Career Progression (MACP) scheme and is hereby placed in the Pay Band-3 of Rs,

2. Financial Upgradation under the MACP Scheme granted to the above officers issubject to inter-alia, the following conditions;

The MACP Scheme contemplates merely placement on personal basis in theimmediate higher Grade Pay / Grant of financial benefits only and shall notamount to actual / functional promotion of the employees concerned. •

(I)

The residency period (regular service for grant of benefits under MACP Scheme,shall be counted from the grade in which an employee was appointed as DirectRecruit.

On grant of financial upgradation, there shall be no change in the designationclassification or higher status. However, financial and certain other benefitswhich are linked to the pay/ grade pay drawn by an employee such as HBA,allotment of Government accommodation shall be permitted.

Financial upgradation under the MACP Scheme shall be purely personal to theemployee and shall have no relevance to his / her seniority position. As such,there shall be no additional financial upgradation for the senior employees on theground that the junior employee in the grade has got higher pay / grade payunder the MACP Scheme

Benefit of pay fixation available at the time of regular promotion shall also beallowed at the time of financial upgradation under the MACP Scheme.Therefore, the pay shall be raised by 3% of the total pay in the pay band and thegrade pay drawn before such upgradation. There shall, however, be no furtherfixation of pay at the time of regular promotion if it is in the same grade pay asgranted under MACP Scheme.

With regard to fixation of this pay on grant of promotion / financial upgradationunder MACP Scheme, a Government servant has an option under FR 22(I)(a)(1)to get his pay fixed in the higher post / grade pay either from the date of hispromotion / upgradation or from the date of his next increment viz. 1 st ,July of theyear. The pay and the date of increment would be fixed in accordance withclarification no. 2 of Department of Expenditure's O.M. No.1/1/208-1C dated13.09.2008.

PayP drawn in the pay band and the grade pay allowed under the MACP Schemeshall be taken as the basis for determining the terminal benefits in respect of the •retiring employee.

The above order is based upon the assumption that the officer is not undersuspension and there is no vigilance / non-vigilance case pending against theofficer neither officer is undergoing penalty. Further, he / she is not undersuspension and not covered by any of the three conditions mentioned in DOPT,New Delhi's 0.M. No.22011 /04/91-Estt (A) dated 14.09.92. The concernedD.D.O.s may kindly ensure that this condition is satisfied before grant of 1\11ACP.In respect of officers, where this condition is not satisfied, the order is deemed tonot have been issued. Before granting MACP benefit, the period of suspension of officers if any, mayplease be excluded.

Financial upgradation has been allowed due to stagnation and the employeessubsequently refuse the promotion, it shall not be a ground to withdraw thefinancial upgradation. He shall, however, not be eligible to be considered forfurther financial upgradation till he agrees to be considered for promotion againand the next financial upgradation shall also be deferred to the extent of period ofdebarment due to the refusal.

Employees on deputation need not revert to the parent Department of availingthe benefit of financial upgradation under the MACPs. They may exercise a freshoption to draw the pay in the pay band and the grade pay of the post held bythem.

(xii) Option (exercisable within One month from the date of receipt of this .order) forfixation of pay in the higher-grade scale(s) based on the date of increment (i.e. lstJuly of the year) of the incumbent is also allowable. Such option once exercisedshall be treated as final.

4. Financial Upgradation under the MACP Scheme granted to the above officers issubject to inter-alia, the following conditions;

The MACP Scheme contemplates merely placement on personal basis in theimmediate higher Grade Pay / Grant of financial benefits . only and shall notamount to actual / functional promotion of the employees concerned.

The residency period (regular service for grant of benefits under MACP Schemeshall be counted from the grade in which an employee was appointed as DirectRecruit.

On grant of financial upgradation, there shall be no change in the designationclassification or higher status. However, financial and certain other benefitswhich are linked to the pay/ grade pay drawn by an employee such as HBA,allotment of Government accommodation shall be permitted.

Financial upgradation under the MACP Scheme shall be purely personal to theemployee and shall have no relevance to his / her seniority position. As such,there shall be no additional financial upgradation for the senior employees on theground that the junior employee in the grade has got higher pay / grade payunder the MACP Scheme

Benefit of •pay fixation available at the time of regular promotion shall also beallowed at the time of financial upgradation under the MACP Scheme.Therefore, the pay shall be raised by 3% of the total pay in the pay band and thegrade pay drawn before such upgradation. There shall, however, be no furtherfixation of pay at the time of regular promotion if it is in the same grade pay asgranted under MACP Scheme.

2. The said transfer will be effective from the date on which the above officer reports forduty and agrees to abide by all terms and conditions as laid down in Board's Instructions suchas:-

He/She will be placed below all the officers appointed/promoted regularly in thegrade of Havaldar on the date of his/her appointment on transfer basis in termsof Para 3.5 of DOP&T's O.M. dated 03.07.1986. In other words, he/she will bejunior to those regularly appointed/promoted officers prior to his/her transfer.However, such transferred officer will retain his/her eligibility of the parentCommissionerate for his/her promotion to the next higher grade, etc.

On transfer he/she will be not be considered for promotion in the oldCorn missionerate.He/She will not be entitled to any joining time & transfer travelling allowance.He/She is liable to be transferred/ posted anywhere within the jurisdiction ofCentral Excise, Customs and Service Tax, Vadodara — I/11 Commissionerate.
