Topic 14: AMENDMENTS TO THE STAFF RULES OF THE PAN AMERICANSANITARY BUREAU

Annex I to this document contains the amendments made!

to certain Staff Rules of the Pan American Sanitary Bureau as

approved by the Director under the terms of Staff Regulation

12.2 and Staff Rules 060 and confirmed by the 16th and 17th

Meetings of the Executive Committee with the following modifica-

tions (Resolution VI of the 17th Meeting of the Executive Com-

mittee):

a. Rule 870 shall remain in effect without change.

b. Rule 821. In the second sentence of the new textthe words "for serious maisconductt" shall be addedfollowing the word "dismissal".

c. Rule 1616. The new text shall read as follows:

The Director may grant to staff members subject tolocal recruitment an allowance equivalent to onewithin-grade increase in recognition of demonstratedproficiency in one of the official languages of theBureau, provided:

1) that the candidate whose mother tongue is French,Portuguese, or Spanish demonstrates proficiencyin English; or

2) that the candidate whose mother tongue is Englishdemonstrates proficiency in French, Portuguese,or Spanish; or

Reasons for Change

Following WHO, we propose to de-lete Staff Rule 142 because itis no longer required as an organ-izational safeguard. Local staffmembers under Staff Rule Section1600 are required to be recruitedfrom the immediate area of theduty station and are deemed tobe residents of the duty station.Rules governing normal place ofresidence for international:staff members and rights in con-nection therewith are adequate-ly defined in provisions relatingto allowances, leave, etc.

The change in the wording ofthis paragraph is necessary inorder that the PASB practicesin this connection will coin-cide with the practices underWHO making changes effectivefrom the beginning of a month.The PASB has two pay periods permonth whereas under WHO, there:is a single pay period coin-ciding with the calendar month.

212.4 The service requirements forwithin-grade increases are:

(a) One year for all steps inlevels P-1 through P-5 and D-1of the salary schedule in Rule710.

(b) Two years for levels D-2and PD of the salary schedulein Rule 710.

(c) For posts subject to localrecruitment, service time to bedetermined by the Director inestablishing the local salaryschedule.

212.7 When a staff member's salary hasbeen adjusted upward as a resultof a change in grade or payschedule, service time towardthe next within-grade increasecommences from such adjustmentprovided the amount of theadjustment was not less than thenext within-grade increase afterthe adjustment.

When a promotion is effected itwill be to the lowest step inthe higher grade which willresult in a salary increase notless than that which would havebeen earned in the former gradeby the next within-grade increase.

The service requirements forwithin-grade increases are:

(a) One year for all steps inlevel P-1 through D-1 Step IIIof the salary schedule in StaffRule 710.

(b) Two years for levels D-1Step IV through level PD inStaff Rule 710.

(c) Same as "previous text".

When a staff member's salary hasbeen adjusted upward as a resultof a change in grade, servicetime toward the next within-gradeingrease commences from the dateof such adjustment, providedthat the amount of the adjust-ment was not less than the nextwithin-grade increase in thelower grade.

To clarify the intent of therule that reasonable compen-sation should be realized froma grade promotion.

The purpose of the change is toset the point for commencementof a.two-year service period forwithin-grade increase at Step IIIof D-1 rather than at Step I ofD-2. This change conforms to adecision of the 6th General As-sembly of the United Nationstaken to remove the possibleanomaly of a staff member inGrade D-l1 arriving at a highersalary in less service time thana staff member in D-2.

The words in the first part ofrule referring to change in payschedules have been deleted sincea change of this type would behandled by a one time transitionalprocedure. The last line waschanged to correspond with therevision being effected underrule 211.2.

These are editorial changes

required to bring this rule into

line with the previous deletion

of Rule 142 on Waivers. Rule

620.3 provides that no indemnity

will be paid to staff member Yho

accepts an appointment for a year

or more and resigns after less

than one year of service.

The purpose of this change is to

simplify payroll computations

and establish a formula which

is easily understood by the

staff.

The World Health Organization

has always considered a pay

period as covering each cal-

endar month. However, confor-

ming to general practices in the

Western Hemisphere regarding

frequency of salary payments the

Pan American Sanitary Bureau has

generally operated on a semi-

monthly pay basis with the pay

period covering the first through

fifteenth, and sixteenth through

the last day of each month. This

will bring the wording of the

Staff Rule in line with this ac-

cepted practice.

Persons whom it is necessary torecruit outside the local areafor such posts, shall be appointedunder the conditions of employmentestablished for'persons locally re-cruited except that in additionthey shall be paid an annual non-residence allowance in an amountto be established by the Directorfor each area, and the provisionsof Staff Rile 851.1 shall applyto such persons.

Reasons fo Change

Although the salary and allow-ance plan introduced on 14 April -

1951, made provision for a lan-guage allowance for staff in postssubject to local recruitment, theauthority for granting such anallowance was not specificallyintroduced into the rules. It isconsidered desirable, that pro-vision for the allowance bepositively stated in-the StaffRules.

It is not necessary for theBureau to recruit outside thelocal area for posts in thelocal wage rate categories sinceadequate sources of supply existat the PASB Headquarters and atthe various Zone Offices. Hence,it has only confused the operations[of the Bureau to have intimationsof such allowances provided forunder the Staff Rules.
