01) Item No. 27/2012 SPO(R&T)

APPOINTMENT ON COMP. GROUND – CASE OF SHRI SHER ALI, S/O OF LATE SHRI HAJI ALI, EX.G/MAN UNDER SSE(P.WAY) BCO – ADI

(i) Back reference made to Division calling for proforma and specific justification of DRM-ADI.

(ii) Sr.DPO ADI has advised that the case is put up to DRM-ADI

(iii) ADI division has advised that the case for CG appointment of ward of employee was prosecuted to Aii division before formation of ADI division & declined. Now, in view of the above, there is no cause for action to consider CGA on ADI division.

Union requested that this case is a genuine one and be considered.

02) Item No. 62/2012 CMD

REIMBURSEMENT OF MEDICAL CHARGES – CASE OFSHRI D.G. KANAIYA, HC (G) W/U DRM-BVP

The reimbursement case was regretted by HQ, it was confirmed by CMS BVP that no appeal has been received from the employee.

03) Item No.159/2012 CMD/FA&CAO /APO(T&C)

CREATION OF LR-RG IN PARA MEDICAL STAFF-ADI DIVISION.

(i) CPO(Adm) vide letter dated 18.3.2016 has asked all Divisions/Units to critically review to find out what all posts in their system are surplus/redundant. New posts should be created against such surplus/redundant posts, following the prescribed benchmark.

(ii) Creation proposed for non-safety posts and not for new assets.

(iii) As per FC/RB's letter dated 27.11.2015, there is ban on creation of non safety posts.

GRIEVANCES OF TRAFFIC & OPERATING STAFF – BRC DIVN.

GS WREU has been requested vide letter dated 25.5.2016 to provide names of Gr'D' staff who has not been paid overtime.

GS WREU handed over the list of Gr D staff who has not been paid overtime in the meeting.

This will be examined.

REQUEST FOR PERFORMA FIXATION ON PROMOTION AS PAINTER / POLISHER – CASE OF SHRI RAJKUMAR SINGH CHAUHAN, WORKMATE

SSE(W)-II BCT.

DRM(E)-BCT vide letter No. E/E/840/1 dated 25/04/2016 have advised that, this is being an old case and before granting proforma fixation and promotion to Shri Rajkumar in 2008, the matter is under examination and will be reviewed expeditiously and further action would be taken.

Union contended that he is entitled for proforma from BCT.

LOSS OF PENSIONARY & SETTLEMENT BENEFITS AS EMPLOYEE DIED DURING NIP IN FORCE OF WITHOUT FUTURE EFFECT – DAR POLICY

As per D&A Rules/provisions, the chargesheet may be dropped if the charged official dies during its pendency and before imposition of penalty. But when the penalty has been imposed and is in operation and employee dies during penalty, there is no provision to change or drop the penalty in such case, unless any appeal or petition of the employee was pending for disposal before his/her death. Here, in this case no appeal/petition of the employee is pending. The appeal/petition of family members of deceased employee can not be entertained in DAR case. Clarification in this regard sought from Railway Board vide letter dated 16.6.2015, whether there is any scope in the instant case as per which the effect of punishment as " without future effect " can be implemented for pensionery purpose. Reply is still awaited from Railway Board.

14) ITEM NO.12/2014 APO(B&A)

ENHANCEMENT OF PAYMENT OF FLAG BOOKING ALLOWANCE BY 25%.

RBE No.65/2010 which clarifies increase of 25% in rates of various allowances, is applicable in case of Special Allowance as listed out as listed out in the Annexure to the said letter. In this case, honorarium is being paid to Passenger Guards at the rate of Rs.10/- per trip for booking on 'D' class stations and thus it is not covered under RBE65/2010..

Union requested for making reference to Railway Board.

15) ITEM NO.17/2014 FA&CAO/APO(B&A)

NON INCLUSION DIVORCE DAUGHTER NAME IN PPO – CASE OF SMT. REKHABEN V PARIKH, D/O LATE SHRI VANMALIDAS M PAREKH,

EX.HD.CLERK-BVP.

The family pension case of Smt Rekhaben Parikh was submitted to Associate Accounts but the same was returned with queries. BVP Division has submitted the case to Associate Accounts on 21.3.2016.

CREATION OF REVENUE CADRE AGAINST INCREASED OUT-TURN OF LHB COACHES AND BOGIES.

The case was submitted by SPO(W)PL to finance department PL W shop for obtaining concurrence who has returned the case unvetted and has asked to submit fresh proposal. The same is under examination with CWM-PL.

PROVISION OF WALKING PATH IN OLD BUILDING COMPOUND FOR STAFF.

Provision of walking path in old bldg. compound has been provided by marking 4 " width enamel paint patta separating 65 feet wide pathway from GLO entry gate near skywalk to reservation office in the month of June 2015 and again re writing and marking done in Sept 2015. 0 parking has been written between the paths Ss pipe railing is also provided for walking staff at the same location of 3 " width.

21) ITEM NO.45/2014 CMD/APO(B&A)

REFUND OF RS.6000 COLLECTED FROM SHRI GOPAL KRISHNAN NAIR, RETD. SS, AGAINST RE-ISSUE OF RELHS CARD.

(i)A copy of zerox receipt of Rs.6000/- received from WREU, forwarded to CMD on 16.5.)016.

(ii)It has been advised by CMS BRC that no instructions were issued to Shri GK.Nair for payment of Rs.6000/- towards RELHS card.

(iii)CMD has advised that there is no evidence produced by employee which shows that he was asked to deposit Rs.6000/- against re –issue of RELHS card. the only evidence available on file shows that he had a valid RELHS card at BRC which Dr. Pravin Bhide, CMS BRC had transferred to CMS/Kozikode. The reply of CMS BRC dated 12.11.2013 stands good.

WREU stated a new RELHS Card was issued to Shri J.K.Nair on the basis of money receipt of Rs.6000/- paid to Railway administration by APO BRC. Hence, no other proof required and therefore Rs.6000/- be refunded.

22) Item No. 52/2014 DY.CPO(M&E)

IRT – CASE OF SHRI VIJAYSINGH KUSHWAH, CMS(LAB) ELECTRIC LOCOSHED/BL TO SPRING WORKSHOP SITHOLI, NCR

COM has ordered not to relieve the employees due to large number of vacancies. however, RJT Division has been asked vide letter dated 20/4/16 as to whether the above employees can be relieved so that the case can be put up to COM for deciding their relieving.

PRESERVING SERVICE RECORDS OF ALL RETIRED RAILWAYMEN COMING UNDER THE JURISDICTION OF ADI DIVISION

(i)As per practice in vogue, the Service Records of retired staff will be maintained by the Units/Division from where he has retired.

(ii)Union contended that Admn should find out how many age related cases of revision of pension related to age are pending with Sr.DPO ADI. Simultaneously Union will provide list of such cases.

GSWREU has been replied vide letter dated 20.1.2016 that in terms of Railway Board's letter No.E(HQ)II/70/BRI of 4.8.1972, no request for alteration in the recorded date of birth can be entertained if it has not been submitted before the

completion of probation period or three years whichever is earlier. In this case, Shri Harshad has not requested within the specified time frame by Railway Board. He has already retired from service on 31.8.2015, which is in order.

Union contended administration forcibly retired the employee on 31.8.2015 by altering the date of birth.
