhi gave the statement that Gauri never do any house hold work. She
always complaint of her bad health and so never do any work of the home,
and if Raghvendra ask her to help his mother and sister in the work she starts
fighting with him and injured herself and threatens them to lodge a police
complaint for domestic violence.
6) Dev Singh gave a statement that one day when he returns from the
showroom he found that Gauri is fighting with his mother and standing in
front of the main door of the house with her luggage ready to go at her
father’s house. His mother was asking her to come back in the house and
wait till the Raghvendra return from the office from Tonk and then he will
drop her to Jodhpur as she is having the seventh month of pregnancy. But
she refused and left for Jodhpur all alone. Later whenever they ask her to
come back she put a condition before them that she will return only when
Raghvendra will ready to shift at Tonk. Her mother also write a letter to
Charan Singh in which she informs all these activities of Gauri to him and
ask him to send her back to Isarda, and after getting a call from Charan
Singh he and Nidhi went to Jodhpur and bring back Gauri and daughter to
home.
