This Addendum is issued prior to receipt of bids to provide for certain changes and clarifications to the

specifications and/or the plans, as herein specified, and is hereby made a part of the Contract Documents and

shall be taken into consideration in preparing the Proposal. All other conditions remain the same.

this alternate shall be listed below and deducted from the Total Amount of the Bid for the Project

BID FORM

ARTICLE 1 – BID RECIPIENT

1.01 This Bid is submitted to:

City of Howell City Hall – City Clerk’s Office, 611 E. Grand River Ave., Howell MI 48843

1.02 The undersigned Bidder proposes and agrees, if this Bid is accepted, to enter into an Agreement

with Owner in the form included in the Bidding Documents to perform all Work as specified or

indicated in the Bidding Documents for the prices and within the times indicated in this Bid and in

accordance with the other terms and conditions of the Bidding Documents.

ARTICLE 2 – BIDDER’S ACKNOWLEDGEMENTS

2.01 Bidder accepts all of the terms and conditions of the Instructions to Bidders, including without

limitation those dealing with the disposition of Bid security. This Bid will remain subject to

acceptance for 90 days after the Bid opening, or for such longer period of time that Bidder may

agree to in writing upon request of Owner.

ARTICLE 3 – BIDDER’S REPRESENTATIONS

3.01 In submitting this Bid, Bidder represents that:

A. Bidder has examined and carefully studied the Bidding Documents, other related data identified in the Bidding

Documents, and the following Addenda, receipt of which is hereby acknowledged:

D. Bidder has considered the information known to Bidder; information commonly known to contractors doing

business in the locality of the Site; information and observations obtained from visits to the Site; the Bidding

Documents; and the Site-related reports and drawings identified in the Bidding Documents, with respect to the

effect of such information, observations, and documents on (1) the cost, progress, and performance of the Work;

(2) the means, methods, techniques, sequences, and procedures of construction to be employed by Bidder,

including applying the specific means, methods, techniques, sequences, and procedures of construction expressly

required by the Bidding Documents; and (3) Bidder’s safety precautions and programs.

E. Based on the information and observations referred to in Paragraph 3.01.E above, Bidder does not consider that

further examinations, investigations, explorations, tests, studies, or data are necessary for the determination of this

Bid for performance of the Work at the price(s) bid and within the times required, and in accordance with the other

terms and conditions of the Bidding Documents.

F. Bidder is aware of the general nature of work to be performed by Owner and others at the Site that relates to the

Work as indicated in the Bidding Documents.

G. Bidder has given Engineer written notice of all conflicts, errors, ambiguities, or discrepancies that Bidder has

discovered in the Bidding Documents, and the written resolution thereof by Engineer is acceptable to Bidder.

H. The Bidding Documents are generally sufficient to indicate and convey understanding of all terms and conditions

for the performance of the Work for which this Bid is submitted.

ARTICLE 4 – BIDDER’S CERTIFICATION

4.01 Bidder certifies that:

A. This Bid is genuine and not made in the interest of or on behalf of any undisclosed individual or entity and is not

submitted in conformity with any collusive agreement or rules of any group, association, organization, or

corporation;

B. Bidder has not directly or indirectly induced or solicited any other Bidder to submit a false or sham Bid;

C. Bidder has not solicited or induced any individual or entity to refrain from bidding; and

D. Bidder has not engaged in corrupt, fraudulent, collusive, or coercive practices in competing for the Contract. For

the purposes of this Paragraph 4.01.D:

1. “corrupt practice” means the offering, giving, receiving, or soliciting of anything of value likely to influence

the action of a public official in the bidding process;

2. “fraudulent practice” means an intentional misrepresentation of facts made (a) to influence the bidding

process to the detriment of Owner, (b) to establish bid prices at artificial non-competitive levels, or (c) to

deprive Owner of the benefits of free and open competition;

3. “collusive practice” means a scheme or arrangement between two or more Bidders, with or without the

knowledge of Owner, a purpose of which is to establish bid prices at artificial, non-competitive levels; and

“coercive practice” means harming or threatening to harm, directly or indirectly, persons or their property to

influence their participation in the bidding process or affect the execution of the Contract.

5.02 ALTERNATES: Voluntary Alternates proposed by the Bidder will not be considered. The

Bidder shall submit a bid based on the information shown on the Drawings and Specifications.

Alternates listed below are for the Owner’s convenience and shall be priced as indicated by the

work description. All alternates shall be clearly marked whether they represent an add or deduct to

the Base Bid Price quoted herein. All Alternates which are quoted shall be complete and the price

shall include all Bidder mark-ups. Each Alternate shall be clearly marked if it represents an Add or

a Deduct from the Base Bid Price.

ALTERNATE 1 – Replace Membrane Roofing

The Specifications and Drawings indicate an alternate option for the replacement of the WTP membrane

roofing. This additive alternative line item shall be the additional cost to install the roofing as shown in the

Contract Documents and shall include all work associated with the replacement of the membrane roof on the

main treatment building including the demolition of the existing membrane and insulation and the

installation of the new insulation, vapor barrier, and membrane roofing material.. The costs associated with

this alternate shall be listed below and shall not be included in the Total Amount of the Bid for the

Project above. The City will decide after the bids are opened whether to elect this alternate.

5.03 PAY ITEMS

A. Lump sum pay items include all necessary material plus cost for delivery, installation, insurance, overhead, and

profit. Compensation for all such services, materials, and related work is to be included in the prices stipulated for

the unit and lump sum pay items listed herein.

3. Item No. 2 – Carbon Dioxide Feed System and Process Piping

a. Description: This line item shall include the installation of the new carbon dioxide feed system including

the bulk carbon dioxide storage tank and foundation pad. This also includes instrumentation, SCADA

programming, and electrical equipment to complete the carbon dioxide feed system installation. Other

costs include the installation of the carrier water piping, carbon dioxide gas piping, carbon dioxide

solution pipe to the diffuser in the clarifier effluent box, and the new 20” pipe from the ClariCone to the

filters.

b. Unit of Measurement: Lump sum.

4. Item No. 3 – Lime Feed System

a. Description: This line item shall include demolition of the existing lime slaker and supports and the

installation of a new lime slaker. This also includes instrumentation, SCADA programming, and

5.04 SUBCONTRACTORS / MAJOR EQUIPMENT ITEMS

A. The Base Bid above Includes the following Equipment Items on which the Base Bid has been

determined and, if awarded the Contract.

B. In connection with major items of equipment to be furnished and installed in this Project, Bidder

expressly agrees to the following provisions:

1. That the Total Base Bid Price stated above includes the furnishing and installing of major

equipment, products, and systems furnished by the Supplier which Bidder has selected from those

listed “Schedule of Proposed Major Equipment and Subcontractors” completed as part of this Bid

Form; and Bidder has circled the name of the selected Supplier “Schedule of Proposed Major

Equipment and Subcontractors” form in of this Section.

2. That the installed price of the equipment, products, and systems includes the cost (if any) of

changes in the structure, buildings, piping, wiring, accessories, etc., necessary to accommodate the

particular equipment, products, or systems proposed.

C. The “Schedule of Proposed Major Equipment and Subcontractors” below of this Bid Form shall be

binding in terms of the selected equipment, products, systems, subcontractors, and suppliers to be

provided by the Bidder under the Total Base Bid Price.

D. Substitutions offered by Bidder shall be governed by the requirements of Instructions to Bidders;

Paragraph 6.05 of the General Conditions; and Material and Equipment of these Specifications. Bidder

expressly agrees to the following provisions:

1. Where proposed substitutions for major equipment and system items listed in the “Schedule of

Proposed Major Equipment and Subcontractors” form are to be considered, they must be designated

by Bidder in the spaces provided on the Schedule Form. No further requests for substitutions on

those items listed on the Schedule Form will be considered after Bids have been received and

opened.
