Call to Order
Len Cockman, chair, called the meeting to order at 1:00 p.m. He welcomed and thanked
the Investment Board for joining the meeting.
Introduction of New IPERS Personnel – Donna Mueller
Donna introduced two new staff at IPERS. Elizabeth Hennessey hired as IPERS’ general counsel and Jim Graham hired as the bureau chief and supervisor for the special services,
death and disability bureau.
Incoming CEO Introduction – Greg Samorajski
Governor Kim Reynolds appointed Greg Samorajski, former Deputy Commissioner of the Alaska Department of Revenue, as the next CEO of IPERS effective May 1, 2020. Greg
introduced himself to the group.
Report on IPERS’ Activities and Responses during the Declared Health Emergency
Each IPERS division provided highlights of activities taken in their respective divisions
due to the declared health emergency. Donna reported that IPERS continues to provide services to members and employers without interruption.
Approval of BAC Meeting Minutes from January 27, 2020
Matt Carver made the motion to approve the minutes from the January 27, 2020, Benefits
Advisory Committee meeting. Jim Romar seconded, the motion carried by unanimous roll call vote.
BAC Membership Elections
Three voting positions on the BAC were up for election. The statue requires one of these
vacancies be held by a constituent group representing teachers. Lowell Dauenbaugh
nominated the Iowa State Education Association. Matt Carver seconded the nomination. The nomination was approved by unanimous roll call vote of the full BAC membership.
The statue requires one of these vacancies be held by an organization that represents cities. Lowell Dauenbaugh nominated the Iowa League of Cities. Matt Carver seconded
the nomination. The nomination was approved by unanimous roll call vote of the full BAC membership.
The statue requires one voting seat be held by a public citizen who is not a member of
IPERS. Phil Tetzloff nominated Lowell Dauenbaugh as the citizen representative on the BAC. Matt Carver seconded the nomination. The nomination was approved by
unanimous roll call vote of the voting membership. Farewell by Departing CEO Donna Mueller
Donna thanked the members of the Investment Board and Benefits Advisory Committee
for their support and dedication to her and IPERS during her 17 years as CEO.

Pursuant to §97B.8A(4)(b), the BAC is charged with submitting to the Governor a slate of at least two nominees per position to the IPERS Investment Board designated for the three IPERS membership positions. The seat currently vacant on the IPERS Investment Board member is designated as an active member who is an employee of a school district, area education agency or merged area. Iowa Code §§69.16 and 69.16A require appointive boards to be balanced by gender and political affiliation. The gubernatorial appointments to the Investment Board are currently equally balanced as to gender, three males and three females, and political affiliation is as follows: (3) republicans, (2) democrats and (1) independent. One-half the membership plus one of a particular affiliation complies with the balance requirement. Please see the attached applications submitted by Mr. James Duncan, Ms. Brooke Fischels, Ms. Kristi Fisher and Mr. Kurt Subra.

August 19, 2020 TO: IPERS Benefits Advisory Committee FR: David Martin, Chief Benefits Officer RE: Request for Actuarial Cost Study The School Administrators of Iowa have previously discussed with the Benefits Advisory Committee their legislative priority to study the cost impact of reducing the bona fide retirement period for certain educators. The BAC at their January 27, 2020, meeting established a subcommittee of Len Cockman, Matt Carver, Melissa Peterson and Phil Tetzloff to further explore the option. To aid the actuary in identifying licensed teachers, beginning July 1, 2020, IPERS employers reported licensed teachers under a new occupation code. The number of reported licensed teachers was 21,864. School Administrators of Iowa proposed the following amendment to Iowa Code 97B.52A. Bona fide retirement—licensed teachers. For retirees whose first month of entitlement is no earlier than ______ and no later than ___________, a retiree who is reemployed as a “licensed teacher” by a “school district” does not have a bona fide retirement until all employment with covered employers is terminated for at least one calendar month. In order to receive retirement benefits, the member must file a completed application for benefits form before returning to any employment with a covered employer. “Licensed teacher” means a teacher who is required to be licensed under Iowa Code chapter 272. “School district” means a political subdivision of the state of Iowa that is authorized by legislative authority. This subrule only applies to reemployments that meet all the foregoing requirements and in addition occur following a “complete termination of employment.” Prior to employing a retired teacher pursuant to this subrule, the employing school district shall meet the following requirements:
1. The school district must post the opening for a teaching position pursuant to Iowa Code §256.27.
2. Make a reasonable and good faith effort to employ a non-retired teacher, licensed under chapter 272 (for the purposes of this subrule “good faith effort” means the same as defined in Iowa Code Chapter 279.19A, subsection 9 (see below*).
A “complete termination of employment” means: 1. The employer must post the opening and conduct a job search;
2. the retired member must receive all termination payouts that are mandatory for other terminated employees of that employer; and
3. the retired member must not enter into a reemployment agreement with the prior employer or another school district as defined in this subrule prior to or during the first month of entitlement.
*Iowa Code Chapter 279.19A subsection 9 – For the purposed of this section, ‘good faith effort” includes advertising for the position in an appropriate publication, interviewing applicants, and giving serious consideration to those licensed or authorized, and otherwise qualified applicants who apply. If approved, this would be a permanent benefit change, unlike the licensed health care providers whose shortened bona fide retirement period had a sunset provision. Possible motion: I move that the BAC approve an actuarial cost study to estimate the cost impact of reducing the bona fide retirement period for licensed teachers from the current four months to one month. The BAC will pay for the study from its budget.

IPERS’ Appeal Process. An IPERS member or beneficiary can appeal a decision that impacts their rights. Typically, an initial appeal is filed after IPERS makes
an “initial agency decision” on some matter. Pursuant to Iowa Code chapter 97B, each initial appeal is routed through an internal review process. During this
internal review, IPERS’ staff conduct a thorough review of the facts and law surrounding the initial appeal. Frequently, this review includes gathering additional
information and may include further discussions with the appellant. Once the initial review is finished, a Final Agency Determination (FAD) is issued. The
FAD can affirm, modify, or rescind the initial agency decision. The FAD is sent to the appellant who has the opportunity to appeal the FAD. If the FAD is
appealed, IPERS transfers the case to the Department of Inspections & Appeals for assignment of an administrative law judge to hold a contested case hearing.
After the contested case hearing is held and the administrative law judge issues a proposed agency decision, IPERS or the appellant can appeal the proposed
agency decision to the Employment Appeal Board (EAB). The EAB reviews the records and proposed agency decision. The EAB issues its own opinion that
can affirm, deny, or modify the proposed agency decision. If IPERS or the appellant are unsatisfied with the EAB’s decision, then a Petition for Judicial Review
can be filed. Ultimately, IPERS or the appellant can appeal all the way to the Iowa Supreme Court.
