Young Business Leaders is a nondenominational religious organization focused ·on involving young men in small group Bible studies. I was part of a weekly YBL small­group study for many years, but our small-group has not been active for several years. Jackson Club is a weekly social lunch club that, at least through practical implementation of membership policies, is limited to men. The club hosted women as speakers and guests during some meetings. Otherwise, to the best of my knowledge, none of the organizations listed above either currently discriminates or formerly discriminated on the basis of race, sex, religion or national origin.

In February 2019, I was appointed to the Mississippi Court of Appeals by Governor Phil Bryant to serve the remainder of an unexpired term that will end January 2, 2023. Ten Court of Appeals judges are elected in non-partisan elections from five districts. Court of Appeals judges serve eight-year terms. The Court of Appeals is an error correction court. The Mississippi Supreme Court assigns cases to the Court of Appeals for disposition; the Supreme Court retains cases of first impression, constitutional challenges, and issues of broad public interest. While the Court of Appeals sits in three-judge panels, all ten judges on the Court vote on every opinion handed down.

Buckhaults worked as a "Mental Health Direct Care Alternate Supervisor" for a state institution. After being slapped on the right side of her face by a patient at work, Buckhaults filed an application for duty-related disability benefits with the Public

Employees' Retirement System of Mississippi (PERS). After going through various administrative steps of review, PERS denied Buckhaults's request for disability retirement benefits. Buckhaults then appealed to the Hinds County Circuit Court, and the circuit court affirmed PERS's decision. On appeal to the Court of Appeals, Buckhaults contended that the PERS Board's decision was not supported by substantial evidence and was arbitrary and capricious. The court disagreed and affirmed. The court found that PERS' s decision was supported by substantial credible evidence, and we applied "the law as it is written," which requires disability to occur as a direct result of an on-duty incident in order to qualify for duty-related disability retirement benefits.

2. Estate of Johnson v. Kitchens Law Firm, P.A., No. 2018-CA-00260-COA, 2019 WL 4024774 (Miss. Ct. App. Aug. 27, 2019).

After years oflitigation handled by his attorneys ( appellees here), the decedent was adjudicated to be the now world-renowned bluesman Robert L. Johnson's son. This appeal centered on the interpretation and application of the contingency fee contract between the decedent and his attorneys, which assigned 40% of all royalties and other monies obtained by virtue of his heirship to the law firm. After the decedent's death, his last will and testament was admitted to probate in the Chancery Court of Copiah County, Mississippi. Because the decedent's estate withheld payment of the 40% royalty share, the Kitchens Law Firm P.A. filed a "Motion to Authorize and Direct Executor to Turn Over Monies and Render an Accounting and Order Turn Over of Future Monies" in the probate matter. Decedent's estate opposed the law firm's motion and asserted affirmative defenses. Both parties filed motions for summary judgment. The chancellor granted Kitchens's motion and denied the estate's motion. The estate appealed. Based on the language of the contract, we found no error and affirmed.

Appellant appealed the chancery court's order denying her motion to set aside a judgment of divorce, entered on May 3, 2018; the order denying her motion to reconsider, entered on May 25, 2018; and, in whole, the final decree of divorce, entered on June 5, 2017. She raised two issues on appeal: (I) whether the chancery court erred by finding it had jurisdiction over the parties and thereafter entering a judgment of divorce and property distribution order; and (2) whether the chancery court erred by denying her motion to set aside judgment of divorce. Because service of process failed to comply with the requirements of Rule 4 of the Mississippi Rules of Civil Procedure, we found that the chancery court lacked jurisdiction at the time it entered the final decree of divorce, rendering the divorce decree void. The chancery court therefore erred by denying Appellant's motion to set aside judgment of divorce. The court of appeals reversed the chancery court's order denying the motion to set aside, vacated the final decree of divorce and the accompanying distribution of marital assets, and remanded for further proceedings.

4. Morales v. State, No. 2018-CP-00737-COA, 2019 WL 3562031 (Miss. Ct. App. Aug. 6, 2019).

Morales was indicted in 2007 on two counts of sexual battery (Counts I & III) and one count of fondling (Count II). At the time of trial, Morales failed to appear. The circuit court found that Morales had willfully, voluntarily, and deliberately avoided trial and therefore would be tried in absentia. The jury returned a guilty verdict on all three counts. In 2012, the United States Marshals Service found Morales in Mexico and returned him to the United States to be placed in custody. In September 2017, Morales

filed a petition for post-conviction collateral relief. In May 2018, the circuit court entered an order granting in part, and denying and dismissing in part, Morales's petition. The court granted relief to amend Morales's sentencing order to correctly reflect the sentences relative to the specific counts in the indictment. On appeal, Morales asserted that (1) the circuit court erred by allowing him to be tried in absentia; (2) he was given an illegal sentence; and (3) he received ineffective assistance of counsel. After a thorough review of the record, the court of appeals affirmed the trial court's order.

5. Bishop v. State, No. 2018-KA-00487-COA, 2019 WL 3297038 (Miss. Ct. App. July 23, 2019).

Bishop was convicted of four counts of gratification of lust, two counts of sexual battery, and one count of statutory rape. The charges pertained to two minor females. After

· Bishop was convicted, he filed an unsuccessful post-trial motion. On appeal, the Defendant raised the following issues: ( 1) whether the evidence was sufficient for the statutory rape conviction in Count III or whether the verdict was contrary to the overwhelming weight of the evidence; (2) whether Bishop was irreparably prejudiced by an improper limitation of his cross examination of the victim's mother; (3) whether the trial court erred by excluding evidence that one victim had been in the presence of another man suspected of abuse; and (4) whether trial counsel was ineffective for failing to request an alibi instruction. The court of appeals affirmed, finding that the evidence was sufficient to sustain Bishop's conviction and that the verdict was not against the overwhelming weight of the evidence. The court also found no abuse of discretion in the trial court's evidentiary rulings. The court declined to address Bishop's claim for ineffective assistance of counsel on direct appeal, preserving the claim for possible post­conviction relief.

6. Putney v. Sanford, No. 2018-CA-00454-COA, 2019 WL 3297032 (Miss. Ct. App. July 23, 2019).

The Plaintiff (Sanford) filed a petition for declaratory judgment against the Defendants (Putneys) in chancery court, requesting an order declaring that title to two parcels ofland be vested solely in his name. The Putneys had conveyed the parcels to a third party, who conveyed the land to Sanford. The chancellor entered a judgment in favor of Sanford, denying the Putneys' motions to dismiss and counter-claims and determining that Sanford should be vested with title to all of the real property requested. Upon denial of their general motion for reconsideration, the Putneys appealed the declaratory judgment and the order denying reconsideration. The Putneys raised the following issues: (I) whether Sanford's claim is barred for lack ofprivity of contract between Sanford and the Putneys; (2) whether Sanford failed to join a necessary party to the action; (3) whether Sanford's claim is barred by the doctrines ofestoppel and/or !aches; and (4) whether Sanford's petition for declaratory judgment failed to state a claim upon which relief could be granted. The court of appeals first addressed sua sponte the issue of jurisdiction, following precedent to reach the merits of the appeal. Upon review, the court found that each of the Putneys' assignments of error regarding the deeds and contracts at issue were without merit and affirmed.

7. Payne v. State, Cause No.: 2018-KA-00292-COA, 2019 WL 2511477 (Miss. Ct. App. June 18, 2019).

A grand jury indicted Payne for unlawful possession of a firearm by a convicted felon (Count I) and possession of a controlled substance (Count III). After a trial, the jury

found Payne guilty on both counts. The trial court sentenced Defendant to serve ten years on Count I and three years on Count III. The trial court denied Payne's motion for a judgment notwithstanding the verdict, or alternatively, for a new trial. Payne appealed, raising two issues: (1) whether Count III of the indictment was defective; and (2) whether Payne received ineffective assistance of counsel. Based on a thorough review of the record, the court of appeals reversed Payne's conviction and sentence on Count III of the indictment and rendered a judgment dismissing that count. The court denied Payne's claim for ineffective assistance of counsel without prejudice to his right to file a separate motion for post-conviction relief.

8. Coast Plaza LLC v. RCH Capital LLC, Cause No.: 2017-CA-01036-COA, 2019 WL 2428751 (Miss. Ct. App. June 11, 2019).

Coast Plaza LLC is a Mississippi limited liability company that was owned equally by two members. One of the members died testate in July 2016. Coast Plaza's sole asset was certain real property in Waveland, Mississippi. Prior to the member's death, Coast Plaza entered into a promissory note secured by a deed of trust on the property and guaranteed by both members as personal guarantors. RCH Capital LLC later purchased the note and became the assignee of the original lender's rights. Coast Plaza defaulted on the note. In November 2016, RCH issued a notice of default to Coast Plaza, and shortly thereafter, RCH' s counsel issued a notice of intent to foreclose on the secured property and offer it for sale on December 30, 2016. Prior to the foreclosure date, Coast Plaza filed a complaint to enforce a purported settlement agreement, and for injunctive relief. Coast Plaza alleged that RCH had offered to accept a deed in lieu of foreclosure and that Coast Plaza had accepted the offer, creating a binding agreement. However, because Coast Plaza lacked the applicable statutory authority to agree to dispose of its only asset via a deed in lieu of foreclosure, the chancellor correctly held that "no settlement agreement was reached by ... the parties." The court of appeals found that the chancellor properly denied Coast Plaza's complaint to enforce the settlement agreement and thus affirmed.

9. Kaiser v. Kaiser, No. 2018-CA-00278-COA, 2019 WL 2428757 (Miss. Ct. App. June 11, 2019).

This appeal arose from disputes over custody and whether the chancery court should modify its prior temporary custody order. During the proceedings, and at Wife's request (which Husband did not oppose) the chancellor appointed a guardian ad !item ("GAL"). The GAL gave a preliminary recommendation that Husband should be awarded "primary physical custody" and that Wife should be awarded visitation. However, the GAL did not make a final recommendation to the court. The chancellor later entered a detailed final judgment that awarded physical custody of the children to Wife and regularly scheduled visitation to Husband. Husband appealed the chancellor's custody award, challenging inter alia, the sufficiency of the evidence in support of the chancellor's ruling, whether the GAL appointment was discretionary or mandatory, and the chancellor's custody analysis. The court of appeals affirmed, holding that the chancellor's findings were supported by substantial evidence and that the chancellor's appointment of the GAL, and disagreement with GAL's preliminary recommendations, were in accordance with law.

Roberts was convicted in 1985 of sexual battery of a child. He was released from prison for good behavior in June 1992. In March 2006, as a result of new legislation, the State notified Roberts that he had to register as a sex offender for his prior conviction. From that time forward, Roberts maintained his registration with the Mississippi Department of Public Safety. In 2017, Roberts filed a petition for relief from the duty to register as a sex offender. The circuit court denied his petition. We affirmed on appeal, applying the clear language of the applicable statute.

Over the course of my career, I have had a general civil litigation practice, focusing on commercial and business litigation in both state and federal courts. For the first ten years (at my first two firms), my practice was concentrated in matters involving white collar crime and compliance, environmental law, complex contract, business tort and intellectual property claims, and securities litigation. When I joined Bradley Arant in 2001, my practice grew to encompass more responsibility and cases involving corporate fiduciary litigation, antitrust claims, products liability, and mass tort. From 2008 to 2011, my tenure at the Secretary of State's Office entailed significant work in administrative law, public contracts and leases, business transactional, and elections law issues. I also worked closely with the Personnel Director on a variety of employment matters. When I resumed private law practice in 2011, I worked for two boutique law firms, where my practice concentrated in business litigation in state and federal courts, including appellate work. In addition to commercial, business, insurance defense, and construction litigation, my practice grew to include business and nonprofit advisory and transactional work, regulatory compliance, and elections-

During my initial years of practice, with larger regional law firms, my clients tended to be larger companies and current or former company officers, directors, and leaders. Many matters involved out-of-state clients who had been sued in Mississippi prior to tort reforms enacted in 2003 and 2004. The cases on which I worked tended also to be complex, "bet-the-farm" type litigation involving large claims and a number of lawyers. Later, with my second two firms, my clients tended to be smaller businesses, local entrepreneurs and companies, and individual clients. Some matters involved complex issues and large claims, but I also handled many smaller matters ( with a larger variety of types of cases).

This case arises out of the high-profile 2014 Mississippi Republican primary election for United States Senate. During that campaign, several individuals were arrested and charged for their involvement in a conspiracy to enter the room of Senator Thad Cochran's ailing wife, photograph her, and publish those images in an attempt to hurt Senator Cochran's re-election campaign. In the aftermath of this episode, one of the persons implicated committed suicide. The Plaintiffs, his estate and heirs, asserted claims against various actors for, inter alia, infliction of emotional distress, wrongful death, and civil conspiracy. As lead counsel for an individual defendant, I drafted and then successfully argued a Rule 12(b)(6) motion to dismiss all claims asserted against my client. The federal action was preceded by significant state court litigation in two venues targeting my client for discovery; we also successfully quashed the relief sought in those state court actions.

2. Ruppert v. Mav6 Holdings, LLC, 185 So. 3d 1033 (Miss. Ct. App. 2015), reh'g denied Nov. 17, 2015; cert. denied, March 3, 2016.

In this this lawsuit, Plaintiffs asserted both individual and derivative claims arising out of Defendants' refusal to repurchase their equity interests in two related companies that owned a third company, which was a start-up that after a meteoric rise in defense contracts and work, declined and ceased operations. I served as counsel for Defendants, including the two principal owners/managers of the entities. Boiled down, Plaintiffs disputed decisions by Defendants regarding whether to repurchase their equity interests in the companies upon their departure as employees and at what valuation to do so. The case involved a complex set of operating and employment agreements, financial records, and fiduciary duties. I successfully moved and argued to compel arbitration, which the trial court ordered and the Court of Appeals affirmed. Thereafter, the parties engaged in discovery, and eventually, I negotiated with Plaintiffs' counsel to settle the matter in advance of arbitration.

3. Matthies v. Red Mountain Entm 't, Inc., Hinds County Circuit Court, Civil Action No. 251-09-400CIV, rev'd on appeal, 156 So. 3d 342 (Miss. Ct. App. 2014).

This action arose out of an incident at a concert that occurred on the premises of the state fairgrounds in Jackson in May 2008. The Plaintiff was ejected from the concert by my client, who was an off-duty sheriffs deputy working the concert as a security guard. The Plaintiff, who according to the evidence was visibly intoxicated, admitted that he was "irate," "using profanity," and that he fought with my client as he escorted Plaintiff out of the concert. The Plaintiff alleged that he was injured because my client had used excessive force in ejecting him. The Plaintiff asserted personal injury and tort claims against the State Fair Commission, the

concert promoters, and my client. The procedural posture of the case was protracted, and legal issues included contract, employment, and state sovereign immunity issues, as well as the elements of Plaintiffs personal injury tort claims. The security guard had not been represented by counsel during substantive discovery, including his own deposition; I was hired after discovery in the case had largely completed. We prepared the matter for trial twice, working with co-defendants' counsel, and then I successfully moved and argued for summary judgment, on the ground that my client was immune from suit as a state employee. The Court of Appeals, after oral argument, reversed, finding that the trial court applied an incorrect standard for summary judgment. The parties eventually negotiated a global settlement of all claims.

4. Ware v. Dupree, Forrest County Circuit Court, Civil Action No. CI13-0152, consolidated for trial with Lamar County Circuit Court Civil Action No. 2013-053H.

This was an election contest of the June 4, 2013 General Municipal Election for Hattiesburg Mayor. I served as co-lead counsel for the Plaintiff Ware, who lost by 37 votes to Defendant DuPree, in an official tally of 4,775 votes for DuPree and 4,738 votes for Ware. I drafted the contest petition and filed it in late June 2013. We tried the case before a panel of jurors from Forrest and Lamar Counties in late July 2013, over approximately six trial days. I assisted in picking the jury, handled witnesses in court, and developed facts and evidentiary proof. That proof substantiated a systematic breakdown in the way absentee ballots were requested, cast, and

counted, blatant examples of illegal voting, and other material departures from the requirements of Mississippi election law. After initially reporting a verdict for Ware, the jury deadlocked in open court. The judge thereafter declared a mistrial. In post-trial, the judge threw out the June 2013 election results and granted our request for a new election.

5. Rosamond v. Brown, Madison County Circuit Court, Civil Action No. CI-2013-0162-JE.

This was an election contest of the Democratic Primary Election held in Canton, Mississippi, on May 7, 2013, for the office of Alderman, Ward 1. I served as sole counsel for Plaintiff Rosamond, who lost to Defendant Brown by 4 votes in the primary. I tried the case in mid-July 2013, before the trial judge and the Madison County Board of Election Commissioners, sitting "with the judge as advisors or assistants in the trial and determination of the facts" pursuant to Miss. Code Ann. § 23-15-931. The evidence substantiated serious examples of illegal voting and other material departures from the requirements of Mississippi election law. The trial judge found for the Plaintiff and ordered a new election. And, based on "willful[ ] and corrupt[]" violations of elections law, the judge referred the matter to the District Attorney's office for presentation to the grand jury.

6. Dunn v. Hyster Co., Jackson County Circuit Court, Civil Action No. 96-0124(3)(1).

Plaintiff was injured in an accident involving a forklift manufactured by my client. Seeking treatment for continuing problems, Plaintiff took medication that led to a severe adverse reaction, rendering her blind and in constant pain. Plaintiff filed suit against my client and her medical providers. The case had languished for six years by the time I entered an appearance. It involved complicated fact issues, as well as legal issues including tort, workers compensation, design defect/failure to warn, and medical malpractice. While some defendants employed a posture of delaying any eventual liability, my client and I took a different tack and worked to craft a settlement with Plaintiff, despite meritorious defenses and the possibility of dismissal. We navigated significant practical obstacles and competing interests of numerous codefendants to reach a settlement that provided the Plaintiff with money to make her house more accessible and livable and to improve her level of ongoing care.

Plaintiff was injured in an accident while operating a forklift manufactured by my client at his place of employment. Plaintiff filed a personal injury action, alleging claims for design defect and failure to warn. I served as associate counsel for one of the defendants, and engaged in significant discovery, including depositions of the plaintiff and his expert witness. After discovery was completed, the Defendants moved to exclude the expert witness, under the standard set forth in Daubert, and for summary judgment. I drafted and then argued my client's motion to exclude the Plaintiff's expert witness and the related motion for summary judgment. The trial court granted the motion to exclude the expert witness and held that, as a result, the Plaintiff could not prove the elements of his product liability claims, such that summary judgment was proper.

This case arose out of a sustained bank fraud scheme committed by a small-town bank president as well as wrongdoing committed by the bank's executive secretary and others. I served as associate counsel for the bank, which filed a civil action to recover stolen and missing funds. I did not participate in the trial of the case because I changed law firms shortly before trial, but I engaged in significant discovery, including numerous depositions and analysis of numerous bank documents and other evidence involving sensitive legal and fact issues (civil and criminal). In my first trial experience, I served as an associate counsel for a global aerospace contractor in this False Claims Act case brought by the Department of Justice on behalf of a qui tam relator. The case arose from alleged mischarging practices in two laboratories operated by Sverdrup at the Stennis Space Center in Hancock County, Mississippi. In both instances, NASA alleged that the company mischarged the United States when it had the technical services contract at the Stennis Space Center in the 1990s. My work involved significant discovery, including depositions of engineers and corporate executives and work with expert witnesses; review and analysis of government contracts, purchasing laws, and hundreds of boxes of records; and witness interviews across the country. After a bench trial, in which I examined witnesses and handled evidentiary exhibits, the court eventually found violations of the False Claims Act but awarded significantly lower damages than initially sought by the government.

Though I have spent most of my law practice as a litigator handling disputes that already generated litigation, I have also spent significant effort to resolve disputes outside the judicial process, preferably before litigation. I have handled a number of formal mediations and tried one National Association of Securities Dealers securities arbitration claim to decision. In 2018 through 2019, I favorably concluded a protracted negotiation/ mediation of a commercial lease dispute between my client, a commercial lessor, and a multinational corporate tenant, involving a significant amount of unpaid rent and lease contract interpretation issues. Working with counsel opposite, we first negotiated a framework for resolving the dispute, and then negotiated a significant settlement that avoided litigation. Similarly, in 2014, I handled tense negotiations between a closely held small company and a managing member of the LLC that resulted in his withdrawal from the company after allegations of wrongdoing. The underlying facts led to a federal government investigation, in which my client was not a target but fully cooperated. I navigated those issues and successfully kept my client in business and out of litigation. Since 2011, I have handled a number of transactional matters, including complicated contract drafting and negotiations. I have also advised small companies and entrepreneurs on compliance with state laws and agency regulations, business structures, and best practices.

For two clients, The Nature Conservancy and American Treasures, Inc., I registered as a state lobbyist in 2013. I worked on conservation policy and funding issues for The Nature Conservancy, including meeting with legislative and other leaders to raise awareness, but I did not ever lobby for or against government or agency action. For American Treasures, Inc., I tracked legislation of interest during the 2013 Session and suggested proposed amendment language to a bill pertaining to "internet sweepstakes cafes" to clarify the bill's inapplicability to my client's business activities.

From my early years oflaw practice, I have endeavored to handle pro bono matters for disadvantaged people who need legal services. For example, I served as Pro Bono Committee Chair for the Jackson Young Lawyers from 2004 to 2005. As chair, I organized a network of young lawyers willing to handle pro bono matters and helped to connect them with pro bono referral organizations. I also personally handled matters referred by the committee-a divorce for an indigent woman, a birth certificate correction for a man seeking benefits, drug counseling and legal advice for several indigent criminal defendants. During this same time frame, I led the effort to develop and implement my firm's Jackson Office charitable giving plan, which included an endowment for the Bradley Arant Boult Cummings/William Winter Institute for Racial Reconciliation Law School Scholarship at the University of Mississippi, the first of its kind in the nation.

More recently, I have volunteered as my other duties permitted to provide pro bono services. As examples, on May 24, 2012, I prepared wills and other legal documents for law enforcement officers at the Clinton, Mississippi Fire and Police Departments (Wills for Heroes); on June 29, 2018, I participated in the District 11 Chancery Court pro bono legal clinic in Madison, Mississippi, providing legal advice to indigent parties in various chancery matters.

I contacted Senator Cindy Hyde-Smith and Senator Roger Wicker in late May 2018 to express interest in being considered for one of the impending vacancies on the United States District Court for the Southern District of Mississippi. On June I, 2018, I forwarded Senator Wicker a letter and a resume reiterating my interest. I sent a similar letter to Senator Hyde-Smith on June 4, 2018. In early 2019, after Governor Phil Bryant appointed me to the Mississippi Court of Appeals, I forwarded updated resumes to Senator Wicker's and Senator Hyde-Smith's offices, per their staffs requests. On or about April 24, 2019, while we were both on the Mississippi Gulf Coast, Senator Wicker and I had a conversation about the vacancies on the District Court, and he indicated that he intended to submit my name to the White House for consideration.

On or about May 6, 2019, I was contacted by the Office of White House Counsel to schedule an interview. On May 13, 2019, I interviewed with lawyers from the Office of White House Counsel and the Office of Legal Policy of the Department of Justice. On July 12, 2019, I was notified by the Office of White House Counsel, and by staff from Senator Wicker's office, that I had been selected as the preliminary candidate for one of the vacancies, pending the completion of the requisite background checks.
