CEOREPORT

The safety and well-being of people working in the private sector was our focus during Safe Work October. ACCI has led the way in securing government, business and even union support for practical measures to improve work health and safety outcomes for people in small businesses. We can all be safety champions, for ourselves and our colleagues.

To make it easier to do business, we need smarter rules and regulations, not more. ACCI was at the heart of the government’s ongoing project to cut red tape to free up businesses to better meet the needs of the communities we serve. The appointment of our Trade Director, Bryan Clark, to Minister Ben Morton’s Deregulation Taskforce was another endorsement of ACCI’s thought leadership in Trade, on which so much of Australia’s prosperity depends.

The impact of years of drought was compounded by bushfires that unsettled millions of people in our south eastern capitals and terrified regional communities. ACCI and our members encouraged people to use their purchasing power to support drought affected communities and help fire affected businesses get back on their feet.

The growing economic impact of disasters reinforced our calls for policies to respond to public and business needs, boost business investment and manage the nation’s finances wisely. We set out a comprehensive plan in our Federal Budget submission; and we lobbied to make sure that, in the implementation of the recommendations of the Financial Services Royal Commission, we make it easier, not harder, for small business to access the finance they need to operate and to grow.

Unfortunately, people in businesses were let down badly when the Senate rejected the Ensuring Integrity Bill. The upper house gave the green light to lawless unions to intimidate people who don’t have the money or the muscle to withstand them. With our strong support the government re-introduced the Bill, and we committed to redouble our efforts with members to persuade the Senate to make it law.

We kept up pressure on the federal and state and territory governments to increase their investment in vocational education and training. We campaigned with members across several fronts, with political leaders, senior officials and businesses. We secured a seat at the table for industry and worked hard to put in place effective funding and governance to train Australians for the jobs of today and tomorrow.

The Australian Chamber held our quarterly Education, Employment and Training Committee meeting in October which was attended by the Assistant Minister for Vocational Education, Training and Apprenticeships the Hon Steve Irons MP.

The Australian Chamber also met with the Department of Employment, Skills, Small and Family Business regarding the Review of the Skilled Migration Occupation Lists, which underpins Australia’s skilled migration program. With the most significant potential changes to the skilled occupation lists revealed in the most recent Traffic Light Bulletin, the Chamber continues to provide members input in this process ensuring that their interests are represented. We continue our advocacy for a major review of the Australian and New Zealand Standard Classification of Occupations (ANZSCO) and met with representatives from the ABS to encourage greater action on this issue.

Jenny continued her engagement on the Disability Employment Services Advisory Group, Industry advisory Committee on Veterans’ Employment and the Collaborative Partnership on Mature Aged Employment.

The key focus this quarter was once again on the Vocational Education and Training (VET) sector reform agenda. Leveraging the key message from the Morrison Government of their commitment to delivering high-quality skills and vocational education system, the Australian Chamber continued to actively engage with the Minister’s Office and the Department of Employment, Skills, Small and Family Business (DESSFB) regarding the progress of reform initiatives, including the VET Stakeholder Committee, national careers institute co-design and national skills commission workshops where the Australian Chamber is represented by Jenny Lambert.

Further, we made a formal submission to the Productivity Commission Review of the National Agreement for Skills and Workforce Development (NASWD) and engaged with Commissioner Jonathon Coppel to highlight the key areas of improvement needed within the VET system. The Australian Chamber engaged with various other VET stakeholders including the newly appointed Skills Commissioner and the Australian Skills Quality Authority (ASQA). The Chamber also provided formal submissions on input into the Co-design of the National Careers Institute and the National Skills Commission and Skills Organisations in addition to a submission to the Educational Council’s Review into Senior Secondary Pathways.

this reform will need to be business-led, so close engagement with the Federal Government on related policies is important.

ACCI’s Board and Chief Economist met with the Reserve Bank Governor, Dr Philip Lowe, at the annual luncheon in early October, and with the Treasury Secretary, Dr Stephen Kennedy, and his senior executives in November to discuss the state of Australian economy and exchange views. Both meetings were highly informative and provided senior bureaucrats with the opportunity to hear about how small and medium-sized businesses are dealing with challenging economic conditions.

The team coordinated a roundtable between members and the Treasury Taskforce responsible for implementing Hayne Royal Commission recommendation 1.7 – Abolition of Point of Sale credit exemption. The meeting has resulted in ongoing discussions with the Taskforce and the Treasurer’s office to minimise the cost and regulatory impacts on retailers and financiers of implementing the recommendation.

The Secretariat extensively engaged with members on policy priorities for the 2020-21 Budget in the preparation of the ACCI’s Pre-Budget Submission. This Submission included recommendations to expand the mandate of the Deregulation Taskforce, extend the instant-asset write-off for the first $50,000 of all investments in plant and equipment by small businesses, and to grow the circular economy by committing funds from the Clean Energy Finance Corporation (CEFC) and Australian Renewable Energy Agency (ARENA) to mobilise private investment in waste management, recycling and more efficient use of material.

We continue to engage with key Ministers, the Shadow Ministry and bureaucrats in support of our key policy priorities. Over the quarter, we have also been active in representing industry on a number of government and non-government working groups and committees, including the ACCC Performance Consultative Committee, ATO Small Business Stewardship Group, and NAB Small business Customer Advisory Council.

The Economics and Industry Policy Committee meeting was held on 14 October and included round table discussions at Parliament House with the Assistant Minister on Deregulation, Ben Morton, Minister for the Environment, Sussan Ley, and Minister for Population, Cities and Urban Infrastructure, Alan Tudge. Members appreciated the opportunity for the open discussions with the Ministers on a range of issues, including regulatory reform and the progress of the deregulation taskforce, environmental regulation and the emergence of the circular economy as a priority for the Government over the current term of Parliament, infrastructure development through the City Deals program and adjustments to the immigration targets.

As a result of the EIP Committee meeting, Minister Ley participated in a Business Leaders Council event on the Circular Economy in both Sydney and Brisbane, with the latter also being attended by Trevor Evans, Assistant Minister on Waste and Recycling. With policy development around the circular economy still in its early stages, Minister Ley appreciated the frank views and advice of Members. It is clear

war between major economies, and the significant decrease in poverty in the Asia Pacific in the context of the region pursuing equitable and sustainable growth.

In December, ICC Australia Chair Nola Watson attended ICC Knowledge Sharing sessions in Paris on behalf of all ACCI members and engaged with the Business and Industry Advisory Committee (BIAC) to the OECD. Nola was assisted by Andrew Willcocks, Associate Director of ICC Australia. The Knowledge Sharing Sessions are a vital component of ICC’s National Committees coming together. The meetings provided the opportunity for Australian feedback and input on ICC’s global work, and to also understand the actions of other National Committees and global ICC members.

ICC Australia is pleased to announce the appointments of Australian Dr Peter J Glynn as Vice Chair of the Environment and Energy Committee for the Business and Industry Advisory Committee with the OECD; and Mr Silvio de Denaro, Acting Chairman of Industry Association (IA) member Australian Tyre Industry Council (ATIC), to the ICC Commission on Environment and Energy in Paris.

As Acting Director of the International Chamber of Commerce (ICC) Australia, Andrew Willcocks, met with the former President of the European Parliament, Mr Pat Cox in Sydney. Mr Cox was in Australia to promote Australia’s trade ties with the European Union (EU) given the upcoming EU-Australia Free Trade Agreement (FTA) negotiation rounds, and to promote the Republic of Ireland as a place for Australia to do business with the EU.

ACCI co-hosted the inaugural Trade Modernisation event with ANZ, exploring the theme “The Race to Integrate Emerging Technologies with Trade”. The event was launched by Senator Andrew Bragg, High Commissioner for the Republic of Singapore Mr Kwok Fook Seng, and Nola Watson, Chair of ICC Australia. This was the first in a series of new conversations sparked by industry on the topic of Trade Modernisation in Australia and was well attended by the Department of Home Affairs, Australian Border Force, and the Department of Industry, Innovation and Science. Industry advocates speaking at the event included WiseTech Global, ANZ, Westpac, IBM, MuleSoft, Port of Brisbane, PwC, Agile Digital, KPMG, and the Ethical Trade Alliance.

Members of ICC Australia organised the Paris International Arbitration Reception at the Australian Embassy in Paris in October. Speeches at the reception were delivered by Australian Ambassador Brendan Berne, ICC Secretary General John Denton, ICC Court Secretary General Alex Fessas, and ICC Counsel in charge of the Common Law team Tunde Ogunseitan. This event was preceded by an informal conference to discuss issues and recent developments in international arbitration. The ICC Australia National Policy Committee also met in October to discuss a range of international policy topics, including Global Policy Products and policy positions around the now concluded Regional Comprehensive Economic Partnership (RCEP).

A meeting of the Australian Chamber – Tourism Committee and a roundtable with Austrade and Assistant Minister for Vocational Education and Apprenticeships, the Hon Steve Irons were also held alongside the Friends of Tourism event.

Executive Chair of Australian Chamber - Tourism, John Hart is on the Board of Tourism Australia and continues to represent the Australian Chamber - Tourism on the Passenger Facilitation Committee, the Tourism Visa Advisory Group, and the Tourism Access Working Group.

The quarter, once again, focused on progressing the Tourism 2030 strategy. The Australian Chamber-Tourism was nominated to assist Austrade to rewrite the strategy document following a forum of industry stakeholders in December. Australian Chamber – Tourism met with Minister Birmingham’s office in the lead up to the event, to frame industry input into the strategy.

The Australian Chamber - Tourism hosted a Friends of Tourism event in Parliament House at which Minister Birmingham and convenor, Trent Zimmerman, MP for North Sydney spoke. The event was co-hosted by the Australian Tourism Export Council, with Managing Director, Peter Shelley, speaking on a panel with local operators about the challenges facing inbound businesses.

Back on Australian soil, ACCI participated in consultations on the operation of the Fair Work Act relating to stillbirth, and engaged with the Sex Discrimination Commissioner as part of her National Inquiry into Sexual Harassment in Australia to ensure future actions and initiatives in this area are practical and effective. Graeme Watson, Senior Adviser to the Attorney-General, and Sandra Parker, the Fair Work Ombudsman both joined the Workplace Policy Committee as guest speakers in October.

In the last sitting week of Parliament for 2019, the Ensuring Integrity Bill was reintroduced and passed the House of Representatives, following ACCI’s campaign to encourage the Government to re-introduce the Bill after its unexpected defeat in the Senate in November. ACCI continues to engage with crossbench senators to support passage of the Bill, which remains a key priority for 2020.

The final quarter of 2019 saw the ACCI Workplace Relations team engaging with and advancing members’ interests in relation to the Attorney-General’s review of the industrial relations system. ACCI lodged substantial written submissions in relation to life of project agreements for greenfields projects, and legal protections of employees’ wages and entitlements. We have commenced engaging with members on the third discussion paper relating to cooperative workplaces and are identifying opportunities to improve the system to better support more productive and harmonious workplaces.

Outside of the industrial relations review, ACCI lodged submissions prosecuting the interests of members in response to the Australian Human Rights Commission’s Discussion Paper on Priorities for Federal Discrimination Law Reform, and the Attorney-General’s Department’s Religious Freedom Bills. A number of concerns ACCI raised in relation to the first exposure draft were addressed in the second exposure draft of the Religious Discrimination Bill, which ACCI is currently drafting a further response to.

Internationally, ACCI’s Director-Workplace Relations, Scott Barklamb represented Australian employers at the Governing Body of the International Labour Organisation, which is shaping a significant global and regional work program relevant to Australia’s future law and practice on workplace relations.

WORK HEALTH AND SAFETY & WORKERS’ COMPENSATION Director:

In November, ACCI continued our efforts against over-prescriptive dust disease and silica responses by regulatory agencies lodging a submission to the National Dust Disease Taskforce. Further opportunity to raise concerns with regulatory responses to silica and the workplace exposure standards review came at the Safe Work Australia Members Meeting mid-November. Other key topics discussed at the meeting included: Safe Work Australia research priorities, progress on the National WHS Prosecutions Database, approval for an Enforceable Undertakings Database, two new Codes of Practice proposed and subsequently dismissed as well as an initial discussion on capturing injury data and policy responses to migrant workers, transport and gig economy workers.

The final General Council meeting of the year canvassed a strategic response to emerging social issues that are crossing over to the workplace such as mental health and sexual harassment. The final WHS & WC Committee meeting of the year followed council and focused on progressing a new WHS and WC small business strategy to lead engagement with key agencies in 2020.

ACCI continued to regularly engage with the Federal Attorney-General’s Department and Office on the model WHS laws Decision Regulatory Impact Statement (DRIS) process and recommendations and progressed a political engagement strategy with WHS & WC Committee members to effectively engage with state and territory WHS Ministers in a coordinated effort.

October’s Safe Work Month theme was ‘Be a safety champion…’ ACCI was once again active in promoting the safety and health message and used the theme as an opportunity to combine similar imagery with the ‘Small Business Is a Big Deal’ campaign theme. A suite of social media tiles, email banners and posters were distributed with ‘Safety is a BIG deal’ messaging and #smallbusinessbigdeal.

The Productivity Commission released their draft report on mental health which we responded to in the media. The WHS & WC Committee meeting in November canvassed the draft report and discussed our follow-up submission which will oppose a number of recommendations as well as a greater media and public response leading up to the final report.

The Morrison Government’s Ensuring Integrity Bill was a high priority for ACCI throughout the final quarter of 2019, and due to the outcome of the bill in the Senate, its reintroduction in 2020 means it will continue to be front of mind. James, Workplace Relations Director Scott Barklamb and Deputy Workplace Relations Director Tamsin Lawrence all appeared in the media (across broadcast, radio, print and online) to emphasise the importance of the bill.

Tamsin Lawrence, policy lead on the Ensuring Integrity Bill, entered the media for the first time with a photoshoot, television interview and print op-ed trifecta. Underlining our support for the bill, she emphasised the disgraceful behaviour of some rogue union members, including that against women in the workplace.

Tamsin and our Director of WHS Jennifer Low also ended the year discussing mental health in the workplace following the release of the Productivity Commission’s report. Both were in The Australian, providing strong representation on behalf of ACCI and its members.

As the year drew to a close, the Morrison Government announced that “Small Business” would be removed from departmental titles. ACCI was first to raise concerns over the move - captured the next day on the front of the Australian Financial Review.

In all, ACCI was mentioned or appeared in more than 70 radio and television segments, 86 print articles and 140 online news items.

From the effects of tumbling interest rates, to the tumultuous landscape of our trade relations and the campaign to hold militant unions to account, the ACCI was quick to respond as the year drew to a close. At the beginning of October, the domestic discussion centred around the RBA’s decision to slash interest rate cuts to an historic low. James’ reaction was swift, urging banks to pass on the full cut.

Our new Chief Economist Dr Ross Lambie hit the ground running in the media. He conducted a number of on-air and print interviews regarding the economy, arguing against more powers to block mergers, and discussing calls to delay an increase to superannuation. The latter landed Dr Lambie on the front page of the Australian Financial Review.

Both the burgeoning digital and circular economies are high on the ACCI agenda, with Dr Lambie positioning ACCI as thought leaders through our pre budget submission.

Meanwhile, our tourism and education policy teams were busy spotlighting both the dire need to increase VET funding and boost tourism to regional communities. Regional and agri-tourism promotions increased heading into Christmas, with ACCI supporting a number of initiatives to get people to buy from and visit the bush. Both Australian Chamber - Tourism Chair John Hart and Chief Executive James Pearson made numerous public appearances urging Australians to support small, regional businesses.

As trade tensions between the US and China continued to escalate, ACCI and ICC Australia publicly stressed the need for trade diversification as well as new opportunities available in trade digitisation. We called for bipartisan support for the Indonesian and Hong Kong free trade agreements, and encouraged industry to explore new trade opportunities in the Indian Ocean Rim.

Our concerns on the WTO’s appellate body freeze were also picked up in the media, across the Fairfax/Nine network.

The Business Leaders’ Annual Dinner on November 27 received good coverage, both before and after the event, with Treasurer Frydenberg’s speech on the launch of the Business Growth Fund leading coverage in the papers, and
