It is observed that Colleges Viz. - 1) K.J. Somaiya Medical College, Sion, Mumbai, 2) Sanjeevan Sarljeevan Medical College, Ivliraj, 3) N.K.P. Salve Medical College, Nagpur and 4) S.D. Kalmegh Dental College, Nagpur have admitted the students over and above the 15% hlRI Quota.

After deliberations, Samiti directs aforesaid Colleges/Institutes to submit their explanation in respect of excess admissions in done 15% NRI quota. After receipt of the same, explainations to be placed before Samiti for its consideration.

I tem No. 3 : To consider and decide the circular dated 2gth Mav 2012 received from Medical Education and Druas Department, Mantralava, Mumbai in respect of the admission process of MBBS and BDS course.

Samiti perused the circular under reference and noted the same.

I tem No. 4 : To consider and decide on the letter dated 2gth Mav 2012 received from Association of Manaqement of Unaided Private Medical and Dental Colleaes of Maharashtra reqardina result of Asso-CET 2012 as per the schedule of Hon'ble Hiah Court order in Review Petition No. 120 of 2006 and Writ Petition No. 7799 of 2010.

Samiti perused the letter under reference.

The CD containing the result of Asso-CET-2012 submitted by Association of Management of Unaided Private Medical and Dental Colleges of Maharashtra is sent to the Expert Committee i.e. Direcotrate of Medical Education and Research, Mumbai for their scrutiny and remarks/suggestions.

It is observed that report of Expert Committee is not yet received. Samiti directs the Expert Committee i.e. Directorate of Medical Education and Research, Mumbai to verify and scrutinize the result submitted by the Association and subniit their report to Samiti within one week, positively.

I tem No. 5(al : To discuss, consider and ratifv the decisions taken on circulatorv submission on 22nd Mav 2012 reqardins admission of Post Graduate MDIMS course on the basis of Non-CET for Academic Year 2012-13.

Samiti perused the following letters received from Colleges/Institutes:-

1 Letter dated 21/05/2012 signed by Dean, Dr. Vasantrao Pawar Medical College, Nashik, DeanJChairman, N.K.P. Salve Medical College, Nagpur, Chairman/Dean, Pad. Dr. Vitthalrao Vikhe Patil Medical College, Ahmednagar

2) Letter dated 15/05/2012 bearing no. PDMMC/S/2078/2012 signed by Dean, Dr. P.D.M. Medical College, Amravati.

3) Letter dated 15/05/2012 bearing no. PDWPF/MCH/PG/SS/2012/2971 signed by Principal, Pad. Dr. V.V. Patil Medical College, Ahmednagar.

4) Letter dated 10/02/2012 bearing no. NKP/dEAN/214/10/02/2012 signed by Dean, NKP SIMS & RC, Nagpur.

Aforesaid Colleges/Institutes have requested to approve admissions of Post Graduate MD/MS course on the basis of the criteria laid down in clause 9(1) (a), 9(2) of Medical Council of India - Post Graduate Medical Education Regulations, 2000 (Amended upto December 2010). Samiti also perused the clause 9(3) of the said regulations. Said letters were circulated amongst the members of Samiti for urgent decision vide circulatoy submission of the letter dated 22/05/2012.

After deliberation Samiti ratifies the decision and permit to admit candidate only for Pre and Para clinical subjects in MD/MS course on the basis of criteria laid down in clause 9(1), 9(2) and 9(3) of Medical Council of India - Post Graduate Medical Education Regulations, 2000 for the Academic Year 2012-13. The above admissions are approved subject to permissions/affdiations of all the authorities Central Government, Respective Council, Government of Maharashtra and Maharashtra University of Health Sciences, Nashik for the Academic Year 2012-13

Samiti further directs that the said permission is granted only for the Academic Year 2012-13 and the Colleges/Institutes and should not treat it as a precedent for the years to come.

Item No. 5(b) : To discuss, consider and ratifv the decisions taken on circulatorv submission on gth May 2012 re~ardina admission of B.A.M.S. and B.P.Th. course on the basis of Non-CET for Academic Year 2011-12.

Samiti perused the following letters received from Colleges/Institutes:-

1) Letter dated 7/5/2012 signed by Chariman, DPO's hl€lT College of Physiotherapy, Thane

2) Letter dated 9/5/2012 signed by Principal, Siddhakala College of Physiotherapy, Ahmednagar

3) Letter dated 7/5/2012 bearing no. AMAMCM/025 signed by Secretary, Association of Management of Ayurvedic Medical College of Maharashtra

Aforesaid Colleges/Institutes have requested to approve admissions of B.A.M.S. and B.P.Th. course on the basis of Non-CET for Academic Year 2011-12. Said letters were circulated amongst the members of Samiti for urgent decision vide circulatoy submission of the letter dated 22/05/2012.

After deliberation Samiti ratifies the decision and approve the admissions of B.A.M.S. and B.P.-th, course on the basis of HSC (Science passed) basis for the

2gth June 2012 Academic Year 2011-12, subject to candidate fulfillment of eligibility criteria laid down by the respective council and Maharashtra University of Health Sciences, Nashik.

Samiti further directs that the said permission is granted only for the Acadeniic Year 2011-12 and the Colleges/Institutes and should not treat i t as a precedent for the years to come.

Item No. 5(c) : To discuss, consider and ratifv the decisions taken on circulatorv submission on gth Mav 2012 reqardina admission of Sandi~ Thakur admitted for B.H.M.S. course for the Academic Year 2006-07.

Samiti perused the letter dated 7/5/2012 received from Anantrao Kanse Homoeopathic Medical College, Junnar, Pune requesting to approve admission of Kum. Sa~idip Thakur admitted in S.T category to open category in Academic Year 2006-07. Said letters were circulated amongst the members of Samiti for urgent decision vide circulatoy submission of the letter dated 9/5/2012.

It is observed that College/Institute vide its aforesaid letter dated 7th May 2012 has mentioned that there are 05 seats vacant in open category and 01 seat vacant in ST category in Academic Year 2006-07.

I n view of the above, after deliberation, Samiti decides to approve the admission of Kum. Sandip Thakur in open category for first year B.H.M.S. course for the Academic Year 2006-07, subject to fulfillment of eligibility criteria for open category as prescribed by Central Council of Indian Medicine, New Delhi (CCIM) and IYaharashtra University of Health Sciences, Nashik.

Item No. 6 : To consider and decide on the Ietterslre~resentations received :-

Item No. 6(al: Letter dated 23rd Mav 2012 received from M.A. Ranaoonwala Collecre of Phvsiotherapv and Research, Pune recrardina draft brochure of CET - 2012 for Manaaement Ouota admission for first vear M.P.Th. course for the Academic Year 2012-13.

Samiti perused the letter under reference.

The copy of draft brochure in respect of CET-2012 for management quota adrr~issions for first year M.P.Th. corse for the Academic Year 2012-13 submitted by aforesaid College/Institute is forwarded to the Expert Committee i.e. Directorate of Medical Education and Research, Maharashtra State vide office letter dated 4/6/2012 for their scrutiny and expert comments/ remarks. But report of Expert Committee is not yet received.

After deliberation, Samiti directs the Expert Comrnittee i.e. Directorate of Medical Education and Research, Mumbai to verify and scrutinize the said draft brochure and submit their report to the Samiti within one week, positively. After receipt of the same it be placed before Samiti for its consideration.

The copy of draft brochure in respect of CET-2012 for management quota admissions for first year B.P.Th. corse for the Academic Year 2012-13 submitted by aforesaid College/Institute is forwarded to the Expert Committee i.e. Directorate of Medical Education and Research, Maharashtra State vide office letter dated 4/6/2012 for their scrutiny and expert comments/ remarks. But report of Expert Committee is not received.

After deliberation, Samiti directs the Expert Committee i.e. Directorate of Medical Education and Research, Mumbai to verify and scrutinize the said draft brochure and submit the report to Samiti within one week, positively. After receipt of the same it be placed before Samiti for its consideration.

Samiti perused the letter under reference and letter dated 1 6 ~ ~ June 2012 submitted by the Expert Committee i.e. Directorate of Ayurved, lvlaharashtra State, Mumbai

Considering the suggestions of Expert Committee on the draft brochure and after deliberations, Samiti allows the Association of Muslim Ivlinority's Medical Educational Institutions of Maharashtra, Pune to conduct AMMMEI-CET-2012 for management quota admission for first year B.U.M.S. (Unani) course for Academic Year 2012-13, Subject to the Following:-

a) CET and CAP should be conducted in fair and transparent manner and as per the directives, orders, norms, rules and regulations laid down by the Hon'ble Supreme Court of India, New Delhi, 2) Hon'ble High Courts, 3) Cental Council of Indian Medicine, New Delhi, 4) Department of AYUSH, New Delhi, 5) Maharashtra University of Health Sciences, IYashik, 6) Govt. of Maharashtra and 6) Pravesh Niyantran Samiti, Maharashtra State.

b) List of notified centers with details of seating arrangement made in each such centers and list of eligible candidates appearing for examination to be provided to Samiti. IVo. of seats available college wise to be provided to Samiti.

c) Schedule of CET and CAP should be as per directives of Hon'ble Supreme Court of India, New Delhi, Central Council of Indian Medicine, New Delhi and Department of AYUSH, New Delhi and Maharashtra University of Health Sciences, Nashik, if any.

d) Samiti directs the Association to declare the result of the said CET within 10 days

e) Result of CET should be displayed on website and the notice boards of the Association. Result of AMMMEI-CET-2012 to be submitted to the Samiti office, within two days from the date of declaration of result.

f) Association should ensure that allotment of students to colleges is made strictly as per merit and as per the options of choices exercised. Association should also ensure that colleges submit Fee Approval proposals to Shikshan Shulka Samiti, Maharashtra State for finalization of fee structure for the Academic Year 2012-13. It should also to be ensured that allotment of students is done only to the colleges who are permitted/affiliated to Council/University for the academic year 2012-13. Association should ensure that colleges submit the list of admissions within two days form the cut off date to Samiti's office.

g) Association conducting CET/ CAP should communicate to Samiti's office vacancy details immediately after the each round is over.

h) The Competent Authority of the Association and / or Representatives of Director, Directorate of Ayurved, Maharashtra State will be Grievance Redressal Authority who will take care of all complaints of students/parents during CET examinations and admission process. Association should further ensure appointment of appellate authority to hear and decide and dispose of grievances against the decisions of said competent authority.

i> All admissions to be done on the basis of CET conducted by the Associaton with the requisite mark.

j > Association/Colleges are directed to display details of their infrastructure available on their website.

k) Association should submit detailed information in respect of appointments of moderators/examiners their names qualifications, etc to Samiti immediately.

1) Where seats are likely to be increased, Association to publish the details before hand in Local as well State Level News papers, notice boards and websites of association and respective Colleges also and invite/call the fresh preferences / choices from the candidates for such seats.

m) Samiti further directs the Association to submit the following information to office from time to time without fail:-

i> No. of students appeared

ii) No. of students qualified in the Exam.

2) Rule No. 12.1 : To be read as AMMMEI-CET-2012 shall be conducted by the Competent Authority appointed by the Association of Muslim Minority's Medical Educational Institutions of Maharashtra, Pune. The Entrance Examination shall be conducted for the adrr~ission to B.U.M.S. courses for management Quota and unaided colleges seats .....

3 Rule No. 12.2 : To be read as CET-2012 will be condcted to fill unaided and management quota seats for the admission of B.U.M.S. course at the following centres only .......

4) Rule No. 12.2 (iiil : Full para is to be deleted. Not necessary in the brochure

5) Rule No. 14.1 : To be read as - the candidate may be an Indian National from any State. Separate eligibility criteria required for NRI and Foreign nationals.

8) Rule Refund of Fees : The Association/Colleges/Institutes are directed to follow following in the matter of refund of fees and incorporate the same clause as follows:

I ) 'If a candidate cancels his/her admission before the cut-off-date, then College/Institute has deduct only Rs. 1,000/- as administrative charges and balance amount of fees paid by a student be refunded within two days, otherwise the same amount to profiteering and charging of capitation fees. Samiti perused the letter under reference.

Shri Nitin Kavede, Dy. Registrar, IYaharashtra University of Health Sciences, Nashik has pointed out that seat distribution in minority and non-minority quota of M.A. Rangoonwala Dental College, Pune is not as per prescribed policy of State Government of Maharashtra for Academic Year 2011-12 and 2012-13.

I n view of the above, after deliberation, Samiti directs the University to approach the concerned authority in respect of seat distribution in Minority and IYon-Minority quota of aforesaid College.

Samiti further directs M.A. Rangoonwala College of Dental Sciences and Research, Pune to follow the Government Resolutions in respect of seats distribution for Minority and Non-Minority quota seats. Samiti also directs aforesaid institution to follow Government resolutions and modify the information brochure of CET-2012 accordingly.

The aforesaid College/Institute has stated that during the Academic Year 2010-11 there were no admissions for B.P.M.T. course, therefore, College has not submitted their admission details to the Samiti.

I n view of the above, after deliberation, Samiti directs the University to scrutinize and verify the admission process of B.P.M.T. course for Academic Year 2011-12 of the aforesaid College/Institute and submit the report within one week to Samiti. Samiti perused the letter under reference.

As per the decision taken by the Samiti in its meeting held on 1 8 ~ ~ April 2012 (at Item No. 7[b]) the aforesaid College/Institute is permitted to join the PGM-CET-2012 conducted by Directorate of Medical Education and Research, IYumbai - Government of Maharashtra for its Post Graduate course in Dental admission process.

I n view of the above, after deliberations, Samiti directs the aforesaid College/Institute to follow CET rules/regulations as per Government policy.

3) Email dated 25/05/2012 received from Dr. Nishant Vijay Shegaonkar complaining against Association citing a candidate having selected in Diploma in Optholmology through the first round of APGM-CET-2012 at N.K.P. Salve Medical College, Nagpur and having filled the Status Retention Form. Inspite of this in second round he is allotted to MD Pathology at Dr. Panjabrao Deshmukh Medical College, Amravati. He has requested to confirm his retention for Diploma in Opthomology at N.K.P. Salve Medical College, Nagpur.

4) Email dated 27/05/2012 received from Dr. Tushar Bhagwat complainint against Association in respect of confirmation of his admission through selection process of APGM-CET-2012.

5) Letter dated 29/05/2012 received from Dr. sumeet Narayanrao Raut complaining against the Association regarding unfair betterment of seats in the Post Graduate Dental faculty at Y.M.T. Dental College, Kharghar, Navi Mumbai.

6) Email dated 31St May 2012 received from Dr. Komal Kadam complaining against Association and Tatyasaheb Kore Dental College, Kolhapur asking for a claim against the vacant seat in PIDS course for the Academic Year 2012-13.

7) Email dated 2gth May 2012 received from Neelesh Sarode complaining against Association in respect of faulty admission procedure of APGD-CET-2012.

8) Email dated 25th May 2012 received from Priyanka Mantri complaining against Association in respect of injustice towards open merit students.

9) Letter dated 7th May 2012 received from Laxmi Narayan through email complaining against the Association in respect of the faulty procedure being followed by the association in Asso-CET-2012.

10) Email dated 6th May 2012 received from Rajaram Nikhil complaining against Association in respect of faulty admission process of Asso-CET-2012.

11) Email dated 27th June 2012 received from Shantanu Kale complaining against Association in respect of declaration of final merit list of Asso-CET-2012.

All the complaints are forwarded to the Grievance Redressal Authority i.e. Director, Medical Education and Research, Murnbai and Corr~petent Authority, Association of Management of Unaided Private Medical and Dental Colleges of Maharashtra, Mumbai for their necessary action, but enquiry reports of Grievance Redressal Authority are yet to be received.
