Ciclo di fabbricazione e qualità del tuboIl tubo ACR (Air Conditioning & Refrigeration) ottenuto da una scrupolosa scelta delle materie prime selezionate secondo normative internazionali,è senza saldatura e viene finito per trafilatura a freddo con filiere di precisione per uno stretto controllo delle tolleranze.Dopo l’ultimo passo di trafilatura i tubi vengono sgrassati con solventi appropriati per eliminare eventuali residui di olio. Severi controlli sulla puliziadei tubi vengono effettuati durante la produzione; in particolare il tenore di olio residuo sulla superficie interna dei tubi è inferiore al limite massimodelle specifiche internazionali riconosciute (EN 12735/1 - DIN 8964 - ASTM B 743).I tubi, forniti allo stato fisico ricotto, vengono sottoposti ad un trattamento termico as alta temperatura in atmosfera controllata. Il controllo deiresidui sulla superficie interna viene effettuato secondo le norme EN 12735/1, ASTM B 280/03. La qualità di ciascun tubo è assicurata da un rigorosocontrollo qualitativo dei prodotti finiti: il 100% della produzione viene testato elettronicamente con il sistema “EDDY CURRENT” - EN 1971.Le caratteristiche meccaniche e le tolleranze sono conformi alle norme EN 12735/1 e ASTM B 68/99. Il tubo viene fornito con certificazioneattestante le caratteristiche meccaniche.

Procuction cycle and quality of the tubeThe ACR tube (Air Conditioning & Refrigeration) is obtained from ascrupolous choice of raw material selected in accordance withinternational rules and regulations and is unwelded and finished bycold-drawing with precision threaders for strict control of thetolerances. After the last drawing phase the tubes are degreasedwith appropriate solvents in order to eliminate possible oil residues.During production strict checks are carried out on the cleaning ofthe tube; in particular the percentage of the oil residue on the insidesurface of the tubes is inferior to the maximum limit of therecognised international specifications (EN 12735/1 - DIN 8964 -ASTM B 743).The tubes are supplied at the annealed physical status and thenundergo a high temperature thermal treatment in a controlledatmosphere. The control of the residues on the internal surface ismade in accordance with EN 12735/1, ASTM B 280/03. The qualityof the tubes is guaranteed by a rigorous quality control of thefinished products: the total production is electronically tested withthe “EDDY CURRENT” system - EN 1971. The mechanical characteristics and the tolerances are in accordance with EN 12735/1 and ASTM B 68/99regulations. The tube is supplied with certification stating the mechanical characteristics.


RivestimentoMateriale isolante in polietilene espanso reticolato a raggi gamma a cellule chiuse ad elevatissimo fattore di resistenza alla diffusione del vaporeacqueo. L’espansione del rivestimento avviene senza l’uso di CFC, come da regolamento 3952/92 varato dal Consiglio Ambiente della UE perl’eliminazione dei gas nocivi quali i clorofluorocarburi (CFC). La pellicola esterna liscia in polietilene assicura una perfetta resistenza all’abrasione.Autoestinguente in ottemperanza alle norme italiane - Classe 1 - (Legge 1052 Art. 12). Il rivestimento è esente da sostanze ammoniacali, èimpermeabile all’acqua, oli e liquidi in genere ed ha una permeabilità al vapore con µ -7.000. è prevista inoltre la possibilità di fornire a richiesta unrivestimento con una permeabilità al vapore con µ >10.000 (vedi scheda tecnica sotto). La perfetta aderenza tra tubo e rivestimento esclude laformazione della condensa.

CoatingInsulating material in gamma-ray closed-cell expanded reticulated polyethylene highly resistant to the spreading of water vapour. The expansion of the coating

happens without the use of CFC, in accordance with 3952/92 regulations issued by the Environment Counsel of the E.U. for the elimination of harmful gases

such as chlorofluorinecarbides (CFC). The external smooth polyethylene film guarantees a perfect resistance to abrasion. Self-extinguishing in accordance to Italian

regulations - Class 1 (Law 1052 art. 12). The coating does not contain ammoniacal substances, it is resistant to water/oil and general liquids and has a

permeability to vapour with µ -7.000. In addition we can supply on request a coating with a permeability to a vapour with an index of µ >10.000 (see technical

data below). Coating perfectly adheres to the tube thus excluding the formation of condensate.

CAN è un elegante e pratico sistema in PVC rigido autoestinguente, che permette di installare agevolmente e rapidamente i tubi per i vostri nuoviimpianti di condizionamento.Vengono fissate alla parete mediante tasselli ad espansione utilizzando le forature predisposte sulla base. I tubi vengonotrattenuti allabase mediante apposite staffe ad inserimento rapido, rimovibili mediante una lieve di varicazione delle pareti. Sono dotate di un sistemadi accessori di copertura nei punti di congiunzione e deviazione nonchè di passaggio a parete. Tutti gliaccessori si montano a scatto esercitando unalieve pressione alla base di ancoraggio CANALE/ACCESSORIO.

CAN is a smart and pratical system in PVC, which permits you to install the pipes of new conditioning plants eaily and quickly on the wall. They must be fixed

on the wall through extending plugs by using the perforation on the canal bases. The pipes are kept on the basis by proper quick clutch-brackets, which cab be

removed by opening wide lightly the walls. Have its complete system of covering accessoriesfor the jointing and deviating points and wall passage. All the

accessories have a release installation procedure by slightly pressing theanchorage support CANAL/ACCESSORY.

The TT1 flexible insulated pipe is made up of an inner aluminium pipe, with

a harmonic steel spiral enclosed in two multi-layer aluminium/polyester

laminates. A glass fibre insulating layer with a density of 16 kg/m3 is wrapped

over this pipe.

FunzioneLa modalità standard viene indicata da una spia LED VERDE. Quando laconcentrazione di gas sta per raggiungere la soglia d’allarme, la spia LEDdiventa ROSSA e lampeggia, viene emesso un segnale acustico dal buzzer(2Hz)e la trasmissione viene attivata. L’allarme continua ad essere inviatofintanto che il rilevatore è esposto al gas. Se si verifica un problemainterno al sensore, questo verrà segnalato dalla spia lampeggiante rossadel LED insieme ad un segnale acustico emesso dal buzzer per un minuto.

Normal mode is indicated by a GREEN LED. When gas concentration isreaching the alarm threshold, the LED starts to flash RED/AMBER, buzzerstarts with a pulsing sound (2Hz) and the relay will be activated. This alarmwill continue as long as the detector is exposed for gas. If having an internalfault on the sensor, this will be indicated by the LED flashing red together witha sound from the buzzer and an amber flash of the LED once a minute.

RECUPERATORI DI CALORE A FLUSSI INCROCIATICROSS

Le unità di recupero CFR e CFR-PHE sono caratterizzate daridottedimensioni e facilità di montaggio. I recuperatori CFR e CFR-PHEpermet-tono di coniugare il massimo comfort ambientale con un sicurorisparmioenergetico. Negli attuali impianti di condizionamento etrattamento dell’ariaè necessario creare una ventilazione forzata checomporta tuttavia l'espul-sione dell'aria trattata, determinando unnotevole consumo energetico edun aumento dei costi.Le serie CFR e CFR-PHE, intendono risolvere questi problemiutilizzandoun recuperatore di tipo statico.La serie CFR-PHE adotta un recuperatore di calore costituito da foglipianidi carta speciale. Questi scambiatori vengono anche chiamatirecuperato-ri di calore totale: infatti consentono di recuperare sia ilcalore sensibileche il calore latente (umidità), con efficienza del 60-80%sulla temperatu-ra e del 50-70% sull’entalpia.Per la serie CFR il recuperatore consiste invece in una piastra dialluminio,con flussi aria mantenuti separati da apposita sigillatura; questosistemapermette di risparmiare più del 50% dell’energia che altrimentiandrebbepersa. Entrambe le serie, che si integrano in maniera ottimale aitradizionali sistemi realizzati con ventilconvettori, radiatori e unità dicondiziona-mento, funzionano sia in regime invernale che estivo. CARATTERISTICHE GENERALI CFR, CFR-PHE• Recuperatore di calore ad alto rendimento di tipo statico a piastre in

alluminio (serie CFR) o carta (serie CFR-PHE) con flussi aria mantenutiseparati da apposita sigillatura.

• Isolamento acustico e termico dei pannelli tramite polietilene/poliestereconspessore medio di 20 mm

• Ventilatori di presa aria di rinnovo e di espulsione di tipo centrifugo a doppiaaspirazione (per il modello CFR 33 a semplice aspirazione)

• Motore elettrico direttamente accoppiato• Vasca di raccolta condensa in ABS. Attacco scarico condensa dal basso• Corpo ventilante montato su antivibranti per non trasmettere

eventualivibrazioni.

Inoltre:per modelli orizzontali:• La struttura portante e i pannelli laterali (completamente rimovibili)

sonorealizzati in lamiera Aluzink.• Filtri aria con efficienza G4, facilmente estraibili lateralmente allo scopo

FLOW HEAT RECOVERY UNITS

The CFR and CFR-PHE heat recovery units feature compact dimensionsand

easy assembly.

The CFR and CFR-PHE heat recovery units combine maximum roomcomfort

with certain energy savings. Current air-conditioning and air han-dling systems

require forced ventilation, which consequently involves thedischarge of the

conditioned air and as a result means significant energyconsumption and an

increase in running costs.

The CFR and CFR-PHE series had been designed to resolve these pro-bles by

the use of static exchangers.

The series CFR-PHE adopts an heat recovery made of plane sheets of spe-cial

paper. These exchangers are also called tatal heat recoveries: infact,they can

recover both sensible and latent heat (humidity), with temperatureefficiency

between 60-80% and enthalpy efficiency between 50-70%.

For the CFR series , the heat recuperator is composed of aluminium plate,with

air flows separated by special seal; this system allows to save over50% of the

energy that would otherwise be lost.

Both units can be perfectly integrated into traditional systems made up offan

coils, radiators and air-conditioning units, and work in both heating andcooling

modes.

The CFR and CFR-PHE series are made up of eight models, covering arange

of flow-rates from 300 m3/h to 3920 m3/h.

Each model is available in two versions:

- Horizontal, called CFR/O, CFR-PHE/O

- Vertical CFR/V, CFR-PHE/V

Moreover is possible realize lots of configuration.

The high static pressure values available allow the use of ducting for

theextraction or distribution of air in a series of rooms.

The models of the series CFR and CFR-PHE can be given witha ionization

system of the air called BIOXIGEN®.

This system,unique in his type, makes the air and surfsces of the machi-ne, of

the ducts and of the bordering rooms healthy and goodsmelling.

GENERAL CHARACTERISTICS

• High efficiency heat recovery, cross flow and static type plate exchanger

(alluminium for series CFR; paper for series CFR-PHE)

• An average 20 mm-thick layer of polyethylene and polyester is installed

inthe unit to ensure acoustic and heat insulation.

• The dual intake (single intake for size 33) centrifugal fans have

staticallyand dynamically balanced impellers to minimise vibrations and

noise.

• The electric motors used are directly coupled to the fans•Drain pan

collector made of ABS, with condensed water drain connectiondownwards.

• Vibration absorbing supports to ensure low noise level.

• The structure and the paneling (completely removable) are made

fromAluzink.

• The G4 efficiency filters are easily removable from the sides for

periodicalcleaning.

• The structure of models CFR from 110 to 410 features a cut-out section

forcreating a bypass for defrost or free cooling.

GENERAL TERMS OF PURCHASECONDIZIONI GENERALI DI VENDITA1. PRODUCTS

The products object to the Terms of Purchase can be found whether in the Refrigera Catalogue or in the commercial offers inside it along with the designs and specifica-

tions. Specifications such as material, weight, size, capacity, services and other information contained in the catalogue are supplied just as information for the BUYER and

they will not be considered compulsory for Refrigera Industriale srl. The catalogue does not represent an offer for sale and Refrigera Industriale srl exercises the right to

change them at its discretion at any time without notice or cease producing or commercializing any product. Such variations, included replacement of material with others

reasonably similar, will not be accepted as an objection on the part of the BUYER. The BUYER declares to have had express knowledge of the aforementioned catalogue

or as an alternative of the commercial offer enclosed.

2. PRICES AND TERMS OF PAYMENT

The prices are ex-works of Refrigera Industriale srl unless a different covenant which has to be expressly stated in the commercial offer or in the purchase order. Duties,

taxes and charges are expected to be paid by the BUYER. The possible advance payments on the sales prices are always unproductive and serve to bind the BUYER. The

payments are always net at the Seller’s address. Therefore, it creates neither a case or innovation of the original loan or damage to the agreement of personal property or

change of the disregarded territorial jurisdiction. Delayed payments run, from the expire date, with full rights and without pledging any delay, the corresponding interests

to the bank rate of the European Central Bank plus 5,0%. Failure to comply the payment terms or any other contract conditions on the part of the BUYER, entitles Refri-

gera Industriale srl to suspend or delay the exercise of its contractual obligations or rescind the contract with simple notice. The contract resolution involves damage com-

pensation. Refrigera Industriale srl is authorized to retain advance payment as penalty in case the BUYER overturns the order.

3. OFFERS AND ORDERS

Refrigera Industriale srl is bound to the offer for 30 days from the day of the shipment. Refrigera Industriale srl reserves the right to accept or refuse the orders. The BUYE-

R’s orders must be addressed in writing or by fax and they will remain irrevocable for the BUYER after two days of the shipment. The orders placed by phone should be

subsequently regularized by the BUYER in writing within two days. Such orders or any other supply condition regarding them, are accepted only if they are confirmed in

writing by Refrigera Industriale srl. If the confirmation contains changes or additions to the order, the contract is concluded unless waived in writing by the BUYER within

four days from the day of the confirmation of the shipment. In case the order is rejected, Refrigera Industriale srl agrees to communicate the BUYER in writing within two

days from the day of the placement of the order and possible advance payments (see “Prices and Terms of Payment) will be reimbursed to the BUYER.

4. DELIVERY

Delivery time runs from the moment the contract is considered concluded and, if necessary, from the moment the elements of the contract are supplied and Refrigera In-

dustriale srl is provided with the necessary information and the BUYER has duly paid for the maturities. In all cases, the term of delivery is computed in working days and

with reason, adequately extended due to events beyond the control of Refrigera Industriale srl, such as strikes, lock-outs, fire, flood, late delivery of parts from suppliers,

engine failure or other unforeseen circumstances. A delayed readiness of accessory parts that does not prevent the use of the related manufacture product.

Partial delivery is always admitted. The delivery is intended to be carried out in any case on the business premises of Refrigera Industriale srl upon submission of a notice

or failing that, upon remission to the Carrier. This even when, for express derogation, the price includes freight. From this moment onwards all the risks on the goods are

transferred to the BUYER, and will also be at buyer’s risk the charges of unloading, storage and safe keeping, maintenance and insurance. If the BUYER does not remove

the goods at the date established in the order, the order will be cancelled after three months of such date.

5. PACKAGING AND SHIPPING

The packing is at the BUYER’s expense and it is invoiced at cost price. Deliverables travel at the BUYER’s risk even if it was sold free delivered. The insurance is carried

out under strict directions of the BUYER and in any case at his expense.

6. WARRANTY

Refrigera Industriale srl warrants that the Deliverables will conform with good quality and manufacture, in the sense that they commit themselves to repair or replace as

new, in his indisputable judgement, free, in the shortest possible time, the parts that, within the warranty period, could present clear faults of material, manufacture or work

which could render them unsuitable to the final use, that is without indemnification for the direct or indirect damages of any kind or reason. The warranty is six (6) months

for construction details or repaired parts and twelve (12) months for constructions details or new parts. The parts to be repaired or supplied as new should be returned

on the Refrigera Industriale srl premises at care, expense and risk of the BUYER, the repaired ones or supplied as new are delivered free at works for the BUYER.

The replacements remain Refrigera Industriale srl’s property. The expenses for the disassembly and assembly of the parts to be repaired or supplied as new are at the ex-

pense of the BUYER. The BUYER warranty’s right expires if he does not object, at least one time, the payment conditions, and if the faults claimed were originated due to

the BUYER itself, employees or third parties, such as wrong installation, inexperience with respect to delivery, wrong and abnormal use, overload, bad and wrong mainte-

nance, use of fuel, improper lubricants, repairs, replacements, modifications or any other tampering performed or have performed by the BUYER, without Refrigera Indu-

striale srl authorization nor for Acts of God.

All the parts which by nature or use are subjected to normal attrition or inevitable deterioration remain excluded from the warranty. For those parts of the delivery that

Refrigera Industriale srl could buy from other Companies are exclusively in force, toward the BUYER, the possible warranties established by such companies. Vices and faults

must be denounced to the Seller in writing within the time prescribed by law. Damages caused to third parties remain excluded from the warranty, whether they are peo-

ple or things, from the use to the damages due to lack of cold and lack of advantages derived from cease of production.

7. CLAIMS

The BUYER will inspect the products immediately and with accuracy and attention at the moment of the arrival on their own office and communicate at once to Refrigera

Industriale srl any shortage, fault or informality. Any damages of transport must be written on the carrier receipt. The notification on the part of the BUYER about the shor-

tage, faults o non conformity of the products must be done in writing and must contain a complete description of the faults, shortage or non compliance, specifying the

shipping documents corresponding to the products and the parcels under dispute. After eight (8) days from the product’s arrival date on the premises of the BUYER wi-

thout notifying the shortage or non compliance with the products, these will be considered as definitively accepted from the BUYER. The BUYER will not be able, in any

case, suspend or delay the payments, not even in case of objection, claim or controversy.

8. TITLE RETENTION AGREEMENT

According to the possible extended payment envisaged hereby, the BUYER explicitly declares to accept the retention of title on every thing object to the present commis-

sion, in favour of Refrigera Industriale srl pursuant to and by effect of the articles 1523, 1524 and the followings of the Civil Code. And so, until the BUYER has fully paid,

in legal currency, the agreed price, the goods object to the delivery remain property of Refrigera Industriale srl. In case of cancellation of the order/s, Refrigera Industriale

srl can take possession of the goods wherever they are, even united or incorporated in property of the BUYER or a third party, and not being valid for him the legal regime

of ownership or property for destination or incorporation, not even by expressed covenant. During the aforementioned period, the BUYER assumes the obligations and re-

sponsibility of depository for the goods delivered, and commits to guard and insure against any damage, destruction, loss, etc . The BUYER cannot alienate the goods which

are the object hereunder until they are balanced in legal currency, because until such circumstance, they are Refrigera Industriale srl’s property. In default of payment, even

only one, the BUYER is prevented from the benefit of validity and Refrigera Industriale srl can ask for the restitution of the deliveries seizing as indemnity the payments

already done, except the faculty of claiming the damages suffered. In case of cancellation of the order/s before the delivery due to breach on the part of the BUYER, the

possible proportion deposited when ordering is due to the supplier as a penalty in conformity with the art. 1382 of the Civil Code.

9. VALID LAW AND COMPETENT JURISDICTION

The sales under the present conditions are regulated bye the Italian Law. In case of controversy the competent jurisdiction is the one in Pordenone.

1. PRODOTTII prodotti oggetto delle condizioni commerciali sono quelli indicati nel catalogo Refrigera o nelle offerte commerciali della stessa, con le specifiche ed i disegni ivi con-tenuti. Specifiche quali descrizione di materiale, peso, dimensioni, capacità, prestazioni ed altri dati contenuti nel catalogo sono fornite a titolo di informazio-ne per la AZIENDA ACQUIRENTE e non verranno considerate vincolanti per Refrigera Industriale srl. Il catalogo Refrigera non costituisce offerta di vendita e la Refri-gera Industriale srl si riserva il diritto di variare a propria discrezione in qualsiasi momento senza preavviso tali specifiche o di cessare di fabbricare e/o commercializ-zare qualsiasi prodotto, e talivariazioni, comprese la sostituzione di materiali con altri ragionevolmente simili, non potrà dare luogo a contestazioni da parte della AZIENDAACQUIRENTE. La AZIENDA ACQUIRENTE dichiara di avere avuto specifica conoscenza del catalogo suddetto od in alternativa dell’offerta commerciale acclusa.

2. PREZZI E CONDIZIONI DI PAGAMENTOI prezzi si intendono franco stabilimento della Refrigera Industriale srl salvo diversa pattuizione che deve essere espressamente riportata nell’offerta commerciale o nel-l’ordine di acquisto.Tasse, imposte e spese sono a carico della AZIENDA ACQUIRENTE. Gli eventuali anticipi sui prezzi di vendita sono sempre infruttiferi e servono avincolare la AZIENDA ACQUIRENTE. I pagamenti si intendono sempre netti al domicilio del Venditore. Ciò non produce però in alcun caso né novazione del creditooriginale, né pregiudizio alcuno al patto di riservata proprietà, né mutamento nella derogata competenza territoriale. Sui ritardati pagamenti decorrono, dalla datadella scadenza, di pieno diritto e senza alcuna costituzione di mora, gli interessi al tasso ufficiale di sconto della Banca Centrale Europea maggiorato di 5,0%.L’inosservanza da parte della AZIENDA ACQUIRENTE delle condizioni di pagamento o di qualsiasi altra condizione contrattuale, dà alla Refrigera Industriale srl il di-ritto di sospendere o rinviare l’esecuzione dei suoi obblighi contrattuali, oppure di risolvere il contratto con semplice comunicazione. La risoluzione del contratto com-porta la rivalsa dei danni. La Refrigera Industriale srl è autorizzata a trattenersi gli anticipi a titolo di penale nel caso in cui la AZIENDA ACQUIRENTE revochi l’ordine.

3. OFFERTE E ORDINILa Refrigera Industriale srl è vincolata all’offerta per la durata di 30 giorni dalla data di invio della stessa. La Refrigera Industriale srl si riserva la facoltà di accettare omeno gli ordini. Gli ordini della AZIENDA ACQUIRENTE dovranno redigersi per iscritto, anche a mezzo fax e rimarranno irrevocabili per la AZIENDA ACQUIRENTEdopo due giorni dalla spedizione. Gli ordini telefonici dovranno essere successivamente regolarizzati da parte dalla AZIENDA ACQUIRENTE per iscritto entro due giorni.Detti ordini o qualsiasi altra condizione di fornitura che ad essi si riferiscano, si intendono accettati solo se confermati per iscritto da parte della Refrigera Industrialesrl. Se la conferma contiene modifiche o aggiunte all'ordine, il contratto si intende concluso ove la AZIENDA ACQUIRENTE non abbia manifestato per iscritto il suodissenso o rifiuto entro quattro giorni dalla data di spedizione della conferma. In caso di rifiuto del ordine, la Refrigera Industriale srl s’impegna ad informare la AZIENDAACQUIRENTE per iscritto, entro due giorni dalla data di ricevimento dell’ordine ed eventuali anticipi (vedi “Prezzi e condizioni di pagamento”) verranno rimborsati allaAZIENDA ACQUIRENTE.

4. CONSEGNEIl termine di consegna decorre dal momento in cui il contratto si ritiene concluso e, occorrendo, dal momento in cui sono stati forniti e definiti gli elementi delcontratto e notificati alla Refrigera Industriale srl i dati occorrenti al presente, sempre che la AZIENDA ACQUIRENTE abbia effettuato puntualmente il pagamento dellescadenze. In tutti i casi, il termine di consegna viene computato in giorni lavorativi e viene di diritto, adeguatamente prorogato per effetto di avvenimenti non imputabilialla Refrigera Industriale srl, quali scioperi, serrate, incendi, inondazioni, ritardate consegne da parte dei fornitori, mancanza di forza motrice od altre cause di forza mag-giore. Non costituisce inosservanza del termine un differito approntamento di parti accessorie che non impedisca l’impiego del relativo manufatto. Sono sempre am-messe consegne parziali. La consegna si intende sempre eseguita ad ogni effetto, negli stabilimenti della Refrigera Industriale srl all’atto della notifica d’approntamento,o in difetto di tale notifica, all’atto della remissione al Vettore: ciò anche quando, per espressa deroga, il prezzo comprende le spese di trasporto. Da tale momento tuttii rischi sulla merce si trasferiscono alla AZIENDA ACQUIRENTE, e sono a suo carico anche le spese di scarico dai mezzi di trasporto, di magazzinaggio, e custodia, ma-nutenzione ed assicurazione. Se la AZIENDA ACQUIRENTE non ritira la merce alla data stabilita nell’ordine, passati tre mesi da tale data, l’ordine si intenderà nullo didiritto per fatto della AZIENDA ACQUIRENTE, anche senza avviso alla stessa da parte della Refrigera Industriale srl, e qualora la AZIENDA ACQUIRENTE intendesseavere la merce, ciò dovrà essere oggetto di nuovo ordine.

5. IMBALLO E TRASPORTOL’imballo è a carico della AZIENDA ACQUIRENTE e viene fatturato al costo. La merce viaggia a rischio e pericolo della AZIENDA ACQUIRENTE anche se venduta francodestino. L’assicurazione viene effettuata solo su precisa istruzione della AZIENDA ACQUIRENTE ed è in ogni caso a carico della stessa.

6. GARANZIALa Refrigera Industriale srl garantisce la buona costruzione e la buona qualità di quanto è oggetto della fornitura, nel senso che si impegna a riparare od a fornire exnovo, a suo insindacabile giudizio, gratuitamente, nel più breve tempo possibile, quelle parti che, entro il periodo di garanzia, presentassero riconosciuti difetti di mate-riali o di costruzione o di lavorazione che le rendessero inidonee all’uso cui sono destinate, ciò senza essere tenuto al risarcimento di danni diretti od indiretti di qual-siasi natura e per qualsiasi ragione. La garanzia è di sei mesi per particolari o trasmissioni riparate, e di 12 mesi per particolari o trasmissioni nuove. Le parti da riparareo da fornire ex novo debbono essere ritornate allo stabilimento della Refrigera Industriale srl a cura, spese e rischio della AZIENDA ACQUIRENTE, quelle riparate ofornite ex novo sono consegnate franco stabilimento della AZIENDA ACQUIRENTE. Le parti sostituite restano di proprietà della Refrigera Industriale srl. Le spese perlo smontaggio ed il montaggio delle parti da riparare o fornire a nuovo sono a carico della AZIENDA ACQUIRENTE. Il diritto di garanzia della AZIENDA ACQUIRENTEdecade se non osserva, anche per una sola volta, le condizioni di pagamento, e se i guasti lamentati risultano originati da fatti della AZIENDA ACQUIRENTE stessa, suoidipendenti o terzi, quali cattiva installazione, imperizia nella condotta di quanto è oggetto della fornitura, errato o anormale uso, sovraccarico, cattiva o difettosa manu-tenzione, impiego di combustibili, lubrificanti inadatti, riparazioni, sostituzioni, modifiche o comunque manomissioni eseguite o fatte eseguire dalla AZIENDA ACQUI-RENTE, senza autorizzazione della Refrigera Industriale srl, nonché da cause di forza maggiore. Rimangono escluse dalla garanzia tutte quelle parti che per la loro naturaod uso sono soggette a normale logorio od inevitabile deterioramento. Per quelle parti della fornitura che la Refrigera Industriale srl abbia acquistato da altre Ditte vi-gono, nei confronti della AZIENDA ACQUIRENTE, esclusivamente le eventuali garanzie stabilite da tali Ditte.Vizi e difetti devono essere denunciati al Venditore per iscrittonei termini di legge. Restano esclusi dalla garanzia danni provocati a terzi, siano essi persone o cose, dall’utilizzo o danni avuti per mancato freddo e mancato profittoderivante dall’arresto di linee produttive.

7. RECLAMILa AZIENDA ACQUIRENTE esaminerà i prodotti immediatamente e con la dovuta diligenza ed attenzione al momento del loro arrivo presso la propria sede ecomunicherà senza ritardo alla Refrigera Industriale srl qualsiasi mancanza, difetto o non conformità. Eventuali danni di trasporto devono essere annotati sulla ricevutadel trasportatore. La comunicazione da parte della AZIENDA ACQUIRENTE della mancanza, difettosità o non conformità dei prodotti dovrà essere effettuata periscritto e dovrà contenere una descrizione completa dei difetti, delle mancanze o delle non conformità, la menzione dei documenti di spedizione relativi ai prodotti econtrassegni dei colli contestati. Trascorsi 8 giorni dalla data di arrivo dei prodotti presso la sede del Compratore senza che lo stesso abbia contestato la mancanza ola non conformità dei prodotti, questi verranno considerati come definitivamente accettati dalla AZIENDA ACQUIRENTE. La AZIENDA ACQUIRENTE non potrà innessun caso sospendere o ritardare i pagamenti, neppure in caso di contestazione, reclamo o controversia.

8. PATTO DI RISERVATO DOMINIOIn relazione all’eventuale pagamento dilazionato previsto dal presente, la AZIENDA ACQUIRENTE dichiara esplicitamente di accettare la riserva di proprietà sututte le cose oggetto della presente commissione, a favore della Refrigera Industriale srl ai sensi e per gli effetti degli articoli 1523, 1524 e seguenti del Codice Civile. Ecosì, sino a che la AZIENDA ACQUIRENTE non abbia pagato integralmente, in valuta legale, il prezzo pattuito, i beni oggetto della/e fornitura/e rimangono di proprietàdella Refrigera Industriale srl. In caso di risoluzione dell’ordine o degli ordini, la Refrigera Industriale srl può riprendere possesso dei beni ovunque essi si trovino, an-corché uniti od incorporati in beni di proprietà della AZIENDA ACQUIRENTE o di terzi, non valendo per la medesima il regime legale delle pertinenze o degli immo-bili per destinazione o incorporazione, anche per espressa pattuizione. Durante suddetto periodo, la AZIENDA ACQUIRENTE assume gli obblighi e la responsabilità didepositaria per i beni forniti, e si impegna a custodirli ed assicurarli contro qualsiasi danneggiamento, distruzione, perdita, ecc. La AZIENDA ACQUIRENTE non può alie-nare i beni oggetto del presente sino al saldo in valuta legale di essi, perché sino a tale circostanza, sono di proprietà della Refrigera Industriale srl. In caso di mancatopagamento, di un solo pagamento, la AZIENDA ACQUIRENTE decade dal beneficio del termine e la Refrigera Industriale srl può richiedere la restituzione delle cosevendute incamerando a titolo di indennità i pagamenti già incassati, salvo le facoltà di richiedere eventualmente i danni subiti. In caso di risoluzione dell’ordine o degliordini prima della consegna per inadempimento della AZIENDA ACQUIRENTE, l’eventuale quota versata all’atto dell’ordinazione viene riconosciuta dovuta alla casafornitrice quale penale ai sensi art. 1382 Codice Civile.

9. LEGGE VALIDA E FORO DI COMPETENZALe vendite sottoposte alle presenti condizioni sono regolate dal diritto italiano. Per qualsiasi controversia il foro competente è quello di Pordenone.

RoHS and WEEE Compliance State-ment.2002/95/EC Directive.

On January 27, 2003 the European Parliament and theCouncil of the European Union authorized Directive2002/95/EC on the restriction of the use of certainhazardous substances in electrical and electronicequipment. This new Directive, also referred to asRoHS (“ro-has”) requires that manufacturers reduceusage of six hazardous substances to minimum accepta-ble levels by July of 2006.

This Directive will ban the placing on the EUmarket of new electrical and electronic equipment con-taining more than agreed levels of Lead (Pb), Cadmium(Cd), Mercury (Hg), Hexavalent chromium (Cr +6), Po-lybrominated biphenyl (PBB) and Polybrominateddiphe-nyl ether (PBDE) flame retardants (art.4).On the samedate, Directive 2002/96/EC or WEEE (waste electricaland electronic equipment) was authorized. This Direc-tive encourages and sets specific criteria for the collec-tion, handling and recycling of electric and electronicwaste in particular (art.10):Sets requirements for the amount of WEEE collection(separate from households)Holds resellers accountable for providing WEEE re-turns, free of charge. Requires WEEE to be treatedRequires manufacturers to mark EEE products with theWEEE symbol (trash can with “X”)

Both Directives impact the entire electronics industryat every level, from the retail store, to manufacturers,distributors and OEMs, but restrictions shall not applyto applications listed in annex 2 and in particular forHVAC manufacturers:

• A2.6 Lead as an alloying element in steel containingup to 0,35% lead by weight, aluminium containing up to0,4% lead by weight and as a copper alloy containing upto 4% lead by weight.

• A2.9 Hexavalent chromium as anticorrosion of thecarbon steel cooling system in absorption refrigerators.

In any case our strategy to support these environmen-tally important initiatives include:• 90% of all Refrigera Industriale srl packing materialsare already recyclable• Refrigera Industriale SRL products have not includedthe intentional use of Cd, Hg, PBB, PBDE since 2003.• Lead in copper alloys products is present within theaccepted RoHS limits.• Hexavalent Chromium in yellow zinc plating treat-ment not exceeds 0,003% by weight.

REACH Compliance Statement.

1907/2006/EC Regulation.

The European Regulation 1907/2006/EC concerning theRegistration, Evaluation, Authorization and Restrictionsof Chemicals, the so called REACH Regulation, was pu-blished on GUCE L136 dated 29 May 2007 and cameinto force in the European Union on the 1st June 2007.

This Regulation requires to pre-register and registerchemical substances produced or imported into Europeat the European Agency for Chemicals (ECHA).

Refrigera Industriale srl is not a “manufacturer” or an“importer” of substances and so the company has notthe obligation to pre-register and/or register.Refrigera Industriale srl is not a “manufacturer” or an“importer” of preparations and so the company hasnot to give to its customers either information aboutregistrations of the contained substances or informa-tion about safety. Refrigera Industriale srl is not a “manufacturer” or an“importer” of articles that have substances intended tobe realised during normal and reasonable foreseeableconditions of use (Art. 7.1 of REACH) and so the com-pany has not the obligation to pre-register and/or regi-ster these substances.

For its suppliers, Refrigera Industriale srl is a “dow-nstream users” of substances, preparations and arti-cles, used in its own manufacturing processes and in itsown products. Together with its suppliers of substan-ces/preparations and articles, Refrigera Industriale srl isconstantly engaged to verify that:- they well know the contents and the aims of REACHRegulation- they are working to fulfil the obligations pertaining tothem , foreseen by the Regulation- they guarantee us smooth continuity of their suppliesalso in the future

For its customers, Refrigera Industriale srl is a “manu-facturer” of articles and in this rule our company isconstantly engaged to verify that in its products:- the restricted substances listed in Annex XVII are notused in a manner not conform to restrictions, in com-pliance with to Art. 67 of REACH- the SVHC, Substances of Very High Concern, listed inthe Candidate List of Annex XIV; are not present in thearticles we supply you in more than 0,1% mass/mass(the 0,1% threshold relates to the total weight of thearticles) and simultaneously satisfied all the conditionslisted in Art. 7.2 of REACH. If this case happens ourcompany binds itself to communicate it in time to itsown customers, ensuring sufficient information to sa-fety use, according to Art. 33 of REACH.
