    The 2016 Regular Legislative Session

    adjourned sine dieat 6:00 p.m., June 6, and

    thirty minutes later, House Speaker Taylor

    Barras brought the gavel down again toconvene the 2016 Second Extraordinary

    Session.

    A total of 2,211 bills were introduced

    during the regular session. Six hundred

    seventy-six bills were sent to the governor and

    to date, he has signed 398into law.

    The governor has submitted a 48-item

    call to be considered during the 18 calendar

    day special session that will end June 23.

    A brief description of some of the bills

    that generated public interest during theregular session follows.

    APPROPRIATIONS

    * House Resolution 231, adopted by the

    House 89-6, directs the state treasurer to

    allocate money deposited into the state

    treasury from constitutional and statutory

    dedications that flow through the Bond

    Security and Redemption Fund for the

    purpose of paying state debt, and allows for

    approximately $74 million to be allocated for

    debt service payments.

    * House Bill 1, which has completed the

    legislative process, provides for the ordinary

    operating expenses of state government.

    * House Bill 409, which has completed

    the legislative process, provides for the

    transfer, deposit, and use of monies among

    state funds

    * House Bill 454, which has been sent to

    the governor, reduces the cost thresholdrequiring report, review and approval for

    professional, personal and consulting

    contracts from $40,000 or more per year to

    $25,000 or more per year and applies this

    process to all contracts regardless of means of

    f inance and/or d i scre t ionary or

    nondiscretionary status.

    * House Bill 603, a proposed

    constitutional amendment to be submitted to

    voters at the statewide election held on

    November 8, 2016, creates the RevenueStabilization Trust Fund as a special treasury

    trust fund, deposits into the fund mineral

    revenues and corporate tax revenues, and

    dedicates other mineral revenue to repayment

    of the unfunded accrued liability of the state's

    retirement systems.

    * House Bill 1047, which has completed

    the legislative process, appropriates

    supplemental funding and provides for means

    of financing substitutions and other budgetary

    adjustments for the operation of various

    departments for Fiscal Year 2015-16.

    * Senate Bill 201, a proposed

    constitutional amendment to be submitted to

    voters at the statewide election held on

    November 8, 2016, provides for the reduction

    of constitutionally protected expenditures and

    dedications to eliminate a projected deficit in

    an ensuing fiscal year.

    * Senate Bill 177, which has been sent to

    the governor, requires the state treasurer to

    submit an annual report to the Joint

    Legislative Committee on the Budgetregarding the status of fund transfers

    authorized to eliminate budget deficits for the

    prior fiscal year.

    * Senate Bill 443,which has been sent to

    the governor, provides for mandatory

    meetings of the Health and Social Services

    Estimating Conference for purposes of

    developing budget recommendations for the

    Medicaid program.

    AGRICULTURE* House Bill 335, which has been sent to

    the governor, establishes a registration fee of

    $500 and a licensing fee of $50 for unmanned

    aerial drones.

    * House Bill 336, Act 220, adds the

    origin of certain foods and shellfish to the list

    of items that may not be misrepresented when

    offered for sale to consumers.

    * House Bill 569, Act 256, removes

    references to sections of the Federal Meat

    Inspection Act and the Federal ProductsInspection Act that have been repealed and

    removes the East Baton Rouge Parish Health

    Unit from the meat inspection program.

    Additionally, HB569 designates the

    Louisiana Commissioner of Agriculture as the

    state's authority to enter into cooperative

    efforts with the U.S. Secretary of Agriculture.

    * House Bill 1099, which has been sent

    to the governor, provides oversight to the

    Department of Agriculture and Forestry for

    the production of marijuana for therapeutic

    use and requires the department to collect all

    fees associated with the license to fund

    expenses associated with the regulation of

    therapeutic marijuana.

    CIVIL LAW

    * House Bill 459, which has been sent to

    the Secretary of State, (a proposed

    constitutional amendment) provides that the

    manner of appointment of registrars of voters

    is as provided by law and requires thequalifications of the registrars to be provided

    by law.

    * House Bill 505, a proposed

    constitutional amendment to be submitted to

    voters at the statewide election held on

    November 8, 2016, authorizes an exemption

    from ad valorem property tax for the total

    assessed value of the homestead of an

    unmarried surviving spouse of a person who

    died while on active duty as a member of the

    armed forces of the United States or theLouisiana National Guard, or while

    performing their duties as a state police, law

    enforcement, or fire protection officer.

    COMMERCE

    * House Concurrent Resolution 37,

    which was sent to the Secretary of State,

    provides for the promotion of trade between

    Louisiana and Cuba.

    * House Bill 678, which has completed

    the legislative process, authorizes anassessment of a surcharge fee on prepaid 911

    services.

    * House Bill 1015, Act 157, redesignates

    rule-making authority from the Department of

    Health and Hospitals to the state fire marshal

    to conduct reviews for plans or specifications

    of a facility licensed, certified or seeking

    licensure or certification.

    * Senate Bill 338, which has been sent to

    the governor, provides for the protection of

    vulnerable adults from financial exploitation.

    * Senate Bill 251, pending gubernatorial

    approval, prohibits certain Wi-Fi "hotspot"

    blocking.

    person having served fifteen years in custody.

    * Senate Bill 70, Act 267, prohibits sex

    offenders from soliciting business door to

    door.

    * Senate Bill 90, Act 269, expands the

    crime of human trafficking to provide that itshall also be unlawful for any person to

    knowingly recruit, harbor, transport, provide,

    solicit, sell, purchase, receive, isolate, entice,

    obtain, or maintain the use of a person under

    the age of 21years for the purpose of engaging

    in commercial sexual activity regardless of

    whether the person was recruited, harbored,

    transported, provided, solicited, sold,

    purchased, received, isolated, enticed,

    obtained, or maintained through fraud, force,

    or coercion.* Senate Bill 326, Act 302, requires the

    Department of Children and Family Services

    to submit a report annually to the Legislature

    that provides certain child-specific

    information regarding reports of child abuse

    or neglect reported to the department.

    SB326 is named the Alfred C.

    Williams Child Protection Act in honor of

    former state Rep. Alfred Williams who served

    in the Legislature for House District 61 until

    his death in August 2015.

    EDUCATION

    * House Resolution 237, which was

    adopted by the House, recognizes the

    authority of public post-secondary education

    management boards to establish student

    admissions criteria.

    * House Bill 97, Act 234, requires the

    posting of the state child abuse hotline number

    in all public schools.

    * House Bill 401, which is pending the

    governor's signature, requires public

    elementary or secondary schools to offer

    instruction in personal financial management.

    * House Bill 830, pending executive

    approval, authorizes the Department of

    Education, rather than the owner or operator

    of an early learning center, to request criminal

    history information on employees and

    volunteers of early learning centers.

    * House Bill 887, which has completedthe legislative process, creates a pilot

    residential school for at-risk students in East

    Baton Rouge Parish.

    * House Bill 940, Act 401, requires that

    student identification cards issued by public

    post-secondary education institutions contain

    the elements required for voting purposes.

    * House Bill 1156, which has been sent

    to the governor, authorizes an added exception

    to present law that applies to a limited

    situation in which a reduction of teachersalaries is authorized.

    * Senate Bill 80, a proposed

    constitutional amendment to be submitted to

    voters at the statewide election held on

    November 8, 2016, authorizes post-secondary

    education management boards to establish the

    tuition and fee amounts charged by

    institutions under their supervision and

    management, without legislative approval.

    * Senate Bill 174, Act 18, provides that

    if tuition is raised next year, TOPS recipientswill have to pay for the difference out of

    pocket.

    * Senate Bill 260, which has been sent to

    the governor, eliminates local charter

    authorizers from the definition of "chartering

    authority" and removes the authority of local

    charter authorizers to enter into charters, thus

    providing that only local school boards and

    BESE have this authority.

    * Senate Bill 275, which has been sent to

    the governor, requires that cursive writing be

    taught in all public and charter schools. The

    bill was amended to delay the implementation

    of SB275 until July 1, 2017.

    * Senate Bill 303, which has been sent to

    the governor, provides for Office of Juvenile

    Justice schools to be included in the state

    school and district accountability program and

    provides for specific criteria and timelines for

    the purpose of providing education services to

    youthful offenders.* Senate Bill 317,which has been sent to

    the governor, creates the Advisory Council on

    Student Behavior and Discipline to provide

    advice and guidance to the State Board of

    Elementary and Secondary Education and the

    state Department of Education and provides

    for the use of seclusion and physical restraint

    to address the discipline of students with

    exceptionalities in schools systems that have

    complied with prescribed reporting

    requirements.* Senate Bill 329, Act 388, increases the

    GPA requirements for TOPS students to

    receive extra stipends.

    * Senate Bill 470, pending the

    governor's signature, provides that if the state

    fails to fully fund TOPS, students who meet

    the minimum qualifications would get a

    portion of TOPS, but no one would get full

    tuition.

    HEALTH

    * House Resolution 173, adopted by the

    House, urges the Department of Health and

    Hospitals not to establish freestanding

    emergency departments as a type of licensed

    facility.

    * House Concurrent Resolution 94,

    which has been sent to the Secretary of State,

    extends the Task Force on Youth Aging Out

    of Foster Care.

    * House Concurrent Resolution 107,

    which has completed the legislative process,

    authorizes and directs the Department of

    Children and Family Services to convene a

    consortium of emergency care facilities

    designated in the Safe Haven Law and create

    and maintain a registry of such facilities.

    * House Concurrent Resolution 108,

    which has completed the legislative process,

    requests the Department of Health and

    Hospitals to create a Medicaid transformation

    plan and to convene a task force to advise thedepartment of the plan's development.

    * House Concurrent Resolution 110,

    adopted in House concurrence, requests the

    Department of Wildlife and Fisheries and the

    Department of Natural Resources to study

    water use from natural and scenic rivers.

    * House Concurrent Resolution 112,

    which has completed the legislative process,

    requests a study of appropriate mental health

    and behavioral health treatment systems in the

    capital region.* House Concurrent Resolution 115,

    which has completed the legislative process,

    urges and requests the Office of Conservation

    to study the effects of ground water

    withdrawals from the Southern Hills Aquifer

    System.

    * House Bill 123, which has been sent to

    the governor, requires high schools to keep

    automated external defibrillators on their

    premises.

    * House Bill 237, Act 84, establishesand provides for an official Safe Haven

    symbol to identify emergency care facilities

    designated in the Safe Haven Law.

    * House Bill 386, Act 97, extends the

    mandatory waiting period between certain

    required pre-abortion procedures and the

    performance of an abortion to at least 72

    hours.

    * House Bill 557, which has been sent to

    the governor, provides for the licensing of

    acupuncturists.

    * House Bill 606, Act 304, prohibits

    entities that perform abortions from receiving

    public funding.

    * House Bill 815, which has completed

    the legislative process, prohibits post-abortion

    harvesting of fetal remains and requires burial

    or cremation of such remains.

    * House Bill 792, which has completed

    the legislature, provides for the licensure and

    regulation of massage therapists.* House Bill 922, pending the governor's

    approval, changes the maximum provider fee

    amount for nursing homes from $10 per

    occupied bed per day to the percentage of net

    patient service revenues permitted by federal

    regulations to a fee increase by an additional

    $1.80 to $11.80 per bed per day.

    This measure will generate

    approximately $16.9 million more in statutory

    dedication revenue in FY 2017 used to draw

    down federal matching funds.* House Bill 1157, pending the

    governor's approval, provides for the

    Medicaid recovery audit contractor program

    and authorizes the Department of Health and

    Hospitals to enter into contracts to establish a

    standardized recovery audit contractor

    program to identify and correct improper

    Medicaid payments made to Medicare

    recipients.

    * Senate Bill 131, pending the

    governor's signature, provides that anindividual's cost for pharmacy services shall

    not be greater than the amount that would be

    paid by all other payment sources for such

    services.

    * Senate Bill 180, Act 343, provides

    exemption from prosecution for anyone

    lawfully in possession of medical marijuana.

    * Senate Bill 230, which has completed

    the legislative process, increases the capacity

    of the Health Education Authority of

    Louisiana (HEAL) to obtain funds to defray

    costs of the acquisition of land, acquisition or

    construction of buildings structures and other

    facilities through the incurring of debt and

    issuance of bonds, notes and other evidence of

    indebtedness for an amount not in excess of

    $800 million.

    SB230 additionally transfers HEAL to

    the Officer of the Governor.

    * Senate Bill 271, Act 96, amends

    current law related to medical marijuana.SB271 provides for medical marijuana

    to be recommended by a physician who is

    licensed by the Louisiana Board of Medical

    Examiners, domiciled in Louisiana, and in

    good standing with the board.

    SB271 expands the list of conditions

    that can be treated with medical marijuana.

    SB271 provides for the language

    change from "prescribed" to recommended

    as in "recommended or recommendation of

    marijuana for therapeutic use," which isanticipated to legally allow physicians to

    instruct applicable pharmacies to dispense

    medical marijuana.

    SB271 clarifies that LSU AgCenter

    and SU AgCenter have right of first refusal,

    shall have separate licenses and need to make

    determination of their intent to be licensed as

    a production facility, either separately or

    jointly by September 1, 2016.

    Also, SB271 grants authority to the

    Department of Agriculture and Forestry toobtain state and national criminal background

    information on applicants seeking to be

    producers of medical marijuana.

    * Senate Bill 291, Act 396, which has

    completed the legislative process, provides for

    patient access to physical therapy without a

    prescription or referral from a physician.

    * Senate Bill 360, has been sent to the

    governor, makes technical changes to the

    statutory requirements for the Louisiana

    Physician Order for Scope of Treatment and

    specifies that LaPOST complements an

    Advance Directive and is not intended to

    replace that document.

    * Senate Bill 376, Act 351, creates the

    Louisiana Family Caregiver Act.

    HOUSE AND GOVERNMENTAL

    House Concurrent Resolution 88,

    which has completed the legislative process,

    requests parish governing authorities to workwith higher education institutions to establish

    on-campus polling places.

    * House Concurrent Resolution 100,

    which has completed the legislative process,

    requests the Metro Council of East Baton

    Rouge Parish to work with LSU to consolidate

    polling places on campus to one central on-

    campus location.

    * House Bill 459, a proposed

    constitutional amendment to be submitted to

    voters at the statewide election held onNovember 8, 2016, provides that the manner

    of appointment for registrar of voters in each

    parish and requires the qualifications of the

    registrar to be provided by law.

    * House Bill 1102, which has been sent

    to the governor, prohibits genetic gestational

    carrier contracts and certain gestational carrier

    contracts, provides for the enforcement of

    gestational carrier contracts, and provides for

    data collection of certain information relative

    to gestational carrier contracts.* Senate Bill 398, which has been sent to

    the governor, exempts video or audio

    recordings generated by law enforcement

    body-worn cameras from the Public Records

    Law, but provides that body-worn camera

    recordings that are determined by the

    custodian to violate an individual's reasonable

    expectation shall be disclosed upon a

    determination and order from a court of

    competent jurisdiction.

    INSURANCE

    * House Bill 746, Act 312, provides for

    licensing and regulation of insurance

    consultants by the commissioner of insurance

    and requires the commissioner to develop

    written examinations for these consultants to

    pass within the 75th percentile or to contract

    the exam and require the applicants to pay for

    exam expenses.

    * House Bill 798, Act 258, creates alimited lines license to sell property insurance

    for property self-stored in a self-storage

    facility.

    JUDICIARY

    * House Bill 68, pending the governor's

    signature, authorizes the use of electronic

    signatures on temporary restraining and

    protective orders.

    * House Bill 304, Act 44, exempts

    veterans of the U.S. armed forces from all feesassociated with concealed handgun permits.

    * House Bill 539, pending the governor's

    signature, authorizes the use of human

    biological matter for the purpose of training

    cadaver dogs.

    * House Bill 600, pending the governor's

    signature, provides for the qualifications,

    salaries, and number of judgeships of the

    Municipal and Traffic Court of New Orleans,

    and provides for other changes to the

    consolidated court.* House Bill 1002, Act 402, authorizes

    certain honorably discharged active-duty

    military personnel and family to receive

    benefits through the Louisiana Military Family

    Assistance Fund.

    Additionally HB1002 defines

    'honorably discharged active-duty military

    personnel' to mean a person domiciled in

    Louisiana who was on full-time active duty in

    the military service of the U.S. and received

    an honorable discharge.

    * House Bill 1022, sent to the governor,

    provides that if a defendant successfully

    completes the Offender Rehabilitation and

    MUNICIPAL

    * House Concurrent Resolution 80, sent

    to the Secretary of State, establishes the

    Virtual Library Study Commission to conduct

    a study and make recommendations for the

    establishment of a statewide virtual library in

    Louisiana.

    * Senate Bill 277, which has been sent to

    the governor, requires Peace Officer Standards

    and Training program certification of the

    Department of Culture, Recreation andTourism security officers at state museums

    and provides for a Poverty Point State Historic

    Site Archaeologist.

    * Senate Bill 412, which is pending the

    governor's signature, provides for a special

    district within Donaldsonville and provides

    for tax increment finance authority.

    * Senate Bill 468, Act 395, prohibits

    strip clubs from employing persons under 21.

    NATURAL RESOURCES

    * House Bill 179, Act 7, adds "blaze

    pink" as an alternative to the "hunter orange"

    requirements of hunters during hunting

    season.

    * House Bill 188, Act 241, adds alligator

    in the Louisiana Catch and Cook program.

    * House Bill 464, which has completed

    the Legislature, increases three fees on

    pipeline inspections to meet the work needs

    associated with new federal requirements.

    * House Bill 465, Act 277, establishes a

    monthly fee of 2 per barrel of exploration

    and production waste delivered to be paid by

    the waste producer from certain facilities.

    Additionally, HB465 prohibits wastes

    from containing brine, produced water, or

    salvageable hydrocarbons.

    * House Bill 631, pending the

    governor's signature, authorizes the secretary

    of the Department of Environmental Quality

    to impose a delinquent fee of 10% of theunpaid fee or $25, whichever is greater, on

    any person failing to timely remit waste tire

    fees and a delinquent fee of $25 on anyone

    failing to timely submit a required monthly

    waste tire fee report.

    Additionally, HB631 adds all-terrain

    vehicle tires, utility-terrain vehicle tires and

    spare tires to the list of eligible waste tires.

    Proceeds from the collection of the

    fees shall be used for special waste tire

    projects. Any remaining proceeds at the endof the fiscal year shall be deposited in the

    Waste Tire Management Fund.

    * House Bill 632, which has completed

    the legislative process, provides for financial

    security requirements of certain drilling permit

    applicants.

    * House Bill 819, which has completed

    the legislative process, increases the balance

    in the Oilfield Site Restoration Fund and

    additionally requires $1 million from the Fund

    to be used to plug orphaned wells inShreveport and Monroe.

    * House Bill 900, which has been sent to

    the governor, authorizes the Department of

    Environmental Quality to increase ground-

    water, air, hazardous waste, solid waste,

    water, underground storage tanks and

    radiation fees by 10%.

    * House Bill 995, which has been sent to

    the governor, increases the safe drinking water

    administration fee.

    * Senate Bill 165, Act 342, requires

    landowner notification when an operator

    transfers an oil or gas well.

    * Senate Bill 257, which has been sent to

    the governor, provides that monies deposited

    Auditor to prepare, every five years,

    comparative summaries of each system's

    actuarial assumptions and funded ratio and the

    auditor's findings as to the appropriateness of

    each system's assumptions.

    * Senate Bill 2, Act 93, authorizes aone-time cost of living adjustment (COLA)

    effective July 1, 2016, to eligible retirees,

    survivors, and beneficiaries. The maximum

    COLA grant that may be given effective July

    1, 2016, will be increased to the amounts

    shown below subject to available funds in the

    Experience Accounts.

    1. For LASERS: a 1.5% COLA.

    2. For TRSL: a 1.5% COLA.

    3. For LSERS: a 2.0% COLA.

    4. For STPOL: a 2.0% COLA for all eligibleretirees plus an additional 2.0% COLA for

    those over age 65.

    * Senate Bill 5, Act 94, requires the

    retirement systems to timely pay

    administrative costs rather than roll them into

    the 30-year debt.

    * Senate Bill 18, Act 95, reduces the

    amortization period, paying off debt on a fixed

    schedule, from 30 years to 20 years on the

    first valuation date for which the funded ratio

    for LASERS is 70% or more. The applicablethresholds for TRSL, LSERS and STPOL are

    70%, 72%, and 70% respectively.

    * Senate Bill 277, which is pending the

    governor's signature, makes museum police

    officers and state park wardens eligible for the

    Hazardous Duty Retirement Plan.

    TRANSPORTATION

    * House Bill 245, Act 397, allows the

    Office of Motor Vehicles to enter into

    installment payment plan agreements for

    persons owing reinstatement fees of $250 or

    more.

    * House Bill 481, which has completed

    the legislative process, authorizes a licensee to

    have an electronic copy of their license

    provided by the Office of Motor Vehicles as

    an alternative to a physical license and allows

    persons to use the digitized license in lieu of

    a physical license when stopped by law

    enforcement.* House Bill 702, which is pending the

    governor's signature, provides for the issuance

    of REAL ID compliant driver's license or

    special identification cards.

    HB702 additionally prohibits the

    Department of Public Safety, Office of Motor

    Vehicles to exchange or access facial

    biometric data of Louisiana citizens obtained

    in the issuance or renewal of Louisiana

    drivers' licenses to the agencies, governments,

    or contractors of other states or nationswithout a warrant.

    * Senate Bill 91, pending the governor's

    signature, increases penalties for texting or

    using social media while driving to $500 for a

    first violation and $1,000 for each subsequent

    violation.

    Minors face a fine of $250 for a first

    violation and for each subsequent violation, a

    fine of $500 and a 60-day driver's license

    suspension.

    For a text messaging and socialnetworking violation in a school zone, the

    offender will be fined $500 and for each

    subsequent violation, a fine of $1,000

    including a 60-day driver's license suspension.

    SB91 also provides for the dispositions

    of fines, including $25 from all fines shall be

    distributed to the indigent defender fund of the

    judicial district in which the citation was

    issued.

    * Senate Bill 227, pending the

    governor's signature, allows a driver to choose

    a licence that meets the federal REAL ID

    requirements or one that does not.

    Additionally, SB227 prohibits the

    DMV from sharing any facial biometric data

    * Senate Bill 357, Act 348, requires

    notification or signs posted indicating that a

    red light camera is present.

    WAYS AND MEANS

    * House Bill 783, pending the governor's

    signature, moves the capital expenditure

    benefit authorization within the Quality Jobs

    Program statutes so that it is no longer linked

    to the Enterprise Zone statute.

    Additionally, the deadline for

    application approval is extended by six

    months to July 1, 2018.

    * House Bill 794, pending the governor'spen, moves the capital expenditure benefit

    authorization within the Competitive Projects

    Payroll Incentive Program statutes so that it is

    no longer linked to the Enterprise Zone

    statute.

    HB794 additionally extends the sunset

    provision by one year from July 1, 2017 to

    July 1, 2018.

    * House Bill 1121, which has been sent

    to the governor, establishes notification and

    reporting requirements relative to retail salesmade in Louisiana by remote retailers and

    provides for filing of annual statements by

    certain retailers concerning their sales in

    Louisiana, for implementation and

    enforcement.

    Teachers' Retirement System of Louisiana to

    purchase credit for service as a teacher at an

    * HB67, providing for the crime

    prohibiting possession or consumption of

    * HB122, providing relative to the sale

    of negotiable instruments and related rights.

    * HB162, prohibiting communication

    among a quorum of the members of a publicbody unless the communication is

    contemporaneously visible or audible to the

    public unless the public body is in an

    executive session authorized by law.

    * HB205, authorizing an automobile

    expense allowance for the assessor in

    Livingston Parish.

    * HB235, requiring the Joint Legislative

    Committee on Capital Outlay to approve line
