The Parties have reached an agreement to settle this litigation. The settlement
agreement is attached hereto as Exhibit A. The relator and defendants have also
reached a separate agreement to resolve claims of the relator for attorneys’ fees and
costs pursuant to 31 U.S.C. § 3730(d)(1) and for retaliation under 31 U.S.C.
§ 3730(h).
The Parties agree that the Court will retain jurisdiction over the parties to
enforce the terms of the settlement agreements. The Parties agree that except as
specifically set forth in the settlement agreement between the relator and
defendants, the Parties will each bear their own costs, expenses, and attorneys’ fees.
Accordingly, the Parties hereby request that the Court enter the attached order
dismissing this matter with prejudice as to relators, with prejudice as to the United
States to the extent of the “Covered Conduct” in the Settlement Agreement attached
as Exhibit A, and without prejudice as to the United States on all other claims.
