MICA hosted its City Council Candidates Night on January 25 at the United Church of Marco. It was the first opportunity for the 150 people in attendance to meet the seven candidates and hear what they had to say. MICA President Jim Arnold moderated the evening and posed many relevant questions to the candidates. The Marco Island residents who filed and qualified to run for Marco Island City Council are Joseph Batte, Heyward Boyce, Ted Forcht, Chuck Kiester, Rob Popoff, Joseph Simons, and Steve Stefanides. The Marco Island Civic Association recently surveyed itsmembers with regard to the length of time boats should bepermitted to anchor in the Marco Island waterways. OnDecember 6 MICA mailed 5,930 surveys to our members. Thesurvey consisted of just one question, which is listed belowalong with the number of respective responses.

How long should a boat be permitted to anchor in thewaterways within the corporate limits of the City of MarcoIsland?

Although “zero” and “thirty” days were not options fromwhich to choose, 34 members wrote in votes for “zero” daysand one member wrote in “thirty” days. We also receivedvarious notes from members saying they did not live on thewater, did not feel qualified to answer the question, andtherefore, did not enter any number of days.

Based upon the fact that 75% of the respondents wishedto limit anchoring to three days or less, the MICA Board ofDirectors voted unanimously to endorse an anchoring limit ofthree days or less. In addition, to protect the sanctity of thesingle-family homes and neighborhoods, the MICA Board alsorecommends anchoring at no less than 200 feet from any man-made structure. To make the City Council aware of thewishes of property owners on Marco Island and to assist intheir decision making, this information was supplied to theseven members of City Council.

MICA has had an extremelybusy couple of months. We havehosted our Annual Meeting, aMarco Island City CouncilCandidates Night, co-sponsoredhealth seminars, and unveiled awonderful piece of sculpture atSarazen Park. In addition, wesurveyed our members regardinga proposed waterways ordinanceand represented the membersbefore City Council regardingdecreasing density on ourbeautiful island. This edition isfull of articles and pictures ofsome of these events.

MICA’s 2006 Humanitarianof the Year Award was presentedat our Annual Meeting to a verydeserving Luise Romano. Asalways, Luise was gracious inaccepting the award, stating thatshe felt honored to follow pastrecipients. Please read the fullarticle on page 8.

The Residents’ BeachPavilion has been under con-struction since June and is sovery close to opening. We lookforward to taking down theconstruction tape and signs andopening the doors to this fabulousnew facility to our members!

Homeowners associationsand their counterparts, such ascondominium or cooperativeowners associations, haveundergone explosive growth inthe past few decades. In 1965there were only 500 suchassociations. The latestinformation from theCommunity AssociationsInstitute (CAI), the trade groupfor homeowners associations,indicates there are more than250,000 associations in theUnited States.

Approximately 50 millionpeople now live in developmentsgoverned by homeownersassociations. This growth isaccelerating, with an estimatedfour out of every five housingstarts included in a homeownersassociation.

In the absence of statelegislation to the contrary, anassociation’s rules will takeprecedence over less restrictivelocal land use regulationsbecause the residents of theassociation have agreedcontractually to be bound bythose rules. Thus, a homeownersassociation is able to restrict, oreven prohibit, uses of propertythat would be allowed under thecommunity’s zoning.

Most homeowners associationshave mandatory membershiprequirements, however, theMarco Island Civic Associationis a voluntary membership of$35 per year. With the year

ending August 31, 2005, therewere 6,700 MICA members.This number does not includeResidents’ Beach members.

Deed Restrictions wereassigned to MICA from Deltonain 1986. Although the deedrestrictions were not as wellwritten compared to ourstandards of today, they remainan important part of ourfunction. Thirty years ago theMackle Brothers did not foreseea 5,000 square foot house on an8,800 square foot lot.

Homeowners associationsare organized on a democraticmodel. Members of the MarcoIsland Civic Association elect aboard of directors from amongits members. An association

board meeting is roughly com-parable to a city council meeting.

There are several importantbenefits to living in adevelopment governed by acivic association. The mostsignificant is the proven trackrecord homeowners associationshave in maintaining, and oftenenhancing, property values.Developments with civicassociations better protectproperty values because theassociations provide somecritical benefits to residents thatthey normally would not be ableto obtain on their own.

American Artist’s SculptureDisplayed at MICA’s Sarazen Park

by Ruth McCannSarazen Park is sporting a

wonderful piece of sculpturethat feels right at home! OnJanuary 26 “It’s Only a Game”was officially unveiled. MICA’sSarazen Park is named after golflegend and Marco Island residentGene Sarazen.

As you can see in thesepictures on the page opposite,“It’s Only a Game” is a tributeto the great game of golf. Itstands 7’3" tall and featuresthree golfers, two men and awoman, from the 1900’s fightingover a ball.

The Marco Island Foundationfor the Arts launched“ArtQuest,” a fine arts projectthat illustrates the organization’smission of promoting thedisplay of art in public placeson Marco Island. The MarcoIsland Civic Association, alongwith 14 other businesses on Marco,is sponsoring a sculpture, whichwill be displayed throughout theyear. An ArtQuest tour map isavailable and each piece is listedalong with information regard-ing the artist and the sponsor.

Bill Bond, the sculptor of“It’s Only a Game”, spent hisyouth in the ranching country ofthe Texas panhandle. He wenton to complete his studies at theArt Center School in Los Angeles,California. Moving to Dallas,Bill had a successful career inadvertising — winning over 100awards throughout the U.S. He

was also named Art Director ofthe year in the Dallas/FortWorth area during his career. In1980, Bill moved into fine artwith his first sculpting efforts,using traditional western themes.Creativity and ideas led to otherthemes — including Biblicaland historical. Then, aftermoving to Loveland, Colorado,he added a fun type of art thathe refers to as ‘whimsical’.

In all of Bill’s bronzes,humor is evident in a subtleway. “I’m trying to take you tothe barely perceptive edge ofhumor — to a point where youlaugh, but are hard-put toexplain why,” says Bill. He saysfurther, “Style is not art. Art isgood design, studied exaggeration,

interesting rhythm...just aboutany theme can be legitimatelyexplored in art, and humorcertainly is one of them.” Billhas exhibited in the CowboyArtists of America Museum inKerrville, TX; the DelawareMuseum in Wilmington; thePanhandle Plains HistoricalMuseum in Canyon, TX; andthe Gilcrease Museum in Tulsa,OK. The Knox Gallery inNaples displays Mr. Bond’sartwork, which is available forpurchase.

Collier Regional Medical Center –Closest Hospital to Marco Island

At MICA’s Annual Meetingon January 19 Mike Mastej,Chief Executive Officer ofCollier Regional Medical Center,explained that there will soon bea state of the art, 100-bed acutecare hospital that will serve thehealthcare needs of CollierCounty, and it will be situatedas the closest hospital to MarcoIsland. Collier Regional MedicalCenter is currently underconstruction along Route 951(Collier Boulevard) at RattlesnakeHammock Road and is part of theHealth Management Associates(HMA) organization. The260,000-square-foot facility isbeing constructed on a 60-acresite east of the Florida SportsPark on the south side ofCollier Boulevard. The newfacility will also include an80,000 square foot professionalbuilding. The hospital openingis planned for January 2007.

This advanced medicalcenter will have emergencyservices, outpatient services,and obstetrical services as wellas a host of other advanced careservices, such as clinical laboratoryservices, MRI, C/T scanner,nuclear medicine and angiography.All 100 rooms are private,which Mr. Mastej stressed is

vital to the recovery of theirpatients. He also stated that thefacility could grow to 400rooms in the future. Thebreakdown of rooms is asfollows:

Mr. Mastej emphasized thatcommunication with all countycitizens is important in thatresidents will support thehospital financially through theuse of the services offered.The hospital will add theequivalent of 300 full-timepositions to the community.HMA cares about and supportstheir employees through trainingand education, who in turn arecaring and committed to patientsand the organization. At thesame time, HMA is a stableorganization that is financiallysound and will provideapproximately $3.5 millionannually in tax revenue to thecounty, state and federalgovernment.

Just days following MICA’sAnnual Meeting HMAannounced that it had entered

into an agreement to purchaseCleveland Clinic Naples. Thetransaction should be completedby June 30, HMA said in astatement.

“We believe this acquisitionwill complement our de novoproject, the 100-bed CollierRegional Medical Center,currently under construction insouthern Collier County, therebyproviding more effectivecompetition in Collier County,”Joseph Vumbacco, HMA’s chiefexecutive officer and vicechairman, said. “Upon completingthe transaction, the existingCleveland Clinic - NaplesHospital medical staff will soonbe able to serve the communityat two Collier County hospitals,effectively improving access tomore of the area’s residents.”

After completing the ClevelandClinic transaction in Naples andtwo other announced transactions,HMA will operate 62 hospitalsin 16 states with about 8,995beds. The Cleveland Clinic -Naples hospital has 83 beds.

The 2006 MICAHumanitarian of the Year Award

by Lynn BradeenThe MICA Humanitarian of

the Year Award has become themost prestigious award on MarcoIsland. This valued award wasdeveloped to honor the unsungheroes of Marco Island, thepeople who do so much for somany. The wonderful peopleyou do not hear much about.

Past recipients of thisprestigious award include MimiTorbush; Shirlee and BrianBarcic; Ward Bradeen; D’Annand David Brandt; Dr. Sam andMary Ann Durso; Judy andArturo Perez; Maury Dailey; ArtSegal and Stevi Walthour.

The 2006 honoree is a veryspecial person with a heart ofgold and a long, long history ofbeing there for others. Ourhonoree has led a very courageousand giving life. The mostobvious and impressive attributethat comes to the surface overand over is the loving andgiving compassion our honoreeextends to others.

Our honoree was selectedclass Salutatorian and the “mostlikely to succeed” in highschool. University was completedat night after work by ourhonoree. Our 2006 honoreewas a scout and PTA leader andan auxiliary member of her localfire department.

Here on Marco Island ourhonoree was active with theYMCA teens, President of

Kiwanis Club, co-chair of theFeast of San Gennaro, a volun-teer at the Cancer Society and awilling and eager volunteer atHabitat for Humanity, buildinghouses for others. Our honoreeis a Eucharistic Minister at SanMarco Catholic Church, and Iam proud to say our honoree isa hard working member of theMICA Residents’ Beach AdvisoryCommittee.

Our Humanitarian of theYear can often be found cleaning,working and care giving, free ofcharge, to our community’selderly who need assistance.

Of the many accomplishmentsthe one I find the most impressiveis the untold hours our honoreespends with cancer patients. As

a two-time cancer survivorour honoree knows first handthe trials and tribulations ofthis dreaded disease. Ourhonoree steadfastly refused tobe brought down by the evilsof cancer. While fighting thevictorious battles over cancerour honoree was an inspirationto everyone around. Todayour honoree quietly shares thisinspiration and love of lifewith others who need helpfighting the battle.

These are just a few of theoutstanding contributions to lifeour 2006 MICA Humanitarianof the Year, Luise Romano,has given to those around her.Congratulations, Luise, andwe thank you!

The Marco Island CivicAssociation works closely withthe City of Marco Code Enforce-ment officials and the BuildingDepartment. Although ourregulations vary, if MICA findsa violation of City codes, we willnotify the Building Departmentor Code Enforcement Department.In the City’s application for abuilding permit, it advises theapplicant to check with MICAto see if there are applicabledeed restrictions on the property.

most of the Island. The excep-tions are Old Marco, everythingnorth of the center of OldMarco Lane, the Highlands,Esplanade, Hideaway and someof the beach front properties.

The City of Marco Islandand Collier County have re-zoned several residential prop-erties to commercial. At thesame time, the properties werestill deed restricted as singlefamily. Case in point: Mazziniproperties on San Marco Road,east of Bald Eagle. MICAtook this to court and after along and costly battle, theCivic Association prevailed.The deed restrictions wereupheld, thereby, protecting the

sanctity of the single familyneighborhood.

Rony Joel and his wife ofalmost 31 years, Nora, visitedNaples over Christmas vacationin 1997, drove over the bridgeto Marco Island, stopped at arealty office and returned toPittsburgh with a house! Whentheir youngest daughter graduatedfrom high school in June 1999they moved full time to Marco.Both of Rony and Nora’sdaughters have since graduatedfrom the University of Florida.

Mr. Joel’s engineeringexperience spans well over thirtyyears in both transportation andenvironmental. Mr. Joel servedas Vice President-Pittsburgh, PAwith Camp Dresser McKee, oneof the top five water and waste-water treatment organizations inthe world. He joined the City inJuly 2004 as Director of Public

Works and in February 2005 theindependent utility division wasadded to his department.

A big challenge in his positionis the constant criticism by well-intentioned individuals whodon’t necessarily have all thefactual information. Mr. Joel’sjob, as with all city staff, is toimplement policy set by theMarco Island City Council.

Joel is a Diplomate with theAmerican Academy of Environ-mental Engineers, a member ofthe Marco Island Rotary, amember of this year’s Leader-ship Marco class, and also holdsthe high honor of Eagle Scoutwith the Boy Scouts of America.

Mr. Joel holds an M.B.A.from Baldwin-Wallace College,a Masters in environmental civilengineering from PurdueUniversity, and a Bachelors incivil engineering from ClevelandState University.

Mr. Joel reported good

news in that the South CollierBoulevard project is on scheduleand on budget to be completedby early May 2006.

Additionally, workshopswith MICA, Restaurant Asso-ciation, Realtors, Chamber andthe Condo Association wereheld and based upon thatfeedback a plan was devisedand implemented for the NorthCollier Boulevard project. Thefirst phase of the project, northof San Marco Road to theSmokehouse Bay Bridge, isscheduled to begin on April 1,2006, and to be completedDecember 15, 2006. Thesecond phase, SmokehouseBay Bridge to Rose Court, willrun from April 1, 2007 toDecember 15, 2007. Basedupon funds available, theremaining portion of NorthCollier Boulevard to Button-wood Court will have minorroad repairs performed.

Concerned About Your Pension?by Howard Jordon CFP®, AAMS

In the wake of poor marketperformance over the past fewyears, a number of traditionalpension plans sponsored byprivate employers do not havesufficient assets to provide thepromised benefits. These plansare under funded.

In general, if your plan is atraditional pension plan, itpromises to pay you a specifiedmonthly benefit in retirement.Your plan may specify a flatdollar amount, such as $700 permonth. Or, more commonly, itmay specify a benefit formula,which takes into considerationother factors such as your ageand your length of service. Forexample, your plan may providefor a benefit equal to 10% ofyour average salary, based onyour three highest wage earningyears with your employer, forevery year of service with youremployer.

With a traditional pension plan,your employer is responsible formaking all contributions to theplan. Each year, your employermust hire an actuary to calculate,based on interest rate and otherassumptions, the amount thatmust be deposited into the planso that the plan will be able toprovide the promised retirementbenefit.

So, how will you know ifyour plan is under funded? Ifyou want to check the status ofyour pension plan, simply askyour Plan Administrator to tell

you what your plan’s fundedpercentage is. In fact, you maywant to inquire even if you arenot concerned about your plan.

What happens if your plan isunder funded? Don’t panic.Even if your plan is underfunded, it may not be in trouble.Many plans become underfunded for one reason or an-other. It doesn’t mean youremployer will not be able tocure the plan. Most plansrecover quite nicely within acouple of years. And, for thoseplans that continue to havetrouble, help may be availablefrom the Pension BenefitGuarantee Corporation (the“PBGC”).

The PBGC is a federalagency that protects and insurespension benefits in privatesector pension plans. When aplan has insufficient assets topay all promised benefits andthe employer is not able to curethe plan, the PBGC will step into pay the promised benefit, upto certain limits set by law.When this happens, it is likelythat some employees will notreceive the entire benefitpromised under the plan. TheSummary Plan Description,provided by your PlanAdministrator, will tell you ifyour plan is covered by thePBGC.

What should you do first ifyou find your plan is in trouble?Unfortunately, your options are

While not everyone needsestate tax planning, everyoneneeds estate planning. Here arefour common mistakes that canbe quite costly, but are easy toavoid with just a little bit ofplanning.1. Failure to Have a Plan.Unexpected death or disabilitycan happen at any time. Accordingto a 2003 survey by the AARP,over fifty-seven percent ofAmerican adults do not have awill. Failure to have a willmeans that your assets will passvia Florida’s laws of intestacy.

Many people assume that ifthey are survived by a spouseand have no will (that is, die“intestate”) their assets willautomatically pass to thespouse. Under Florida law,this is only true if the decedenthad no children. If the dece-dent is survived by a spouseand children or grandchildrenfrom the marriage, the first$60,000 of the estate, plusone-half of the remainingestate will pass to the survivingspouse. The rest of the estatewill be divided among thechildren. If the decedent haschildren other than with thesurviving spouse, thesurviving spouse will receiveonly one-half of the estate.Also, a spouse who is legallyseparated from a decedent willstill be treated as a spouse forthis purpose.

An estate plan includes morethan just a will. A comprehensiveplan begins with preparationsfor the chance that you becomeincapacitated and are unable tomake your own personal, healthcare, and financial decisions. Ifyou fail to name someone tomake those decisions for you,then a court may have toappoint someone to make thosedecisions for you. If you haveminor children, you should becertain to name a legal guardianfor them in the event somethinghappens to you.2. Failure to review andupdate an existing plan. Anestate plan is only as good as itis current. Life events, such asbirth, marriage, divorce, death,retirement, change in incomeand change in net worth, as wellas changes in law, are some ofthe key times when a planshould be reviewed.

A prime example is a personwho has a will, marries subsequentto the date of the will and dieswithout executing a new will.Under Florida law, unless theparties entered into a prenuptialor postnuptial agreementwaiving the right, the survivingspouse is considered a pretermittedspouse and will be awarded anintestate share of the deceased’sestate. The same rule appliesto children (not grandchildren)who are born or adopted afterthe date of the will.

Divorce or annulmentfollowing the execution of awill in Florida revokes all giftsand administrative appoint-ments in favor of the formerspouse. While the rest of thewill will be valid, the ex-spouseis treated as predeceasing thetestator. This rule only appliesto divorce or annulment for thetestator. It does not apply tospouses of children orgrandchildren. 3. Failure to have correctbeneficiary designations.Certain assets, such as IRAs,401(k)s and other QualifiedRetirement plans, annuities andlife insurance, pass outside of awill through beneficiary desig-nations. If you name a minorchild as a beneficiary, that childwill receive the money at age 18,regardless of what your otherestate planning documents mayprovide. If you name yourformer spouse as a beneficiary,divorce does not remove thedesignation, so absent a changeof beneficiary designation, theformer spouse would stillreceive the assets.

A major problem in this areaconcerns IRAs and QualifiedRetirement Plans. The rulesregarding distributions fromthese plans are complex. Evenif you do not have a taxableestate for estate tax purposes, an

improper beneficiary designationmay trigger unnecessary incometax consequences. Properplanning may allow the moniesfrom these plans to be rolledover to a surviving spouse orpaid out over a long period oftime to reduce the tax consequences.

4. What Is A Reader To Believe AboutMarco Island Real Estate?

trying to top the other, are tryingto capture readers to their story.But what is really happeningwith the real estate market?That depends on the writer’sperspective. My previous articlesare specific to only Marco Islandreal estate activity. To get thepulse on sales activity I chose tolook at pending sales versus salesthat have closed. The differenceis that pending sales are thosethat were put under contract thatparticular month. It will close acouple of months later. But thepending contracts measure whatbuyers are doing in our market-place that particular month.

Other articles take differentapproaches to the same facts.To each their own. But the time ofyear from Thanksgiving throughNew Years normally buyers arespending time consumed in theholidays. There have beenabnormal times like last year,2004, when the holiday period wasvery active. But that was unusual.

So, at this time of year it isnot a good time to judge howour market is. Just think aboutwhat happened during thetimeframe we are trying to takea pulse on our market. We werein the Summer time. Usually alittle slower time anyway. Butthen we went through a toughhurricane season and then intothe holidays. So it makes sensethat our numbers would look lowespecially compared to last year

when we had an exceptionallyactive market.

I think that there is a goodargument that there is somepent up demand for our realestate. Buyers were not aroundwhen talk was all about hurricanesand they aren’t around for theholidays either. We did have alot of property owners comedown after the Hurricane toinspect their property. But thenthey left to go home for theholidays. They were not lookingto buy.

After several months ofbuyers being out of the market Iexpect we will see them showup during the first quarter of2006. It coincides with ourSeason. Financing purchasesare still great and sellers haveeased off on some of theirexpectations bringing some pricesdown a little. Our availabilityof property is giving buyerschoices they didn’t have lastseason. All of the demographicsabout Baby-Boomers, EchoGeneration and other buyersgetting into the market are allstill in place and growing.These buyers are all addingdemand for real estate.

Even looking at nationalheadlines about real estatedoesn’t tell the whole story. Weare in a lag time as the GulfRegion gears up to have amassive building boom. Hundredsof thousands of homes andbusinesses need to be rebuilt.

That will have a major impacton the national scene.

So what are all of the headlinesabout? Various financialmarkets compete for our dollars.If there is some chance toconvince us to redirect ourfunds from one thing to anotherthen more power to them totake that liberty to try. Butcapitalizing on the past severalmonths’ slower activity seemsunfair and inappropriate. It alsomeans that Sellers expectingBuyers during these past severalmonths need to think twice andalso reflect on what we havegone though. Maybe their

When you get the OK fromyour physician to start anexercise program you shouldconsider what your goals areand proceed from there. Itwould be in your best interest toconsult a fitness professional toset up a program for you. Hewill take into consideration anyrecommendations from yourdoctor and your goals. Your age,sex, lifestyle and eating habitsare factors that must be consideredto properly evaluate you.

There are four majorcomponents to physical fitness.They are cardio respiratoryendurance, muscular strength,muscular endurance and flexibility.A good workout program willcontain all four componentsincluding a pre-exercise warmup and a post-exercise cooldown, combined with stretching.

Three balanced workouts aweek are recommended but noton consecutive days. Cardioworkouts can be done on a dailybasis. In order to improve,exercise intensity and/orduration should be increased. Itis a good idea to keep anexercise log and record yourroutine. That way you will beable to make a decision, basedon performance, when to increaseweights, intensity or duration.

Keeping a log, or exercisediary, is also a good way togauge which exercise might becausing you some problems. Itwill be easier to determinewhich exercise should beeliminated or adjusted if you’vekept a log of all that you’ve

done. A log will also be helpful ifyou go to an exercise specialistfor a tune-up on your routine ifyou don’t feel that you aremeeting your exercise goals. Hewill be able to garner theinformation he needs from yourlogs and an interview with you.

Another exercise basic thatshould be considered is properclothing. Clothing should beloose fitting, never binding, soyou can move easily. Dress forthe weather and in layers.Remember, dark clothes absorbthe sun’s warmth and lighterclothes reflect the sun’s rays. It’salways safer to wear white orreflective clothing at night. It’salso important to wear theproper footwear for the taskyou’re performing. Make sure youhave a proper fit for your shoes,and don’t let them becomebroken down or worn out. Goodarch support and cushionedsoles are very important.

The best time of day toexercise is the most convenienttime for you. It doesn’t reallymatter when you exercise, as longas it’s convenient. Importantdon’ts for exercise time includeexercising right after eating (it’sbest to wait a couple of hours) andexercising outside during extremelyhot or humid weather. In very hotweather, it’s best to avoidexercising outdoors during thehottest part of the day which isfrom 10:00 in the morning until2:00 in the afternoon.

The important thing, ofcourse, is to exercise. Clear itwith your doctor and get itmoving.

Don’t let headlines andrumor mongers try to talk youinto some negative picture ofthe future of Marco Island.Temporary bumps in the roadshould be expected but thereis no need to think the bumpsare permanent. Making longterm decisions based on shortterm bumps probably issomething not to get caughtup in, as tempting as it maybe.

Let’s judge the market in abetter light sometime afterFebruary or March. In themeantime, enjoy the spin onfacts and figures.
