Last, year's state aid for education was S15.6 billion. This year it could be as much as SI? bil- lion. That's the good news but the bad news is that most of that increase will go to New York City schools and disadvan- taged school districts throughout New York state. Governor Spitzer is also proposing to provide SI.5 billion this year to subsi- dize local real estate levies that will alter the STAR rebate program by offering a tax relief program aimeJ at middle class residents earning anywhere from SSO.OOO to $235.000 a year. The gover- nor says it could potentially help Freeporters reduce their property taxes but state Republicans disagree. To complicate matters, the average property tax bill for Nassau County- households is 87 percent higher than the statewide mean and 24 percent higher than the downstate suburban region. In Freeport the proposed increase in state aid for the 2007-200S school year is 6.92 percent. There are 56 school dis- tricts in Nassau County. Eight school districts received more aid; 47 received less. On average, school districts received about three percent. "We must look at this figure with cau- tion," said Deputy Superintendent of Freeport Schools Kishore Kuncham. He explained that some of the increase is misleading because programs usually funded separately are now included in the foundation aid package. "Previously some things were sepa- rate. The early grade class size reduction grant and the magnet grant have been collapsed into the foundation aid," said Mr. Kuncham. Those grants, for $456,000 and $400.000 respectively, mean that the aid package really includes "5856,000 less since there is one single education aid formula,'' said Mr. Kuncham. Governor proposes smallincrease in state aid

Governor Eliot Spitzer unveiled hisproposed 2007 New York State budgetlast week that included an increase ofSI.4 billion in school aid. Last, year'sstate aid for education was S15.6 billion.This year it could be as much as SI? bil-lion. That's the good news but the badnews is that most of that increase will goto New York City schools and disadvan-taged school districts throughout NewYork state.

In Freeport the proposed increase instate aid for the 2007-200S school year

Contracts for capital improvementstotaling nearly $3.33 million and anagreement with Nassau County to pro-vide $465,000 in grants for a storm watertreatment project received approval fromFreeport trustees Monday.

The contracts included:• The Colony Park Area Road

Improvement Project with Richard W.Grim Inc./BiCounty Paving Corp. forSI.23 million.

• The Tanglewood, Delaware andWillowbrook Road ImprovementProject, also with BiCounty PavingCorp., for $1.17 million.

• Boardwalk construction at SeaBreeze Park with Talty Construction for$563,117

• The 2005 tree planting program with. Louis Barbato Landscaping at a finalcost of $76,682

• Miscellaneous sidewalk repairs for$18,262.

A five-year contract for elevatormaintenance at Village Hall was award-

ed to Excelsior Elevator Corp. ofWestbury for $159 a month.

The storm water treatment project con-sists of installing devices at BrooksidePreseve and Meadowbrook Creek. Eachproject will cost $250,000 and the coun-ty will provide $465,000 in grants.

In other actions, the board added a$1,323 business exemption to the 2007Assessment Roll for 146-164 WestSunrise Highway and reduced theassessment of the property at 309 GrandAvenue from $6,370 to $6,000.

Trustees also transferred about$55,000 in Community Developmentfunds to various rehabilitation projectsunder way.

Trustees adjourned after their briefagenda meeting to executive session fordiscussion of real estate, personnel andlitigation issues.

Mayor William F. Glacken said theboard will not meet the next twoMondays because of Lincoln's birthdayand Presidents Day.

Next meeting will be Monday,February 26.

Now, Dr. Robert Jerome is relocating to the West Coastafter decades of service to local patients. We can honestly saythat "just talking to Dr. Jerome is half the cure."

The average guy, whodoesn't think much about such con-cerns as color or decor, will spend adisproportionate amount of time tryingto decide between red roses and amixed bouquet a bracelet or earrings,and milk or dark chocolates.

For the.mosj-part. Valentine's Day isa somewhat ^ lopsided holiday in thatmen, more than; women, are expectedtolextend themselves. It is the occa-sion for a Clover to acknowledge asweetheart -and generally that publicdisplay of affection, despite efforts atequality and political correctness, ismore skewed in favor of the female.

One area of expression, usually nota masculine strength, involves the ver-bal expression of love. Saying, "I loveyou," seems difficult, generally abbre-viated to;"Love Ya." Many men thinkthat the .purchase of a Hallmark cardshould suffice or else: that his signifi-cant ottier. should simply understandhis love"aVa given. v- "-

There are a certain few, however,who have that rare ability, and indeedthat seemingly even rarer need, toexpress love in %vords. And not onlywords, but in words that rhyme or atleast follow in some sort of poetic pat-tern.

Even those who don't enjoy poetry,who find it obscure and inaccessible,have some familiarity with the greatestlove poets. Christopher Marlowe, die16th Century poet, is one of thosewriters whos& words come to mind:"'Come live with me. and be my love.And we will all the pleasures prove..."

Who could resist, then or now, hispromises of a future that wouldinclude a bed of roses, a gown made ofthe finest wool, a belt of straw andivy-buds with coral clasps and amberstuds...the,-same flowers and jewelry-offered by today's lovers but offered

then with words that have livedthrough the centuries.

And of course there is Shakespeare,that observer of humankind, who isalways good for a quote, no^natter theoccasion. Many recognize the sonnetin which he asks, "Shall I comparethee to a summer's day? Thou art morelovely and more temperate."

A slightly more modern approach,from the female perspective, would bethe words of Elizabeth BarrettBrowning. What modern womanwould not admire her - a poet, a frag-ile invalid, an older woman, and yetshe snared the much younger andwell-known poet Robert Browningwho was attracted to the poetess, firstthrough the letters they exchanged,and only after that, at weekly meetingswhich finally resulted in marriage.

"How do I love thee?" she asks andthen begins her answer - "to the depthand breadth and height my soul canreach—to the level of every day's mostquiet need—with the breath, smiles,tears of all my life—and if Godchoose, I shall but love thee betterafter death."

Today's writers seem to lack suchintensity. Today's poets, it is said,write for movies. If so, their expres-sions of love must conform to theircharacters and so don't often reach theheight of language or passion of themore traditional poets.

But love is love, no matter howexpressed. Who can forget the emo-tionally challenged character, the dys-functional Melvin Udall, .played byJack Nicholson in the movie "As GoodAs It Gets?" The best he can manageto tell the waitress Carol Connelly,played by Helen Hunt is, "You makeme want to become a better person."

And of course, there is Tom Cruise,speaking to Renee Zellweger in "JerryMaguire," I think I did discern a fewfeminine sighs of approval when hetold her, "You complete me."

But. for the most part, our verbalmanifestations of love are more mutedtoday. The former United States poetlaureate Billy Collins, whose veryname is unpretentious, in his collec-tion of works entitled "The TroubleWith Poetry" speaks of the changes intoday's poetry.

In his poem, "American Sonnet" heacknowledges, "We do not speak likePetrach or wear a hat like Spenser..."Instead, he says, our writing is oftenconfined to the scribblings on a post-card and our search for the perfectword is focused on finding the correctadjective to describe the weather weare enjoying.

The poetry of Billy Collins scruti-nizes the everyday with an awarenessof detail that is amazing, but his almostcasual style lacks the passion of his-toric love poetry. His observations,such as those found in the poignantpoem, "The Lanyard" in which heremembers crafting a lanyard for hismother when he was a child at camp,are more subtle.

His adult understanding of what hismother has done for him and what shehas meant to him is contrasted with Mschildhood belief that his gift of a sim-ple, handmade lanyard would "eventhings." The poem is one of the mostbeautiful tributes found in any lovepoetry, despite being written withoutexaggeration or extravagant language,but rather in the ordinary words andphrases of life.

Perhaps the writings of Billy Collinsare a truer expression of how we com-municate today - less rhetoric, littlerhyme. It would be a pit}', however, if

we felt that instead of words, purchases sufficed because it is too easy tosimply buy a card, a bunch of flowers,a box of chocolates or even a piece ofjewelry.

Whenever I think of love and theways in which love should be shown, Ithink of my old Italian grandfather, asmall, fair skinned, aristocratic look-ing man. The day was warm but a lateSpring breeze was blowing. I was sit-ting beside my grandmother on ourporch which was protected by thecooling leaves and pale lavender blos-soms of a winding wisteria vine.

"I love you, Grandma," I whispered,having listened once again to her won-derful story of the beautiful princessthat she told me whenever I asked.

And suddenly, I heard my grandfa-ther, as he walked by. "You love yourgrandmother?" he questioned.

"Yes, Grandpa, I do.""Then go sweep the stoop."

"How do I love thee, let me countthe ways," said the husband..."! go towork each day, I mow the lawn, shov-el the snow, sit at soccer practice nomatter the weather, miss football play-offs to go to a play...that's how much Ilove you."

"And how do I love you?" said thewife..."! bear our children, cook ourmeals, welcome you home each day,care for us all when we're sick, makea home for us, bolster you when youare upset or depressed about work, andtell you 'thanks' when I remember."

Shakespeare was correct, then andnow. "Love is not love, which alterswhen it alteration finds."

innocent unless and until convicted incourt.

Crimes Against Property Squaddetectives report an arrest thatoccurred on February 1 at 9 a.m. inFreeport:

According to detectives, LenitaBrinson, 20, of Hempstead, wasemployed as a bank teller betweenJune 2006 and the present, for RoslynSavings Bank, on South Main Street,Freeport. While employed, she madeeight fraudulent transactions, remov-ing $13,600 from a customersaccount.

These transactions occurredbetween November 3, 2006 andJanuary 30, 2007. On Thursday,February 1, the suspect was arrestedand charged with Falsifying BusinessRecords, Possession of ForgedInstruments, Identity Theft and GrandLarceny.

On January 23, a 17-year-old femaleresident of Milburn Avenue, Baldwin

was arrested on Sunrise Highway andMeadowbrook Parkway, Merrick andcharged with Driving While AbilityImpaired/Combined Influence,Criminal Possession of a ControlledSubstance, Driving While AbilityImpaired by Drugs, and three viola-tions of the Vehicle and Traffic Law.

On January 28 police received a callfor suspicious youths at the SunriseHighway overpass in Massapequa.Two male Hispanic youths dressed inblack were observed entering thewooded area behind the overpass.

They were stopped and observed tobe wearing latex gloves covered infresh paint. Knapsacks containingspray paints and markers were on theirperson and in the nearby vicinity.

Suspects, both age 15, from Baldwinand Freeport, admitted to making graf-fiti and both were arrested. TheJuvenile Affairs Bureau and the MTAwere notified and responded. Graffitiinstruments were confiscated and keptas evidence, police said.

Hempstead Senior TownCouncilman Anthony J. Santino willbring Town Hall to Baldwin residentswhen he hosts a special town hallmeeting on Tuesday, February 13, at7:30 p.m.

The meeting will be held at theBaldwin Middle School, at 3211Schreiber Place in Baldwin. Themeeting will solely focus on the Townof Hempstead's revitalization projectfor Grand Avenue and Merrick Roadin Baldwin.

Last year, at the direction ofSupervisor Kate Murray andCouncilman Santino, a planning con-sultant was hired by the Town ofHempstead to review the condition ofthe six-acre area beginning at the fireheadquarters going south on GrandAvenue and then west on Merrick Roadto Fullerton's Funeral Home and thearea on the southwest corner. Thatconsultant reported back to Ms. Murray

and Mr. Santino that the area is blight-ed. The Town Board has unanimouslyadopted the consultant's blight study.

Last fall, Supervisor Murray andCouncilman Santino, through theTown of Hempstead Department ofPlanning and Economic Development,issued a "Request for Qualifications"from various commercial real estatedevelopers.

Recently, the town received theresponses from several well-known andrespected real estate development firms.These responses have been forwarded toan evaluation committee to decidewhich developers are qualified to moveonto the next stage of the project.

Representatives from the Town ofHempstead Department of Planningand Economic Development will be onhand at the meeting to detail the vari-ous aspects of this project and toaddress the questions of Baldwin resi-dents.

enjoy a summer camping experienceeach year, giving family members amuch-needed, worryfree respite.

AHRC Nassau is a not-for-profitorganization whose mission is to meetthe needs of children and adults withdevelopmental disabilities by provid-ing community-based programs andservices, as well as guidance and sup-port for families. AHRC is a participat-ing agency in Long Island's UnitedWay.

Destination weddings were not big backin the 1970s when I was married. And thegas crisis at the time meant many impor-tant people weren't able to come.

But many family and friends did, andeveryone seemed to have a great timethanks to the organizing skills of mymother and my cousin and his wife whoserved as both minister and matron ofhonor ...and caterers.

We served a picnic on the lawn next tothe little wooden Chapel by the 'Sea inCaptiva Island, Florida where the two-faithceremony ended. For years later, we wouldrevisit this favorite place of ours, alongwith the cement-and-steel Saint IsabelRoman Catholic Church on Sanibel Island,nearby. Imagine our surprise last yearwhen we discovered the Chapel By TheSea had survived the hurricane that almostobliterated Captiva, but Saint Isabel was

Thomas Edison once said that Ft.Myers, Florida, is one of the most beauti-ful places on earth and one day millions ofpeople would discover it. He was right, butit still holds lots of charrri for a destinationwedding, with its white sand beaches. Youcan still find solitary islands and coves, butnow there's also parasailing, jet skis, nightlife and more.

The next big wedding in our own familywas also a destination wedding, but thistime on Lake George, New York, in thelittle stone church in Hague, with theparty in a tent on the lawn of my son's in-laws' summer home, with a fantasticview of the lake.

Once again the mother of the bride didan amazing job of organizing and everyonehad a wonderful time. The bride made arule that no one could swim during theparty, but she added later, "knew it wasbound to be broken."

Over on this side of the Atlantic, the portof Old San Juan, Puerto Rico, also hasromantic promenades and beautifulbeaches are nearby, along with the rain-forest of El Yunque, with the waterfallsmade famous in the television series,"Fantasy Island." Sipping a tropical drinkby the side of a pool or strolling with ashaved ice get pretty close to paradise.

Over on the West Coast, San Francisco,with its cable cars, or San Diego, with itsworld-famous zoo and Sea World, could belots of fun.

And what about the mountains, skiing in

winter or hiking in summer? Telluride,Colorado, Stowe, Vermont, they wouldboth be grand.

Of course, New York City as a destina-tion would make any out-of-town guesthappy after a wedding party in any of ourbeautiful local catering halls. If you thinkoutside the box, almost any wedding canbe a destination wedding success story.

I have this friend who just got mar-ried, her name is Lisa (I will not useher last name to save her from poten-tial embarassment). Lisa is one of myfriends that I went to art school with,she has always been very creative,much more so than I.

When Lisa got engaged, she sent out

a "save the date" magnet, over a yearin advance of the planned wedding.Her hand-crafted save date item wasjust the beginning of what was comingmy way.

Her theme being fall colors and theturning leaves was evident from thiscard. Her hand-tied, wired edge ribbonended up in hindsight coordinatingwith the inviations, the place cards and

favor gifts. I'm sure it will match thethank you note once I receive it.

But I give her a break in the thank-you note department. With all thetedious, minute detail paid to thistheme, I actually would be happy toreceive a pre-filled out card, similar tothose the children give to their friendsat birthday parties.

Fast forward about a year afterreceipt of the save the date to the invi-ation's arrival. It was like nothing I hadever seen before. Having gone to col-lege with .this girl and knowing theskills we were taught such as using anx-acto blade and rubber cement, herfinal piece was beyond comparison towhat we constructed in any of ourpackage deisgn classes.

The self-mailer card looked like apiece of ornate origami the way itopened. The colors she chose reflectedthe autumnal theme and the script fontgave a sense of elegance to what wasto be a fabulous occasion.

She even used a garnet-coloredgem to "beda/zle" the invite evenmore. All of this was sealed in hotwax like the Royal Family would do.I only mention the Royals since

Lisa's mom hails from England, butthat's a whole other story .(sic).

When we arrived at the wedding,guests were immersed in the chosencolors of burnt orange, deep red gar-nets, and bronzy browns. They were apart of the centerpieces, the bridalbouquets with the same flowersadorning the wedding cake.

Place cards were brown craft paper-like, but at closer look you found thatthey were actually CD covers of thecouple's favorite romatic songs. Whatwould be the liner notes to the albumwas really a program introducing thebridal party and thanking everyonefor coming.

The final touch of the day was thefavor. It was a brown craft paper box,hand-stamped with various leaves ofall the aforementioned colors. Insidewas a set of wine glasses etched'bythe bride herself lying in a bed ofcolor-coordinated raffia.

All-in-all it took Lisa well over ayear to get the details to her specifica-tion for her big day. She brings newmeaning to the old saying, "If youwant something done right, do it your-self."

The past met the present on January 13as the late Dolores "Babe" Minke,Baldwin High School graduate of theClass of 1947, was honored by herfriends. A small group of neighbors andhigh school buddies gathered in the highschool cafeteria to pay tribute to a womanwho was not only an avid athlete but aSportsnite devotee and the original presi-dent of the Girls Athletic Association.

She, along with the revered EthelKloberg, started the club and wrote theoriginal GAA bylaws. The youngwomen from both the Blue and Goldteams of Sportsnite 2007 were also onhand to remember Babe's school spirit asthey presented a memorial wreath and abouquet of yellow roses tied with a blueribbon to those gathered.

Babe had been a Blue team captain backthen, and in true Sportsnite fashion, thegirls of '07 sang "The Captain's Song"and "The Blue Team Alma Mater" in hermemory. Babe's friends then took thepodium to praise a woman who embodiedthe love and passion for all the athleticactivities that Baldwin had to offer.

Babe was on the basketball team, fieldhockey team and softball team, and shewas a cheerleader. As an adult, she was aphysical education teacher at BaldwinHigh School. When she left to pursue acareer as a flight attendant for Pan Am, shewas replaced by the also revered MarieJensen. At a celebration honoring MissJensen's many years at Baldwin, she toldthe audience that she got the job because ofBabe.

Babe's dear friends Sheila Cohen,also a Sportsnite girl, athlete and gradu-ate of the Class of 1947, along withCarol McCall and Mary Kaspararranged this celebration of Babe's life.They praised Babe as a woman of deepconviction and a passion for life and forthe people she knew. Because the highschool meant so much to Babe, herfriends chose it as a fitting place tomemorialize her.

Mrs. Cohen said that Babe loved thatspecial recognition from Miss Jensen.She said that all of Babe's connectionsto and memories of Baldwin HighSchool meant so much to her. In her-eulogy, Mrs. Cohen reflected, "As Blueteam leaders, we worked hard for Blue,won the Song and Cheer, and tied forSportsnite. No one who wasn't in itcould ever understand how much itmeant to us, and how it positively

affected our character for life."And so it is in the spirit of people like

The Empire Zone (EZ) Programoffers significant tax incentives andutility reduction benefits to certifiedbusinesses located in or investing in adesignated Empire Zone to encourageeconomic and community develop-ment, business investment and job cre-ation.

Businesses apply through the localEmpire Zone for certification in theprogram and are jointly certified by thelocal Empire Zone Certifying Officerand the State Commissioners of Laborand Economic Development.

For the next ten years, each year, thebusiness must demonstrate to StateDepartment of Taxation and Financethat they have created net new jobs tothe state and/or made their projected

business investment in order to receivethe various tax incentives under theEmpire Zones Program.

Three of the four businesses are inFreeport. They are:

The businesshad been considering a" move toPennsylvania. 87 new jobs are project-ed for the next five years in engineer-ing, sales management and tool anddye maker jobs. Capital investment isestimated at $3,776,150 for the pur-chase of machinery and equipment andbuilding renovations.

a Mini Graphics, Inc. is a manufac-turer of quality package inserts servic-ing the Pharmaceuticals industry. Thecompany plans a capital investment ofover $2,000,000 to expand its currentoperations and will create 50 new jobsto add to its current employment of129.

• SJ Price, Inc. is a wholesaler ofpaper goods and restaurant supplies ina key Main Street/urban core area tar-geted for revitalization. This businessplans an investment of $100,000 toexpand operations through a buildingrenovation and purchase of equipment.They will increase their employees bymore than 20% (six new jobs) over thenext five years.

B. If by August 1 of the year for which thenotice was sent a landlord does not have awritten communication signed by the tenant,and does not otherwise have actual knowledgeof the need or desire for window guards, thenthe landlord or his agent shall at reasonabletimes inspect the dwelling unit to ascertainwhether a child ten (10) years of age oryounger resides in the dwelling and if so,whether approved window guards are properlyinstalled and maintained.

C. Every landlord shall notify no later thanSeptember 1, each year, commencingSeptember 1, 2007, the Superintendent ofBuildings of the Incorporated Village ofFreeport, in writing, of all dwelling units whichhave been verified by him of requiring windowguards 'and of those units which have notresponded to his census inquiry and or whereaccess has been denied.

D. The Superintendent of Buildings shallnotify the Freeport Fire Department of all suchdwelling units where window guards have beeninstalled, no later than November 1 of eachyear beginning in 2007.§128-44. Mandatory window guards.

A, No communication from a landlord to atenant shall indicate that the installation of -window guards is optional or in any mannerdependent upon payments by the tenant.

B. Landlords shall not impose any type ofpre-condition, such as fees, or any other psy-chological deterrant, preliminary or subsequentto the installation of window guards.§128-45. Tenant obligation to provide informa-tion and access.

A. No tenant in a dwelling unit shall refuseor unreasonably fail to provide accurate andtruthful information regarding the residency ofchildren therein, or refuse, prevent or obstructany inspection required by this Article.

B. A landlord who has been denied accessto a dwelling unit for the purpose of installingor inspecting window guards required by theCode of the Incorporated Village of Freeportshall notify in writing to the Superintendent ofBuildings, 46 North Ocean'Avenue, Freeport,New York, 11520. Said statement shall speci-fiy the landlord's efforts to gain access and thecircumstances of the denial thereof.

C. Tenants or occupants shall respond tomandated inquiries by landlord as to their win-dow guard needs or desires.. Tenants or occu-pants must also provide access and permitinstallation of guards and stops, whererequired.§128-46. Selective window guard installationprohibited.

Window guards may not be installed selec-tively. They shall be installed in all windows,except fire escape access windows and a sec-

ondary egress window, on all windows abovegrade.§128-47. Specifications for window guards fordouble hung windows.

A. Guards shall be constructed of rigidmetal, free of sharp projections, edges orrough surfaces.

8. Guards shall be constructed as to rejectthe passage of a solid five (5) inch sphere atevery space and interval.

C. Guards shall bear a one hundred and fiftypound (150 Ib.) load at center-span whenextended to maximum width. A test with theguard attached in accordance with the manu-facturer's instructions for installation must beperformed, and the results, including informa-tion as to temporary or permanent distortion,certified by a Professional Engineer, or inde-pendent testing laboratory.

D.(1) On guards utilizing non-telescoping bars,

there shall be.a permanent spot weld on atleast two of the horizontal bars so as to pro-vide a minimum of two (2) inches overlap whenthe guard is fully extended.

(2) On telescoping bars, when the guard isextended to the maximum allowable width,there shall be a minimum overlap of five (5)inches or 1/3 of the length of the bar, whichev-er is greater.

(3) A permanent label shall be affixed on atleast one horizontal bar, on each facing sur-face. Said label shall read: WARNING! EXTEN-SION OF THIS GUARD BEYOND INCHES IS DAN-GEROUS AND ILLEGAL, (insert the number ofinches appropriate to the particular model inthe space).

(4) On telescoping guards, there shallbe anadditional stile or other approved support(s), atthe telescopic opening of the outer tubing ofthe bars, that shall prevent any spreading ofthe bars. -

E. Guards shall be a minimum of 15 incheshigh measured along the vertical stiles.

F. Jhe channel stiles.shall each have atleast two (2) holes for permanent windowmounting. If guards are more than 15" inheight, additional mounting holes are requiredto provide a maximum interval of 18" betweenmounting holes.

G. Stops.(1) Rigid metal "L" shaped stops, to be a

minimum of one half the width of the windowtrack and each leg of which shall measure atleast two (2) inches, shall be installed securelywith two (2) screws in the upper tracks of eachside of the bottom window to prevent the lowerwindow from being raised more than 4 1/2inches above the lowest section of the top hori-zontal bar of the window guard.

(2) Where "L" shaped stops cannot beplaced in the window track without interferingwith the normal operation of the window, a rigidmetal strip may be securely fastened acrossthe track of the bottom window to prevent thelower window from being raised more than 41/2 inches above the lowest section of the tophorizontal .bar of the window guard. Strips shallbe mounted on each of the windows and shallbe secured by (2) screws on each side of thewindow track.

(3) In situations where the stops describedin (1) and (2) above cannot be used, such as inballast windows, rigid metal "L" shaped stopsmay be securely fastened to the frame of thewindow to prevent the lower window from beingraised more than 4 1/2 inches above the low-est section of the. top horizontal bar of the win-dow guards. A stop shall be securely mountedon each side of the exterior lower .windowframe and shall be secured by two (2)approved screws in each stop.

(4) In special situations where the, stopsdescribed in (1), (2), and (3) above cannot beused, a letter request for.a waiver may bemade to the Superintendent of Buildings forapproval of an alternative stopping device.

(5) Stops are not required where approvedwindow guards are installed that are of suffi-cient height to prevent an opening of more than4 1/2 inches above the lowest section of thetop horizontal bar of the window guard whenthe lower window is raised to its maxi'mumopen position.

H. Screws. Screws used to mount windowguards and stopping devices shall be one-waysheet metal screws or metat, tamper resistantscrews. Tamper resistant screws are definedas screws requiring special tools for theirinstallation and/or removal, which tools are noxreadily available in retail hardware stores. All'tamper resistant screws must be counter sunkflush with the stile or stopping device.Appropriate screws shall be:

(1) Minimum size #10 and long enough topenetrate one (1) inch into a wooden windowframe or;

(2) Of an adequate type, size and length tobe securely fastened to a metal window frame.Manufacturer shall supply all required screwswith guards.

I. The coating of guards shall be unleadec.A statement from the paint manufacturerattesting to this fact must .accompany theapplication for window .guard approval.

J. Coded manufacturer's identification sym-bol (guard model) and fabrication date sym-bols, (month and year) shall be imprintedindelibly (die stamped), on one end of thestiles, so located as to be readily visible when

K. Each guard sold by a manufacturer shallbe sold with a self-contained envelope or plas-tic bag containing:

and stops. If wood screws are supplied by themanufacturer, a warning label should be includ-ed stating that for metal installations, appropri-ate type, size and length screws must be sub-stituted. This warning shall be imprinted onthe packaging container.

L. Instructions for safe installation shall beprovided with each guard by the manufacturer.

(1) Instructions shall specify maximum win-dow width for which the guard is intended andshall contain the following prominervUy printedwording: WARNING: USE OF THIS GUARDBEYOND SPECIRED MAXIMUM WIDTH IS DAN-GEROUS AND ILLEGAL

(2) Instructions shall prominently warn thatguards and stops must be installed only insound (non-rotting) window tracks.

(3) Instructions shall prominently specify:WINDOW GUARDS MAY NOT BE INSTALLED INWINDOWS PROVIDING ACCESS TO FIREESCAPES.

(4) Instructions shall specify that guards beinstalled so that the bottom horizontal mem-bers are mounted a maximum of 4 1/2 inchesabove the window sill.

(5) Instructions shall specif)' the use of thesupplied "L" shaped stops to be installed withscrews provided, or alternative approved stop-ping devices also provided with prescribedscrews, to limit the opening above the lowestsection of the top horizontal bar to 4 1/2 inch-es when the bottom sash is raised.§128-48. Specifications for window guards forother than double hung windows.

A. Applications for approval of windowguards for use in other than double hung win-dows shall specify the window type(s) for whichthe guard submitted is intended. Mountingmaterials and instructions for installation foreach specific type of window must be includedwith the application and must be provided tothe consumer with the guards.

B. Guards shall be constructed so as toreject the passage of a solid five {5} inchsphere at every space and interval..

C; Guards intended for casements, slidersand other'Vpes'of combinatibns'of windows innnich the heignt of ttie openings are not sub-ject to limitation, must e of such size as to f;i;the entire aperture and must reject passage ofa solid five (5) inch sphere at every space andintea'al.

(1) When approved limiting devices are uti-lized in lieu of window guards the size of anyunguarded opening may not exceed 4 1/2 inch-es so as to reject passage of a solid 5 inchsphere at every space or interval.

(2) On guards utilizing non-telescoping bars,there shall be a permanent spot weld on atleast two of the horizontal bars so as to pro-vide a minimum of two (2) inches overlap whenthe guard is fully extended.

(3) On telescoping bars, when the guard isextended to the maximum allowable width,there shall be a minimum overlap of five (5)inches or 1/3 of the length of the bar, whichev-er is greater.

(4) A permanent label shall be affixed on atleast one horizontal bar on each facing surface.Said label shall read: WARNING! EXTENSIONOF THIS GUARD BEYOND INCHES IS DANGER-OUS AND ILLEGAL. (Insert the number of inch-es appropriate to the particular model «n thisspace.)

(5) On telescoping guards, there shall be anadditional stile or other approval supports), atthe telescoping opening of the outer tubing ofthe bars, that shall prevent any spreading ofthe bars.

D. Guards shall bear a one hundred and fifty-pound (150 Ib.) load at its centerspan whenextended to its maximum width. A test withguards attached in accordance with the manu-facturer's instructions for installation must beperformed and results certified by aProfessional Engineer or independent testinglaboratory. The information shall include anyfinding of a temporary or permanent distortion.

E. Each channel stile shall have at least two(2) mounting holes. If the guard is more than15 inches high, additional mounting holes arerequired to provide maximum of 18 inchesbetween mounting holes.

F. Coating of guards shall be unleaded.Statement from paint manufacturer attesting tothis fact must accompany the application forwindow guard approval.

G. Coded manufacturer's identification sym-bol (guard model) and fabrication date sym-bols, (month and year) shall be imprinted onone of the end stiles so located as to be readi-ly visible when viewed from within the roomwhere the guard has been installed.

H. Sliding windows and vertical pivoting win-dows may use stopping devices in lieu of win-dow guards as follows:

(1) Sliding windows. A solid metal block,measuring at least one half the depth of thewindow track and one half the width, shall besecurely fastened by two (2) screws into the

bottom window track and a solid metal block oran 'L' shaped metal stop shall be securely fas-tened by two (2) screws into the upper "windowtrack, to prevent the window from openingmore than 4 1/2 inches.

(2) Vertical pivoting windows. Metal stop-ping devices shall be securely fastened to theupper and lower window frames by two (2)screws so as to prevent the window from pivot-ing open more than 4 1/2 inches. The heightof the stopping devices shall extend no lessthan one inch nor more than two inches beyondthe window frame as needed to stop the win-dow. The protruding edge of the stoppingdevice shall be smooth and rounded.

I. For types of non-double hung windows,other than those described in sub-division Hand in special situations where the: stopsdescribed herein cannot be used, applicationmay be made to the Superintendent ofBuildings for approval of an alternative stop-ping device.j. Screws used to mount window guards andstopping devices shall be one-way metalscrews or metal tamper resistant screws.Tamper resistant screws are defined as screwsrequiring special tools for their installationand/or removal, which tools are not readilyavailable in retail hardware stores. (1) Approved installation instructions;(2) Approved stopping devices; and,(3) Specified screws needed for installation

of the window guard and/or stopping devices,tf wood screws are supplied by a manufacturer,a warning label or message imprinted on thepackaging container shall warn that for metalinstallations, appropriate types, size and lengthscrews must be substituted. This warningshall be imprinted on the packaging container.

L. Instructions for safe installation of window-guards shall be provided by the manufacturerfor each specific type of window for which theyare intended. •

(1) Instructions shall specify that windowguards may not be installed on windows provid-ing access to fire escapes.

A. Any and all windows requiring a windowguard pursuant to this Article shall-be soequipped on or before September 1. 2007.

B. Any and all windows requiring a windowguard, where an occupant so requires .same,shall be properly installed prior to such occupa-tion of the rental unit.§128-50. Mandatory access.

A. tt shall be a violation of the law for anytenant or occupant to refuse or unreasonablydeny the landlord access to the dwelling unitfor purposes of installing or inspecting anyrequired window guards, provided that the land-lord supplies reasonable documentation! of hisefforts to install, inspect or maintain said win-dow guards.

B. Any tenant or occupant shall be responsi-ble to ensure that any window guard shall notbe tampered with, modified or removed once ithas been installed, and shall notify the landlordin writing if same has been tampered with,modified or removed, and said landlord shallcorrect said condition within five (5) days ofreceipt of said notice.§128-51. Applicability.

This Article shall apply to all apartment build-ings, townhouses, condominiums, cooperativebuildings and all dwellings containing morethan one family and non-owner occupied singlefamily homes.§128-52. Penalties for offenses.

A. Any violation of this Article shall bedeemed to be a violation as defined under thePenal Law of the State of New York, and shallbe punishable by a fine of not more than$1,000 or by imprisonment for not more than15 days, or both such fine and imprisonment,said penalties to be in addition to suspensionor revocation of any permit issued under theprovisions of tnis Article.

B. In the event of any failure to compry withthis Article, each and every day such violationcontinues shall constitute a separate offense,and the penalties prescribed herein shall beapplicable to each separate offense, exceptthat no further penalties shall be imposed forthe period during which any appeal from a con-viction of such offenses is pending.

§128-53. Severability.In the event that any part or portion of this

chapter shall be adjudged or determined to beinvalid for any reason, such adjudication ordetermination shall not affect the validity of any

other part or portion of this chapter. In theevent that any provision of this chapter shallconflict or be inconsistent with any other provi-sion of law, the more restrictive such provisionshall be deemed to prevail to the extent incon-sistent.Section 2. This local law shall take effectimmediately upon filing with the Secretary ofState.

Aboard the Long Island Round-about Railroad,or...a six-hour commute

In four hours you can take theAmtrak to Boston or Washington.

In five hours, or so, with a good tailwind, you can make it to LA or SanFrancisco by commercial airline.

In about six hours, you can fly toLondon.

Also in six hours, you can ride theLIRR from Penn Station to Merrick,Bellmore and Wantagh.

That's how long it took some ridersto get home after last Friday evening'slatest debacle when some power linesfell on the rails of the Babylon linenear Valley Stream.

The 6:05 p.m. to Seaford was speed-ing along on the eastbound track whenit came to a stop about 6:30 p.m. acrossfrom the Green Acres Mall.

Now, Green Acres was not the placeI wanted to be at the time.

There we were, just sitting still.In a few minutes the conductor's

voice came over the speaker, inform-ing us that a power line had fallen onthe rails and we would not be movinguntil the lines were removed and elec-tricity was restored to the line; no indi-cation of how long it would take; sorryfor the inconvenience.

There we sat. Out came the cellphones notifying spouses or whoeverthe callers felt they simply had toinform about our predicament.

In another. 10 minutes, the conductormade another announcement: a powef-line fell on the rails and \ve would not

removed and electricity was restored tothe third rail. The wait would be indef-inite.

Out came the cell phones — again.Ten more minutes and the same mes-

sage was heard with no indication ofhow long it would take to resolve theproblem.

Strange, but, though it was raining,there were no strong winds, no frigidtemperature and no reason to why apower line would just snap and fall onthe rails.

By now all but a few lights in our carwere shut off and the cell phone conver-sations became continuous. For most,there wasn't enough light to read.

About an hour into the wait, and sev-eral more of these announcements thatadded not one fragment of new infor-mation as to when we could hope to bemoving were made.

A combination of claustrophobia,mutiny and cabin fever set in for somepassengers, as several donned theircoats and headed for the end of the car.

now stale-air-filled car, whose bath-room had begun to. overflow, severalsqueezed through the narrow spacebetween the cars and jumped down tothe "un-electrified" tracks and into thepath of - another stalled train?

quite dark. Furthermore, the ValleyStream and Lynbrook stations were aconsiderable walking distance away inthe steady rain.

A conductor eventually warned ridersnot to get off the train because that woulddelay efforts to electrify the rails and theMTA Police were on their way make sureno one was on the tracks.

But several riders kept exiting thecars anyway.

After 8 p.m., the announcementsbegan to change. Now we wereinformed that, if (seemed like a big if)power could be restored to the thirdline, we were to travel west back toJamaica station. Or, they would bringin a diesel engine to take us there ifthey couldn't.

Why could we not just continue east-ward? It wasn't that far to Merrick. Iguess we'll never know.

This "new" information was broadc-cast for nearly an hour.

Finally, all the lights came on. A surge ofpower could be heard moving through the car.

By around 9, we slowly got under waywith about half the number of passengersthat originally started out

Our safely hidden-away conductorannounced that the train would return toJamaica station where eastbound passen-gers could board a diesel train forMontauk. Like that's the top destination offolks going home on a Friday night!

Yes. This train did stop in Jamaica. Wecrawled into the station about 9:15 p.m.The -conductor said this train would'"shoot out" to Hicksville, where wecould board another train for Babylon toboard still another train and head west toour original destinations.

After another wait of several minutes, westarted moving. We were "shooting out"non-stop on the Main Line to Hicksville.That is, until we got to within about a mileof the station. Then "shooting out" became"inching along" with occasional stops.

It was around 10:10 p.m. when we didcome to a full-stop on track 2. They told usthe train for Babylon would leave on thenumber one Track 1.

A resolution? No such hickAt the time, there was one of those nice

double-decker trains that provide a nicescenic view of the countryside — providedyou're traveling in broad daylight

But the red digital indicator sign on theoutside of the cars read Port Jefferson.Caution was in order. The las* thing Ineeded was to end up on the North Shore,

deep in Suffolk County.Most riders getting off the train headed

down the stairs to street level. I guessmaybe the information was wrong. I wentdown the stairs and over to an escalator thatled back up to.the platform and the numberthree track.

"Is this the track for the train forBabylon?" I asked the first availablestranger.

He replied it was on track 1. The double-decker turned out to be the train forBabylon after all.

So I, along with several riders from theprevious train who were still remainingloyal to the LIRR, got on board:

I found a seat on the upper deck thatoffered a nice view of the nighttimedarkness.

So we waited.. .and waited.. ..and wait-ed....for the train to move. Turns out wewere waiting for another train fromJamaica. More passengers got on board,including a funny little man who keptrepeating "tickets please" as he looked fora seat, to the amusement and chagrin ofmany.

By 10:35 p.m., we finally pulled out ofHicksville for Babylon, arriving theresome 20 minutes later.

There was an empty train on the otherside of the platform, but we waited inbetween trains for at least 15 minutes as theair became colder and colder.

The monitor showing the train sched-ules said the train was westbound forPenn Station. The human announcer con-

Tinned this and that it would be goingnonstop. It pulled out of the station withan average of one rider per car. We west-bound folks would just have to wait somemore.

The outdoor monitor also showedthat another train scheduled to arriveby 11:07 was running 18 minutes lateand that it would carry no passengersonce it did arrive.

Very useful information.Our long-awaited train pulled in around

11:25. We boarded and waited some more.Finally getting underway, it made all the

local stops, arriving in Bellmore, my stop,at ll:50p.m.

To make an already long story short,after the LIRR made a short trip long, theApplebee's on Sunrise Highway was open.Before walking the last several blocks tomy house, I needed a midnight snack,which consisted of Buffalo chicken wings,a Caesar salad, French onion soup and atall glass of Sam Adams.

I deserved it.

But Senator Fuschillo told TheLeader that the Senate plans to putforth a new plan that will acceleratethe STAR program now in effect."The rebate will go directly to resi-dents and would be triple that of lastyear."
