12/01/2016 22/01/2016 & 12/02/2016 has verified /
Scrutinized (08) claim application of reimbursement
of Sales Tax and (51) claim applications of
reimbursement of power cost as per the Guidelines
under respective schemes and recommended for
sanction/rejection of eligible Incentives /
Concessions to the units. The Minutes of
Verification / Scrutiny Committee of Sales Tax and

1. Reimbursment of Sales Tax Sanctioned
reimbursement of sales tax to (08) units
under IIPP and the list is appended as in
Annexure – I. In respect of Sl. No. 7, M/s
Adani Wilmar Limited, the Revised Rs.
1,74,18,039/- (Rupees One Crore Seventy
Four Lakhs Eighteen Thousand and Thirty
Nine only) was sanctioned towards sales
tax reimbursement.

hence could not be correlated. GM,DIC to
furnish the products indicated in Form A in
terms of Kgs.
3. SLC decided to release incentive amount to
the unit after the apportioned amount in
respect of tax paid in the State Telangana
as per the Section 56(1) (2) of the A.P.
Reorganisation Act 2014 is received.
4. SLC have taken a view of the member
representing State Bank of Hyderabad and
decided to furnish the information of
claims sanctioned duly indicating the name
of the Financial Institution.
5. SLC opined that the agenda shall be
circulated well before 2 days of convening
the State Level Committee so as to enable
the members to go through the contents
carefully while taking decisions.
6. SLC also taken a view of member
representing the AP Spinning Mills
Association and decided to allocate the
time from 3.00 PM to 5.00 PM on every
Monday exclusively for the spinning mills
to reconcile the shortfall information so as
to expedite the sanctions and clear the
issues pertaining to Textile Sector.

A.P.State Reorganisation Act. Hence SVC
recommended for sanction of
Rs.8,64,45,365/- against the tax paid in
residual Andhra Pradesh. (50% of Rs.
17,28,90,730/). In respect of an eligible
amount of Rs. 4,14,41,360/- (50% of
8,28,82,720/-) signed by CT Department,
Hyderabad towards sales tax
reimbursement, the release of funds shall
be shared by the State of A.P and
Telangana as per the outcome of the
Government decision.

scheme of amalgamation, Godrej Oil Palm
Ltd., is amalgamated with Godrej Agro vet
Limited on 16.03.2012 but the date of
commencement of commercial production
after amalgamation is declared on
15.06.2013. 4. Power consumption of the
unit is less than the base consumption and
hence recommended zero value proposals
for 1st half year 2013-14. 5. Valid Gram
Panchayat approval 6..Land Conversion
permission. 13. List of Plant & Machinery
duly certified by the GM, DIC and
Financial Institution as per guidelines in the
prescribed format in original. 7. Factories
Department approval. 8. GM, DIC has
his remarks on existing unit ie M/s Godrej
Oil Palm Ltd., and unit not achieving the
Base power consumption units in respect of
expansion project.
SVC opined that the GM, DIC
recommended zero value proposals, the
above shortfall information shall be
obtained from the GM,DIC in order to

The General Manager, DIC,
Visakhapatnam has recommended the
Reimbursement of Power cost claim application of
M/s Sri Durga Kanakeswari Ice Plant, S.No. 176/3B,
Lankalapalem, Parawada, Visakhapatnam for
sanction of Power cost for 4th quarter of 2008-09, 1st
to 4th quarters of 2009-10 & 1st & 2nd quarter of
2010-11 under IIPP 2005-10 scheme.
In this connection it is to submit that,
the unit holder has procuring power from M/s
Anakapalli Rural Electricity Cooperative Society
Ltd., Kasimkota. As per the guidelines para 5.3.5
under IIPP 2005-10 scheme is as follows:
“The power cost reimbursement shall
be applicable to the industries, which are utilizing
power from DISCOM only and power consumption
should be in the name of the unit.”
The decision of SLC is as follows:
“SLC examined the issue in detailed and decided to
recommend to Govt., for considering the units
availing power from Rural Electricity Cooperative
Society Ltd, for availing the reimbursement of power
cost under IIPP 2005-2010 and also under IIPP 2010-
15, as the RECS are being fed by DISCOMs”.
Accordingly, the proposals were recommended to the
Government vide letter No. 20/02/12/0053 DT:
15/05/2012. The issue was placed in SIPC
meeting held on 03/01/2013 and SPIB held on
26/04/2013. The SIPB approved the proposal to
provide power subsidy incentive those industries
drawing power from Rural Electricity Supply (RES).

IIPP 2005-10 - Reimbursement of Power cost -
Application of M/s Sri Satya Surya Industries,
Boduvalasa (V),Sabbavaram (M), Visakhapatnam
District - Regarding.
The General Manager, DIC,
Visakhapatnam has recommended the
Reimbursement of Power cost claim application of
M/s Sri Satya Surya Industries, Boduvalasa
(V),Sabbavaram (M), Visakhapatnam for sanction of
Power cost for 1st quarter of 2010-11 onwards under
IIPP 2005-10 scheme.
In this connection it is to submit that,
the SLC in its 78th SLC meeting held on 23/09/2009
has sanctioned reimbursement of Power cost of Rs.
3,700/- for the 3rd quarter of 2008-09. So far an
amount of Rs. 22,010/- has been sanctioned towards
reimbursement of Power cost to the unit. The
reimbursement of power claim application are
pending for sanction. Further, the unit holder has
procuring power from M/s Anakapalli Rural
Electricity Cooperative Society Ltd., Kasimkota. As
per the guidelines para 5.3.5 under IIPP 2005-10
scheme is as follows:
“The power cost reimbursement shall be applicable

IIPP 2005-10 – M/s. Visaka Industries Limited – RS
No. 385,386, jujjuru, Veerullapadu (M), Krishna
District – Sanction of reimbursement of power cost –
regarding.
The SLC has examined the issue on the following
points:
G.O. Ms. No.108, Industries & Commerce (IP)
Department, dt.20/05/1996 pertains to Target – 2000
Scheme – New Industrial Policy 1995 and policy
period is from 15.11.1995 to 31.03.2000, in which
line of activity “Mangalore Tiles / Asbestos
Products” is listed at Sl. No.49 in the ineligible
industrial activities.
In this regard vide G.O. Ms. No.196, Industries &
Commerce (IP) Department, dt.11.06.1998 an
amendment was issued that words “Asbestos
Products” occurring against item 49 in the list of
ineligible industries annexed to G.O. Ms. No.108,
Industries & Commerce (IP) Department,
dt.20/05/1996 shall be deleted”.
While issuing the G.O. Ms. No.178, Industries &
Commerce (IP) Department, dt. 21-06-2005, the
Government has not taken the order issued for
amendment to the G.O. Ms. No.108, Industries &
Commerce (IP) Department, dt.20/05/1996. They
have taken only ineligible list annexure with the
G.O.Ms.9 Industries & Commerce (IP) Department,
dt. 05-01-2001.
M/s. Visaka Industries Limited – RS No. 385,386,
jujjuru, Veerullapadu (M), Krishna District were also
processed for sanction of incentives under IIPP
2005-2010 and sanctioned in various SLCs an
amount of Rs.30,18,270/- and also an amount of
Rs.13,05,190/- were released pertaining to
reimbursement of power cost.
In view of the above circumstances, the SLC has
decided to recommend the issue to the Government
for making eligible for the line of activity of
“Asbestos Products” and issue amendment
accordingly to the G.O. Ms. No.178, Industries &
Commerce (IP) Department, dt. 21/06/2005, since
the same line of activity are eligible under IIPP
2010-15 schemes.
Accordingly, the proposals were recommended to the
Government vide letter No. 10/3/2007/0568,
dt.21/03/2013.

The SLC discussed the issue in detail and
decided to send the proposal of extending incentives
to differently able persons, to Government for the
issue of appropriate orders on the operational
guidelines in respect of G.O.Ms.No.188 Industries
and Commerce (IP) Department dated 20.12.2013.
Accordingly, the proposals were
recommended to the Government vide letter No. Lr.
No. 30/1/15/0288, dated 18/06/2015.

IIPP 2005-2010 and 2010-15- claim applications
revised for reimbursement of sales tax – clarification
– regarding.
The SLC discussed the issue in detail and
decided to seek clarification from the Government
regarding the reimbursement of sales tax paid by the
unit in the united state of Andhra Pradesh when the
physical location of the unit is in residual Andhra
Pradesh. In view of the above Sales Tax
reimbursement is sanctioned to all such units subject
to outcome of Government orders.
Accordingly, the proposals were recommended
to the Government vide letter No. Lr. No.
30/1/14/0288/0288/ID, dated 23/05/2015

IIPP 2005-2010 – M/s Eisai Pharmatechnology &
Manufacturing Private Limited – change of name to M/s
Eisai Pharmaceuticals India Pvt Ltd., Visakhapatnam –
requested – regarding.
M/s Eisai Pharmatechnology and manufacturing
Pvt Ltd., SEZ, Parawada, Visakhapatnam is a Mega
Project promoted by M/s Eisai Co Ltd., Tokyo, Japan,
established with an investment of Rs. 280 Cr and
commenced commercial production on 28.06.2010 in the
line of activity “ Pharmaceutical Manufacturing and
Research Development Services”. Further M/s Eisai
Pharmatechnology and manufacturing Pvt Ltd., SEZ,
Parawada, Visakhapatnam is a 100% subsidiary of M/s
Eisai Co Ltd., Tokyo, Japan.
General Manager, District Industries Centre,
Visakhapatnam forwarded the claim application for
sanction of power cost reimbursement pertaining to 4th
quarter 2013-14 treating the claim as belated claim, since
the claim application was filed on 24.10.2014 manually
in the office of the General Manager, District Industries
Centre, Visakhapatnam which is beyond 6 months from
the end of quarter making the claim ineligible for
availing power cost reimbursement as per Para No. 5.3.1
of operational guidelines issued under IIPP 2005-2010.
“Para No.5.3.1 read as “ All Eligible
industrial units shall submit their claims
in the prescribed application form given
at annexure-IV for reimbursement of
SLC deferred the issue to next meeting
requsting the members to go through the
contents of the agenda for taking a decision.

months from the date of completion of
such quarter along with the documents
mentioned in the Application to the
General Manager, District Industries
Centre concerned.”
The captioned unit represented that they have
submitted the claim application for 4th quarter of 2013-14
in Meeseva centre for uploading the claim application on
08.10.2014 but could not uploaded due to HUDHUD
Cyclone affecting the Meeseva services in
Visakhapatnam. The claim application was uploaded on
23.10.2014 in meeseva portal and hence the unit
requested the Government to condone the delay in filing
the claim application.
Subsequently Government have considered the
proposal of the unit vide Govt. Memo No.
5316/P&I/A1/2015 Dated 17.11.2015 duly condoning
the delay in submission of above claim and directed the
Director of Industries to process the claim application of
4th quarter of 2013-14 in relaxation of the rules as an
exceptional case subject to satisfaction of the other
applicable provisions and furnish the action taken report
at an early date.
Accordingly General Manager, District
Industries Centre Visakhapatnam was directed to inspect
the unit and send his proposals as per the procedure in
vogue. GM,DIC recommended the claim application of
4th quarter of 2013-14 for sanction of reimbursement of
power cost.
Further, General Manager District Industries Centre,
Visakhapatnam recommended the proposal of change of
name of the unit from M/s Eisai Pharmatechnology and
manufacturing Pvt Ltd to M/s Eisai Pharmaceuticals
India Pvt Ltd., for placing in State Level Committee
enclosing the following documents.
1. Application for change of name of the company
in Form 1(A)
2. Copy of certificate of Incorporation for change of
name duly certified by Registrar of Companies,
Hyderabad
3. Copy of list of Directors
4. Copy of A.P.High Court order
5. Copy of Bombay High Court Orders
6. Copy of Memorandum & Articles of
Association.
The power cost reimbursement from 1st quarter of
2010-11 to 3rd
quarter of 2013-14 were already
sanctioned and released to the captioned unit.
:: 20 ::
The claim applications from 1st quarter of 2014-15 to
1st quarter of 2015-16 for sanction of power cost
reimbursement are scrutinised by SVC held on
12.02.2016 and it was decided to recommend for
sanction of incentives towards power cost reimbursement
subject to submission of shortfall document of Civil
Engineer Certificate for all civil works.
As per Para No. 11 of operational guidelines issued
vide G.O.Ms.No.328 Industries and Commerce (IP)
Department dated 13.12.2005 which read as
“11.0. INSTANCES OF CHANGE OF
CONSTITUTION/MANAGEMENT/
NAME OR STYLE OF INDUSTRIAL
UNIT: The Industrial units that availed
incentives/concessions should obtain the
No Objection Certificate from the
concerned financing institutions in
respect of aided units before seeking the
approval of Commissioner of Industries
for any change of the
constitution/Management/name & style of
the unit within the first six (6) years from
the date of commencement of Commercial
production.”
In view of the State Level Committee may take a
view with regard to processing the claim application for
the sanction of power cost reimbursement in respect of 4th
quarter of 2013-14 as per Government Memo and
according permission for change of name from M/s Eisai
Pharmatechnology and manufacturing Pvt Ltd to M/s
Eisai Pharmaceuticals India Pvt Ltd.

M/s Spin Cot Textiles Pvt Ltd.,19th Kilometer
NH 5 , Marripalem Village, Edlapadu Mandal, Guntur
District is a Private Limited Company established with
an investment of Rs. 59 Cr for the manufacture of Cotton
Yarn and commenced commercial production with effect
from 05.04.2007. The unit is a large scale Industry
having IEM Part B bearing No. 1763/IIM/PROD/2008
Dated 26.09.2008. The incentives of Rs.1,65,90,184/-
was released towards power cost reimbursement under
SLC deferred the issue to next meeting
requsting the members to go through the
contents of the agenda for taking a decision.

The General Manager, DIC, Guntur in his letter
dated 28-12-2014 informed that the unit is sick / closed
and he has not recommended for release of the above
sanctioned amount.
As per operational guidelines issued vide
G.O.Ms.No. 328 Industries and Commerce (IP)
Department dated 13.12.2005,
Para No. 4.11. Continuous Production:
Continuous production meanscontinuous working of
an industrial unit in the manufacture of approved
lines for a minimum period of six (6) years, without
any break-in-Production.
Para No. 21.10. In respect of APSFC
financed industrial units, subsidy amounts
sanctioned and released shall not be credited to the
A/c. of respective industrial units if they are sick,
closed or changes of management taken place or
sold away, etc.
Also wherever the General Manager, DICs
finds an industrial unit sick, closed, change of
management taken place etc. or for any other
reason not worthy or receiving subsidy fill
further examination, the Managing
Director, APSFC / Branch Manager,
APSFC shall not disburse the subsidy to such
units on written intimation given to them by
the General Managers DICs, or by Commissioner of
Industries. In case of above two situations,
the subsidy shall be disbursed only afterfurther
clearance given by the Additional Director
of Industries and Member-Secretary, SLC.
Further the unit holder vide his letter dated
06.02.2015 informed that due legal issue in NSEL
Mumbai, the financial institution have not disbursed the
working capital to the unit and unit was stopped due to

financial crisis and accordingly represented to
Government to release the sanctioned power cost
reimbursement for revival of the unit.
The request of M/s Spin Cot Textiles Pvt Ltd was
submitted to the Government vide letter no.
30/1/2009/0266 dated 7-2-2015. Government of Andhra
Pradesh issued orders vide G.O.Rt.No.388 Industries and
Commerce (P & I) Department Dated 28.08.2005
according permission for the release of an amount of
Rs.2,50,00,000 to M/s Spin cot Textiles Pvt Ltd., Guntur
District out of the total eligible subsidy of Rs.4.70 Crore
from out of the already released funds towards incentives
for Industrial promotion during the current financial year
2015-16 and available with the Department, so as to
revive the unit by the promoter in relaxation of existing
rules and subject to ratification by the State Level
Committee.
In pursuance of the orders in the G.O.Rt.No.388
Inds & Comm (P & I) Department dated 28.08.2015 and
as per the recommendation of General Manager, District
Industries Centre, Guntur District an amount of
Rs.2,49,96,220/- was released to the captioned unit
16.09.2015 and credited into the Joint Account
No.3488716164 of Central Bank of India, Gottipadu
operated by General Manager, District Industries Centre,
Guntur and Managing Director of M/s Spin Cot Textiles
Pvt Ltd towards the following.

While releasing the amount of Rs.2,49,96,220/-
to GM, DIC, Guntur, the General Manager, DIC, Guntur
was directed to ensure that the funds released are not
misutilised and that the funds are to be used only for
revival / reopening of the unit. He should open a
separate bank account with joint signatory of the
Managing Director of M/s. Spincot Textiles Pvt Ltd for
release of funds so that the General Manager, DIC,
Guntur to oversee that the released funds can be utilized
only for revival / reopening of the unit. Further M/s.
Spincot Textiles Pvt Ltd should submit the utilization

certificate with relevant proof that the amount of Rs 2.50
crs released is spent for the revival of the unit within 15
days from the date of release or else proceedings under
AP RR Act 1864 will be initiated by the General
Manager, DIC, Guntur for the recovery of the above
amount along with interest as per the lending rate of
State Bank of India. The General Manager, DIC should
have constant supervision and extreme vigil over the
utilization of funds released to M/s. Spincot Textiles Pvt
Ltd, Guntur and report compliance to the Director of
Industries.
Subsequently, the General Manager, DIC,
Guntur in his letter dated 27-10-2015 informed that the
trial production of the unit started and the preparatory
section machinery were found working except one
carding machine and that he has given a cheque for Rs
1.00 crs in favour of court receiver, Mumbai High Court.
He also informed that he released Rs 1,00,15,747/- and
has balance Rs 50 lakhs available. He has requested
another Rs 1.00 crs for procurement of raw material
(cotton yarn) in addition to Rs 2.50 crores already
released to him. Accordingly an amount of Rs.1.00 Cr
out of pending power cost reimbursement Rs. 2.20 Cr
payable to the captioned unit was released on
05.11.2015 duly imposing the same conditions for the
revival of the unit.
Subsequently, the General Manager, DIC, Guntur
in his letter dated 22-1-2016, & 1-2-2016 informed that
the power bill of Rs 38,96,000 is to be paid by 5-2-2016
otherwise the power supply would be disconnected again.
He has requested whether to recommend for release of
balance Rs 1.20 crs or to utilize the amount of Rs 1.00 cr
kept aside for payment towards court receiver in the joint
account.
The General Manager, DIC, Guntur in his letter
dated 2-2-2016 informed the details of the utilization of
the Rs 3.50 crs released to him for revival of the unit.

In this connection it is submitted that the total
amount due for release to the units towards reimbursement
of the power charges is Rs 4,71,69,347/-. Till now, the
amount released for the purpose of the revival of the unit
is Rs 3,49,96,220. The balance amount is Rs.
1,21,73,127/-
:: 24 ::
The request of the General Manager, DIC,
Guntur for release the balance amount of Rs
1,21,73,127/- was examined by the Director’s Office and
noticed that the possibility of revival of the unit with the
balance amount appears to be bleak. Hence, the matter is
being examined on the working capital requirement of
the unit and for further course of action in the matter.
In view of the above, SLC may take a view to
ratify the release of funds of Rs 2,49,96,220 /- to the
captioned unit as per G.O.Rt.No.388 Inds & Comm (P &
I) Department dated 28.08.2015 and also further amount
of Rs 1.00 cr released to the unit as requested by the
General Manager, DIC, Guntur.
8 IIPP 2010-15 – Processing of claim application for
sanction of Reimbursement of Sales Tax in Annexure IX
– sanction as per Form A certified by Commercial Tax
Department - Tax refunds by the Commercial Tax
Department in certain cases – regarding.
The reimbursement of sales tax is being
sanctioned based on the amount tax paid by the industrial
unit and as certified by the Commercial Tax Department
in the form A prescribed with contents furnished
hereunder.
“ It is certified that all the facts and figures
furnished by the Enterprise is verified with the
records and found correct. The above
Enterprise/Industry has paid the sales tax amount of
Rs. ______ and also there is no due for the year - 201
- 201 .”
The sales tax reimbursement is being sanctioned
by the Department as per Para No.5.7.7 of operational
guidelines issued vide G.O.Ms.No.42 Industries and
Commerce (IP) Department Dated 05.05.2011 on the tax
paid by the unit during the year and as per certification
that there are no due for the year for which claim is
preferred.
“5.7.7 The enterprise/industry shall obtain the
details of the net commercial tax paid
during the year for which the claim is being
made duly certified by Commercial Tax
authorities in form prescribed at Form-A for
original/expansion / Diversification
Enterprise/Industry separately as the case
may be.”
Further, the Assistant Commissioner,
Commercial Taxes Department has raised the issue in
Scrutiny cum verification Committee held on 12.02.2016
that there are certain cases where there are instances of
refund of tax paid to the units after assessment. But
Scrutiny cum verification committee is processing claims

based on Form A certified by Commercial Tax
Department indicating that the there is no due for the
year. Wherever it is observed that there are tax refunds
on the claims which were sanctioned, CT Department
shall provide such data so that the proportionate tax
reimbursement will be computed and deducted in next
claim. The decision of the Scrutiny cum verification
Committee held on 12.02.2016 is as follows.
“SVC discussed the issue and decided to place
before the SLC for taking a view.”
SLC may take a view
9 IIPP 2005-10 - Claim application of M/s. Shri
Govindaraja Textiles Ltd., 708, Peddarangapuram (V),
Pulivendala (M), Kadapa Dist for the sanction of
reimbursement of power cost under IIPP 2005-10 -
Regarding.
M/s. Shri Govindaraja Textiles Ltd. has
established the unit at 708, Peddarangapuram (V),
Pulivendala (M), Kadapa District for the line of activity
of “Cotton Yarn Spinning”, obtained IEM bearing
No.2145/SIA/IMO/2007 from the Government of India
and commenced commercial production
w.e.f.01/04/2008.
The unit has entered MoU with Government of
Andhra Pradesh on 16/11/2006. As per MoU, the
Government has offered the following incentives:
1. GoAP shall provide land measuring 100 acres to
the proposed textile unit at Peddarangapuram
(V), Pulivendala (M), Kadapa District, cost of
which shall be the actual cost of acquision as
mutually agreed between GoAP/APIIC and SGT.
2. GoAP shall provide necessary infrastructure
facilities such as roads, electricity,
communication facilities and water at the ‘door
step’ of the unit at the cost of the GoAP.
3. The unit shall be exepted from any statutory
power cuts to ensure uninterrupted production. A
special concession of Rupee One per unit unit on
the power tariff as prevailing on November, 1st
2006 shall be provided to the unit for a minimum
period of 5 years from the date of preferring the
claim for reimbursement of subsidy provided
such claims are preferred before 31st December
2010.
SLC deferred the issue to next meeting
requsting the members to go through the
contents of the agenda for taking a decision.
:: 26 ::
4. GoAP shall supply water to the doorstep of the
unit and the tariff for such water shall be Rs.15/-
per kiloliter, for a minimum period of five years
from the date of commencement of commercial
operations, provided the unit commence
production before 31st December 2010.
5. GoAP shall provide an approach road linking to
the site of the unit.
6. GoAP shall provide the unit with an additional
tax reimbursement at the rate of 25% of VAT
paid during first five years to be done from 2nd
to
6th year, 50% of the VAT paid 6
th and 7
th years in
the 7th and 8
th year of commercial production
respectively.
7. GoAP shall provide incentive of Rs.5,000/- for
every person of the origin of AP trained and
employed by the unit, provided the employee
stays in the employment for a period of at least
one year.
8. GoAP shall declare the unit as Public Utility
Services and the women will be allowed to work
in all the three shifts in the units subject to taking
necessary safety and welfare measures.
9. GoAP shall reimburse 100% stamp duty and
transfer duty related to transaction of land
between the Government and the unit, as per the
IIPP 2005-10.
10. GoAP shall provide all other incentives as
applicable under the relevant IIPP 2005-10.
The Government has not issued G.O. for the
above MoU. Only basing on the above MoU, the claims
are processed for reimbursement of power cost duly
fixing @1/- per unit as per 2005-06 power tariff and
sanctioned duly following the pegged down as per IIPP
2005-10 for the claims received up to December, 2010.
From January, 2011, the claims are processed for
reimbursement of power cost duly fixing @0.75/- per
unit as per 2005-06 power tariff and sanctioned duly
following the pegged down as per IIPP 2005-10 upto
December, 2013. The pegged down eligibility from DCP
for various quarters are as detailed below:

From the above, it is clear that the Power Tariff
sanctioned is not either as per MoU or as per IIPP 2005-
10 for the period from April, 2008 to December, 2010.
However, Rs.1/- per unit was sanctioned for the period
from January, 2014 to March, 2015 is not as per IIPP
2005-10 under the provisions of G.O.Ms. No.42
Industries & Commerce (IP) Department,
dated:05/05/2011. MoU expires on 31/12/2010.
Further, Government of Andhra Pradesh
extended the eligibility period for spinning mills
commissioned during IIPP 2005-10 period by another 3
years making total eligibility period as 8 years vide
G.O.Ms. No.42 Industries & Commerce (IP) Department,
dated:05/05/2011 and the captioned unit is falling under
IIPP 2005-10.
Further it is observed that the claims from
January 2014 to March 2015 were processed and

sanctioned power cost reimbursement @Rs.1/- per unit
(upper sealing) without following the method of pegged
down by erroneously.
The captioned unit represented on 21/09/2015
that their claims are considered at the fixed power cost
Rs. 1/- per unit instead of Pegged down as per policy
applicable to their unit as per G.O.Ms.No. 42 Industries
& Commerce (IP) Department, dated:05/05/2011 from
the claims from January 2014 to March 2015.
The General Manager, District Industries
Centre, YSR Kadapa District has recommended the claim
application for sanction of reimbursement of power cost
for the period of 1st quarter of 2015-16. The same has
been placed before Scrutiny/Verification Committee
(SVC) meeting held on 12/02/2016 and the decision of
SVC is as follows:
“SVC scrutinised in detailed and observed that
the earlier claims from January 2014 to March
2015 were processed and sanctioned @Rs.1/- per
unit by erroneously instead of pegging down the
eligibility to the base price at prevailing power
rate. The same was verified with G.O.Ms. No.26
Industries & Commerce (Tex) Department,
Dated:12/01/2012 wherein the fixed cost
reimbursement of Rs.1/- per unit is only for new
unit commencing under IIPP 2010-15.
SVC verified the claim application in detailed
and recommended for sanction of
Rs.6,03,60,918/- (Rupees Six Crores Three Lakhs
Sixty Thousand Nine Hundred and Eighteen
only) towards power cost reimbursement for the
period of 1st quarter of 2015-16 and difference
amount in previous period from January 2014 to
March 2015 under IIPP 2005-10 duly placing
before SLC as a detailed Agenda Item, subject
to submission of the following shortfall
information.”
1. Reasons for increase power load in KVA from
2500 to 10500 KVA and clarification on connected
load in HP/KW.
2. Valid CFO from APPCB.
3. CA certificate indicating share holding
particulars.
4. DTCP approved plan
5. Form B Self Declaration is not properly filled

Limited, Chikkavaram, Gannavaram Mandal
Krishna District- Sanction of reimbursement of
Power Cost based Government Memo - Regarding.
M/s. Usha Spincoat Pvt. Limited,
Chikkavaram, Gannavaram Mandal Krishna District
has approached the Govt., to consider the unit under
IIPP-2005-10 by condoning the delay of 9 months
and 4 days for commencement of commercial
production. The request is placed in the SLC 96th
held on 01.03.2013 and request of the unit is
recommended to Govt., for consideration for
extending the incentives under IIPP-2005-10.
In this context, the Govt requested the
Commissioner of Industries to provide incentives
under IIPP-2005-10 to M/s. Usha Spincoat Pvt.
Limited, Chikkavaram, Gannavaram Mandal
Krishna District. Duly condoning the delay of 9
months and 4 days in commencement of commercial
production on 04.04.2011 vide Memo No. 4850/IP
& INF/A1/2014-5, Dated 16.12.2014 Industries &
Commerce (IP & INF) Department.
“5th
State Leve Committee held on
23.12.2014 discussed the issue on the orders issued
by Government, vide Memo No. 4850/IP &
INF/A1/2014-5, Dated 16.12.2014 Industries &
Commerce (IP & INF) Department and sanctioned
differential amount of Rs. 3,29,49,250/- towards
reimbursement of power cost pertaining to 11
quarters from April 2011 to September 2014 and
further decided to refer to the Government for taking
a decision in respect of 3rd
quarter of 2012-13, 1st
and 3rd
quarter of 2013-14 claims for sanction of
reimbursement of power cost which are filed under
IIPP 2010-15 policy and become belated due to
coverage of the unit under IIPP 2005-2010.”
Subsequently the claim application for the
sanction of power cost reimbursement of M/S.
SLC deferred the issue to next meeting
requsting the members to go through the
contents of the agenda for taking a decision.

Usha Spincoat Pvt Ltd, Rs No: 341, Chikkavaram,
Gannavaram (M), Krishna Dist pertaining to 1st
quarter of 2015-16 under IIPP 2005-10 was placed
in the Scrutiny cum verification committee meeting
held on 12.01.2016 and decision of the SVC is as
follows.
“SVC opined that Government permission for
condonation of delay in filing claim
application and making the unit eligible for
availing the incentives under IIPP 2005-2010
vide Government Memo No. 4850/IP &
INF/A1/2014-5, Dated 16.12.2014 shall be
circulated to the State Level Committee for
perusal” 11 IIPP 2005-2010 – M/s Idupulapadu Cotton Mills Pvt
Ltd., Expansion 5 , Ganapavaram Village, Nadendla
mandal, Guntur District – sanction of power cost
reimbursement – revising the appraisal from January
2011 – regarding.
The General Manager, District Industries Centre,
Guntur District recommended the claim application for
the sanction of power cost reimbursement of M/s.
Idupulapadu Cotton Mils Pvt Ltd (Exp-5), Ganapavaram
(V), Nadendla (M), Guntur Dist pertaining to 4th quarter
of 2014-15 under IIPP 2005-10 and the same was
received in this office on 28.08.2015.
The claim for 4th quarter 2014-15 has been
placed before SVC meeting held on 12/02/2016 for
scrutinized and revised appraisal is prepared from the
