D. PUBLIC CONVENIENCE AND NECESSITY EVALUATION

The City of Los Angeles is very concerned if a new request to sell alcohol is subject to one of the conditions below. There is a strong likelihood that the City will deny vour “public convenience or necessity” application if one of the above listed conditions apply to your site. (It is strongly suggested that you contact your Council Office and discuss your project. If the Council Office does not oppose your project, you should then check with your local area police vice unit as well as the Planning Department Public Counter at (213) 977-6083 for the determination of whether the proposed site is within a Specific Plan area, and the Community Redevelopment Agency (CRA) project staff at (213) 977-1682 or 977-1665, to determine if your site is in a CRA Project Area. If any of the five conditions listed below apply to your site, you should carefully consider

. if you want to file for a Public Convenience or Necessity finding.

1. The proposed site is in an area with a long-term level of undue concentration of alcoholic beverage outlets.

2. The geographic area is the target of special law enforcement activity, i.e., police task force is working on reducing vice in the area, or eliminating juvenile crime (such as cruising or graffiti) or gang activity.

3. The proposed site is in close proximity to sensitive uses* including schools, parks, churches, youth activities, homeless shelters, mental health or alcohol or drug treatment centers.

4. The geographic area has elevated levels of alcohol-related crimes, including but not limited to: public intoxication, driving under the influence, assault, vandalism, prostitution, drug violations, loitering.

5. The proposed site is located in a Specific Plan or Community Redevelopment Agency Project area which specifically includes a policy to control future alcoholic beverage sales.

E. If the project site is not subject to one of the above criteria, your project will be evaluated by the City Councilwith consideration given to the following possible benefits and detriments to the community:

Therefore, you should answer below as to why you believe any of these above listed beneficial or detrimental conditions apply to your project and provide any documented proof to support your belief:**

a determination of deemed to be approved status to permit the sale of a full line of alcoholic beverages for off-site consumption in conjunction with a convenience store; and

Pursuant to Los Angeles Municipal Code Section 12.24-M, I hereby APPROVE:

plans authorizing the sale of a full line of alcoholic beverages for off-site consumption in conjunction with the relocation of the existing convenience store to another location within the same shopping center located in the C2-1 Zone,

upon the following additional terms and conditions:

1. All other use, height and area regulations of the Municipal Code and all other applicable government/regulatory agencies shall be strictly complied with in the development and use of the property, except as such regulations are herein specifically varied or required. 2

2. The use and development of the property shall be in substantial conformance with the plot plan and floor plan submitted with the application and marked Exhibit "A", except as may be revised as a result of this action.

3. The authorized use shall be conducted at all times with due regard for the character of the surrounding district, and the right is reserved to the Zoning Administrator to impose additional corrective Conditions, if, in the Administrator's opinion, such Conditions are proven necessary for the protection of persons in the neighborhood or occupants of adjacent property.

4. All graffiti on the site of the restaurant shall be removed or painted over to match the color of the surface to which it is applied within 24 hours of its occurrence.

5. A copy of the first page of this grant and all Conditions and/or any subsequent appeal of this grant and its resultant Conditions and/or letters of clarification shall be printed on the building plans submitted to the Condition Compliance Unit (“CCU") and the Department of Building and Safety for purposes of having a building permit issued at any time during the term of this grant

6. Indemnification. The applicant shall defend, indemnify and hold harmless the City, its agents, officers, or employees from any claim, action, or proceeding against the City or its agents, officers, or employees relating to or to attack, set aside, void or annul this approval which action is brought within the applicable limitation period. The City shall promptly notify the applicant of any claim, action, or proceeding and the City shall cooperate fully in the defense. If the City fails to promptly notify the applicant of any claim action or proceeding, or if the City fails to cooperate fully in the defense, the applicant shall not thereafter be responsible to defend, indemnify, or hold harmless the City.

7. " Approved herein is the sale of a full line of alcoholic beverages for off-siteconsumption in conjunction with a 1,500 square-foot convenience store with hours of operation/alcohol sales from 7:00 a.m. to 10:00 p.m.. daily.

8. The authorization granted herein for the.sale of a full line of alcoholic beverages for on-site consumption is for a period of seven (7) years from the effective date of this grant. Thereafter, this authorization shall become null and void and a new authorization will be required to continue] the sale of alcohol. The applicant is advised that he/she should allow appropriate time for a new entitlement application to be processed and the application should be approved prior to the expiration dale of this grant in order to continue the sale of alcoholic beverages at the restaurant.

9 The Zoning Administrator reserves the right to require that the how owner or '; operator file a Plan Approval application, it it is determined that the new operation is not in substantial conformance with the approved floor plan, or has changed in mode or character from the original approval or If at any time during the period of validity of this grant, should documented evidence bo submitted showing a continued violation(s) of any condition(s) of this grant resulting in a disruption or interference with the peaceful enjoyment of the adjoining and neighboring properties. The application, in association with the appropriate fees, shall bo submitted to the Department of City Planning. Condition Compliance Unit within 30 (Jays of the date of legal acquisition by the new owner or operator. The purpose of the plan approval will bo to review the operation of the premise and establish

conditions applicable lo the use ns conducted by the new owner or operator, consistent with the intent of the Conditions of this grant Upon this review, the Zoning Administrate! may modify, add or delete conditions, and if warranted, reserves the right to conduct this public hearing for nuisance abatement/revocation purposes.

10. Should there he a change in the ownership and/or the operator of the business, the property owner and the business owner or operator shall provide the prospective new property owner and the business owner/oporator with a copy of the conditions of this action prior to the legal acquisition of the properly and/or the business. Evidence that a copy of this determination including the conditions required herewith has been provided to the prospective owner/operator, shall be submitted to the Code Compliance Unit (CCU) in a letter from the new operator indicating the date that the new operator/management began and attesting to the receipt of this approval and its conditions. The new operator shall submit this letter to tfie CCU within 30-davs of the beginning day of his/her new operation of the establishment along with the dimensioned floor plan, seating arrangement and number of seats of the new operation.

1,1. No additions to the approved site plan such as pool tables, coin-operated games, or video machines shall be permitled on the premises at any time unless permitted by the Plan Approval process of Section 12.24-M of the Los Angeles Municipal Code

12. Prior to the effectuation of the grant, a 24-hour "hoi line' shall be provided for complaints or concerns from the community regarding the operation. The 24-hour phone number shall be posted at the following locations:

a. Entry, visible to pedestriansb. Customer service desk, front desk or near the hostess station

The applicant shall maintain a log of all calls, detailing: dale complaint received, nature of complaint, and the manner in which the complaint was resolved. This log shall he made available lo law enforcement personnel upon request and presented as part of the application if and when a new application lo continue the operation is submitted to the Department. Complaints shall be responded to within twenty four hours. The applicant shall provide photographs of the sign postings and a copy of the log to the CCU for inclusion in the Case File.

13. Prior to the effectuation of the grant, an electronic age verification device(s) which can he used to determine the age of any individual attempting to purchase alcoholic beverages shall he installed on the premises at each point-of-sale location. The device(s) shall ho maintained in an operational condition and all employees shall bo instructed in their use prior to the sale of any alcoholic beverages or tobacco products.

14. Prior to the effectuation of the grant, a camera surveillance system shall be installed by a State licensed contractor to monitor the interior, entrance, exits and exterior areas, in front and around the premises. Recorded tapes/images shall be maintained for a minimum period of 30 days. The tapes shall be furnished to the Los Angeles Police Department upon request. The applicant shall provide evidence of the surveillance system to the Condition Compliance Unit (CCU) by submitting an invoice or receipt from the licensed installer, photographs of the cameras installed, the central monitoring system and a schematic plan cross- referencing the camera and central system locations. The plan must be reviewed and approved by the Police Department. The approved plan will be maintained by the CCU and be made be available to the Police Department and the Department of Building and Safety for the purpose of verification or inspections.

15. Adequate lighting shall be installed in all areas within the business in conformance with the Los Angeles Municipal Code. The lighting shall be such that it renders all objects and persons clearly visible within the establishment. Photographic evidence of the light fixtures, and if available, a copy of the electrical plan approved by the Department of Building indicating the locations and types of sign fixtures, shall be submitted to the Condition Compliance Unit, prior to the effectuation of this grant.

10." Prior to the effectuation of the grant, the manager of the facility shall be made aware of the conditions and shall inform his/her employees of the same. A statement with the signature, printed name, position and date signed by the manager and his/her employees shall bo provided to the Condition Compliance Unit (CCU). The statement shall stale,

l8?HWithin six months of the effective date of this letter, all employees involved with the sale ol beer and wine shall enroll in the Los. Angeles Police Department “Standardized Training foi Alcohol Retailers” '(STAR) Upon completion of such training, the applicant shall request the Police Department to issue a letter identifying which employees completed the tiaining. The applicant shall transmit a copy of the letter referencing Case No. ZA-2014-4081(PAB) from the Police Department to the Condition Compliance Unit as evidence of compliance. In the event thorej is a change in the licensee, within six months of such change, this training program shall be icquired for all new staff The STAR training shall be conducted for all new hires within two months of their employment.

20. The applicant shall regularly police the area under their control in an effort to prevent littering by patrons about the premises.

21. Prior to the effectuation of this grant, a covenant acknowledging and agreeingto comply with all the terms and conditions esfablishod herein shall be recorded in the County Recorder’s Office. The agreement (standard master covenant and agreement for CP-6770) shall run with the land and shall be binding on any subsequent owners, heirs or assigns. This agreement with the conditions'attached must be submitted to the Development Service Center or to the Condition Compliance Unit (CCU) for approval before being recorded. After recordation, a certified copy bearing the Recorder's number and date shall be provided to the CCU for attachment to the subject case file. ...

OBSERVANCE OF CONDfTIONS - TIME LIMIT - LAPSE OF PRIVILEGES

All terms and conditions of the approval shall be fulfilled before the use may be established. The instant authorization is further conditional upon the privileges being utilized within three years after the effective dale of approval and. if such privileges are not utilized or substantial physical construction work is not begun within said time and carried on diligently to completion, the authorization shall terminate and become void.

TRANSFERABILITY

This authorization runs with the land. In the event the properly is to be sold, leased, rented or occupied by any person or corporation other than yourself, it is incumbent that you advise them regarding the conditions of this grant.

VIOLATIONS OF THESE CONDITIONS, A MISDEMEANOR

Section 12.29 of the Los Angeles Municipal Code provides:

"A variance, conditional use, adjustment, public benefit or other quasi-judicial approval, or any conditional approval granted by the Director, pursuant to the authority of this chapter shall become effective upon utilization of any portion of the privilege, and the owner and applicant shall immediately comply with its Conditions. The violation of any valid Condition imposed by the Director. Zoning Administrator, Area Planning Commission, City Planning Commission or City Council in connection with the granting of any action taken pursuant to the authority of this chapter shall constitute a violation of this chapter and shall bo subject to the same penalties as any other violation of this Code.”

Every violation of this determination is punishable as a misdemeanor and shall be punishable by a fine of not more than S2.500 or by imprisonment in Ihe county jail for a period of not more than six months, or by both such fine and imprisonment.

APPEAL PERIOD - EFFECTIVE DATE

The applicant's attention is called to the fact that this grant is not a permit or license and and that any permits and licenses required by law must be obtained from the proper public agency. Furthermore, if any condition of this grant is violated or if the same be not complied with, the same be not complied with, then the applicant or his successor in interest may be prosecuted for violating these Conditions the same as for any violation of the requirements contained in the Municipal Code. The Zoning Administrator's determination in this matter will become effective after JULY 23, 2015. unless an appeal there from is filed with the City Planning Department. It is strongly advised that appeals be filed early during the appeal period and in person so that imperfections/incompleteness may be corrected before the appeal period expires. Any appeal must be filed on the prescribed forms, accompanied by the required fee, a copy of the Zoning Administrator's action, and received and receipted at a public office of the Department of City Planning on or before the above date or the appeal will not be accepted. FINDINGS OF FACT

After thorough consideration of the statements contained in the application and the plans submitted therewith, all of which aio by reference made a part hereof, as well as knowledge of the property and surrounding district. I find that the requirements for authorizing a conditional use permit under the provisions of Section 12.24-L and 12.24­M have been established by the following facts:

BACKGROUND

The subject property is a level, interior 61.200 square foot parcel located along the north side of Foothill Boulevard. It is comprised of six contiguous lots that are tied by use and ownership. The property has a frontage of 360 feet, an even depth of 170 feet and developed in 1961 with one- and two-story multi-tenant commercial buildings (per Certificate of Occupancy No. VN 48791/59) consisting of (retail) shops. The retail shops consist of a pharmacy store, a beauty supply store, an acupuncture clinic, a nail salon, a dry cleaning business, Big 5 Sporting Goods and a restaurant. There are 60 on-site parking spaces, consisting of 42 standard. 8 compact, and 6 accessible parking spaces. The property includes addresses in the range from 6227 to 6261 Foothill Boulevard

The proposed project involves the relocation of "City Maiket #22" presently located at 6247 Foothill Boulevard consisting of approximately 4,000 square feet to 6239 Foothill Boulevard consisting of approximately 1,500 square foot within the same shopping center. City Market #22 has requested a determination of deemed to be approved status to permit the continued sale of a full line of alcoholic beverages for off-site consumption in conjunction with a convenience store and an approval of plans authorizing the sale of a full line of alcoholic beverages for off-site consumption in conjunction with the relocation of the existing convenience store from 6247 Foothill Boulevard to another location within the same shopping center (6239 Foothill Boulevard), having hours of operation from 7:00 a.m. to 10:00 p.m. daily. According to the city records, City Market #22 has been operating at 6247 Foothill Boulevard since January 13, 1961 per the issuance of the Certificate of Occupancy No. VN 48790/59 and LA64882/60). The subject site was issued an Alcohol License, Type 21, No. 476988, by California's Department of Alcohol Beverage Control (ABC), which was surrendered on October 2014 Based on ABC's license query system, the establishment has conducted alcohol sales since 1985 prior to the City’s requirement for a Conditional Use filing for alcohol sales. According the applicant the proposed relocation and reduction in site was triggered due to a proposed upgrade of the existing shopping center and a proposed lease of the site occupied by City Market #22 (located at 6247 Foothill) lo the national retailor Big 5 Sporting Goods for its proposed expansion.

Adjoining properties to the rear of the subject site, along Vista Court, arc* classified in the R1-I Zone and developed with one- and two-story single-family dwellings.

Adjoining property to the southwest of the subject site, across Foothill Boulevard, is classified in the (T)(Q)C2-1 and C2-1 Zones and developed with an Albertson's supermarket and surface parking

Adjoining properties to the northwest end southeast of the subject site on Foothill Boulevard are classified in the C2-1VL and developed with fast food restaurants.

The subject property is located within the area covered by the Sunland-Tujunga- Sliadow Hills-Lakeview Terrace Community Plan. The Plan Map designates Ihe property for General Commercial land uses with corresponding zones of Cl.5, C2, C4 and RAS3, and Height District No. 1VL.

The property is within the area of the Foothill Boulevard Corridor Specific Plan (Ordinance No. 170,094, effective October 27, 1995)

Foothill Boulevard adjoining the subject property is designated a Major Highway with a dedicated right of way of 100 feet and is improved with curb, gutter and sidewalk.

Previous Cases, Affidavits, Permits, and Orders on the Applicant's Property­

Building.Permit No. 02016-10000-25159: A building permit was issued for tenantimprovement of an existing restaurant and the replacement of an exterior wall.

Case No. ZA-2006-8687-CUB - On February 22, 2007, a Zoning Administrator approved a conditional use to permit the sale and dispensing of beer and wine for on­site consumption in conjunction with an existing 1,750 square-foot restaurant with seating for 40 patrons in the C2-1 L Zone.

Case No. CPC 19S6-0608-GPC - On January 3. 1989, the City Council adopted a Height District change from Height District 1 to Height District 1VL as part of the General Plan Zoning Consistency Program. Ordinance No. 164,330 (Subarea 2600) became effective on February 20, 1989.

Case No. ZA 87-1436(E) - On February 10, 1988, the Zoning Administrator approved a conditional use exception to permit the sale and consumption of alcoholic beverages incidental to restaurant service at. 0255 Foothill Boulevard.

Case No cup. 80-114 - On June 26. 1980. Ihe Zoning Administrator approved a conditional use to permit the on-site sale of alcoholic beverages for a restaurant at 6233 Foothill Boulevard.

Surrounding Properties:

Case No APCNV-2001-5025-SPE-ZV-CU-PAB: On May 31, 2002. the North Valley Aren Planning Commission denied the requested Specific Plan Exception. Zone Variance. Conditional Use Permit. Plan Approval, and Project Permit as filed. The Area Planning Commission did approve 1) Specific Plan Exceptions to allow a building without the i< owned 10-foot setback for that portion of the building exceeding 25 feet in height, three signs exceeding 75 sguaie feet sign aioa limit for the signs, permitted eight wall signs, pormilfed pedestrian access to the supemiaiket from the parking lot; permitted the building ;n(1.ndw not to have at least 50% transparent glass, 2) approved Zone Variances from Ordinance No 172.254 to the following "O' conditions to permit three signs to exceed the 75 square foot maximum size limit, to permit more than three

ZA 96-0528, to permit hours of operation of the supermarket between 6:00 a m and 1 a.in . 7 days a week. 3} approved a Conditional Use Permit for the development of a Mini Shopping Center/Commercial Corner Development pursuant to Section 12.24.W.27 of the Municipal Code with Ihe following exclusions and subject to the attached conditions of approval: a) The project shall not be required to have the minimum requirement of 50% transparent windows along the street, h) A 25-foot pole sign shall be permitted, c) Permit the hours of operation to be between 6:00 a.m. and 1:00 a.m.. 7-days a week; 4) approved a Plan Approval, pursuant to Section 12.24.M. of the Municipal Code, requesting the continued sale of alcohol lor off-sito consumption from the subject site, subject to the attached conditions of approval; 5) Approved the request for a Specific Plan Project Permit Compliance for the project as modified, subject to the attached conditions of approval.

Case No. ZA 1996-528 (PAD). On September 4, 1996, Ihe Zoning Administrator approved a determination of conditional use status and approval of plans in conjunction with the demolition of an existing 64,137 square-foot retail commercial center including a Lucky supermarket and a new 10,853 square-foot Sav-On Drug Store to permit (tie supermarket to sell alcoholic beverages for off-site consumption and to add additional wireless telecommunications equipment, to an existing wireless telecommunications facility previously approved under Case No. ZA 95-0605{CUZ). The proposed hours of operation for the supermarket are 24 hours a day, seven days a week.

PUBLIC COORESPONPENCE

On June 17, 2015, a letter was received from the Office of Councilmember Felipe Fuentes indicating their support for waiving the public hearing of the subject case. The letter stated that City Market #22 has been in operation in the Sunland-Tujunga Community since 1961 and has been a good neighbor with no violations from the Department of Alcohol Beverage Control and no concerns reported from the Los Angeles Police Department Foothill Division.

PUBLIC HEARING-WAIVED

On May 13, 2015, the Chief Zoning Administrator acted to waive the required public hearing stating in part that:

Based on a preliminary review of the attached application, including plans and exhibits submitted therewith, and a review of the zoning and (and use patterns in the area, I find that the nature of the request is such that it appears that the proposal.

1. will not have a significant effect on the adjoining properties or on the immediate neighborhood and, 2

2. is not likely to evoke public controversy,

AUTHORITY FOR PLAN APPROVAL

Section 12.24-M of the Los Angeles Municipal Code provides in pertinent part:

"M. Development of Uses. (Amended by Ord. No. 173.092, Eff. 7/6/01)

1 Development of Site. On any lot or portion of a lot on which a deemed- proved conditional use is permitted pursuant to the provisions of this section,

n. w buildings or structures may be erected, enlargements may be made to existing buildings, existing uses may be extended on an approved site, as permitted in Subsection L of this Section, provided plans are submitted to and approved by the Zoning Administrator, the Area Planning Commission, or the City Planning Commission, whichever has jurisdiction at that time ...".

BASIS FOR CONDITIONAL USE PERMITS

A particular type of development is subject to the conditional use process because it has been determined that such use of property should not be permitted by right in a particular zone. All uses requiring a conditional use permit from the Zoning Administrator are located within Section 12.24 of the Los Angeles Municipal Code. In order for the sale of a full line of alcoholic beverages for off-site consumption to be authorized, certain designated findings have to be made. In these cases, there are additional findings in lieu of the four standard findings for most other conditional use categories.

MANDATED FINDINGS

Following (highlighted) is a delineation of the findings and the application of the relevant facts to same;

1. The project will enhance the built environment in the surrounding neighborhood or will perform a function or provide a service that is essential or beneficial to the community, city or region.

City Market #22 has requested a determination of deemed to be approved status to permit the continued sale of a full line of alcoholic beverages for off-site consumption in conjunction with a convenience store and an approval of plans authorizing the sale of a full line of alcoholic beverages for off-site consumption in conjunction with the relocation of the existing convenience store from 6247 Foothill Boulevard to another location within the same shopping center (6239 Foothill Boulevard), having hours of operation from 7:00 a.m. to 10:00 p.m. daily. According to the city records, City Market #22 has been operating at 6247 Foothill Boulevard since January 13, 1961 per the issuance of the Certificate of Occupancy No. VN 48790/59 and LA64882/60). The subject site was issued an Alcohol License, Type 21, No. 476988, by California’s Department of Alcohol Beverage Control (ABC), which was surrendered on October 2014. Based on ABC’s license query system, the establishment has conducted alcohol sales since 1985 prior to the City’s requirement for a Conditional Use filing for alcohol sales. According the applicant the proposed relocation and reduction in site was triggered due to a proposed upgrade of the existing shopping center and a proposed lease of the site occupied by City Market #22 (located at 6247 Foothill) to the national retailer Big 5 Sporting Goods for its proposed expansion.

The project will continue to provide a service to the community by providing a convenience store option within walking distance to nearby residences. The applicant, City Market #22, has been in operation for over 54 years. The request to continue the sale of a full line of alcoholic beverages will allow the business to remain competitive with other businesses in the area and provide a function that is fitting and compatible with the character of the surrounding community and commercial viability of the region as a whole. The imposed conditions will serve to ensure that the built environment is not jeopardized but, rather, enhanced by the continuation of the existing use.

The project’s location, size, height, operations and other significant features will be compatible with and will not adversely affect or further degrade adjacent properties, the surrounding neighborhood, or the public health, welfare and safety.

The area surrounding the project is developed with a mixture of single family, and commercial uses such as shopping centers, a grocery store, liquor stores, retail shops, offices, and parking lots are immediately adjacent to the subject property Adjoining properties to the rear of the subject site, along Vista Court, are classified in the R1-I Zone and developed with one- and two-story single-family dwellings. Adjoining property to the southwest of the subject site, across Foothill Boulevard, is classified in the (T)(Q)C2-1 and C2-1 Zones and developed with an Albertson's supermarket and surface parking. Adjoining properties to the northwest and southeast of the subject site on Foothill Boulevard are classified in the C2-1VL and developed with fast food restaurants.

The applicant is requesting a Conditional Use to allow the continued sale and of a full line of alcoholic beverages for off-site consumption in conjunction with the proposed relocation of the convenience store into a 1,500 square foot tenant space. The establishment proposes hours of operation from 7:00 a.m. to 10:00 p.m. daily. As conditioned, the grant ensures that negative impacts associated with alcohol sales are mitigated and that the convenience store will be operated in a reasonable manner in relation to the surrounding neighborhood. Furthermore, the new floor area of the convenience store is less than half the size of the original store, therefore the relocation will not adversely impact or degrade adjacent properties.

3. The project substantially conforms with the purpose, intent and provisions of the General Plan, the applicable community plan, and any specific plan.

There are eleven elements of the General Plan. Each of these Elements establishes policies that provide for the regulatory environment in managing the City and for addressing environmental concerns and problems. The majority of the policies derived from these Elements are in the form of Code Requirements of Los Angeles Municipal Code. Except for those entitlements described herein, the project does not propose to deviate from any of the requirements of the Los Angeles Municipal Code. The Land Use Element of the City's General Plan divides the city into 35 Community Plans.

The Sunland-Tujunga-Lake View Terrace-Shadow Hills-East La Tuna Canyon Community Plan Map, which designates the property for General Commercial land uses with corresponding C1.5, C2, C4, RAS3 Zones and Height District No. 1VL. The subject site is zoned C2-1VL which is consistent with its existing zoning and the existing convenience store use is permitted in the zone. The property is not currently subject to any interim control ordinances but is within the boundaries of the Foothill Boulevard Corridor Specific Plan. According to the Community Plan Referral Form dated December 16, 2014 and submitted at the time of filing, the sale of alcoholic beverages it is not considered a project per the Specific Plan. Therefore, no further regulations are triggered by the Specific Plan. The Community Plan text does not specifically address the requested conditional use for the sale of alcoholic beverages. However, the project will provide a service to the community, and is thereby consistent with several goals, policies, and objectives of the Community Plan. Specifically, the project addresses the following goal and objective of the Community Plan:

Goal 2: A strong and competitive commercial sector which best serves the needs of the community though maximum efficiency and accessibility while preserving the unique character of the community.

Objective 2-1: Conserve and strengthen viable commercial development in the community and to provide additional opportunities for new commercial development and services

Therefore, the proposed project will be consistent with the intent of the General Plan and Community Plan.

ADDITIONAL REQUtRED FINDINGS FOR THE SALE OF ALCOHOLIC BEVERAGES

4. The granting of the application will not result in an undue concentration of premises for the sale or dispensing for consideration of alcoholic beverages, including beer and wine, in the area of the City involved, giving consideration to applicable State laws and to the California Department of Alcoholic Beverage Control’s guidelines for undue concentration; and also giving consideration to the number and proximity of these establishments within a one thousand foot radius of the site, the crime rate in the area (especially those crimes involving public drunkenness, the illegal sale or use of narcotics, drugs or alcohol, disturbing the peace and disorderly conduct), and whether revocation or nuisance proceedings have been initiated for any use in the area.

According to (he California Department of Alcoholic Beverage Control (ABC) licensing criteria, four on-sile and two for off-site consumption licenses are allocated to the subject census tract (Census Tract 1013.00). Currently there are one on-site license and six off-site licenses in this census tract. The existing convenience store already has a Type 21 license with no disciplinary history. Therefore, the proposed continued sale of a futl line of alcoholic beverages would not add additional licenses to the Census Tract. .

According to statistics provided by the Los Angeles Police Department’s Foothill Division Vice Unit, within Crime Reporting District No. 1659, which has juriscliction over the subject property, a total of 54 crimes were reported in 2014 (36 Part I and 18 Part II crimes), compared to Ihe city-wide average of 163 offenses and the high crime reporting district of 196 crimes for the same reporting period.

Part 1 Crimes reported by LAPD include. Homicide (0), Rape (1), Robbery (0). Aggravated Assault (4). Burglary (10), Auto Theft (6), Larceny (15), Part II Crimes reported include, Other Assault (0), Forgery/Counterfeit (0) Embezzlement/Fraud (0), Stolen Property (0). Weapons Violation (1), Prostitution Related (0), Sex Offenses (0), Offenses Againsl Family (0), Narcotics (9), Liquor Laws (0), Public Drunkenness (1), Disturbing the Peace (0), Disorderly Conduct (2), Gambling (0), DWI related (1) and other offences (4).

Of the 48 crimes reported, zero arrest was made for liquor laws, one arrest was for under the influence of alcohol, and one arrest was for driving under the influence. Crime reporting statistics for 2015 are not yet available.

Approval of the Deemed-to-be-Approved Plan Approval does not increase the number of licenses within the neighborhood as the site is currently operating with an off-sile license. As conditioned, allowing the continued sale and of a full line of alcoholic beverages at the subject location will benefit the public welfare arid convenience.

5 The proposed use will not detrimentally affect nearby residentially zoned communities in the area of the City involved, after giving consideration to the distance of the proposed use from residential buildings, churches, schools, hospitals, public playgrounds and other similar uses, and other establishments dispensing, for sale or other consideration, alcoholic beverages, including beer and wine.

The project site is zoned for commercial uses and is located within the Sunland- Tujunga-Lake View Terrace-Shadow Hills-East La Tuna Canyon Community Plan with a General Commercial land use designation. The following sensitive uses are located with a 600-foot radius of the project site:

The project site is located along a developed commercial corridor and will not detrimentally affect the existing commercial uses located along Foothill Boulevard. Presently, there are existing single family dwellings located to the rear of the subject site. The singe family uses will not be further impacted as the convenience store has existing in the community since 1961. There was neither significant opposition from neighboring residents nor any opposition submitted by the above referenced sensitive uses. The project will not detrimentally affect neighboring residentially zoned properties or any other sensitive uses in the area.

ADDITIONAL MANDATORY FINDINGS

6. The National Flood Insurance Program rate maps, which are a part of the Flood Hazard Management Specific Plan adopted by the City Council by Ordinance No. 172,081, have been reviewed and it has been determined that this project is located in Zone C, areas of minimal flooding.

7. On January 29, 2015, the subject project was issued a Notice of Exemption (Subsection c, Section 2, Article II, City CEQA Guidelines), log reference ENV - 2014-4682-CE, for a Categorical Exemption, Class 1, Category 22. Article III, Section 1, City CEQA Guidelines (Sections 15300-15333, State CEQA Guidelines). I hereby adopt that action
