A Letter from the General Manager

The State of the Association

Thank you for the warm and enthusiastic welcome since my ar-rival to the Lake Linganore Community in December of 2012. My family and I are overwhelmed by the kindness of the great people in this beautiful community. Lake Linganore has proven to be a rewarding environment to me – both professionally & personally. We have accomplished some monumental tasks in the last eight months and are excited about working on the future developments yet to come.

Association OperationsOf late, infrastructure has been at the forefront of operational pri-orities. We had a sinkhole on Eaglehead Drive which was unfor-tunate and unforeseen; but, nevertheless, we had to deal with it and repair and replace the culvert pipe across Eaglehead Drive. In lock-step with the repairs on Eaglehead Drive, we also addressed the necessary repairs to damaged roads in Pinehurst.

As of September 2013, we are nearing completion of our planned paving on Pinehurst Drive and Twin Lakes Drive. We commend Pinehurst residents for their patience throughout the CDA pro-cess. We have identified storm-water management issues in Pine-hurst during the paving project and we will be working to address these concerns during the Fall of 2013.

LLA—Developer: Memorandum of Understanding (MOU)Setting the tone and vision this year was the critical and histor-ic Memorandum of Understanding (MOU) that was signed and executed by the Association with the Developer. This MOU was recorded in Frederick County and is binding upon the current Developer (Oakdale Investments LLC) and any future developers. This MOU will add some $10 - $11 million dollars directly to the Association’s amenities and infrastructure over the next 20 – 25 years.

The MOU included several parcels of land which will be donated to the Association by Oakdale Investments. One parcel includes approximately 20 acres and will be used to set up a dredging site

for Lake Linganore. This parcel, upon completion of the dredging operations, could provide the Association with additional amenity areas such as sports fields and a dog park, as well as, picnic areas and potentially a marina. Another tract of land is on Northshore Drive and is over two acres. This parcel borders the lake and could serve multiple uses. This land could serve as a marina, additional beach, or perhaps provide marina parking and a park-like atmo-sphere with additional picnic areas. There are many possibilities and future discussions will be necessary to determine the use of this parcel. This parcel was originally slated for home sites, but now will provide other opportunities for our community.

Another parcel being donated is known as the Barn Area. This site is an eight acre parcel and will be the future site of our new community center. The developer valued this parcel at one mil-lion dollars! It is zoned commercial and is very central to this great community. The possibilities are endless with a community center. The Strategic Planning Committee (SPC) will be working on this project and many others over the coming months.

In the interest of preservation, the MOU also includes the “Indian Caves.” This land will be deeded to the Association and the pres-ervation of its beauty will be here to enjoy for generations to come. We are very fortunate that this site is now protected from future development.

In order to ensure that the beauty of the lake will be enjoyed for years to come, we have incorporated a tree buffer into the MOU. This 100 foot buffer to the lake means that nothing can be devel-oped and trees cannot be removed (except for possible utility con-nections, if necessary). This buffer area will also be turned over to the Association and will become part of the preservation and way of life around beautiful Lake Linganore.

The DRRA:Development Rights & Responsibilities AgreementThe Memorandum of Understanding (MOU) has created many positive assurances and commitments that will benefit Lake Lin-ganore in the future. In return, the Association wanted to foster

a stable environment for the Developer’s operations. To ensure future stability, the Association petitioned for, and supported, the approval of the Development Rights & Responsibilities Agreement (DRRA). In May of 2013 the Frederick County Board of County Commissioners held a public hearing and ultimately approved the DRRA. Similar to the MOU document between the LLA and the Developer, the DRRA document is an agreement between Freder-ick County and the Developer (Oakdale Investments LLC). Each party specifies expectations and guidelines for moving forward, until terms are mutually agreeable. The approval of the DRRA will give the Developer the security and stability needed in order to move forward with massive investments and maintain confidence over the next 25 years.

The DRRA will improve significant infrastructure surrounding Lake Linganore, including the expansion and repair of roadways. The DRRA also includes language for the addition of a new ramp to better connect New Market to Interstate 70. This new highway connection will create access from Route 144 and help to allevi-ate local congestion. Lastly, and perhaps most significant to As-sociation residents, is the commitment to develop the Eaglehead Bridge. The Eaglehead Bridge will traverse the Dam and connect Eaglehead Drive to the proposed commercial center and Oakdale High School.

A Plan for DredgingOver the coming months we will be working with Frederick County and Frederick City to attempt to spearhead a joint dredg-ing program with these two entities. We have engaged an inde-pendent dredging specialist to be a Project Manager for this opera-tion. Lake Linganore is the number one asset of this community and the health of the lake is a driving force on all property values within Eaglehead. Lake dredging is not a wish list item—the sus-tainability of the Lake directly affects everyone and will be brought to the forefront of our community over the next year.

Meaningful Dialogue 2013 was a year full of productive debate within our community. Over the coming years, Lake Linganore will face infrastructure-re-lated challenges generated from within the community and pres-sures from outside of the community. I hope that homeowners will engage in opportunities to become involved in this decision making process. Henry Ford said, “Coming together is a beginning; keeping together is progress; working together is success.” I hope that we as a community can all work together and bring prosperity to this great community we all call home.

About the AssociationLake Linganore at Eaglehead is a rural lake community situated in the southeast section of Frederick County Maryland, just east of the city of Frederick and 45 miles from both Washington, D.C. and Baltimore, Maryland.

Originally planned in 1968 as a "new town" by the original developer, Linganore Corporation (J. William Brosius and Louie J. Brosius), Eaglehead was the county's first planned unit development (PUD). The community of villages is centered around a system of lakes, the centerpiece of which is Lake Linganore, a 210-acre lake. Lake Linganore is the largest privately owned lake in the state of Maryland.

The management of the Eaglehead community is accommodated through the operation of the Lake Linganore Association Inc. (LLA), a homeowners associa-tion (HOA) which represents and serves the interests of the HOA corporation and its property owners within the PUD. The Association is guided by an elected Board of Directors who operate under direction of the legal covenants of the corporate charter. The Association is supervised and maintained by an in-house Management Staff.

The Developer’s NoteOver the past several years, there have been countless hours of discussion among the residents of Lake Linganore, LLA staff and board member, developer represen-tatives and citizens of Frederick County about the continuation of development plans for Lake Linganore. On June 18, 2013 the outcome of these discussions came to fruition with a vote by the Frederick County Board of County Commis-sioners in favor of a Development Rights and Responsibilities Agreement, or DRRA, for Lake Linganore. This DRRA will be the primary document to guide and direct all future growth within Lake Linganore. I want to thank all the residents, board members and staff who worked to let your voices be heard through hundreds of phone calls, emails, and petitions directed to the County Commissioners as well as to those residents who came out to the public hearing!

Although the adoption of the DRRA is a significant milestone, it is not the final stop on this journey. We expect there could be appeals to the Board of Appeals where we will appreciate a reiteration of support from the community. Addition-ally, there will be a hearing in September 2013, on our Tax Increment Financing and Community Development Authority proposal which will provide a financing mechanism to assist in expediting the construction of the missing ramps onto I-70 at Meadow Road and the Eaglehead Drive bridge. Watch out for more spe-cific details in e-blasts from the LLA.

Now, what next?

As a part of the Memorandum of Understanding (MOU) that was adopted between the Lake Linganore Association and Oakdale Investments, we will be initiating development of a comprehensive Amenities Plan for Lake Linganore. This plan will consider current amenities within current Lake Linganore villages, as well as future opportunities in areas yet to be constructed. The starting point of this plan will be the Amenity Survey which was conducted last year by the Strategic Planning Committee. Items frequently mentioned were the community center, improved trails, parking at beaches, boat storage, dog park, skate park, play fields and many more. We need your help to ensure that this plan meets the needs of ex-isting Lake Linganore community members as well as future residents. Through-out the Fall of 2013 we plan to hold several stakeholder sessions in order to gather community input and to present drafts of the plan for discussion. We hope to have as many voices heard as possible and will establish an engaging process with multiple communication mechanisms. Residents will be able to weigh into this plan both in person and through other methods. Our goal is to create a plan that is realistic and achievable with an action plan to move towards implementation. We look forward hearing from the community as this Amenity Plan is developed so look out for more details on the process within the coming month.

AccountInformationEach year, in late January, when the annual assessment invoice is mailed to members, the invoice carries all the member data that has been provided to the LLA about that account. You are required to verify, update and approve that information. Returning the data/invoice form triggers the timely response of getting your updat-ed stickers for the fiscal year and makes your member-ship card and vehicle tag valid for the coming year.

Animal ControlIf you are having a problem with another member’s pet, please contact Animal Control. If you believe there is a dangerous animal (dog or otherwise) loose in the neigh-borhood, or if you believe an animal is distressed and in need of emergency assistance, please contact Animal Control at 301.600.1544 or 301.600.2558 (emergency line).

Annual Association Assessments & DuesThe legal covenants of the LLA require all property own-ers to pay annual assessment dues (Covenants, Article V, Section 10). The annual dues are used to maintain com-mon property (including swimming pools, trails, tennis courts, lakes, dams, etc.), trash services, snow removal, provide routine road maintenance, community patrol services, as well as administrative staffing. Dues assess-ment invoices are mailed the last week of January and members are required to pay in full or to make monthly payment arrangements as stated on the invoice form. Payment is due March 1 and late March 31. Monthly payment arrangements must be made by March 1.

Annual Membership Meeting The LLA annual general membership meeting is held the second Saturday in May. Location of the meeting is announced in the monthly community publication La-keTalk and on the LLA web site: www.lakelinganore.org.

The primary purpose is to elect a board of directors and to report to the members the state of the association.

Basketball HoopsPortable basketball hoops must be registered with the LLA office, and may not be left in, or adjacent to a yard or street when not in use. There is no charge for a per-mit. Permits allow us to identify hoops and return them to their rightful owners when found. Permits should be placed on the back of the backboard. Hoops only need to be registered once.

BeachesLake Linganore has two private beaches for the exclu-sive use and enjoyment of its members. All members must be in good standing and have their LLA photo ID’s with them at all times, to avoid being asked to leave the beach. Between Memorial Day and Labor Day (sum-mer season), dogs are only permitted on the beach from 7pm-10pm. There are no lifeguards on duty, swim at your own risk. Fires, glass bottles, alcohol and fireworks are not permitted. All items must be removed from the beaches daily, tents or other items may not be left over-night to “stake out” territory.

Beach Parking AreasThe beaches are very limited on parking spaces and are on a first come first serve basis. You must have your cur-rent and registered vehicle parking permit hanging from the rear view mirror with the ID number and expiration sticker clearly visible from the outside. Violators will be towed at owner’s expense, no exceptions.

Beach PartiesIf you would like to have a party at one of the beaches, a reservation is required. Any planned gathering of more than 10 people constitutes a party. No party can exceed 30 people without prior written approval by the LLA GM. Only one party on the beach will be approved at any given time. This does not grant exclusive use of the beach. Reservations are on a first come first serve ba-sis. To check availability please call 301-831-6400 x110. Stop by the LLA office 6718 Coldstream Drive Mon-Fri 9am-5pm to make a reservation; a $100 damage deposit and a signed rental agreement are required.

Board of Directors Candidacy All LLA property owners “in good standing” can submit their names to be placed on the ballot in March of each year. Required candidate information is published in the community publication LakeTalk in February each year. Additional information can be found in the LLA Covenants and Bylaws.

Board of Directors (BoD) MeetingsBoD meetings are held the first Monday of the month, and sometimes special community workshops on im-portant issues are held on the third Monday of the month. In cases where meetings fall on a holiday, the regular meeting may be rescheduled to: the following Monday, the third Monday, or the Tuesday immediately following the original meeting date. Meetings are held at 7 p.m. at the Lake Linganore Association office, lo-cated at 6718 Coldstream Drive, in the Coldstream vil-lage. The meeting agenda is emailed to the community the morning of the meeting date or the Friday before. Any meeting date changes are also emailed to the com-munity.

Boats Boats operated by electric, wind, or paddle ONLY, are allowed on the lakes. Gas powered boats are not per-mitted on Eaglehead lakes. All boats must be motor-ized with electric engine only. Gas motors cannot be stored on boats. All boats (operated, docked, or on a rack) must display the proper LLA permit on both the bow and the stern of the boat. Boat Permits may be purchased and renewed annually by members in good standing for $25, at the LLA office at: 6718 Coldstream Drive Mon.-Fri. 9am-5pm.

BoatRacksThere are 5 boat rack storage locations. Boat Rack leas-es are $75 and renewed annually to members in good standing. Boats are permitted to stay on the racks year round, however they must be removed from the racks upon request by LLA staff for annual repairs and main-tenance. There is a waiting list for the boat racks and those on the list are notified when a rack space becomes available. If you would like to go on the waiting list please email your request to officecoordinator@lakelinganore.

org Boat racks are inspected periodically throughout the year to ensure compliance. Any boats found in the wrong space, on the ground, without stickers, or stick-ers in the wrong location, etc… are confiscated and sold at auction if unclaimed within 30 days. If you would like to be notified of an upcoming boat auction, please email your request to [email protected]

Boat Storage at HomeIf you keep your boat on your property it must be stored within the garage or by an approved screen that keeps it from street view.

Boat TrailersBoat trailers must use designated launching ramps and display a valid LLA trailer permit. Trailer permits may be purchased and renewed annually by members in good standing for $15, at the LLA office at 6718 Cold-stream Drive Mon.-Fri. 9am-5pm.

Bulk TrashBulk trash pick-up is scheduled twice a year. Once in January for Christmas trees only, and again in Octo-ber for bulk trash items that are not considered regular household waste. Visit the LLA Website for scheduled dates and a list of approved items.

CabanasThere are approximately 30 (8’x10’) cabana’s surround-ing the Coldstream Pool that are available for lease during the summer season. Cabana’s are a convenient way to store items such as mini-refrigerators, pool toys, beach towels and other items that you use at the pools. Cabana rentals are $75 for the season, from Memorial Day Weekend to Labor Day Weekend. They are avail-able on a first come first serve basis to members in good standing. Please stop by the LLA office at 6718 Cold-stream Drive Mon.-Fri. 9am-5pm to secure your cabana lease. Payment & signature will be required.

Christmas TreesA Christmas tree collection is offered in mid-January and the date is announced in the December issue of La-keTalk and on the Website.

LakeTalkThe official notification publication of the LLA is the community magazine LakeTalk, which has been pub-lished monthly since 1996. Residents can publish clas-sified items for free in a regular column called “Trading Post.” Traditional business advertising is also available for a fee. Committees

Village CommitteesThe LLA has several village committees that act as rep-resentatives for their respective villages to plan, discuss, and bring topics to the LLA Board of Directors on be-half of their neighbors. Members are encouraged to at-tend their village meetings where they can bring matters to the attention of their village committee chair person, who will then relay the needs to the Board of Directors who have the power and authority to take action. BoD Chartered Committees/Interest Groups/Social ClubsThe LLA has several standing committees that work on areas that are important to the board of directors for re-search, information, policy recommendations, etc. The LLA standing committees are: Finance, Municipal In-corporation, Strategic Planning, Contracts, Trails (LLA Trailblazers), Tennis, Friends of the Lake, Golf Carts, and Events. Ad hoc groups to study specific issues are created as needed. Visit the LLA web site at www.lakel-inganore.org or reference a current issue of LakeTalk to get more information and contact info.

Community Development Authority (CDA)In 1997 the owners of properties within the villages of Balmoral, Coldstream, Meadows, Nightingale and Pine-hurst agreed to pay a special tax to have storm water management and refurbished roads installed. The spe-cial tax is on the property and stays with the property for a period of 30 years. The monthly CDA amounts are included in the mortgage payment of these properties. Not all properties within Pinehurst agreed to partici-pate in this special tax. To determine if your property is included in this tax, check your county property tax invoice, where it should be noted. The Nightingale CDA project is expected to commence during 2013-2014. Community PatrolThe LLA employs a staff of officers from a regional se-curity firm to serve as community patrol officers. These officers oversee the common areas and amenities to en-sure that trespassers are not present and to enforce the privacy of these facilities for members in good standing. These officers also enforce LLA rules and regulations on all community property. This is a year-round service. If you are experiencing an emergency, always call 911.

DamsEach of the lakes are created by an earthen dam. Lake Linganore is impounded by the J. William Brosius Dam, named for the father of the original Eaglehead develop-ers. The dam was dedicated in 1972 and is marked with a six-foot stone bearing a bronze plaque with information about the namesake. Though the dam is owned by the LLA, which is responsible for the care and maintenance of all the community dams, the city of Frederick has been an active partner in helping to upgrade them and ensure they meet the standards required by the Mary-land Dam Safety Division of the Department of Natural Resources.

Dogs on Eaglehead PropertyBetween Memorial Day and Labor Day (summer sea-son), dogs are only permitted on the beach from 7pm-10pm. The LLA strongly encourages leash use. It is against Frederick County ordinance to allow dogs or any other pet to run loose. All dogs must be under the physical control of its owner. LLA formally adopted the county’s animal ordinance as consistent with the associ-ation regulations and restrictions. Members and/or their guests may expect a citation of violation by the LLA for any such violation, as well as those that may be issued by Frederick County.

Doggi-PotStationsThe primary responsibility of dog owners is to clean up after your pet while out walking in the community. Throughout each village the LLA provides doggi-pot stations along trails and pathways, as well as open com-mon areas. These stations provide owners with bags with which to clean up dog waste. Please dispose of your dog waste at home.

Expiration StickersExpiration stickers are issued annually to members who are in compliance with their HOA dues and do not have any ECC or Compliance violations. Stickers must be placed on the following membership materials (Photo Id Cards, Vehicle Tags, Boat Permits & Trailer Permits) in order to validate them and allow access to the ameni-ties and common areas.

Eaglehead Community Preservation CorporationECPC has been formed exclusively for charitable pur-poses and in particular to lessen the burdens of the county government. Among other things ECPC will as-sume the county’s obligation to construct needed road-ways in the community of Eaglehead. The new roadways will provide environmentally beneficial public ingress and egress, as a result fire protection and other emergen-cy vehicles response times will reduce the risk of future losses to life and property by fire or other causes. The new roadways will aid in the protection of the environ-ment for Lake Linganore and its tributaries. ECPC’s cur-rent projects are the roads and infrastructure for Aspen North, the first platted village in Lake Linganore. Funds for the construction of the roadways will be raised from the creation of a special taxing district and the dedica-tion of the proceeds of revenue bonds that will be ap-proved and issued by the County. The County will levy a tax on the Aspen North Village to repay the bonds.

Fishing

State RequirementsAll flowing waters are owned by the State of Maryland and as a result all state laws regarding flowing waters are in effect and do impact usage on Eaglehead lakes, which are privately owned by the LLA. You are required to li-cense your boat with the state and must obtain a state license to fish on Eaglehead lakes. Eaglehead lakes are privately owned and only LLA members are permitted to fish or boat on them. Please make sure that you have the appropriate LLA and Maryland State credentials. You can obtain a State fishing license at:http://dnr.maryland.gov/service/license.asp

LLA RequirementsFishing for bass in Eaglehead lakes is ‘catch-and- release’ only. Your boat must be registered with the LLA. The an-nual fee to register a boat is $25.

Golf CartsMust be registered with the LLA office. Golf Cart Per-mits must be placed somewhere clearly visible on the Golf Cart. Golf Carts are permitted on designated path-ways, but are not permitted for on road use. All golf carts are restricted to turf tires only.

Guest PrivilegesMember/Owner Guest Policy – may have up to 10 guests per house-hold accompany them on the common properties and amenities.

Member/Resident Guest Policy – may have up to 2 guests per house-hold accompany them on the common properties and amenities.

Member/Child Guest Policy – No guests.

LakesThere are four lakes in Eaglehead. These lakes are for the exclusive use and enjoyment of Linganore members.

Lake LinganoreThe largest of the lakes is Lake Linganore, which is ap-proximately 209-acres with 13 miles of shoreline. This lake has two beaches, one located in the Coldstream Vil-lage on the northern shoreline, and the other located in the Nightingale Village on the southern shoreline. The lake was created by impounding the waters of Linganore Creek and Ben’s Branch with the Brosius Dam, named for the father of the original community developers. Permission to create the lake was granted only with the condition that the community never impede the flow of the water of Linganore Creek because historically it has been a major source of drinking water for the nearby City of Frederick since the early 20th century. Snow melts and heavy spring rains cause much of the sand at the beaches to be washed away so every year about mid-May new sand is placed on the beaches, depending upon weather trends. The lake is 50-feet at its deepest spot.

Lake MerleLake Merle is located in the Meadows village. It has a small beach at its northern shoreline, located at the end of Fox Chase Road.

Lake Anita LouiseLake Anita Louise is located in the Pinehurst village. This lake does not have a beach but does have a dock from which fishermen can try their hand at catching some of the small and large-mouth bass, crappie and blue gill that live in the lake.

Lake MarianLake Marian is located along Eaglehead Drive heading toward the Woodridge village. This lake does not have a beach or a dock but there is a trail that circles a portion of the shoreline and allows for fishing.

MembershipIdentificationCardsMembers are issued photo ID membership cards that allow access to community amenities. When out us-ing the amenities, members must carry their cards with them. Because of the large number of trespassers who attempt to use the amenities, members must have their ID cards while at the pools, lakes, beaches, dams, parks, trails, playgrounds and tennis courts to be able to prove membership to community patrol officers if asked. To get your card: you must visit the LLA office at 6718 Coldstream Drive, where your photo will be taken and the card will be produced while you wait. Lost ID Cards: Call the office to see if anyone has turned in your ID. If so we can mail it to you or you may pick it up. ID’s can be reprinted for $10 (cash or check).

Membership Type/StatusThe Lake Linganore Association (LLA) Board of Di-rectors has reviewed the LLA governing documents to provide a more concise definition of membership. By LLA covenants, a ‘member’ (those who are entitled to membership cards, parking tags and free use of LLA amenities) is strictly defined as the owner and their de-pendents. However, the Board of Directors recognizes that there may be some unusual circumstances where a membership card and /or parking tags could be issued to others within a household.

Member/OwnerThis is a person who is the legal owner of a property in Lake Linganore, (ie. This person/s name is on the deed).

Member/ResidentA person who resides at a property in Lake Linganore. (Spouse, tenant, relative, nanny, children between age 13-17).

Member/ChildThis is a person who is under 13 and resides at a property in Lake Linganore. All residents need a membership ID card, even newborns. Those without an ID are consid-ered a guest of the card carrying member /resident and will be subject to guest fees at the pools.

MotorcyclesShould be registered with the LLA office just like any other vehicle. Permits are not issued for these at this time, but are listed on the approved vehicle list.

MowingAll common areas are mowed by a contractor hired by the LLA. If you have questions about the condition of the common area near your home, please contact a village manager by calling the LLA Office at 301-831-6400.

Neighborhood Watch ProgramsWatch programs exist at this time in the following vil-lages: Coldstream, Summerfield, Meadows, Nightingale and Pinehurst. These programs are “manned” by vol-unteers or teams of volunteers. If your village has a pro-gram and you want to join the effort contact your village committee chairperson(s). If your village does not have a program and you want to organize one, contact your village committee. See page 31 for more details.

New OwnersNew owners must provide a copy of their settlement sheet to the LLA staff within 30 days of closing. They must also fill out an Owner Data Sheet in order to be entered into the Association database. Both of these ac-tions are necessary to gain access top to the amenities, receive membership cards, vehicle ID tags and to receive future correspondence, including assessment notices and the monthly association news publication—LakeTalk.

New TenantsNew tenants must provide a copy of their lease agreement to the LLA staff within 30 days of signing. The must also fill out a Tenant Data Sheet signed by the owner in or-der to be entered into the Association database. Both of these actions are necessary to receive membership cards, vehicle ID tags and to receive future correspondence, in-cluding the monthly association news publication – La-keTalk.

Parking Policies

Guest parkingGuests staying with members for an extended period of time should park in the member’s driveway, though parking on the streets is not prohibited unless it could impede the passing of other vehicles or delay emergency response vehicles. That way the member’s vehicle ID can help the LLA to identify and contact the owner should the vehicle block emergency vehicles.

• Guest vehicles cannot park at any beach parking lot; these are reserved for member vehicles only. Guest vehicles parked at beach lots will be towed. Do not place your member vehicle ID tag into a guest ve-hicle. Guest vehicles must park at the Coldstream Pool parking lot and be escorted to beaches via the member vehicle.

• Guest vehicles are not permitted to park at, on or near community dams.

• Overnight parking on the streets in Aspen village is not permitted.

Towing Policy To protect the privacy of members and the amenities the LLA Directors strengthened all these security ele-ments by adopting and enforcing a towing policy. Ve-hicles without affixed parking permits and current expi-ration stickers are subject to towing. Towing is handled by an outside contractor. Towing fees/fines are collected solely by the towing company; the LLA does not reim-burse towing fines. At this time the company contracted to handle towing is Dorsey’s Towing. If you have been towed, call 301- 607-4357. The tow storage lot is located at 580 E. Church Street, Frederick.

Vehicle PermitsAll vehicles must be registered with the LLA office and listed on your account. Each vehicle must have the fol-lowing information documented on file with the office: year, make, model, color, plate#. Each vehicle is issued a parking permit which must hang from the rear view mirror with the ID number and expiration sticker clearly visible from the outside. At any time throughout the year, should you buy or sell a vehicle, contact the LLA of-fice to update information. When selling a vehicle, please retain your vehicle ID permit. Vehicle ID permits should not be transferred to a vehicle that is not registered to a member account. License plate numbers are checked against the ID tag number and if the two do not match up the ID tag can be considered stolen and the vehicle can be towed. Parking permits and expiration stickers are issued to members in good standing at the LLA office at: 6718 Coldstream Drive Mon.-Fri. 9am-5pm.

ParksMcFadden Park and a handful of our tot-lots are avail-able for parties. Only one party per park will be ap-proved at any given time. This does not grant exclusive use of the park. Reservations are on a first come first serve basis. To check availability please call 301-831-6400 x110. Security through EnforcementThe key to ensuring that the overall security efforts re-ally work, is by enforcing LLA identification and permit usage. Sheriff’sOfficeIn addition to the regular coverage of the community by Frederick County Sheriff ’s Office deputies, the LLA employs off-duty deputies to provide security for most of the year. They provide regular reports to the LLA about the kinds of situations they respond to, which as-sists the LLA in assigning deputies for timeframes and locations where incidents seem to be developing in the community. This is on a year-round basis. In emergency situations always remember to call 9-1-1 but to report a non-emergency incident, contact the sheriff ’s dispatch at 301-694-2071.

Water Quality & ConservationIt is always recommended that Eaglehead residents do everything they can to conserve water and to protect the quality of the lake environment in the community. Ev-erything you do on your lot affects the lakes so please be mindful of how landscaping, etc. will impact drain-age around your property. The grass swales that exist

throughout the community are part of a storm water drainage system that protects the condition of our roads and the water quality of our lakes. When drought condi-tions exist, the LLA follows the Frederick County orders regarding water restrictions.

Yard WasteYard Waste pick-up is every Wednesday (April-Novem-ber). Grass, clippings and leaves must be bagged (in pa-per bags) or placed in personal containers no larger than 30 gallons in size (clearly marked “Yard Waste”). Sticks and limbs must be bundled, and bundles may not be larger than 3 x 3 feet in size.

Winter Weather Plan The LLA handles all snow removal activities, including those roads within Eaglehead that are owned by Frederick County. The winter plan is pub-lished in the fall and winter issues of LakeTalk and is on the LLA web site (www.lakelinganore.org) year ’round. The LLA Winter Weather Plan is to be enacted anytime there is the potential for a winter precipitation event including snow, sleet and / or freezing rain as pronounced by the National Weather Service.

The purpose of this plan is to ensure that roadways are clear of vehicle traffic and parked cars to allow for the safe passage of snow removal equipment and / or emergency service vehicles.

This plan will go into effect no more than eight hours prior to the forecasted weather event and will remain in effect no more than eight hours after precipitation has ceased.

• Do not park on the streets; park in your garage or driveway so that snow plows can do their job and emergency vehicles can get through, if needed.

• Please remove all basketball hoops, soccer nets, and other portable items that may be damaged by snow plows.

• Clear snow from your driveways, driveway culverts, parking areas, heating compressors, mailboxes, nearby fire hydrants, storm drains and trash container areas.

Report hazards and areas in need of maintenance to your Village Manager. In case of an emergency involving community roads and properties after office hours, call the 24hr Answering Service at (301) 293-3802. The information will be reported to LLA Staff.

Four-wheel drive and snowmobile owners are asked to be available to assist neighbors with emergency medical access needs or other service assistance.

The following roads are deemed “Snow Emergency Routes.” Parking along these roads will be prohibited during a storm event once the Winter Weather Plan is effective. Vehicles parked along these roads during a storm event will be towed at the owner’s expense.

A resale disclosure initiates an inspection to be done by LLA staff for any compliance or ECC violations that may exist on the property.

The starting fee for a resale package is $150.00. The requestor can have the documents delivered in various forms, including a PDF sent via email.

From the time you submit your request to www.condocerts.com, you should expect the inspection to be completed with-in 3-5 business days. A resale disclosure letter will be gener-ated and will be released, along with all other LLA Governing Documents, at that time.

You will create an account that will contain all information related to the resale. You will then be prompted to follow the process and provide information related to the subject prop-erty. CovenantsThe Lake Linganore Association Covenants provide an overview of the governance of the Association. It is the official Declaration of the Conditions, Covenants, Re-strictions, Easements and Changes affecting the real property known as Eaglehead. Located within the Cov-enants you will find information on membership rights, property rights in the common properties and more. The LLA Covenants can only be changed with a 2/3 ma-jority vote of the total membership of the Association.

BylawsThe Lake Linganore Association Bylaws dictate the structure of the overall organization. You will find the details outlining who the Board of Directors are, how the Board is structured and how they operate. You will also find information on board elections and committee structure as well.

Environmental Control Committee (ECC)The Lake Linganore Association Architectural Review is delegated to the Environmental Control Committee, also known as the ECC in short. The ECC is a sanc-tioned committee of the LLA Board of Directors and is comprised of volunteers who review all of the archi-tectural changes proposed to homes and properties by existing residents within the association. The LLA also

employs an ECC Administrator who can act as liaison between the residents and the committee. The ECC Administrator can review, approve or deny, ECC ap-plications on behalf of the committee itself. The ECC Administrator may use discretion when reviewing all applications and may decipher which applications he/she can approve and which applications warrant review by the committee.

RulesandRegulationsThe Lake Linganore Association has adopted a set of Rules and Regulations in furtherance of meeting the objections and constraints under the Covenants and Bylaws of the Association. The Rules and Regulations mostly encompass the appropriate use of the LLA ame-nities and common property. Rules and Regulations can be changed by a resolution of the LLA Board of Direc-tors.

LLCS has a Board of Directors, which consists of members with a working knowledge of the documentation authorizing the Lake Linganore Community Development Authority.

Maintenance ConcernsLLA residents can report maintenance concerns by contacting a Village Manager, who in turn forwards the resident’s concern to appropriate LLA Staff responsible for addressing the issue. Upon receipt of the maintenance concern, LLA Staff members will investigate the issue and determine the correct means and method for addressing it. Whether through a Service Request directly to LLA Maintenance Staff or through an outside contractor, who will be solicited for a quote for executing the appropriate service. All maintenance concerns are addressed as rapidly as possible. Upon completion of a Service Request or contracted work, LLA Management Staff inspects all of the work performed both during and upon completion to assure satisfactory results before informing the Village Manager who first forwarded the concern.

Brosius DamWater cascaded over the top of the Brosius Dam on June 3, 1972, the same year it received two honor awards, one for Environmental Excellence in Architecture & Engineering, and the second for Engineering Excellence from the Consulting Engineers Council, USA.

A 600-foot long rock-and-earth-fill dam impounds a 204-acre body of water known as Lake Lin-ganore, named for the larger of the two creeks that feed the lake. Brosius Rock, the boulder located at the corner entrance of the earthen dam, has a carved inscription that dedicates the dam—the Brosius Dam— to J. William Brosius, the father of Eaglehead’s original developers. Incorporated into the design of the Brosius Dam are 11 fountains along the northern wing of the dam area.

Lake Linganore Conservation Society (LLCS)State Enabling Legislation established a process to allow Frederick County to create Special Tax Districts, referred to as CDA’s. A “C.D.A”. is a Community Development Authority and is utilized for financing roadway and stormwater management improvements. Under this authority, the resi-dents of Lake Linganore have agreed to tax themselves to pay for these improvements. The mis-sion of the Lake Linganore Conservation Society, (LLCS) is to help preserve and protect the lakes

Community Security & SafetyFred.Co. Security SurveysSecurity Surveys are a free service that the FCSO offers and it’s a great preventive and educational tool to help homeowners safeguard themselves from crime by making their homes less attractive to criminals.

Surveys take approximately 45 minutes to an hour and will be performed by a Deputy who’s certified to perform them. One of the homeowners have to be at the house at the time of the survey. Renter’s can have a survey conducted, but the owners, if they can’t be present, must be aware of the survey and have granted permission for the survey to be done.

The surveys focus on locks, doors, windows and lighting. The survey covers the exterior and interior of the home and property, and the homeowner will receive a copy of the completed survey with the suggested recommendations at the conclusion of the survey.

These Officers oversee the common areas and ame-nities to ensure that trespassers are not present. They enforce the privacy of LLA facilities for members in good standing. An Overview of HOA ServicesTrash and Yard WasteThe LLA Trash Removal Contract is a negotiated contract overseen by the LLA staff. The contract includes weekly pick-up of regular household trash and weekly pick-up of yard waste. Both are curbside pick-up. The contract also includes two bulk pick-up days, once in January for Christmas tree’s only and the other in October for bulk trash items that are not considered regular household trash.

Grass, clippings and leaves must be bagged (in paper bags) or placed in personal containers no larger than 30 gallons in size (clearly marked “Yard Waste”). Sticks and limbs must be bundled, and bundles may not be larger than 3 x 3 feet in size.

RecyclingRecyclables must be placed in a blue bin or in an approved container per Frederick County Office of Recycling. Any questions, please call Frederick County Recycling at 301-694-6498.

Common AreasLLA Maintenance Staff collects trash from over 100 collection containers distributed around the Lake Linganore communi-ty. Collection of the trash, dog pots and aluminum recycling cans is done routinely with extra collections scheduled during the summer when amenities such as the beaches and play-grounds are visited more frequently.

Please remember to do your part to keep the Lake Linganore community and recreational facilities litter free. Always put your trash in a proper container. If one is not available, hold on to your garbage until you find one. AND most importantly, NO GLASS CONTAINERS ARE ALLOWED ON THE BEACHES.

Pet WastePlease keep our community free of pet waste! Pet waste trans-mits disease and contaminates runoff after heavy storms.

Pet waste stations are conveniently located on our property for the courtesy of all LLA residents to enjoy a cleaner, health-ier environment. Each pet waste station provides bags for all pet owners to pick up after their pets. Remember cleaning up pet waste is the responsibility of the pet owner so use the bags provided for your convenience and keep our community waste-free.

SnowRemovalThe LLA Snow Removal contract is a negotiated contract overseen by the LLA Staff. A contractor is chosen and is then put “on call” to treat snow and ice related emergencies on LLA’s private roadways. The contract is generally held from November to April each year and is renegotiated each fall.

LandscapingThe LLA Landscaping contract is a negotiated contract that is overseen by the LLA Staff. The contract includes the weekly mowing and general lawn maintenance of all LLA common property and amenities. The contract also includes mulching, tree pruning, shrub pruning, pest control treatments, turf care applications and flowerbed entrance features. The landscap-ing contract is a two year contract.

Pool ManagementThere are three pools open to the residents of Eaglehead. All of the pools are managed by the same contractor who ensures, the pool water and pool areas are clean, safe and compliant to the Maryland Department of Health standards. DERTZBAUGH CONSTRUCTION, Inc.
