The 2014 Regular Legislative Session has adjourned Sine Die. Speaker Kleckley thanks all members for their hard work and dedication to making the legislative process go as smoothly as possible. Overall, 1,969 bills were filed; 848 bills have been passed and adopted. The governor has signed 291 bills into law. A brief description of a few of the bills that generated public interest during this session follow. The bills are hyperlinked to the current posted version of the instrument. ABORTION House Bill 305 , which awaits the governor's pen, prohibits "abortion providers" from providing health education in public schools. * House Bill 1262 , which awaits gubernatorial consideration, requires patients seeking abortions to be provided information on emotional and psychological impacts and also information about coercion abuse and human trafficking. House Bill 1274, which awaits the governor's pen, requires physicians to provide life-sustaining procedures to a pregnant woman in order to preserve the life of her unborn child. AGRICULTURE * House Bill 878 (Act 205 ) removes the voting criteria and referendum vote for the imposition and extension of assessments on soybeans, wheat, corn and grain sorghum. * House Bill 119 (Act 27 ) prohibits livestock at large on Louisiana Highway 29 from Bunkie to Louisiana Highway 115. BUDGET/REVENUE * House Bill 1 , the $24.6 billion appropriations bill, which provides for the ordinary operating expenses of state government for Fiscal Year 2014-2015, has completed the legislative process. * House Bill 177 (Act 33 ) provides for the annual reporting of all professional, personal, consulting and social services contracts awarded without the necessity of competitive bidding or competitive negotiation. * House Bill 262 , which provides for ancillary expenses of state government, was sent to the governor's desk. ABORTIONHouse Bill 305, which awaits the

funds, has completed the legislative process.* House Bill 1095, which has been sentto the governor, appropriates funds to defraythe expenses of the Louisiana Judiciaryincluding the Supreme Court, Courts ofAppeal, District Courts, Criminal DistrictCourt of Orleans Parish and other courts.* House Bill 1096, which has completedthe legislative process, provides for the annualallocation and distribution of the state revenuesharing fund in the amount of $90,000,000,required by the Constitution, forFY2014-2015. * House Bill 1194, which was sent to thegovernor's desk, appropriates funds for theexpenses of the Louisiana Legislature for FY2014-2015.

CAPITAL OUTLAY* House Bill 2, which provides for thecomprehensive Capital Outlay budget, hascompleted the legislative process.

COMMERCE* House Bill 448 (Act 67) authorizes theLouisiana Cemetery Board to impose fines forcertain violations. * House Bill 771 (Act 88) requiresresigning trustees of a cemetery board to filefinancial reports within certain time limits.* House Bill 1048, which passed bothhouses of the legislature, requires theLouisiana State Uniform Construction CodeCouncil to adopt the International PlumbingCode, the International Building Code,Chapter 29-Plumbing Systems, and theInternational Residential Code, PartVII-Plumbing, instead of the LouisianaPlumbing Code.

CONSTITUTIONAL AMENDMENTS* House Bill 96 would remove themandatory retirement age of judges.* House Bill 111 would authorize thegoverning authority of Orleans Parish (City of

New Orleans) to increase millage rates for fireand police protection.* House Bill 488, which has completedthe legislative process, would authorize agentsof the tax collector to sell property fordelinquent taxes and requires the fee of theauthorized agent to be included within thecosts recoverable in the tax sale.* House Bill 489, which has completedthe legislative process, would authorize theCity of New Orleans to sell or donate certainproperty in the Lower Ninth Ward of the city.* House Bill 628, which has completedthe legislative process, would allow publicfunds to be used to capitalize a stateinfrastructure bank.

CRIMINAL JUSTICE* House Bill 196 (Act 37) allowshabitual offenders to be eligible to participatein a work release program during the last 12months of their terms if the offender hasobtained a low-risk level designation.* House Bill 210 (Act 153) changeseligibility criteria for medical parole.* House Bill 212 (Act 40) adds theS c h e d u l e I V c o m p o u n d s4-anilino-N-phenethyl-4-piperidine (ANPP) asan immediate precursor to fentanyl toSchedule II, adds Perampanel, Methasterone,and Prostanozol to Schedule III, and addsLorcaserin and Alfaxalone to the UniformControlled Dangerous Substances Law.* House Bill 229 (Act 43) adds fifteensubstances to the list of Schedule I of theUniform Controlled Dangerous SubstanceLaw.* House Bill 308 (Act 50) increases theterm of imprisonment for the crime ofaggravated flight from an officer.

House Bill 326 (Act 52) providesrelative to a district attorney's participation inparole hearings.* House Bill 330 (Act 53) authorizes theuse of electronic means for the delivery of an

order for protective custody and transportationto law enforcement.* House Bill 414 (Act 61) amendsresponsive verdicts for theft and attemptedtheft. * House Bill 417 (Act 62) creates thecrime of residential contractor fraud. * House Bill 752 (Act 17) expands thecrime of filing a false lien against a lawenforcement or court officer to include liensagainst any clerk of court, deputy clerk ofcourt and recorder of mortgages.* House Bill 732, which has been sent tothe governor, authorizes a waiver of minimummandatory sentences for felonies ormisdemeanor offenses that specify a sentencewith a minimum term of confinement orminimum fine. * House Bill 741 (Act 85) provides for acontradictory hearing for a motion towithdraw a guilty plea.* House Bill 743 (Act 86) provides formembership, voting procedures and proxies ofthe Louisiana Sentencing Commission.* House Bill 751 (Act 87) provides forthe reinstatement of good time credit incertain circumstances.* House Bill 1025 creates the crime ofunlawful purchase of commercial sexualactivity and sets forth penalties.* House Bill 1037, which has completedthe legislative process, adds criminal penaltiesfor second and subsequent convictions for aviolation of law regarding Peeping Toms.

1.) For a second conviction - a $750fine, six months imprisonment or both.

2.) For a third or subsequentconviction - a 1,000 fine, one yearimprisonment or both.

DOMESTIC VIOLENCE* House Bill 747 (Act 194) adds thecrime of “domestic abuse aggravated assault”to the enumerated list of crimes of violence.Additionally, HB747 requires the offender to

participate in a court-monitored domesticabuse intervention program.* House Bill 753 (Act 195), known asthe Pixie Geaux Act, provide for thepossession of firearms as it relates to personsconvicted of domestic abuse battery or subjectto a protective order.* House Bill 1052 creates the DomesticViolence Prevention Commission. * House Bill 1142 (Act 318), known asGwen's Law, provides for bail restrictions foroffenses committed against a family orhousehold member or dating partner.

EDUCATION/HIGHER ED/TOPS* House Bill 142 which has been sent tothe governor's desk, calls for a 10% reductionof all state professional, personal andconsulting service contracts and creates theHigher Education Financing Fund.* House Bill 1033, which has been sentto the governor's desk, creates the Workforceand Innovation for a Stronger Economy Fund(WISE) to fund degree and certificateproduction and research priorities in high-demand fields through programs offered byLouisiana's public post-secondary educationinstitutions.* House Bill 433 (Act 13) authorizes theBoard of Regents to enter into interstatereciprocity agreements related to onlineinstruction.* House Bill 953, which has completedthe legislative process, provides that the stateBoard of Elementary and SecondaryEducation (BESE) shall collect statewideresults from the assessments administered tostudents in the 2014-2015 and 2015-2016school years in order to define the basis forstudent achievement expectations to be usedin the school and district accountabilitysystem.

SCHOOLS* House Bill 1271, which has been sentto the governor, dedicates local sales andproperty tax revenue to provide for a facilitiespreservation program for the Recovery SchoolDistrict in New Orleans.* House Bill 144 (Act 28) authorizes theWest Baton Rouge Parish School Board toexchange immovable property includingsixteenth section lands.* House Bill 180 (Act 34) authorizesMontessori programs to extend through highschool.* House Bill 1016 (Act 99) provides forthe State Seal of Biliteracy to recognize highschool graduates who meet certain academiceligibility criteria relative to languageproficiency.* House Bill 1076, which has completedthe legislative process, prohibits local publicschools from collecting certain studentinformation without parental consent andprovides penalties for violations. Beginning June 1, 2015, schoolofficials shall not provide student informationto any school board, person, entity or agencywith exceptions for providing aggregated datausing a unique student identification numberfor reporting requirements; and for providingDepartment of Education information for thepurpose of satisfying state and federalassessments, auditing, funding, monitoring,and school and district accountabilityrequirements.* House Bill 1283, which has completedthe legislative process, requires theDepartment of Education to post on itswebsite, beginning Jan. 1, 2015, informationon the type and use of student data collected,profiles of authorized recipients and copies ofthe signed agreements with those recipients,department contact information and a processby which parents may register a complaintrelated to the unauthorized transfer of studentinformation.

ELECTIONS/VOTING* House Bill 193 (Act 152) provides thata person who is not affiliated with anypolitical party is designated as "independent"instead of "no party" on voter registrationrecords, a notice of candidacy and a ballot.* House Bill 226 (Act 42) removes therequirement to re-open qualifying when nocandidate qualified for an office or when thenumber of candidates who qualified for anoffice is less than the number of positions tobe filled.* House Bill 365 (Act 59) authorizes thesecretary of state to enter into certainagreements to share certain voter informationor data.* House Bill 383 (Act 60) makesmultiple technical changes to the electioncode.* House Bill 428 (Act 63) repealsprovisions of law that allow for a refund ofqualifying fees under certain circumstanceswhen a candidate files multiple notices ofcandidacy.* House Bill 432 (Act 64) re-creates theDepartment of State. * Senate Bill 208, which awaits thegovernor's signature, prohibits a public officerwho has been removed from office pursuant toa recall election from qualifying for the sameoffice at a special election to fill the position.

ENVIRONMENT/COAST* House Bill 1075 (Act 100) addscigarettes, cigarette butts, cigars, cigarillos,cigar or cigarillo tips to the definition of litter,and creates increased litter penalties asfollows:

1.) A first offense violation increasesfrom $250 to $300 and eight hours ofcommunity service in a litter abatementprogram.

2.) A second offense violationincreases from $500 to $700 with 16 hours ofcommunity service in a litter abatement

program.3.) Third and subsequent offense

violations increase from $1,250 to $1,500with 80 hours of community service in a litterabatement program and suspension of driver’slicense for one year.* Senate Bill 75, on its way to thegovernor's desk, requires the Department ofHealth and Hospitals to develop regulationsfor minimum chlorine levels for public andprivate waters systems in Louisiana.* Senate Bill 425, which has completedthe legislative process, requires private watersupply or sewer system companies to complywith health standards and regulations,including standards related to chlorination ofa private water supply or sewer system anddisinfection of waste water discharged incompliance with the sewer system company'spermit, rules, regulations and laws governingthe operation of the sewer system provider,and requires iron and manganese controls.

The provisions of SB425 shall apply topolitical subdivisions within a parish having apopulation of 200,000 to 230,000, accordingto the latest federal census.

SB425 further provides for penaltiesand remediation charges.

FIREARMS* House Bill 72 (Act 147) provides forthe possession of firearms by concealedhandgun permit holders and law enforcementofficers in certain alcoholic beverageestablishments.* House Bill 186 (Act 229) allowshunting game birds or wild quadrupeds with afirearm fitted with a sound suppressor.

House Bill 325 (Act 163) provides theuse of force or violence as justifiable when itis used to prevent a person from unlawfullyentering a home, business or motor vehicle. It also allows the use of force orviolence to compel an intruder to leave oncehe has entered.

House Bill 753 (Act 195) creates thecrime of possession of a firearm or carrying ofa concealed weapon by a person convicted ofdomestic abuse battery.* House Bill 1066 (Act 221) providesfor qualifications for concealed handgunpermits.* Senate Bill 651, which has completedthe legislative process, allows members of theLegislature to carry concealed weaponsanywhere a peace officer can, provided thelegislator is Peace Officer Standards andTraining-qualified annually in the use offirearms, and has proof of such certificationand has valid identification showing proof ofstatus as a legislator.

HEALTH/HOSPITALS* House Bill 513 (Act 72) requires theDepartment of Health and Hospitals top r o v i d e i n f o rm a t i o n c o n c e r n i n gvelocardiofacial syndrome and 22q11.2deletion syndrome to each early interventionservices provider in the state.* House Bill 833 (Act 93) creates theAchieving a Better Life Experience (ABLE)account for financing certain qualifiedexpenses of persons with disabilities.* House Bill 1062, which has completedthe legislative process, creates the 12-memberSupplemental Nutrition Assistance Program(SNAP) Task Force to study and makerecommendations to the Department ofChildren and Family Services concerning theelectronic issuance of SNAP benefits.* House Bill 1176 provides restrictionson the use of cash assistance benefitselectronic transfer cards issued through theFamily Independence Temporary Assistanceand the Kinship Care Subsidy Programs.* Senate Concurrent Resolution 48,which has completed the legislative process,expresses the legislative approval of andsupport to the Board of Supervisors of LSUfor the strategic collaboration with the state

related to the closure of Huey P. LongMedical Center to facilitate a new model ofhealth care delivery in the Alexandria andPineville area.

INSURANCE* House Bill 23 (Act 142) providesrelative to expenses and funds of theMunicipal Employees’ Retirement System.* House Bill 39 (Act 143) provides forthe Back-Deferred Retirement Option Plan inthe Louisiana Assessors' Retirement Fund.* House Bill 61 (Act 146) makeschanges to the Livingston Parish RetiredEmployees’ Insurance Fund.* House Bill 286 (Act 47) requires lifeinsurers to notify insureds relative to theconversion option.* House Bill 476 (Act 70) provides forthe denial, non-renewal or revocation of aninsurance producer license.* House Bill 660 (Act 82) provides forproperty residual value insurers.* House Bill 721 (Act 83) providesrelative to continuing education requirements.* House Bill 796 (Act 90) makesmembership changes to Louisiana Health CareCommission.* House Bill 820 (Act 91) provides thatvalued policy clause provisions apply to allpolicies providing fire coverage.* Senate Bill 682, which has completedthe legislative process, requires the state toseek available federal funds to create a statehealth insurance program for individuals withpre-existing conditions and low incomeindividuals.

JUDICIARY/CIVIL LAW* House Bill 16 (Act 7) authorizes the15th Judicial District Court to provide for are-entry division of court.* House Bill 46 (Act 144) requiresjudges to sign and print their names on alljudgments.

* House Bill 102 (Act 26) removes thetitle "A Mentally Retarded Person" from thetitle of proceedings for continuing tutorships.* House Bill 131 (Act 4) authorizespayment of witness fees to retired lawenforcement officers or former lawenforcement officers in certain cases.* House Bill 156 (Act 30) provides forthe transfer and deposit of surplus monies inspecial funds of each parish within theTwenty-First Judicial District to theTwenty-First Judicial District Court's criminalcourt fund.* House Bill 218 (Act 41) allows courtsto hold expedited hearings necessary to makedeclaratory judgments determining theconstitutionality of expenditures.* House Bill 345 (Act 57) defines abroker who may solicit, receive, or transmitorders for beverages with alcohol contentgreater than 6% and creates a permit forbrokers.* House Bill 346 (Act 12) prohibits thetransfer of tobacco permits for certain legalentities and provides for notificationrequirements.* House Bill 460 (Act 69) provides forthe delivery of official correspondence fromthe commissioner of alcohol and tobaccocontrol.* House Bill 480 (Act 71) designates"Louisiana Collector Car Appreciation"weekend the second weekend in July.* House Bill 544 (Act 74) providespenalties for fire prevention interference. * House Bill 752 (Act 17) expands thecrime of filing a false lien against a lawenforcement or court officer to include liensagainst any clerk of court, deputy clerk ofcourt and recorder of mortgages.* House Bill 830 (Act 18) providesrelative to size limitations on containers ofbeverages of high alcoholic content.* House Bill 1206, which has completedthe legislative process, provides for the

consolidation of the New Orleans Traffic andMunicipal Courts.

LABOR* House Bill 164 (Act 32) re-creates theLouisiana Workforce Commission.* House Bill 206 (Act 39) re-creates theDepartment of State Civil Service.

MUNICIPAL* House Bill 201 (Act 38) providesrelative to the powers granted to the mayor protempore in a Lawrason Act municipality. * House Bill 238 (Act 44) provides thatthe position of assistant chief of police inPlaquemine shall be in the unclassifiedservice.* House Bill 253 (Act 155) authorizesthe St. Tammany governing authority to createa geographic information system district.* House Bill 361 (Act 54) provides forthe authority to transfer or lease certain stateproperty in St. Mary Parish.* House Bill 456 (Act 68) provides thatthe position of police chief for the City ofCovington is in the unclassified service.* House Bill 518 (Act 73) provides forthe transfer of certain state property in St.Martin Parish.* House Bill 576 (Act 77) exemptsMandeville from certain laws regarding wagesand hours of police officers.* House Bill 579 (Act 78) grants thegoverning authority of the city of Sulphur thepower to grant certain powers and duties tothe city's zoning commission.* House Bill 642 (Act 79) authorizes anincrease in court costs for the OberlinMunicipal Court.* House Bill 728 (Act 84) provides forthe transfer of certain sixteenth section land inOuachita Parish.* House Bill 784 (Act 89) provides forthe exhibition of a ship by the Kenner NavalMuseum.

* House Bill 918 (Act 97) authorizesredevelopment authorities to create publicbenefit corporations and their powers andduties.

NATURAL RESOURCES* House Bill 297 (Act 48) addselectronic funds transfer to the list ofacceptable methods of payment for minerallease bids on state lands.* House Bill 447 (Act 66) prohibitswaterskiing on a portion of Lake Louie.

REAL ID* House Bill 907 , which has completedthe legislative process, provides for REAL ID-compliant drivers licenses and specialidentification cards.

RETIREMENT* House Bill 27, which has been sent tothe governor, makes substantial changes to theDeferred Retirement Option Plan for membersof the Firefighters’ Pension and Relief Fund inthe City of New Orleans.* House Bill 42 (Act 23) provides forfunds remaining in the La. School Employees’Retirement System’s Experience Account,after payment of a permanent benefit increaseto eligible retirees and beneficiaries, be usedto offset specified debt of the system.* House Bill 77, which has been sent tothe governor, provides for the conversion ofunused leave to service credit in theFirefighters' Retirement System.* House Bill 94, which has completedthe legislative process, provides for retirementbenefits provisions that apply only to NewOrleans firefighters first employed on or afterJanuary 1, 2015. * The governor has signed House Bill1225, which give retirees a cost of livingadjustment and makes changes to the fourstate retirement systems to make themfinancially stable for future retirees.

* House Bill 1278, which has completedthe legislative process, would merge theHarbor Police Retirement System into theLouisiana Employees’ Retirement System andprovides for the enrollment of new hires of theHarbor Police in the Hazardous Duty ServicesPlan.

SEX OFFENDERS* House Bill 885, which has been sent tothe governor, provides for the procedure todetermine a convicted sex offender's or childpredator's registration and notification periodend date.

TAXES* House Bill 97 (Act 24) provides for asales and use tax for the Union Parish SchoolBoard.* House Bill 162 (Act 31) creates anincome tax checkoff for The Louisiana YouthLeadership Seminar Corporation, also knownas Hugh O'Brian Youth Leadership.

TAX AMNESTY* House Bill 663, which has completedthe legislative process, authorizes installmentagreements for the payment of delinquenttaxes, interest, penalties and fees for which ataxpayer applies for amnesty.

The proposed law changes the waiverof the penalties and interest for the 2014 and2015 amnesty programs

TAX EXEMPTIONS/INCENTIVEEXPENDITURES* Senate Bill 543, which has been sent tothe governor, requires specified incentiveexpenditures to be forecast by the RevenueEstimating Conference (REC) separately fromthe forecasts of revenue available forappropriation, and requires these expenditureforecasts to be stated in the executive budgetand appropriation bills, beginning Fiscal Year2016.

TRANSPORTATION/PUBLIC SAFETY* House Bill 9 (Act 21) provides forliability for damages caused by an excludeddriver.* House Bill 136 (Act 150) creates theFlyway Byway and the Creole Nature TrailAll-American roadway.* House Bill 257 (Act 46) creates the"Louisiana Golf Association" special prestigelicense plate. * House Bill 284 (Act 9) recreates theDepartment of Transportation andDevelopment.* House Bill 303 (Act 49) provides forthe size of front and rear overhang for trucksand trailers hauling heavy equipment. * House Bill 304 (Act 10) creates the"Louisiana Cattlemen's Association" specialprestige license plate.* House Bill 317 (Act 51) creates the"U.S. Army Ranger" military honor licenseplate* House Bill 323 (Act 11) creates the"Down Syndrome Awareness" special prestigelicense plate.* House Bill 450 (Act 16) designates aportion of La. VETERANS* House Bill 11 (Act 22) designates theseventh day of August as "Purple HeartRecognition Day."* House Bill 344 (Act 56) provides thatany resident of Louisiana who is the survivingspouse of a member of the U.S. ArmedForces, the Louisiana Army National Guard orthe Louisiana Air National Guard who waskilled while in action in a combat zone shallbe issued all hunting licenses and permits fora total fee of $2.50 and recreational and

saltwater fishing license for a total fee of$2.50.* The governor has signed House Bill654 (Act 252), which expands provisions torights and procedures relative to thetermination of residential leases for militarypersonnel and their spouses.* House Bill 1072 (Act 222) providesfor the issuance of a retired military huntingand fishing license to a person who is a retiredmember of the United States Armed Forces,the Louisiana Army National Guard or theLouisiana Air National Guard and was eitherborn in Louisiana or is a bona fide Louisianaresident.* House Bill 1128, which has been sentto the governor's desk, authorizes highereducation employees who are veterans to takepaid leave on Veterans' Day to attendVeteran's Day activities.* Senate Bill 538 (Act 312) establishesa voluntary registry for veterans who wereexposed to open-air burn pits and provides foraccess to treatment

WILDLIFE AND FISHERIES* House Bill 241 (Act 8) makes atechnical correction to remove the effectivedate reference contained in the ballot languagefor the proposed constitutional amendmentthat would specify certain geographicalqualifications for members of the Wildlife andFisheries Commission.* House Bill 440 (Act 14) provides forthe size and configuration of shrimpingskimmer nets.* House Bill 1046 (Act 217) requires allshucked oysters to be labeled and packaged asrequired under the National ShellfishSanitation Program and the National Instituteof Standards and Technology. Further,HB1046 requires that all licensed oystercaptains, harvesters and certi fiedwholesale/retail dealers of shell stock andshucked oyster products verify that oysters

being sold are in compliance with thesestandards.
