EXECUTIVE ORDER NO. _Oj_Series of 2017
"AN ORDER CONSTITUTING THE DAVAO CITY CHINATOWN DEVELOPMENTCOUNCIL EXECUTIVE COMMITTEE"
WHEREAS, Section 18 of Republic Act No. 7160, otherwise known as the "LocalGovernment Code of 1991," authorizes LGUs to establish an organization that shall beresponsible for the efficient and effective implementation of their development plans,programs, objectives and priorities;
WHEREAS, the City of Davao, recognizing the significant historical, cultural andeconomic contribution of the Chinese-Filipino community in the development of the city,created the Davao City Chinatown Development Council (Chinatown Council) throughCity Ordinance No. 0179-03 Series of 2003, on December 16, 2003, and later amendedby City Ordinance No. 0294-09 Series of 2009, approved on February 15, 2010;
WHEREAS, the Chinatown Council was primarily created to assist the CityGovernment of Davao in the formulation and implementation of policies, programs,projects and activities in the development of the declared Chinatown area as defined inthe aforementioned Ordinance;
WHEREAS, there is a need to identify the official members of the Councilincluding the newly appointed private sector representatives so that they can developgeneral directions for interaction among government agencies and stakeholders; createrelevant programs and projects and aid the legislative and executive branches in policy-formulation;
NOW THEREFORE, I, SARA Z. DUTERTE, Mayor of the City of Davao, byvirtue of the powers vested in me by law, do hereby order the following:
SECTION 1. CONSTITUTION. The DAVAO CITY CHINATOWNDEVELOPMENT COUNCIL EXECUTIVE COMMITTEE is hereby constituted and shallbe composed by the following persons and/or head of the following offices, to wit:
City Mayor as ChairpersonThe Sangguniang Panlungsod Chairperson on Committee on Tourism and
Beautification as Vice-ChairpersonOther Members:

The members of the Chinatown Council are hereby directed to name theirrespective permanent alternate representatives who shall take their place in case oftheir absence.
SECTION 2. FUNCTIONS AND RESPONSIBILITIES - Pursuant to theordinances Davao City Chinatown Development Council shall be tasked with thefollowing functions and responsibilities.
a. Plan, conceptualize and draft the Davao City Chinatown Development Plan inthe context of ensuring the sustainable development of Chinatown;
b. Identify the development goals, objectives, programs and projects of theChinatown Development Plan, and conduct feasibility studies;
c. Provide overall direction, coordination and supervision in the planning andimplementation of the Davao City Chinatown Development Plan,
d. Enlist the support of the different divisions, departments, branches andbureaus of the City of Davao, as well as the Non-Government Organizationsand other components of the private sector involved with the development ofChinatown;
e. Define and promulgate its Implementing Rules and Regulations for theeffective administration of its internal operations; and
f. Conduct itself and its operations in a manner consistent with national andlocal laws, as well as the policies and programs of the City Government ofDavao.
SECTION 3. OPERATING EXPENSES. -The Chinatown Council shall be self-sustaining, its overhead expenditures covered by its own funds which may be sourcedfrom private foundations, non-government organizations and other similarorganizations.
SECTION 4. SEPARABILITY CLAUSE. If any provision of this Executive Orderis declared invalid or unconstitutional, the other provisions not affected thereby shallremain valid and subsisting.
SECTION 5. REPEALING CLAUSE - All orders or parts thereof which areinconsistent with the provisions of this Executive Order are hereby repealed or modifiedaccordingly.
SECTION 6. EFFECTIVITY - This Executive Order shall take effect immediately.
