On September 29,2013 and October 2,2013, the Director of the Arkansas Department ofEnvironmental Quality gave notice of a draft permitting decision for the above referencedfacility. During the comment period, written comments on the draft permitting decision weresubmitted by David Clark on behalf of the Department. The Department's response to theseissues follows.

Note: The following page numbers and condition numbers refer to the draft permit. Thesereferences may have changed in the final permit based on changes made during the commentperiod.

Comment #1:

Specific Condition 9 contained a sentence that gives the appearance that the 22 million boardfeet through SN-05 also applied to SN-01 and SN-02.

Response to Comment #1:

The 22 million board feet throughput limit in SC 9 only applies to SN-05. The second sentenceof the condition has been updated to the following:

Lumber throughput through Dry Kiln # 3 (SN-05), shall not exceed 22 million board feet perconsecutive 12-month period. The permittee shall maintain a monthly record of the lumberthroughput (in board feet) to SN-05. These records shall include the amount oflumber driedeach month and the amount of lumber dried in the previous 12 months. These records shall beupdated by the is" day of the month following the month to which the records pertain, kept onsite and made available to Department personnel upon request.

Section II: INTRODUCTION

Summary of Permit Activity

Hixson Lumber Sales, Inc. hereafter referred to as Hixson, owns and operates a lumber treatmentfacility in Plumerville, AR. The facility is located at 125 Hixson Road west of the intersection ofArkansas Highway 92 and 1-40on the frontage road. This permit incorporates a natural gasdirect fired lumber drying kiln (SN-05) and a sawmill (SN-06), which were already installed andoperations have already commenced. The total permitted emission increases include 8.8 tpy ofPM, 1.4 tpy ofPMIO, 0.4 tpy ofS02, 38.9 tpy ofVOC, 3.8 tpy erco, 3.8 tpy ofNOx, and 2.92tpy of total HAPs.

Process Description

Raw lumber is dried, treated, molded and smoothed at the facility. Two types of lumber aretreated at the facility: dry lumber and green lumber. Dry lumber is first sent to the planer mill(SN-03) for processing, and then to the finished shed before being shipped to customers. Thegreen lumber is sent to one of the two natural gas fired drying kilns (SN-Ol) and (SN-02) prior tobeing sent to the planer mill.

The planer mill consists of two planers and one molder machine. The planers are used to smooththe rough lumber with a six knife head, and the molder is used to make patterns. Particulategenerated at the planer mill is routed to a shaving bin, periodically loaded into a truck and hauledaway.

In the treatment plant, the lumber, timbers and plywood to be treated are loaded onto lumbertrams. The lumber is moved into a large horizontal treating cylinder via a small rail. Thecylinder door is sealed, and a vacuum is applied to remove most of the air from the cylinder andthe wood cells. Preservative solution is then pumped into the cylinder raised to about 150psiforcing the preservative solution into the wood.

Following the pressure release, the solution is pumped back into a storage tank for later re-use. Avacuum is drawn within the treating cylinder to remove excess solution from the wood to controldrippage following treatment. At the end of the process the cylinder door is opened and thelumber is pulled out. The area under the rail is the drip track (drip pad) area. The drip track(pad) area collects solution dripping off the lumber and returns it to the front of the cylinderwhere it is collected and pumped back into the storage tank for later use. After the treatedmaterial has set on the drip track (pad) area and the lumber has become surface dry, the productis ready for storage and / or shipment to the customer.

For the green lumber sawmill operations: green, tree length logs with bark on are brought intothe sawmill facility and processed into rough sawn lumber and wood residuals (chips, sawdustand bark together). The sawmill operation equipment includes a log cut-up / bucking sawsystem, a primary log breakdown circular saw / headrig log sawing system, a cant gang sawsystem, a side-board / flitch sawing / edging system, a green lumber trimmer and trimmed board

lumber stacking machine. A "system" includes lumber roll cases and lumber transfers that movethe cants or boards forward or transversely through the various sawmill machines. Bark on treelength logs are placed on a log transfer and conveyed to a log cut-up conveyor. The logs arepositioned at the cut-up saw and sawn (bucked) into shorter log segments for the sawmill. Thebark on log segments are transferred to the circular saw headrig system and passed through it.The headrig saw produces side-boards (flitches) and a center cant. The center cant is transferredto the cant gang saw machine where the cant is sawn into boards. The side-boards aretransferred to a board edging machine where they are edge trimmed into boards. All the boardsare transferred to the trimmer machine where they are end trimmed to finished lengths. Thefinished length lumber is transferred to a lumber sorting / stacking system where they are stackedinto "packs" for drying.

Additionally waste materials (sawdust, green wood edgings and bark together) from the sawingoperations are collected by a waste collection / conveyor system located under the sawmillmachinery and sent to a wood hog machine where they are converted into a mixture of greenwood chips, sawdust and bark. Particulate generated at the sawmill is routed (blown) to acyclone (SN-06) located atop a shaving bin / auger truck loading system and are periodicallyloaded into a truck and hauled away.

The majority of the rough sawn green lumber produced at the green lumber sawmill is dried by adirect-fired natural gas lumber dry kiln (SN-05). A very small portion may be air-dried. Thereis no additional planing or finishing of the rough sawn dried lumber at the sawmill. The driedrough sawn lumber is either stored under cover or taken to the treatment plant where it is treatedfor use as fencing material or in the construction of fence paneling products. After the treatment,the rough sawn products are ready for storage and / or shipment to the customer.

Section III: PERMIT HISTORY

Permit 1549-A was issued to the facility on June 6, 1995. This was the initial permit for thefacility.

An Administrative Amendment to Permit 1549-A was issued on February 18,2005. This permitis an administrative amendment to the first air permit for the facility, It handles removal of theCCA treatment processes and converts them to a new ammonical copper quaternary compoundwood preservative. The permit was updated to the new template, and the wood treatmentprocesses were added to the insignificant activities list.

An Administrative Amendment to Permit 1549-A was issued on March 25,2005. Thisamendment corrected the AFIN Number throughout the permit.

An Administrative Amendment to Permit 1549-A was issued on August 25, 2005. Thisamendment corrected errors in the emission rates.

Permit 1549-AR-l was issued on November 2,2007. This permitting action incorporated aproduction increase at the drying kilns which was originally approved in a letter by theDepartment on September 9, 1996. The permitted emission increases included 7.9 tpy ofVOC.The permitted emission decreases included 0.2 tpy of PM and 0.4 tpy of PM IO•

The permitteeshall maintain a monthly record of the lumber throughput (in board feet) to each dryingkiln. These records shall include the amount of lumber dried each month and the amountof lumber dried in the previous 12 months. These records shall be updated by the lS th

The permittee shall maintain monthly records of thenatural gas used in SN-OS. These records shall include the amount of natural gascombusted each month and the amount combusted the previous 12 months. Theserecords shall be updated by the lSth day of the month following the month to which therecords pertain, kept on site and made available to Department personnel upon request.[Regulation 19, §19.70S and A.C.A. §8-4-203 as referenced by A.C.A. §8-4-304 and§8-4-311]

11. The permittee shall demonstrate compliance with the emission limits for SN-06 bycomplying with Specific Condition 9. [Regulation 19, §19.70S and A.C.A. §8-4-203 asreferenced by A.C.A. §8-4-304 and §8-4-311]

Insignificant activityemission determinations rely upon the information submitted by the permittee in an applicationdated August 21, 2003.

Section VI: GENERAL CONDITIONS

1. Any terms or conditions included in this permit that specify and reference ArkansasPollution Control & Ecology Commission Regulation 18 or the Arkansas Water and AirPollution Control Act (AC.A. §8-4-101 et seq.) as the sole origin of and authority for theterms or conditions are not required under the Clean Air Act or any of its applicablerequirements, and are not federally enforceable under the Clean Air Act. ArkansasPollution Control & Ecology Commission Regulation 18 was adopted pursuant to theArkansas Water and Air Pollution Control Act (A.C.A. §8-4-101 et seq.). Any terms orconditions included in this permit that specify and reference Arkansas Pollution Control& Ecology Commission Regulation 18 or the Arkansas Water and Air Pollution ControlAct (A.C.A. §8-4-101 et seq.) as the origin of and authority for the terms or conditionsare enforceable under this Arkansas statute.

2. This permit does not relieve the owner or operator of the equipment and/or the facilityfrom compliance with all applicable provisions of the Arkansas Water and Air PollutionControl Act and the regulations promulgated under the Act. [AC.A. §8-4-203 asreferenced by §8-4-304 and §8-4-311]

3. The permittee shall notify the Department in writing within thirty (30) days aftercommencement of construction, completion of construction, first operation of equipmentand/or facility, and first attainment ofthe equipment and/or facility target production rate.[Regulation 19 §19.704 and/or AC.A. §8-4-203 as referenced by §8-4-304 and §8-4-3l1]

4. Construction or modification must commence within eighteen (18) months from the dateof permit issuance. [Regulation 19 §19.410(B) and/or Regulation 18 §18.309(B) andAC.A §8-4-203 as referenced by §8-4-304 and §8-4-311]

The permittee must keep records for five years to enable the Department to determinecompliance with the terms of this permit such as hours of operation, throughput, upsetconditions, and continuous monitoring data. 7. The permittee shall test any equipment scheduled for testing, unless stated in the SpecificConditions of this permit or by any federally regulated requirements, within the followingtime frames: (1) newly constructed or modified equipment within sixty (60) days ofachieving the maximum production rate, but no later than 180 days after initial start up ofthe permitted source or (2) existing equipment already operating according to the timeframes set forth by the Department. The permittee must notify the Department of thescheduled date of compliance testing at least fifteen (15) business days in advance ofsuch test. The permittee must submit compliance test results to the Department withinthirty (30) calendar days after the completion of testing. 8. The permittee shall provide: [Regulation 19 §19.702 and/or Regulation 18 §18.1002 andA.C.A. §8-4-203 as referenced by §8-4-304 and §8-4-311]

a. Sampling ports adequate for applicable test methods;b. Safe sampling platforms;c. Safe access to sampling platforms; andd. Utilities for sampling and testing equipment

9. The permittee shall operate equipment, control apparatus and emission monitoringequipment within their design limitations. The permittee shall maintain in goodcondition at all times equipment, control apparatus and emission monitoring equipment.[Regulation 19 §19.303 and/or Regulation 18 §18.1104 and A.C.A. §8-4-203 asreferenced by §8-4-304 and §8-4-311]

10. If the permittee exceeds an emission limit established by this permit, the permittee will bedeemed in violation of said permit and will be subject to enforcement action. TheDepartment may forego enforcement action for emissions exceeding any limitsestablished by this permit provided the following requirements are met: [Regulation 19§19.601 and/or Regulation 18 §18.1101 and A.C.A. §8-4-203 as referenced by §8-4-304and §8-4-311]

a. The permittee demonstrates to the satisfaction of the Department that theemissions resulted from an equipment malfunction or upset and are not the resultofnegligence or improper maintenance, and the permittee took all reasonablemeasures to immediately minimize or eliminate the excess emissions.

b. The permittee reports the occurrence or upset or breakdown of equipment (bytelephone, facsimile, or overnight delivery) to the Department by the end ofthenext business day after the occurrence or the discovery of the occurrence.

c. The permittee must submit to the Department, within five business days after theoccurrence or the discovery of the occurrence, a full, written report of suchoccurrence, including a statement of all known causes and of the scheduling and

nature of the actions to be taken to minimize or eliminate future occurrences,including, but not limited to, action to reduce the frequency of occurrence of suchconditions, to minimize the amount by which said limits are exceeded, and toreduce the length of time for which said limits are exceeded. If the information isincluded in the initial report, the information need not be submitted again.

11. The permittee shall allow representatives of the Department upon the presentation ofcredentials: [A.C.A. §8-4-203 as referenced by §8-4-304 and §8-4-311]

a. To enter upon the permittee's premises, or other premises under the control of thepermittee, where an air pollutant source is located or in which any records arerequired to be kept under the terms and conditions of this permit;

b. To have access to and copy any records required to be kept under the terms andconditions of this permit, or the Act;

c. To inspect any monitoring equipment or monitoring method required in thispermit;

d. To sample any emission of pollutants; ande. To perform an operation and maintenance inspection of the permitted source.

12. The Department issued this permit in reliance upon the statements and presentationsmade in the permit application. The Department has no responsibility for the adequacy orproper functioning of the equipment or control apparatus. [A.C.A. §8-4-203 asreferenced by §8-4-304 and §8-4-311]

13. The Department may revoke or modify this permit when, in the judgment of theDepartment, such revocation or modification is necessary to comply with the applicableprovisions of the Arkansas Water and Air Pollution Control Act and the regulationspromulgated the Arkansas Water and Air Pollution Control Act. [Regulation 19§19.410(A) and/or Regulation 18 §18.309(A) and A.C.A. §8-4-203 as referenced by §8­4-304 and §8-4-311]

14. This permit may be transferred. An applicant for a transfer must submit a written requestfor transfer of the permit on a form provided by the Department and submit the disclosurestatement required by Arkansas Code Annotated §8-1-106 at least thirty (30) days inadvance of the proposed transfer date. The permit will be automatically transferred to thenew permittee unless the Department denies the request to transfer within thirty (30) daysof the receipt of the disclosure statement. The Department may deny a transfer on thebasis of the information revealed in the disclosure statement or other investigation or,deliberate falsification or omission of relevant information. 16. This permit authorizes only those pollutant emitting activities addressed herein. [A.C.A.§8-4-203 as referenced by §8-4-304 and §8-4-311]

17. This permit supersedes and voids all previously issued air permits for this facility.[Regulation 18 and 19 and A.C.A. §8-4-203 as referenced by §8-4-304 and §8-4-311]

18. The permittee must pay all permit fees in accordance with the procedures established inRegulation No.9. [A.C.A §8-1-105(c)]

19. The permittee may request in writing and at least 15 days in advance of the deadline, anextension to any testing, compliance or other dates in this permit. No such extensions areauthorized until the permittee receives written Department approval. The Departmentmay grant such a request, at its discretion in the following circumstances:

a. Such an extension does not violate a federal requirement;b. The permittee demonstrates the need for the extension; andc. The permittee documents that all reasonable measures have been taken to meet

the current deadline and documents reasons it cannot be met.

20. The permittee may request in writing and at least 30 days in advance, temporaryemissions and/or testing that would otherwise exceed an emission rate, throughputrequirement, or other limit in this permit. No such activities are authorized until thepermittee receives written Department approval. Any such emissions shall be included inthe facilities total emissions and reported as such. The Department may grant such arequest, at its discretion under the following conditions:

a. Such a request does not violate a federal requirement;b. Such a request is temporary in nature;c. Such a request will not result in a condition of air pollution;d. The request contains such information necessary for the Department to evaluate

the request, including but not limited to, quantification of such emissions and thedate/time such emission will occur;

e. Such a request will result in increased emissions less than five tons of anyindividual criteria pollutant, one ton of any single HAP and 2.5 tons of totalHAPs; and

f. The permittee maintains records of the dates and results of such temporaryemissions/testing.

21. The permittee may request in writing and at least 30 days in advance, an alternativeto the specified monitoring in this permit. No such alternatives are authorized until thepermittee receives written Department approval. The Department may grant such arequest, at its discretion under the following conditions:

a. The request does not violate a federal requirement;b. The request provides an equivalent or greater degree of actual monitoring to the

current requirements; andc. Any such request, if approved, is incorporated in the next permit modification

application by the permittee.
