REPORTS 12.1 Murchison Regional Vermin Council Establishment Agreement Officer: Acting Chief Executive Officer, Mr Gary Martin Amended By: Nil Disclosure of Interest: Nil Meeting Date: 16 September 2016 Matter for Consideration To consider the draft Establishment Agreement to the participant local governments comprising of the Shires of Cue, Meekatharra, Mt Magnet, Sandstone and Yalgoo for acceptance by this Shire. Applicant’s Submission The Murchison Regional Vermin Council (MRVC) of which this Shire is an existing member council has been considering changes to the Establishment Agreement between the participating local governments for some considerable time. The Agreement has been developed with legal advice from Civic Legal and is in accordance with the Local Government Act 1995. At the recent Special meeting of the MRVC it adopted the following resolution: That Council refer the Draft Establishment Agreement to the participant local governments comprising of the Shires of Cue, Meekatharra, Mt Magnet, Sandstone, and Yalgoo for consideration and acceptance”. Background It is understood that the MRVC has been operating for many years under the initial agreement which was apparently inadequate for the requirements of the MRVC, making it necessary to enter into a new agreement. Local Government Act 1995 s3.65 permits participants to amend an Establishment Agreement for a Regional Council by agreement made and with the Ministers approval. The MRVC engaged the services of Civic Legal to prepare a draft establishment agreement. That draft agreement has been considered by the MRVC and now submitted to the member councils for consideration and approval. Comment The Council has long been a supporter of the MRVC and its objectives. This agreement furthers the cooperation between the participating local governments. The draft Establishment Agreement was circulated to all Councillors by email on Friday 9 September to allow maximum opportunity to read the agreement before the Council meeting. Hardcopy will be made available at the meeting. Consultation The Shire’s representatives on the MRVC have been involved in the development of the draft agreement and the recommendation that it be forwarded to all the participant members for consideration and approval. Policy Implications Nil. Financial Implications The agreement itself does not have any direct financial implications for the Shire.

12.2 2016/2017 Firebreak Order Officer: Acting Chief Executive Officer, Mr Gary Martin Amended By: Nil Disclosure of Interest: Nil Meeting Date: 16 September 2016 Matter for Consideration To authorise the 2016/2017 Firebreak Order. Applicant’s Submission Attached is the Firebreak Order for 2015/2016. It is presumed that the Order for 2016/2017 will be very similar and may only involve changes to the relevant dates. Background The author was unable to locate the Council resolution for the adoption of the Fire Break Order for last year but believes that it is necessary for the Council to formally approve the Notice. The last resolution appears to have been in 2014. The difficulty arises in respect of timing. The Firebreak Order is normally distributed along with the Rate Notices to save postage costs, but it is likely that the Rate Notices will be prepared and ready for posting about mid next week before the Council meeting. As the changes to the Notice only relate to the relevant dates and not to the detail of the restrictions or requirements, and the importance of giving as much notice as possible, it is proposed to amend the notice and send out with the Rate Notices before the Council resolution. Copy attached. Comment Following consultation with the relevant Fire Officers that the proposed changes only relate to the relevant dates, and with the intent of saving the cost of duplicate postage, together with the need to give us much notice as possible, it is proposed to amend the notice and distribute with the rate notices if that occurs prior to the Council meeting. As Chief Executive Officer, I take full responsibility for pre-empting the Council decision. Consultation President Jorgen Jensen Cr Jason Haywood Mr Todd Seivwright - CBFCO Policy Implications Nil. It is recommended that in future, the Bush Fire Notice Order be considered in conjunction with the budget adoption so that the Order can be distributed together with the Rate Notices each year. 12.4 Financial Activity Statement to 31 July 2016 Officer: Finance Manager, Ms Maureen Murat Amended By: Nil Disclosure of Interest: Nil Meeting Date: 16 September 2016 Application To consider the Financial Reports for the period ending 31 July 2016 A report will be separately circulated or tabled. Financial Activity Statement Report – s.6.4 1. A local government is to prepare each month a statement of financial activity reporting

on the sources and applications of funds, as out in the annual budget under regulation 22(1)(d), for that month in the following detail – a. Annual budget estimates, taking into account any expenditure incurred for an

additional purpose under section 6.8(1)(b) or (c); b. Budget estimates to the end of the month to which the statement relates; c. Actual amounts of expenditure, revenue and income to the end of the month to which

the statement relates; d. Material variances between the comparable amounts referred to in paragraphs (b) and

(c); and (e) The net current assets at the end of the month to which the statement relates.

2. Each statement of financial activity is to be accompanied by documents containing- a. an explanation of the composition of the net current assets of the month to which the

statement relates, less committed assets and restricted assets; b. An explanation of each of the material variances referred to in sub-regulation (1)(d);

and c. Such other supporting information as is considered relevant by the local government.

3. The information in a statement of financial activity may be shown – a. According to nature and type classification, b. By program; or c. By business unit.

4. A statement of financial activity, and the accompanying documents referred to in sub-regulation (2), are to be – a. presented to the council –

(i) at the next ordinary meeting of the council following the end of the month to which the statement relates; or

(ii) if the statement is not prepared in time to present it to the meeting referred to in subparagraph (i), to the next ordinary meeting of the council after that meeting; and

b. recorded in the minutes of the meeting at which it is presented. 5. Each financial year, a local government is to adopt a percentage or value, calculated in

accordance with AAS 5, to be used in statements of financial activity for reporting material variances.

6. In this regulation –} committed assets~ means revenue unspent but set aside under the annual budget for a specific purpose; } restricted assets~ have the same meaning as in AAS 27.[Regulation 34 inserted in Gazette 31 Mar 2005 p. 1049-50.]

[35. Repealed in Gazette 31 Mar 2005 p. 1050.] Comment A monthly financial report is to be presented to Council at the next Ordinary Meeting following the end of the reporting period. Registration files were checked for compliance. Patrols were also conducted of The Granites. No illegal campers were sighted. Trapping was conducted at various locations around town during the late evening and
