Jefferson Township Board of Trustees June 7, 2016

Regular Meeting Minutes

The Jefferson Township Trustees met in Regular Session on June 7, 2016 at 7:00 p.m. at the Administration Building, One Business Park Drive, Dayton, Ohio.

Trustee Mann called the meeting to order and led the Pledge Allegiance to the Flag.

Fiscal Officer Tracey Edwards did the roll call: Roy Mann — Present

Mary Johnson — Present James McGuire —Present

Administrator Len Roberts and Fiscal Officer Tracey Edwards were also present.

Approval of Minutes Trustee Johnson moved to approve the meeting minutes held on May 3rd , Work Session held May 17th, and Special Work Sessions held on May 24th and May 31, 2016. Trustee McGuire seconded the motion.

DEPARTMENTAL REPORTS (Full detail of all department reports can be found at wwwieffersontwaorq)

Road Department — Craig Howell Installed a "No Parking" sign on Knapp Street. Installed a street sign at Altrim Road & Blairwood, Forney Road, and Mile Road Patched potholes on Infirmary, Huffman, Pinnacle, Fiske, Colgate, Fry Town, and Knox Cleaned and added asphalt grindings in alley of Colgate & Hanover Ave., and replaced asphalt on Stacey Road. Redirected water to run in catch basin on Cherokee Street. Lawn maintenance at cemeteries, fire stations, parks, the Point, and the administration building. Seeded Lower Miami Cemetery Mowed & weed whipped several roads throughout the Township

Fire Department — Chief Larry Sexton: Chief Sexton reported for the month of May 2016: There were a total of 124 incidents (7 Fires, 99 rescue/EMS, 5 hazardous conditions (non-fire), 2 service calls, 7 good intent calls, 4 false alarm and false calls)

Fire hydrant checks have been completed. Hose testing starts this week.

The AFG Grant includes the 40 sets of Personal Protective Gear (helmets, gloves, hoods, pants, boots, coats), three cardiac monitors with the latest technology and upgrades included, three thumpers which will perform CPR/chest compressions, 24 SCBAs. The bid specs are on the township website and will be advertised in Dayton Daily Newspaper. All bids must be in by 11:00 a.m., June 23 rd .

The SAFER Grant has been applied for. It provides funding for staffing. The grant applications were reviewed on May 16h, - the township is awaiting the outcome to see if we were approved.

Community Paramedic Program Tammi Whalen reported the following:

Sixty-six residents were transported or cared for by paramedics during the month of May. Referrals were down for the month of May.

Blood Pressure screenings on Wednesdays. Yoga attendance was 62 for the month.

Eat Smart Be Active is on Thursdays at Station 59 at 6:00 p.m.-7:30 p.m. (food is at this event) The first class had 6 participants.

Chronic Disease Self-Management Program Tuesdays starting July 5, 9:30a — noon (seating is limited, you must sign up in advance). There is a $15 fee for those less than 60 years old (they are looking at a couple of sponsors to cover the $15 fee).

Diabetes Wellness Retreat — Saturday, June 25, 9:am — 12 noon at Good Samaritan North Hospital.

Community Day, August 6 — a tent will be set up there.

Tammy provided an updated list of the Farmers Markets in the township, this will also be on the township website.

Grants — Dayton Foundation (provided funding for the community paramedic program) will be completed by September 2016.

CVS Coordinated Care Grant (allows for renovation of Station 59) six-month evaluation is coming up. Tammi hope to report the report at the next Trustee meeting.

Zoning Department — Jeffrey Payne Mr. Payne provided a written summary of activities for the month of May to the Trustees and meeting attendees which consisted of the following information:

BZA Cases: There was one case — 6349 Germantown Pike (mobile home)

Zoning Cases — (1) Recommendation for amendments to the Comprehensive Plan and (2) Draft of the proposed Zoning Resolution

Zoning Certificates — One zoning certificate at 5255 Germantown Pike

Complaints — 31 nuisance declarations in May

The property at 5106 Retford has been completed

The environmental review for 5054 Coulson has been completed, the property has been assigned to a local contractor for demolition.

The Jefferson Township Zoning Commission is holding public hearing to review the final recommended changes to the Township component of the Montgomery County Comprehensive plan on Thursday June 9th starting at 7:00 p.m. at the Jefferson Township Administration Building.

Also at the June 9th meeting the Zoning Commission will recommend adoption of the proposed amendments to the Trustees, and the Zoning Commission will direct the staff to submit the first draft of the proposed Zoning Resolution to the Montgomery County Planning commission.

Montgomery County Sheriff Office (MCSO): Captain Brem report for the month of May 2016:

Total reported crime in Jefferson Township is down 10% compared to this time 2015; reported crime is down 26% compared to this time 2014. May 2016 compared to April 2016 total reported crime is up 17%.

May 2016, property damage traffic crashes in Jefferson Township are down 39.5%, injury crashes are up 50%, OVI crashes are down 50% and hit and run crashes are down 50%, compared to May 2015. On May 5, deputies were dispatched to the Drexel Dive-Thru on an armed robbery. An unknown suspect walked into the drive-thru and demanded money from the register. The owner/clerk managed to take the gun away from the suspect and fire at least once at the suspect. The area was searched; a suspect was not located.

On May 14, deputies responded to Napoleon's Bar on Germantown Street in Jefferson Township on the report of a shooting. Four individuals were shooting at each other in the bar parking lot. Witnesses stated that two individuals exited the bar and two other individuals came from the rear of the building where they started shooting at the other two. High caliber rifle rounds and hand gun rounds were located in the parking lot. The victim was transported to the hospital where he was treated and released. The victim gave little information on the incident and is not cooperating in the investigation

ADMINISTRATOR COMMENTS Mr. Roberts commented on the zoning code stating that the zoning code should be aspirational and not necessarily reflecting what's there; what is it you want the community to look like down the road.

He stated there are some standards in the zoning codes that are significantly higher than what the township is used to. One of those is commercial truck parking in residential neighborhoods if it is an issue on the street parking issue it is for police enforcement, if it is on private property it is a zoning enforcement issue. The other zoning code is protecting the rural nature of the township.

The grass is getting high in the Radcliff Heights (Colin Powell School). Horizon of Hope Ministry is in the process of purchasing the building. Jeff and he had a conversation with Bill Saunders who is with the church about cutting and putting on their tax bill. A letter was received today from Mr. Saunders stating the church will take responsibility for maintenance of the property.

Concentration on Third Street cleaning and zoning issues. He and Jeff toured from Third Street to Diamond Mill and cited a number of properties. The plan is to tour this area once a week to complete the Third Street area.

TRUSTEES COMMENTS

Trustee Johnson mentioned that the latest Newsletter is available on table. Free appliance recycling on Thursday, Friday, and Saturday sponsored by Montgomery County Environmental Services flyer on table also.

If anyone know of vendors who want to participate at the Community Day event there are representative at the meeting tonight.

Trustee McGuire mentioned the additional work sessions that have been held to knock out lingering issues.

He's been working with Captain Brem on hotspots and drug activities in the township.

He spent about 12 hours over the Memorial Day weekend trimming and pulling bushes, pulling up dead stuff, getting the beds ready for mulch and flowers. The hard work is done, anyone is welcome to help out with mulching and flowers. As he gets time, he will try to get over to Station 59 and work on that. He thanked Road Department for the use of their truck.

This month he is going to be taking pictures and sending to the Road Department, and Zoning. He wants to see code enforcement down in Dayton Farmersville area. He asked for the code enforcement on Third Street.

Spent several hours driving around the Liberty with Mr., Thomas. Looking at nuisances out toward the Liberty area.

Inspected mowing at cemeteries for Memorial Day.

Citizen Comments:

Carmen Oliver 5925 Dayton Liberty Road — considered a nuisance. She stated she wrote a letter to zoning department indicating that cars are lined up for repair work, and tow trucks are bringing cars compared to an auto repair shop. This is a residential area not a business area. As of the last conversation on September 30, 2015, Mr. Payne said he would look into the matter and she has not heard anything. As of this date the car repair has increased and gotten worse. It degrades the area and runs property values down. Mr. Roberts responded that a cease and desist order was issued. A week ago, a citation was issued for unlicensed and inoperable vehicles. The problem is that running a business cannot be documented that can be taken to the prosecutor. There is nothing illegal about fixing cars in his driveway. The sheriff office is working with the township to try to document there is in fact a business is being run there. As soon as the prosecutor gets evidence the township is ready to go to court on this property. The township can tow inoperable and unlicensed vehicles, but there is nothing that prohibits someone from fixing cars as a hobby on their own property, so until that exchange happens the township cannot document that a business is being operated. The township is aware of it and on top of it on a regular basis, and trying to find a solution to it. Trustee McGuire added that he drove by the property last week and he made a couple of phone calls to some people who work for Mr. Brem to see if he is in business.

Mrs. Oliver was concerned about outdoor fire burning of leaves at 5870 Dayton Liberty Road. She says she was told someone would be sent out to talk to the individual. Chief Sexton says someone from his fire crew did go out and check, but there was no burning at the time. They need to catch them burning. Chief Sexton stated that any type of open burning in Montgomery County must have a permit from RAPCA. Mr. Roberts pointed out that burning is not prohibited in the township. It is allowed with a permit (certain material and certain conditions). He also stated that RAPCA is the party that's responsible for enforcement of the permit

Mable Cross reports that at Blairwood & Derby - vacant house with lots of trash; 5144 Tucson — high grass, 5324 Tucson — high grass, 1741 Hopewell - tall grass. She asked how do the township go about choosing which property they cut the grass at. Mr. Roberts replied he and Jeff will go out this week and look at the properties.

Marry Ann Scott complained about 7342 Dayton Liberty, 6315 Dayton Liberty, 2155 Liberty Ellerton, grass high at all these properties. Mr. Payne responded that 2155 Liberty Ellerton has a significant amount of delinquent taxes. An individual made application and paid for the township to have the property taken through an accelerated sheriff sale.

Ms. Scott asked if anyone had heard about the EPA Grant, the response was "no". She complimented Trustee McGuire for cleaning up the administration building.

Lori Miller & Shelly Simmons states that a neighbor indicated he want to open a gun shooting range adjacent to her property. This would have a future impact on her horse business. Mr. Payne says he called the guy and asked what are his intentions and he acted as if he did not know. Mr. Roberts and Mr. Payne will meet with Ms. Miller and Ms. Simmons following this meeting to further discuss.

Sara Boykins — concern is children on corner of Debry Road & Blairwood in center of street with basketball hoop. She says two children almost got hit, something needs to be done. Captain Brem he will address this again in his office. He says pedestrians cannot just be in the roadway, so they can be cited.

Marian Perry ask when will something be done with the banks that own property that will cut grass at two properties on Altrim Road, and the house on Blairwood & Derby Road. Mr. Roberts stated that the banks are taking possession of the property, but the deeds do not get transferred. When the

township cites for cutting the documentation the township has is the old property owner and the bank has not legally taken possession of the property.

Kelly Kirsh —stated her daughter graduated from CJ and will be attending Wright State University. She has been participating the Yoga classes at Station 59 and encourages everyone to come out. She would be happy to give someone a ride to Station 59. Ms. Kirsh also support the Greenstone Stables.

Trustee Johnson motioned that the meeting be adjourned. Trustee McGuire seconded.
