*For the purposes of this directory, the term Aboriginal may be used interchangeably with the terms Indigenous and First Nations, Métis, Inuit, and is intended to be inclusive of all of those who self-identify as being as such, and who live either off-reserve or on-reserve, and who are either status or non-status registered ‘Indians’.

This directory was created for both Aboriginal and non-Aboriginal service providers and caregivers of Aboriginal

children and youth on Vancouver Island. It is a gift to all who work everyday to build a better future

for Aboriginal children and families in BC.

This directory does not attempt to duplicate other Victoria Capital Region, provincial or Vancouver Island based resource

or business directories. This directory was developed upon request of caregivers of Aboriginal children and youth in care

of the Ministry of Children and Family Development. The information is intended to be a useful guide. Some Vancouver

Island Aboriginal agencies and programs may have been missed in this publication. Surrounded By Cedar does not

In acknowledging the traditional territory that we live and

work in, it is important to remember that we are visitors here.

As time goes on, more and more of our people are moving away from their traditional territory to urban centres such as the Victoria Capital Region. Many Aboriginal people choose

to move to urban centres in search of education and/or employment. Many have very little choice but to leave their

home reserves due to limited housing, employment and education opportunities. At the same time, many Aboriginal

children and families live away from the traditional territories of their family and ancestors because they are disconnected from their roots due to experiences in residential schools or

the foster care systems. Thousands of Aboriginal people have had limited contact with their Aboriginal cultures and

heritage.

It is crucial that we acknowledge the strength and resilience of the Aboriginal children and families that we work with. Often

service providers receive guidance from the wisdom of our children and families.

Traditional Native Code of Ethics

1. Give thanks to the Creator each morning upon rising and each evening before sleeping. Seek the courage to be a better person.

2. Show respect is a basic law of life. 3. Respect the wisdom of people in council. Once you give an idea

it no longer belongs to you, it belongs to everyone.

4. Be truthful at all times.

5. Always treat your guests with honour and consideration. Give your best food and comforts to your guests.

6. The hurt of one is the hurt of all. The honour of one is the honour of all.

7. Receive strangers and outsiders kindly.

8. All races are children of the Creator and must be respected.

9. To serve others, to be of use to family, community, or nation is one of the main purposes for which people were created. True happiness comes to those who dedicate their lives to the service of others.

10. Observe moderation and balance in all things.

11. Know those things that lead to your well-being and those things that lead to your destruction.

Victoria First Nations Band Offices

The Victoria Capital Region encompasses the Traditional Territories of nine Coast Salish First Nations Bands (Esquimalt, Songhees,

Pauquachin, Tseycum, Tsawout, Tsartlip, Scia’new, T’souke, and Malahat), and one Nuu-Chah-Nulth First Nations Band

(Pacheedaht). Traditionally, each First Nations village lived a distinct way of life in terms of their traditional governance and ceremony.

In 1876 the Canadian government, through the Indian Act, imposed a Band Council system of government for First Nations. As a result, elected Chief and Councils govern our communities under the terms

DELEGATED SERVICES


The following information, on delegated services, was gathered from the Aboriginal Operational and Practice

Standards and Indicators manual; copyright, 1999 Province of British Columbia, Ministry of Children and Families.

Level 12 Social Workers employed by Aboriginal Agencies who have received Level 12 delegation have the authority to provide the following services: • support services for families; • voluntary care agreements (e.g. temporary in-home care); • special needs agreements (e.g. for children in care for an

unspecified length of time); • establishing residential resources. These services are identified in Part 2 of the Child, Family and Community Service Act. Delegated social workers must ensure that these services are delivered in a manner that complies with the following sections of Part 4, 5, and 6 which refer to: • children in care (s. 70 – 72); • confidentiality an disclosure of information (s. 73 – 80); • procedures for reviews (s. 93(3) s. 101.1). The following sections of Parts 7 and 8 of the Child, Family and Community Services Act (CFCSA) enable workers with Level 12 delegated authority to: • provide preventative and support services for families

(s. 93.1(a)); • establish support services for youth (s. 93.1(c)); • establish residential services for children and youth

(s. 93.1(d)); • establish services to assist in the resolution of family

disputes (s. 93.1(e));

DELEGATED SERVICES


The following sections of Parts 7 and 8 of the Child, Family and Community Services Act (CFCSA) enable workers with Level 12 delegated authority to:

• establish services to assist communities to strengthen their ability to care for and protect children (s. 93.1(f));

• enter into agreements and contracts for the provision of services (s. 93.1 (g));

• promote the participation of the Aboriginal community in the planning, development and delivery of services (s. 93.1(h));

• enter into agreements for parental contributions for the maintenance of a child in care (s. 97.2);

• request police assistance in enforcing a restraining order made under the Act (s. 98);

Level 13

The area of service covered under Level 13 delegation is the guardianship of children in continuing custody. This is distinct from service under Level 12 delegation which refers to children in care by voluntary agreement. Level 13 is also distinct from temporary, court-ordered care. This is a shared responsibility with the Ministry for Children and Families where the Aboriginal Child and Family Service Agency has into the plan of care for the child. The areas of responsibility under Level 13 delegation which pertain to children in continuing custody but are not part of Level 12, include:

• Child, Family and Community Service Act Part 3, Division 5, Continuing Custody Hearings and Orders

• Child, Family and Community Service Act Part 3, Division 6, Related Orders regarding access to a child in continuing custody of the Director, and enforcement of a custody order

• Child, Family and Community Service Act Part 3, Division 7, Procedure and Evidence.

DELEGATED SERVICES


Guardianship services that relate to children in continuing care under Level 13 delegation are similar to those apply to children in voluntary care, but also include working with a social worker delegated by the Director of Adoption on the registering of a child for adoption. Level 15 Service delivery should be consistent with other sections of the CFCSA which are already in effect for Levels 12 and 13 delegations. The areas of service covered under Level 15 delegation include: • child protection; • temporary custody of children, in addition to the

cumulative agreement of service provided under Level 12 and 13.

Level 15 delegation requires that these services be delivered in a manner which is consistent with Part 3 of the Child, Family and Community Service Act, which deals with: • responding to reports; (s. 13-19); • cooperative planning and dispute resolution (s. 20-24); • how children are protected (s. 25-33); • child protection hearings and orders (s. 34-54); • related orders (s. 55-63); • procedure and evidence (s. 64-69). These operational standards represent the minimum expectations for the agency.

The Transitional Housing Program provides safe housing with residential supports and mentoring to help women at risk of homelessness initiate change and transition to independent living and housing that is stable and secure. Average length of stay is six months. The Integrated Day Program supports at-risk women through life-skills training and the development of personal action plans. The program strengthens self-sufficiency and supports each woman’s transition into regular community life. The Wrap Around Initiative provides integrated case management and flexible funding to ensure access to housing for at-risk women. Upper Island Youth Services The John Howard Society of North Island Description: The Odyssey Program offers two options for treatment of high-risk youth substance misuse: one with residential treatment located at The Challenge Center near Campbell River, and the other providing community services. The John Howard Society of North Island is the sponsoring agency partnering with the Pacific Legal Education Association (PLEA) which jointly operates the Family Care Home Program on Vancouver Island. Services: For males we offer a 16 week residential program for youth ages 13 – 18 which includes 2 weeks of detox and assessment, 8 weeks of residential treatment, 6 weeks of aftercare, discharge planning and recovery. For females or males inappropriate for residential treatment we offer a 12-bed component for youth up to 19 years old who reside in Family Care Homes. This component is specifically designed for disenfranchised youth and those who may have been heavily involved in the street life culture.

Pembroke Supportive Recovery Services: VIHA Services: Withdrawal Management Services—Provides seven beds for people in need of medically supervised detoxification; Sobering and Assessment Center—Provides a short-term shelter for people who are under the influence of substances and need a temporary place to recover. Has 20 beds with separate sleeping area for men and women; Pembroke youth. Can accommodate clients with co-occurring disorders. The average length of stay is seven days and there is no cost to the client. Clients in Ladysmith, Lantzville, Nanaimo, and Nanoose can self-refer. Other clients from central and upper Vancouver Island must have an assessment done by a crisis nurse through their local crisis line, or at a hospital or health clinic. This triage process may result in a referral to Clearview detox, or to other community resources if a medically-supervised detox is not deemed necessary. Provides post-acute withdrawal services for women with an assisted re-entry into the community, through programs about healthy living skills, establishing support, and preparing for treatment or reintegration. The length of stay is somewhat flexible, but not indefinite. There is not cost to the client. Must be referred by the detoxification center or a local alcohol and drug counsellor or crisis nurse. Will accept methadone-using clients wanting to withdraw from other substances. CHILD, FAMILY AND COMMUNITY SERVICES ACT & ABORIGINAL PEOPLE

Aboriginal children, families and communities have entitled rights under the Child, Family and Community Services Act of British Columbia. These rights include the right to be involved in the planning of Aboriginal children-in-care, the right of children to be, whenever appropriate and/or possible, to remain in the care of their parents. When this is not appropriate, Aboriginal children have the right to, again when possible and appropriate, to be placed in the care of their extended family, community and/or Nation. 1(1) In this Act: “Aboriginal child” means a child (a) Who is registered under the Indian Act (Canada), (b) Who has a biological parent who is registered under the Indian Act (Canada), (b.1) who is a Nisga’a child, (c) Who is under 12 years of age and has a biological parent who (i) Is of aboriginal ancestry, and (ii) Considers himself or herself to be aboriginal, or (d) Who is 12 years of age or over, of aboriginal ancestry and considers himself or herself to be aboriginal; Guiding Principles 2 This Act must be interpreted and administered so that the safety and well-being of children are the paramount considerations in accordance with the following principles: (a) Children are entitled to be protected from abuse, neglect and harm or threat of harm; (b) A family is the preferred environment for the care and upbringing of children and the responsibility for the protection of children rests primarily with the parents;

Guiding Principles… 2(c) If, with support services, a family can provide a safe and nurturing environment for a child, support services should be provided; (d) The child’s view should be taken into account when decisions relating to a child are made; (e) Kinship ties and a child’s attachment to the extended family should be preserved if possible; (f) The cultural identity of aboriginal children should be preserved; (g) Decisions relating to children should be made and implemented in a timely manner. Service delivery principles 3 The following principles apply to the provision of services under this Act: (a) Families and children should be informed of the services available to them and encouraged to participate in decisions that affect them: (b) Aboriginal people should be involved in the planning and delivery of services to aboriginal families and their children; (c) Services should be planned and provided in ways that are sensitive to the needs and the cultural, racial and religious heritage of those receiving the services; (d) Services should be integrated, wherever possible and appropriate, with services provided by other ministries and community agencies; (e) The community should be involved, wherever possible and appropriate, in the planning and delivery of services, including preventative and support services to families and children. Best interest of child 4(2) If the child is an aboriginal child, the importance of preserving the child’s cultural identity must be considered in determining the child’s best interests.

Notice of protection hearing 38(1) At least 10 days before the date set for a protection hearing, notice of the time, date and place of the hearing must be serviced as follows: (a) On the child, if 12 years of age or over; (b) On each parent; (c) if the child is registered or entitled to be registered as a member of an Indian band, on a designated representative of the band; (c.1). if the child is a Nisga’a child, on a designated representative of the Nisga’a Lisims Government; (d) If the child is not a Nisga’a child and is not registered or not entitled to be registered as a member of an Indian band but is an aboriginal child, on a designated representative of an aboriginal community that has been identified by: (i) The child, if 12 years of age or over, or

(ii) The parent who at the time of the child’s removal was apparently entitled to custody, if the child is under 12 years of age;

Parties to proceeding 39(1) if the following person appear at the commencement of the protection hearing, they are entitled to be parties at the hearing: (a) Each parent of the child; (b) A director: (c) If the child is an aboriginal child, other than a Nisga’a child, a designated representative of an Indian band or aboriginal community served with notice of the hearing; (d) If the child is a Nisga’a child, a designated representative of the Nisga’a Lisims Government would be served with a notice of the hearing. Transfer of custody to a person who is not a parent 54.1(1) a director may apply to the court to permanently transfer the custody of a child who is in the custody of the director under a continuing custody order to a person other than the child’s parent.
