The City of Kigali Council Members , in their session of 28/06/ 2013;

Pursuant to the Organic Law n°37/2006 of 12/09/ 2006 on State Finances and Property as modified and complemented to date especially in its articles 5, 6, 8, 9, 10, 24, 25, 29, 30, 32, 34, 37, 40, 43, 44, 45, 46, 48, 49, 50, 53 and 64;

Pursuant to the Law No 59/2011 of 31/12/2012 establishing the sources of revenue and property of decentralized entities and governing their management especially in its articles 4, 5, 57, 58, 60, 61, 62 and 63;

Pursuant to the Presidential order n°25/01 of 09/07/2012 establishing the list of fees and other charges levied by decentralized entities and determining their thresholds especially in its article 3;

Vu la Loi N°10/2006 du 03/003/2006 relative à l’organisation et fonctionnement de la Ville de Kigali spécialement en ses articles 30, 32, 33, 34, 35, 36, 39, 207, 209, 210, 211, 212, 216, 219, 220, 222, 223, 224, 225 et 226;

Vu l’Arrêté Présidentiel nº25/01 du 09/07/2012 établissant la liste des taxes parafiscales et autres redevances perçues par les entités décentralisées et déterminant leurs seuils spécialement en son article 3;

BEMEJE:

Ingingo ya mbere: Amafaranga ateganyijwe kwinjira Hakurikijwe Imbonerahamwe "A" ikurikira, amafaranga ateganijwe kwinjira mu Ngengo y’Imari y’Umujyi wa Kigali mu gihe cy’umwaka wa 2013/2014, ahwanye na Miliyari cumi n’icyenda miliyoni Magana cyenda mirongo irindwi n’eshatu ibihumbi magana arindwi miringo ine na birindwi magana cyenda na mirongo cyenda n’atandatu (19 973 747 996 FRW).

Article One: Expected revenues

In accordance with table "A" below, the expected total resources for the City of Kigali Budget for the fiscal year 2013/2014 are valued at Nineteen billion, nine hundred seventy-three million, seven hundred forty-seven thousand, nine hundred ninety-six (RWF 19 973 747 996).

Article 2: Expenditures

In accordance with table "B" below, the expenditures of the City of Kigali during the year 2012/2013 are valued at nineteen billion nine hundred seventy-three million seven hundred forty-seven thousand nine hundred ninety-six (Rwf 19,973,747,996).

The expenditures of the City of Kigali are allocated towards current expenditures to pay salaries and other goods and services as well as capital expenditures for development projects as follows:

Conformément au tableau "B" ci-après, les dépenses totales de la Ville de Kigali pour la période de l’exercice fiscal 2012/2013 sont évaluées à dix-neuf milliard neuf cent septante-trois million sept cent quarante-sept mille neuf cent nonante-six (19.973.747.996 Frw).

Les dépenses totales de la Ville Kigali sont réparties en dépenses courantes pour payer les salaires et autres biens et services consommes par la Ville de Kigali ainsi que les dépenses en capital pour financer les projets de développement de la ville de Kigali comme suit :

Ingingo ya 4: Amahame agenga ingengo y’imari y’Umujyi wa Kigali

Hakurikijwe uburyo bw’ihuzwa ry’ibigize Ingengo y’Imari rusange y’Umujyi wa Kigali n’amahame ategeka ko Ingengo y’Imari ihurizwa hamwe, igakoreshwa mu mwaka umwe kandi ikagaragaza ibizinjira n’ibizakoreshwa byose, Ingengo y’Imari y’Umujyi wa Kigali ihuriza hamwe amafaranga yinjizwa n’Umujyi wa Kigali ubwawo, Inkunga ziva mu Butegetsi Bwite bwa Leta, Inguzanyo, inyungu z’ishoramari, amafaranga y’abaterankunga ndetse n’amafaranga azakoreshwa mu Ngengo y’Imari isanzwe n’igenewe gushorwa mu mishinga y’Iterambere.

Ingingo ya 5: Umuyobozi Mukuru ushinzwe gucunga ingengo y’Umujyi wa Kigali

Umunyamabanga Nshingwabikorwa w’Umujyi wa Kigali ni we Muyobozi Mukuru ushinzwe gucunga ingengo y’imari y’Umujyi wa Kigali.

Article 4:Principles of City of Kigali’s budget

In accordance with the concept of the unified budget, the rules of unity, universality and yearly budgeting, and for policy purposes, the City of Kigali Budget encompasses all revenue generated by the City of Kigali from its own taxes, non-taxes and fees, incomes from Central Government, loans, investment benefits, donor grants as well as current expenditures and capital expenditures.

Article 5: Chief Budget Manager for City of Kigali’s budget

The Executive Secretary of the City of Kigali is the Chief Budget Manager for the City ofKigali’s budget.

Article 4 : Principes régissant le budget de la Ville de Kigali

Conformément au concept du budget unifié et aux règles de l’unicité, de l’annualité et de l’universalité budgétaire, le budget de la Ville de Kigali intègre la totalité des recettes, des dons et des prêts, des dépenses courantes et des dépenses en capital.

Article 5: Gestionnaire Principal du budget de la Ville de Kigali

Le Secrétaire Exécutif de la Ville de Kigali est le Gestionnaire Principal du Budget de la Ville de Kigali.

Article 7: Extra budgetary expenditures

It is prohibited to incur extra budgetary expenditures whatever their source.

Ingingo ya 8: Ifatwa ry’icyemezo cyo kwishyura

Nta mafaranga yishyurwa hatarabanje gufatwa icyemezo mbere kigaragaza ko azishyurwa. Umuyobozi mukuru ushinzwe gucunga Ingengo y’Imari y’Umujyi wa Kigali agomba kugenzura ko inyemezabuguzi zose zakiriwe n’Umujyi wa Kigali zikandikwa mu bitabo byabigenewe mu gihe kigenwe, akanashyikiriza Ministeri ifite Imari mu nshingano zayo impapuro zisaba ko zishyurwa, itariki yo kwishyura itararenga.

Article 8:Prior commitment to pay

No payment shall be made without prior commitment to pay has been established.

The Chief Budget Managers is required to ensure the timely acknowledgement of all invoices by the City of Kigali and their recording in the appropriate registers in a specific period, and the submission of payment requests to the Ministry in charge of finance, before the due date for payment.

Article 8: Engagement préalable au paiement

Aucun paiement ne peut être effectué, sans engagement préalablement établi.

Le Gestionnaire principal du budget est chargé de veiller à la réception et à l’enregistrement dans les délais de toutes les factures reçues par la Ville de Kigali et de soumettre des demandes de décaissements au Ministère ayant les finances dans ses attributions avant l’échéance de paiement.

Article 9: Authority to borrow in City of Kigali

In City of Kigali, the Council of the City may borrow loans for development projects only in accordance with the Organic law N°37/2006 of 12/09/2006 on State Finances and Property as modified and complemented to date and the law No 59/2011 of 31/12/2011 establishing the sources of revenue and property of decentralized entities and governing their management, the organs of local administrative entities do not have powers to give and approve securities on their general property.

Article 9 : Pouvoir d’emprunter oud’autoriser l’emprunt au niveau de la Ville de Kigali

Au niveau de la Ville de Kigali, le Conseil de la Ville ne peut contracter les prêts que pour le financement des projets de développement conformément à la loi organique No 37/2006 du 12/09/2006 relative aux finances et au patrimoine de l’Etat telle que modifiée et complétée à ce jour et à la loi No 59/2011 du 31/12/2011 portant source de revenus et du patrimoine des entités décentralisées et régissant leur utilisation, les Entités Administratives Décentralisées n’ont pas le pouvoir de fournir ni d’approuver des garanties sur leur domaine public.

guidelines relating to procedures of reallocation of funds from one budgetary line to another in City of Kigali’s budget. The Minister in charge of finance shall authorize Council and the Executive Committee of City of Kigali to manage the budget reallocation.

Notwithstanding the provisions of paragraph one of this article, reallocation of funds from one budgetary line to another is not allowed between the salary and allowances line and other line of recurrent expenditure categories.

Article 11: Closing date of payment of funds and expenditures commitment

Payment of funds provided in the 2013/2014 budget shall be allowed until June 30, 2014 but expenditures commitment shall end on May 15 of the same year unless authorized by the Minister in charge of finance.

Article 11: Clôture des opérations de paiement et des engagements de dépenses

Les paiements rattachés au budget 2013/2014 sont autorisés jusqu’au 30 Juin 2014 tandis que les engagements de dépenses sont clôturés au 15 Mai de la même année sauf exception spécifique autorisée par le Ministre ayant les finances dans ses attributions.

Ingingo ya 14: Itegurwa n’isuzumwa ry’iki cyemezo

Iki cyemezo cyateguwe, gisuzumwa kandi gitorwa mu rurimi rw’ikinyarwanda.

Article 12: Abrogating provision

All previous decisions contrary to this decision are abrogated

Article 13: Commencement

This Decision comes into force on the date of the approval by the City of Kigali Council after it is signed, sealed and published. It becomes effective as City of Kigali Budget Decision from July 1, 2013.

Article 14:Draft and Consideration of this decision

This decision was drafted, considered and adopted in kinyarwanda.

Article 12: Disposition Abrogatoire

Toutes les décisions antérieures contraires à la présente décision sont abrogées

Article 13: Entrée en vigueur

La présente décision entre en vigueur le jour où le Conseil de la Ville de Kigali approuve le budget. Après qu’elle soit signée, scellé et qu’elle soit publiée. Elle sort ses effets, comme décision portant fixation des finances de la Ville de Kigali, à partir du 01 Juillet 2013.

Article 14: Initiation et examen de la présente décision

La présente décision a été initiée, examinée et adoptée en kinyarwanda.
