The regular monthly meeting of the Gloucester County School Board was held on Tuesday, March 12, 2013, in the Administrative Offices Room 305. The Chairperson called the meeting to order at 5:35pm

ROLL CALL

Roll call was taken by the Acting Clerk, and the following persons were recorded as present: George R. (Randy) Burak, Chairperson, Troy M. Andersen, Ann F. Burruss, Kimberly (Kim) E. Hensley, Carla B. Hook, Anita F. Parker, and Kevin M. Smith, Members. Also present for the closed meeting: H. Ben Kiser, Ed.D., Superintendent of Schools, John E. Hutchinson, Assistant Superintendent for Administrative Services and Acting Clerk, and Charles A. Wagner, Ed.D., Assistant Superintendent for Instructional Services.

13-30: CALL FOR CLOSED MEETING

At 5:36 pm, a motion was made by Ms. Burruss, seconded by Ms. Parker, and unanimously approved to adjourn for a closed session, pursuant to Code of Virginia , 1950, as amended, Section 2.1-3711 (A) , Subsection 1, for the discussion of personnel matters (appointments, resignations, etc.); and Subsection ·2, for the discussion of student personnel matters (1 recommendation for expulsion) . At 6:39 pm, the Chairperson declared a recess , and the meeting was relocated to the Colonial Courthouse.

13-31: RETURN TO OPEN MEETING/CERTIFICATION

Note: Ms. Betty Jane Duncan, Deputy Clerk, recorded the remainder of the meeting. The Deputy Clerk noted that all members were present for the open meeting.

At 7:00 pm, a motion was made by Mr. Smith to reconvene the meeting into open session and to certify that the Gloucester County School Board, while in closed session , discussed only public matters lawfully exempted from open meeting requirements provided in Subsection A of Section 2.2-3711 and that only public business matters that were identified in the motion convening the closed session were heard, discussed or considered. The motion was seconded by Ms. Burruss and approved as follows:

One (1) Recommendation for Expulsion- A motion was made by Ms. Burruss, seconded by Mr. Smith and unanimously adopted to approve the recommendation to expel one (1) student from attendance in Gloucester County Public Schools. 2. Proposal for Summer STEM Robotics Camp (July 2013)- Mr. Rusty West, GHS/Pa~e teacher, presented a proposal for a Summer STEM Robotics Camp at GHS to serve 18-25 51

and ?'h grade students. A motion was made by Ms. Burruss, seconded by Ms. Hensley and unanimously adopted to support the proposal.

3. Support Services Update-Grounds - Mr. Jimmy Viars, Grounds Manager, updated the Board on activities and services of the GCPS Grounds Department. Mr. Viars noted the accomplishments of the department, highlighted the state and national licenses held by employees, and reported on-going staff development. Board members extended thanks to Mr. Viars and his staff for the outstanding work they do for Gloucester County Public Schools.

4. CTE Business Expo - Dr. Paul Mclean, Director of Career and Technical Education, provided information on the Gloucester CTE and Business Community Expo to be held on May 1, 2013 at Gloucester High School. (Copy of handout attached to minutes)

5. GAllE Redesign - Dr. Mclean explained the proposed GAITE redesign changes for 2013-14. (Copy of presentation attached to minutes)

6. Safety/Security Update with Re-commendations for Action - Mr. Hutchinson, and Ms. Shirley Chirch, Environmental Health and Safety Manager, reported on a meeting held with school staff and representatives from Honeywell regarding a safety survey conducted by that firm . Schools have already begun to incorporate many of the recommendations into their safety procedures, and further follow-up actions will be explored and implemented. Lt. Petrovich with the Gloucester Sheriff's Department will be meeting with teachers to review safety procedures.

Ms. Chirch also discussed with the Board a proposed safety program in cooperation with the Virginia State Police known as the Trooper-Buddy Program. Under this program, a state trooper would be assigned to each elementary school to spend one day per month at that school and to visit the school each week. A motion was made by Ms. Parker, seconded by Ms. Burruss and unanimously adopted to approve participation in the Trooper Buddy Program. Sgt. Sterling with the Virginia State Police will attend the April School Board meeting to further explain the program. (Copy of information on Trooper-Buddy Program attached to minutes)

7. Updates on Committees/Boards by SB Members - No updates were presented at this time.

8. Reserved for Remarks from Citizens in Audience - Mr. Burak asked if there were any persons present who wished to address the Board. He asked that all persons state their name, the district in which they reside and to limit their remarks to five minutes or less. The following persons came forward to speak:

Hannah Witt (GHS Senior) thanked Ms. Parker and other Board members for giving her the opportunity to shadow them for her Senior project.

13-37: BUDGET AND FINANCE ITEMS

1. Grants and Donations Received by GCPS - Ms. Joanne Wright, Director of Budget and Finance, highlighted the donations and scholarships totaling $14,038.27 that had been received by the schools and the division. A motion was made by Ms. Burruss and seconded by Mr. Andersen to accept with grateful appreciation the donations as outlined . The Deputy Clerk polled the Board as follows:

2. Update on Thomas Calhoun Walker Education Center -Mr. Scott Shorland, Project Manager, presented an update on the Thomas Calhoun Walker Education Center modification. (Copy of presentation attached to minutes) The scope of the project is being refined in order to accommodate the appropriation made by the Board of Supervisors to fund the project. Staff will meet with the architect this week to discuss the changes that can be made to the base bid. Mr. Shorland anticipates that work will begin in April and that December 31 still remains a feasible date for occupancy.

3. Adoption of School Board's Recommended FY'14 Budget - Dr. Kiser and Ms. Wright presented the recommended FY'14 budget as adjusted based on revised revenue. (Copy of School Board's Recommended FY 2013-14 Budget attached to minutes) A motion was made by Mr. Smith and seconded by Ms. Burruss to adopt the recommended budget for FY'14 totaling $66,672,414 (Operating Fund, Central Food Service, Capital Improvements Fund, and Debt Service Fund) and Construction Fund totaling $25,636,428. 1 Update on Page Middle School -Mr. Duane Harver, RRMM Architect, provided a progress update on the Page Middle School project. (Copy of Mr. Harver's presentation attached to minutes) Mr. Harver highlighted many of the safety features being incorporated into the design of the school.

1. Discussion of Going Paperless for School Board Agendas - Board members discussed the plan to go "paperless" for School Board agendas effective July 1. Accommodations would need to be made for any Board members who do not have adequate access to Internet.

2. VSBA Hot Topic Conference - April 29, 2013, 8:30 am to 1:15 pm @ Charlottesville Omni - Ms. Burruss and Dr. Kiser have been registered to attend.

3. VSBA Business Honor Roll - Members discussed the VSBA proposal to publish an honor roll to recognize local businesses for their contributions to public schools. After discussion, it was the consensus of the Board to recognize collectively local businesses that provided support following the tornado crisis in Gloucester County. Ms. Wright will retrieve the list of businesses from the records and recommend businesses to the Board for its consideration at the special meeting on March 28. Board members agreed to meet at 6:30 pm at Gloucester High School on March 28 (prior to the joint meeting with the Board of Supervisors) to consider the VSBA Business Honor Roll .

4. Nomination of Ms. Parker for VSBA Vice-Chairperson of Eastern Region -A motion was made by Mr. Smith and seconded by Ms. Hook to approve the nomination of Ms. Parker for VSBA Eastern Region Vice-Chairperson. Motion was adopted by a voice vote of the Board with members Burak, Hensley, Hook, and Smith voting aye, and members Andersen and Burruss voting nay.

1. Policy Manual Update - Mr. Hutchinson presented the following items for consideration:

Mr. Hutchinson recommended approval of File KBA as presented on 1st and 2nd readings. A motion was made by Mr. Smith, seconded by Ms. Burruss , and unanimously adopted to approve policy File KBA on 1st and 2nd readings. 2. Proposed 2013-2014 School Calendar- Mr. Hutchinson presented the proposed school calendar for 2013-2014. He noted that after consultation and communication with staff and with School Board members, some revisions had been made to the report card schedule. Discussion was held regarding the schedules for staff development and planning days. A motion was made by Mr. Smith and seconded by Ms. Burruss to approve the proposed 2013-2014 school calendar as revised. Upon a voice vote, motion was adopted with all members voting aye with the exception of Ms. Hensley who voted nay. (Copy of 2013-2014 School Calendar as adopted attached to minutes)

A special meeting of the School Board Disciplinary Committee was held on Friday, March 22, 2013, at 8:00 a.m., at the Administrative Offices Complex, Gloucester, Virginia, for the purpose of holding one (1) student personnel hearing.

CALL TO ORDER AND ROLL CALL The meeting was called to order by Rita H. Cargill-Brown, Acting Clerk. Present were: Ann

Burruss, Carla Hook, Anita Parker, School Board Members; Layton H. Beverage, Ed. D.; and Howard B. Kiser, Ed. D., Superintendent of Schools.

CALL FOR CLOSED SESSION At 8:13 a.m., a motion was made by Ms. Hook, seconded by Ms. Parker and unanimously

approved to adjourn for a closed session, pursuant to Code of Virginia, 1950, as amended, Section 2.2-3711 (A), Subsection 2, for the discussion of one student personnel matter.

RETURN TO OPEN SESSION At 8:40a.m., a motion was made by Ms. Parker, seconded Ms. Hook, and unanimously

adopted to reconvene the meeting into open session. A motion was made by Ms. Parker and seconded by Ms. Hook to certify that the Gloucester County School Board, while in closed session, discussed only public matters lawfully exempted from open meeting requirements provided in Subsection A of Section 2.2-3711 and that only public business matters that were identified in the motion convening the closed session were heard, discussed or considered. The motion was approved with a roll call vote as follows:

The Department of Parks, Recreation and loumm is pleased to be a sponsor of the Battle of the Hook event which will be held Saturday, October l911i and Sunday, October 20tlt, 20t3. Tam writing to request the use of school hu'ses and the Gloticcster High School srudcnt parking lot for evem parking. The bu::;es would be used to shuttle visitors from the school to Warner HaJJ, the location of the event. You may recall we used several pick-up locations when the event was held five years ago bttt this time, participant~ will be allowed to dnve to the .~ite . Bethel Elementary School

Instructional Report March 2013

• Before and after school intervention sessions have begun at Bethel. Students in grades 3- 5 have been given the opportunity to come before or after school to get extra help in reading, math, and science. Students in 1st and 2nd grades are also meeting after school once a week to participate in Reader's Theater.

• Students at Bethel participated in World Math Day, World Literacy Day, and World Science Day. This event allows students to compete academically with students around the world via the computer.

• Ms. Lisa Witt has begun her after-school Bear Club. The goal of this after school activity is to help students with their homework and organizational skills. This year we have added a second session for kindergarten and first grade students.

• On the evening of March 7, all of Bethel's third grade students celebrated the Grammy Awards. During this event the simple machine projects created by all third graders were displayed and awards were given to the top projects in each simple machine category. What makes our simple machines so special is that each machine actually makes a musical sound. All students dress for the event and get to walk down the red carpet. The winners were featured on WXGM on March 20.

• The week of March 11 was a very busy one for our school. Our students completed Jump Rope for Heart in the gym with Mr. Miller. We opened our week long Book Fair and had Grandparents' lunch throughout the week. Our PTA also sponsored a Lucky Charm bingo night for students and their families.

• March 21 was our Family Math Night at Food Lion. Students used their math skills to complete scavenger hunts throughout the store.

• Our annual Bethel Talent Show was March 28. Mrs. Stanley organized the event. Over 40 students participated. It was very well attended by students and their families.

• The Easter Bunny hopped by Bethel on the morning of March 26. Our cafeteria provided an excellent breakfast for students and their families.

Page Middle School Writing SOL • Teachers and students have been working hard to prepare for the Writing SOL. Ms. Davis shared links to

examples of writing prompts that can be incorporated in all classes. Ms. Crotty has performed her duties as the Page Testing Coordinator with finesse. We anticipate great results.

Intervention/Inquiry Blocks • As we approach 4th quarter, discussions are taking place between administration and teachers as to how to

best prepare students for the upcoming SOL tests in May. Dr. Wendi Andersen has scheduled professional development lessons with each intervention teacher. She will train intervention teachers on how to implement effective, research-based reading comprehension strategies using leveled text. The strategies that will be implemented in all reading intervention classes are the Frayer Model and QAR.

• Special Education teachers have also been given permission to provide direct intervention to students on their caseload. This will enable additional slots for struggling learners in the other intervention classes.

Rising gth Grader Page Info Meeting at GHS • Rising gth Grader Parent/Guardian Information Night is scheduled for March 27th at 6pm in the GHS

auditorium. Parents and students will be introduced to the programs of study and/or courses offered by Page Middle School. Page administration and Guidance will be present to answer questions.

Opportunities for Page Students: • Starting March 19th, the Dukes to Eagles Math Tutoring Program will be replaced with an after school math

acceleration program designed to prepare students for the math SOLs. Two math teachers will serve as facilitators of this program.

• Page Middle School will host an All Pro Dads breakfast beginning at 6:30am on March 251h in the GHS

cafeteria. Dads are invited to bring in their gth grade son or daughter in early to join us for coffee, juice, and breakfast prior to heading out to work. Rev. Haywood Barnes, Jr. will serve as the guest speaker.

• Students and staff are impressed with the products Ms. Rachel Emde's art students have created. Impressive self-portraits and colorful paintings decorate the halls of Page Middle School.

Gloucester High School Agriculture Students Earn their Certification • Under the instruction of Ms. Staples, Landscaping students Hayden Leigh, Joe Harris, and Justin Willis passed

their Private Pesticide Applicators exam, earning their Private Pesticide Applicator's License. Greenhouse students Dedrick Lemon, Christopher Winter, Tucker West, and Michael Hays passed their Greenhouse Operator's exam, earning their Greenhouse Operator's License. Congratulations gentlemen!

English in the Age of Technology • Mrs. Burns, GHS English teacher, and Ms. Saunders, GHS Media Specialist, collaborated on a unit of study

with the Capstone students to emphasize the significance of non-fiction books and resources. Several non­fiction titles were put on kindles which gave students easy access to reading by using technology new to

Gloucester High School. Book talks were presented by both students and teachers who shared what they were reading.

• Students were also introduced to the seven basic principles of research using Follett Destiny Software and lnfotrac/Gale Group databases. This unit began with a lesson on "Thinking about Thinking" to help students recognize gaps in their own thinking, articulate their thought processes, and become better problem solvers using available research.

• Students then used these research methods to find articles and make connections between the non-fiction books they were reading and current research on relatable topics. Student focus for this unit was geared toward collegiate reading, research, and communication in accordance with the College and Career Readiness Standards created by VDOE.

Students as Teachers • Ms. Rhinehart's Biology students are researching and creating presentations using Prezi, a newer software

program that can create different types of visually interesting and creative presentations. Students are covering Human genetic Disorders and will use their presentations to become the teacher-not only presenting the information but creating assessments for their peers.

The Human Body-Up Close and Personal • Ms. Hunter's Athletic Training classes took a study trip to William and Mary and toured the Athletic Training

facilities at W&M Hall and Laycock Stadium. Students had the opportunity to visit the cadaver lab where they were shown the lower extremity of the human body.

Future Scientists of America • Several GHS students competed at the Tidewater Science fair on March 16th, including: Caitlin Cain, Dustyn

Hall, Anna Robins, Jae Cho, and Mitch Haraburda. Caitlin Cain, with her project, "Can folk remedies control E. coli growth"? took 1st place in Microbiology and 1st Excellence award (placed first among all area 1st place winners). Mitch Haraburda's work, "Impact Test on Non-Newtonian Fluids" earned Honorable Mention in Physics & he won the Armed Forces Award (Army).

• Additionally, several students submitted scientific research papers to the Virginia Junior Academy of Science. Though we won't know until April if a student has been selected to present his/her authentic research, all of the students did excellent work. The students who submitted research papers to the VJAS are: Wendy Sparrer, Bethany Love, Caitlin Cain, Rachael Petersen, Anna Robins, Mitchell Haraburda, and Kayla Fuqua. Great job!

The Duke Troupe Made it to Regional Competition • The Duke Troupe, performing It's Bigfoot placed 2nd in the District, earning a spot at the Regional

competition where they placed 8th. Congratulations on a great production! Foreign Language continues to Nourish Students' Brains (and Bodies)

• Latin students are breathing easier after completing the National Latin Exam on Thursday, March 14. They are eagerly awaiting the results and felt confident in their performance after taking the test.

• Spanish students will follow suit and are ardently preparing for the National Spanish Exam which will be given on Monday, March 25th. After school sessions have been and are continuing to be held to make sure the students know additional vocabulary, grammar and receive extra practice.

• The Latin students brought in 435 toiletry items to send to the Eastern shore of Virginia that was hit hard by Hurricane Sandy. Latin IV students were the winners of the Foreign Language challenge to bring these items in, and they will receive a special treat cooked by Mrs. Ryan.

The Foreign Language Banquet is scheduled for March 28. All language classes have been practicing their songs in anticipation of their performances! The posters are on display throughout the school supporting the national theme, Foreign Languages: They Nourish the Brain! Each student, with their families, will be bringing a dish to share representing either the language the student is studying or a dish reflective of the family's ethnicity. Last year there were 700 people in attendance! The Foreign Language department will also sell drinks with the proceeds going towards the Joyce Bascombe Memorial Fund. During Foreign Language Week, March 25-28, each language will have its day with the cafeteria coordinating the food to represent the culture of the language, colors being worn by students and staff, and certain

target language phrases being repeated throughout the day. Foreign Language students will also be on the radio the morning of March 21st promoting and explaining all the events of Foreign Language week!

Automotive Students Head to Hands-On-Challenge • T.J. Priddy and Robert Cain, two of Gloucester High School's Automotive Students, placed in the Ford/AAA

Auto Skills Challenge on February 7th. The 48 Automotive students from GHS challenged an on-line written exam and when the results were in T.J. and Robert scored high enough as a team to compete in the Hands­on Challenge that will be held May 4th in Virginia Beach where the top ten schools in the state will meet. The vehicle they will be diagnosing and repairing is the Ford Focus SE. The Instructors have coordinated with Mr. Medlin from Medlin Ford, in West Point, to allow the team training time on the Focus before the competition. The winning two-person team from each state is recognized with scholarships, tools, and awards, and, along with their instructor, are provided an expense-paid trip to the national finals at the Ford Motor Company Headquarters in Dearborn, MI.

The five TV Ill students (seniors, Cody Hansford, Randall Hazard, Allison Noah, Cole Smith, and Jonathan White) have just completed Episode ?-Synthetic Drug Forum, and Episode 8-Community Enhancement of their Spotlight Series. Both of these are airing on Duke TV 47 and are available as videos on demand (VOD) via Granicus.

The next Spotlight Series videos, currently in the final editing stages, include Traumatic Brain Injuries; Career Coach Services at GHS-Katie Zanette; and The GHS Chili Cook-Off. Segments from the Traumatic Brain Injuries Spotlight Series video were also incorporated into some of the GHS morning shows, The Duke Daily, during the month of March, which is Traumatic Brain Injury month.

The TV I students (A3, B3, B4) are currently finishing up their third rotation in the various roles they will transition into next year in TV II (e.g., anchor, co-anchor, camera person, graphics technician, teleprompter, floor director, director, technical director, audio technician , segment producer, editor). The fourth rotation will begin right after Spring Break. The TV I students will also begin working on their short films for competition in the annual Gloucester County Public Library's Independent Teen Film Festival right after Spring Break as well.

Best Wishes to Mr. Tyler Brayton, Television Production Instructor

All of the GHS Television Production students said their good-byes, and extended their best wishes, to Mr. Brayton, the week of March 18. Mr. Brayton was the television production instructor at Gloucester High School during the 2011-12 and 2012-13 school years. Mr. Brayton will be remembered well, and missed. Ty is one of the most talented graphic artists that we have ever met! All of us wish him the very best in his new position in the Denver, Colorado area! Keep in touch, Ty!

Section 22.1-253 of the Code of Virginia and 8 VAC20-720~0 of the Virginia Administrative Code permit school divisions to make supplies, services and materials available to students at a cost. Textbooks must be provided free of charge. The schedule of fees, provisions for reducing or waiving fees and consequences for non-payment must be included in policy and provided to parents annually and posted on the division's website.

With input from school principals and instructional leaders, the following changes are recommended:

Remove the following: a) High School- NJROTC Club $25 (Duplicate from Supplies, Services and Materials) and

Happy Club $4 Increase the following fees:

a) High School- Gym Locker $3 to $5 Reduce the following:

This summer, the VSBA Legislative Positions Committee will begin its annual task of considering changes or additions to the VSBA Legislative Positions proposed by member school boards. The VSBA Legislative Positions represent the majority opinion of school boards around the state.

The first step in the process begins with you and your school board. If you have any proposals for changes or additions to the VSBA Legislative Positions please submit them on the enclosed form. In order to be considered by the VSBA Legislative Positions Committee, proposals must be approved by a majority vote of a member school board. The LP Committee cannot accept proposals from individual school board members.

What are typical Legislative Positions? Your Board should have received a copy of the red booklet, "Legislative Positions of the Virginia School Boards Association . January 2013. " You can also access the VSBA Legislative Positions

Legislative Positions provide the basis for making present and future decisions about education and school board legislative positions; they constitute VSBA's legislative belief system. For example, Position 9.12 states, "[c]ontrol of the public school calendar should be solely a prerogative of local school boards." Position 5.7 says, "[l]ocal appropriating bodies should allocate and appropriate, on an annual lump-sum basis, all public school funds each July for the succeeding fiscal year."

Legislative Positions remain in effect (i.e., remain in the Handbook) until their desired goals are achieved through legislative action. Thus, you may find that your proposal already is included in the Legislative Positions Handbook and you do not need to submit it.

Please use the attached forms for submitting your position proposal(s). Feel free to copy these forms if you have multiple proposals. Like the Legislative Positions Booklet itself, you may also download the form from the VSBA website. We ask that you submit proposals both electronically and in hard copy. Please address your e-mail to Wendell Roberts at [email protected] and please send a hard copy of your proposals via regular mail. If you have any questions about this process, please call Wendell Roberts, Staff Attorney, at 434-295-8722. Proposals are due in the VSBA office no later than Friday, June 14, 2013. The Legislative Positions Committee cannot accept proposals after this date (June 14th). In addition, if needed, a member of your Board should be available to present your proposal in person to the Legislative Positions Committee when it meets on July 17, 2013, at the VSBA offices in Charlottesville.

After the Legislative Positions Committee meets on July 17th, the Committee will inform you of its action on your proposal(s). All approved items will be brought before the VSBA Board of Directors at its August 21st meeting. Those approved by the VSBA Board will be acted upon by the VSBA Delegate Assembly in November at the 2013 VSBA Annual Conference. If you do not submit a proposal through this process, your board can try to have it introduced on the floor of the Delegate Assembly.

SCHOOL DIVISION LEGAL STATUS

The Constitution of the Commonwealth provides that the General Assembly establish a system of free public elementary and secondary schools for all children of school age throughout the state, and seek to ensure that an educational program of high quality is established and continually maintained. The General Assembly has required requires that such an educational system be maintained and administered by the State Board of Education, the Superintendent of Public Instruction, division superintendents and school boards. SCHOOL BOARD ORGANIZATIONAL MEETING

The School Board shall hold an organizational meeting in January of each year. The first order of business shall be the election of the School Board Chairperson. The new chairperson shall then assume office and preside over the remainder of the meeting.

The School Board also shall appoint a clerk and approve a designee of the division superintendent to attend meetings of the School Board in the absence or inability of the superintendent to attend. The School Board shall elect a vice chairperson of the board and may appoint a deputy clerk. The term of office for the above positions shall be one year. The agenda for the organizational meeting shall include setting time, place and dates of regular School Board meetings and other items of annual business as appropriate.

The Gloucester County School Board will hold an organizational meeting annually.

At that meeting the Board will

• establish its regular meeting schedule for the following year. • elect one of its members as chairman. • approve a designee of the superintendent to attend meetings of the School Board in case

of the superintendent's absence or inability to attend. and • appoint, on the recommendation of the superintendent. a clerk of the School Board.

Upon election. the chairman will immediately assume office and preside over the remainder of the meeting.

SCHOOL BOARD OFFICERS

The officers of the School Board shall beare a Gfhairperson and Vyice-Gfhairperson. The Gfhairperson and the Vyice-Gfhairperson shall be elected annually at the organizational meeting of the School Board.

School Board Chairperson

The duties of the Chairperson shall beare to preside at all meetings of the School Board, to perform such other duties as may be prescribed by law or by action of the School Board, and sign all legal documents approved by the School Board.

The Chairperson, as a member of the School Board, has a vote on all matters before the School Board which come to a vote, but does not have an additional vote as Chairperson in case of a tie.

Vice-Chairperson

The Vice-Chairperson, if present, shall preside in the absence of the Chairperson, and shall be~ empowered to act in all matters in case of the absence or inability of the Chairperson to act or as provided by resolution of the School Board. If neither the Chairperson or Vice-Chairperson is present, the majority Board members present, if they constitute a quorum, shall elect one from among themselves to chair the meeting.

CLOSED MEETINGS

A. Closed meetings of the Board may be held by the School Board or any committee thereof. only in accordance with Virginia law, for purposes including the following :

1. Discussion, consideration or interviews of prospective candidates for employment; assignment, appointment, promotion, performance, demotion, salaries, disciplining or resignation of specific public officers, appointees or employees of the School Board. Any teacher shall be permitted to be present during a closed meeting in which there is a discussion or consideration of a disciplinary matter which involves the teacher and some student and the student involved in the matter is present, provided the teacher makes a written request to be present to the presiding officer of the School Board.

2. Discussion or consideration of admission or disciplinary matters or any other matters that would involve the disclosure of information contained in a scholastic record concerning any student in the Gloucester County school system. However, any such student, legal counsel and, if the student is a minor, the student's parents or legal guardians shall be permitted to be present during the taking of testimony or presentation of evidence at a closed meeting, if such student, parents or guardians so request in writing and such request is submitted to the presiding officer of the School Board.

3. Discussion or consideration of the acquisition of real property for a public purpose, or of the disposition of publicly held real property where discussion in an open meeting would adversely affect the bargaining position or negotiating strategy of the School Board.

4. The protection of the privacy of individuals in personal matters not related to public business.

5. Discussion concerning a prospective business or industry or the expansion of an existing business or industry where no previous announcement has been made of the business' or industry's interest in locating or expanding its facilities in the community.

6. Discussion or consideration of the investment of public funds where competition or bargaining is involved, where, if made public initially, the financial interest of the School Board would be adversely affected.

7. Consultation with legal counsel and briefings by staff members or consultants pertaining to actual or probable litigation, where such consultation or briefing in open meeting would adversely affect the negotiating or litigating posture of the School Board; and consultation with legal counsel employed or retained by the School Board regarding specific legal matters requiring the provision of legal advice by such counsel. For purposes of this subdivisionsubsection, "probable litigation" means litigation which has been specifically threatened or on which the School Board or its legal counsel has a reasonable basis to believe will be commenced by or against a known party. The closure of a meeting is not permitted merely because an attorney representing the School Board is in attendance or is consulted on a matter.

8. Discussion or consideration of honorary degrees or special awards.

9. Discussion or consideration of tests or examinations or other records excluded from public disclosure pursuant to Va. Code § 2.2-3705.1 .

10. Discussion of strategy with respect to the negotiation of a hazardous waste siting agreement or to consider the terms, conditions, and provisions of a hazardous waste siting agreement if the School Board in open meeting finds that an open meeting will have an adverse effect upon the negotiating position of the School Board or the establishment of the terms, conditions and provisions of the siting agreement, or both. All discussions with the applicant or its representatives may be conducted in a closed meeting.

12. Discussion of plans to protect public safety as it relates to terrorist activity and briefings by staff members, legal counsel, or law-enforcement or emergency service officials concerning actions taken to respond to such activity or a related threat to public safety; or discussion of reports or plans related to the security of any governmental facility, building or structure, or the safety of persons using such facility, building or structure.

13. Discussion or consideration of records excluded from mandatory disclosure pursuant to subdivision 11 of Va . Code§ 2.2-3705.6 (the Public Private Education Facilities and Infrastructure Act) by the School Board or any independent review panel appointed to review information and advise the School Board concerning such records.

14. Discussion of the award of a public contract involving the expenditure of public funds, including interviews of bidders and discussion of the terms or scope of such contract, where discussion in an open session would adversely affect the bargaining position or negotiating strategy of the School Board.

B. No resolution, ordinance, rule, contract, regulation, or motion adopted, passed, or agreed to in closed meeting shall become effective unless the School Board, following the meeting, reconvenes in open meeting and takes a vote of the membership on such resolution, ordinance, rule, contract, regulation, or motion which shall have its substance reasonably identified in the open meeting.

C. The School Board shall follow parliamentary procedure as outlined in Robert's Rule of Order.

D. The School Board or any committee thereof may permit nonmembers to attend a closed meeting of the Board or committee if such persons are deemed necessary or if their presence will reasonably aid the Board or committee in its consideration of a topic which is a subject of the meeting.

E. School Board members may attend closed meetings held by any committee or subcommittee of the Board, or a closed meeting of any entity, however designated, created to perform the delegated functions of or to advise the Board. School Board members shall in all cases be permitted to observe the closed meeting of the committee, subcommittee or entity. In addition to the requirements of Va. Code§ 2.2-3707, the minutes of the committee or other entity shall include the identity of the School Board members who attended the closed meeting.

CALLING AND CERTIFICATION OF CLOSED MEETINGS

No closed meetings shall be held unless .Qy_the School Board or any committee thereof. unless the School Board or committee has taken an affirmative recorded vote in an open meeting approving a motion which (i) identifies the subject matter, (ii) states the purpose of the meeting and (iii) makes specific reference to the applicable exemption or exemptions from open meeting requirements provided in the Virginia Freedom of Information Act, and stated in Policy BDC. The matters contained in such motion shall be set forth in detail in the minutes of the open meeting. A general reference to the provisions of the Virginia Freedom of Information Act or authorized exemptions from open meeting requirements, or the subject matter of the closed meeting shall not be sufficient to satisfy the requirements for holding a closed meeting.

The notice provisions of the Virginia Freedom of Information Act shall not apply to closed meetings of the Board held solely for the purpose of interviewing candidates for the position of superintendent. Prior to any such closed meeting for the purpose of intervie'.ving candidates the School Board shall announce in an open meeting that such closed meeting shall be held at a disclosed or undisclosed location within fifteen days thereafter.

The School Board, or committee thereof. in holding a closed meeting, shall restrict its discussion during the closed meeting only to those purposes specifically exempted under the Virginia Freedom of Information Act and identified in the motion required in partsubsection A, above.

At the conclusion of any closed meeting, the School Board or committee thereof shall immediately reconvene in §!]_open meeting immediately thereafter and shall take a roll call or other recorded vote to be included in the &afd-minutes, certifying that to the best of each member's knowledge (i) only public business matters lawfully exempted from open meeting requirements, and (ii) only such public business matters as were identified in the motion by which the closed meeting was convened were heard, discussed or considered in the meeting-Gy-the School Board . Any member of the Board or committee who believes that there was a departure from the requirements of subdivisions (i) and (ii) above, shall so state prior to the vote, indicating the substance of the departure that, in his judgment, has taken place. The statement shall be recorded in the School Board minutes of the meeting .

Failure of the certification required by subsection Q_Q, above, to receive the affirmative vote of a majority of the members of the School Board present during a meeting shall not affect the validity or confidentiality of such meeting with respect to matters considered therein in compliance with these provisions. The recorded vote and any statement made in connection therewith, shall upon proper authentication, constitute evidence in any proceeding brought to enforce these provisionsthe Virginia Freedom of Information Act.

The School Board may permit non members to attend a closed meeting if such persons are deemed necessary or if their presence will reasonably aid the Board in its consideration of a topic which is a subject of the meeting.

Except as specifically authorized by law, in no event may the School Board or committee thereof take action on matters discussed in any closed meeting, except at an open meeting for which notice was given pursuant to Va, Code § 2.2-3707 and Policy BDDA.

NOTIFICATION OF SCHOOL BOARD MEETINGS

Regular Meetings

The School Board and any committees thereof shall give notice of the date, time, and location of its meetings by placing a notice in a prominent public location at which notices are regularly posted and/or in the central office of the School Board at least three working days prior to the meeting. In addition, the Board and any committees thereof shall publish notice of its-their meetings by electronic means whenever feasible. At least one copy of all agenda packets and other non-exempt materials furnished to members of the School Board and any committees thereof shall be made available for public inspection at the same time the documents are furnished to the School Board members of the School Board or committee.

Special Meetings

Notice, reasonable under the circumstance or special or emergency meetings shall be given contemporaneously with the notice provided to members of the School Board or committee.

Notification of Closed Meetings Held Solely for the Purpose of Interviewing Candidates for the Position of Superintendent

The notice provisions described above do not apply to closed meetings of the Board held solely for the purpose of interviewing candidates for the position of superintendent. Prior to any such closed meeting the School Board shall announce in an open meeting that such closed meeting shall be held at a disclosed or undisclosed location within fifteen days thereafter.

Direct Notification

Notice of all school board meetings shall be furnished directly to any person who requests such information. Requests to be notified of all meetings should be made at least once a year in writing and include the requester's name, address, zip code, daytime telephone number, electronic mail address, if available, and organization, if any. Unless the person making the request objects, the school division may provide electronic notice of all meetings in response to such requests.
