Sealed Tender in two bid system “Technical Bid“ & ”Financial Bid” are invited for supply of Surgical Consumables for use in Vardhman Institute of Medical Sciences Hospital, Pawapuri, Nalanda -803115.Tender document containing terms & Condition, eligibility criteria list of items to be procured etc. can be purchased from office of the Superintendent On any working day in working period or can be down loaded from the website www.vimspawapuri.orgTender Document fee:- Rs. Five hundred (Rs. 500/=) only in form of demand draft drawn in favour of Superintendent VIMS, Pawapuri issued from any scheduled Nationalized Bank, Payable at Pawapuri.Earnest Money Deposit (EMD):- Rs. Eligibility Criteria:-

1. Manufacturer Company must have minimum three years old manufacturer license of the items being quoted up to last date of tender with latest license renewal certificate and approved product list. In case of supplier then latter of authorization by manufacturer to the supplier.

2. Should be registered with GST and have pan card.3. Should have update proper drug license

4. Should have experience in supply of items to Government/ PSU Hospital.5. Should not be blacklisted debarred from Govt. Supply both manufacturer and

supplier.6. There should be no case pending before vigilance Police /CBI/Court of law against

the firm7. Annual turnover should be not less than two cores in case of manufacture and not

less than Twenty five lacs in three consecutive years between 2013-2014.2014-2015.2015-2016.

Preparation & Submission of Tenders:- Tenders document should be computer typed. Attached Document must be legible. Cutting should be avoided and if it is necessary. It should be done by one line and should bear initial of authorized signatory. Over writing on any paper will render the document invalid (Non-responsive). Cutting in financial document is not allowed. The tender is in two bid system.

1. Technical bid:- One envelope (cover 1) of sufficient size to accommodate all papers required to be attached with technical bid should be super scribed “Technical Bid for Surgical consumable” addressed to Superintendent Vardhman Institute of Medical Sciences Hospital, Pawapuri, Nalanda. This envelope should contain –A. Demand draft of Rs. Five hundred only (tender document fee) in case of down

B. DD of Earnest Money deposit.C. Registration with registrar of firms (if applicable)D. If the signatory is not the proprietor of the firm then letter of authorization by

competent person.E. GST Registration document.F. Audited balance sheet by CA 03 Years- 2013-14.2014-15.2015-16.G. Last three yrs. I.T ReturnH. Update ISI/CE/US FDA/BIS/WHO GMP/G MP Certificate whichever is applicable.I. Literature and catalogues in support items quoted.J. Current letter of authorization from the principal manufacture supplier.K. Annexure I, II & III Completely filled.L. Any other document which the tenderer feel will give him weigtage eg.

Performance certificate of equipments / Item EACH PAGE of the submitted document inclusive of tender document must be page numbered, signed and stamped by authorized signature. Unsigned, unpaged document will not be considered.NONE OF THE FINANCIAL (COMMERCIAL) DOCUMENT BE PLACED IN TECHNICAL BID. THIS WILL RENDER THE TENDER NON RESPONSIVE.

2. Financial Bid: - Second envelope of sufficient size (Cover II) should be super scribed “Financial Bid for surgical consumable“ addressed to Superintendent Vardhman Institute of Medical Sciences Hospital, Pawapuri, Nalanda. This should contain

Annexure V. Bidder should quote firm rates. No condition like discount in price, free goods/ incentive will be accepted towards finalization of the tenders. Rates should be according to a unit. I.e. per piece/per Box mentioning the box containing how much unit. No items should be quoted with price more than MRP or prevalent market rate. It should not exceed price to retailer/ Trade price /From V as applicable. Price quoted should be in Indian currency. Price list in form of form V / Trade Price list/price to retailer should be attached; Financial Bid Proforma information in Microsoft Excel in compact disc/ DVD should be kept in this envelope. This envelope should now the sealed from all sides and should bear the name, complete email id and contact No. of the tenderer Unsealed, torn envelope will not be considered.

3. Both these two envelopes (Cover I & Cover II) should be placed in third bid envelope of sufficient size to accommodate these two easily. This envelope should be super scribed “Tender for Surgical Consumable” and addressed to Superintendent Vardhman Institute of Medical Sciences Hospital, Pawapuri, Nalanda-803115. This should bear the name, complete address, email id & contact no of the tenderer or Tender document should be sent to Superintendent Vardhman Institute Of Medical Sciences Hospital, Pawapuri, Nalanda-803115 by speed post / Registered post so as to reach the office latest by 15th October 2017 by 5:00 PM. Tender will opened for evaluation of Technical bid at 12:00 PM on 16th October 2017 in front of member of purchase committee. Tender or their representative with proper authorization letter may be present on the date. Date of opening of financial bid will be fixed after evaluation of technical bid and those who will qualify in technical bid. will be informed by email/mobile no/ website. On that day it is their discretion to attend or not.

General Terms & Condition:-1. This Rate contract will be valid for one year from the date of finalization.2. Tender document fee is non-refundable.3. For claim of exemption from EMD, the tenderor has to submit proper documents.4. In case tender is sole distributor of a particular items, he should submit self attested

authority letter in support from the actual manufacture or In case tenderor is selling agent of a particular item than he should submit an authority letter in support of the some from the actual manufacture or /sole distribute concerned.

5. Firms have to supply the certificate for all sterile consumable items manufactured in India from Govt. authorized laboratory / in house report.

6. Attested Photocopy of latest valid ISI/BSI/ CE/ US (FDA)/ who GMP/GMP certificate whichever is applicable should be provided with technical bid.

7. Attested Photocopy of latest valid license for stockiest and distributor as per Drug & Cosmetic Act.

8. Attested Photocopy of latest valid Drug Import license wherever applicable duly issued by Drug controller of India in respect of items quoted in tender.

9. Quality control of all items must be strictly adhered to.10.The tenderer should submit market standing certificate/Physical existence certificate

issued by appropriate authority.

11.Tenderer are bound to supply the items at store of Vardhman Institute of Medical Sciences Hospital, Pawapuri, Nalanda during the validity period on approved rate.

12.Fall clause- If at any time during contract period, the contractor / manufacture / distributor reduces sale price or sells or offers to sell such store are covered under the contract to any person / organization including the purchaser or any hospital of contract government / State government at a price lower than the price chargeable under contract, he shall forthwith notify Superintendent Vardhman Institute of Medical Sciences Hospital, Pawapuri, Nalanda about such reduction / sale / offer to sale to purchase and the price payable under the contract for the stores supplied after the date of coming into force of such reduction or sale or offer of sale shall stand correspondingly reduced.

13.In case the quality of items supplied are not in conformity with the standard of supplies or supplies are found defective by the user department or during inspection / quality control test done by appropriate authority at any stage, appropriate action such as imposition of penalty, cancellation of agreement, black listing and lawful action apart from forfeiture of Performance security deposit will be taken against defaulter supplier/ manufacture as decided by the purchase committee. Entire batch of the item will have to be taken back by the supplier at its own cost and hospital will not be responsible for any damage during this period, Entire amount of that particular product that failed in quality test / found defective will have to be returned or will be deducted from performance security deposit without taking consideration that a part or entire product has been consumed. Leaked soiled broken containers with damaged labels shall not be accounted for purpose of supply.

14.If the awarded supplier is unable to supply the ordered items in given time frame, the award can be given to L2 by decision of the purchase committee and the difference will be adjusted from performances security deposit of L1. If –L1 is more than one firm, Superintendent reserves the right to award contract to one or may split the order to companies of L1 Rate.

15.Earnest money deposit will be refunded without interest to all those bidder who could not succeed in tender, after award and agreement with the successful bidder. EMD of successful bidder will be treated as performance security deposit and will be returned after sixty days of completion of contract. No interest will be payable over this amount. In case of those who claim exemption from EMD and their claim has been granted by the committee, and if that firm is awarded tender, it has to deposit performance security Deposit in the form of DD/FDR

16.Any certificate which has expired, in that case certificate from appropriate authority that the manufacturing agency / Firm has applied for revalidation / renewal.

17.As these items are to be used in treatment of human beings any compromise with the quality will not be allowed that means quality of the item will be deciding factor and not the price.

18.All annexure will have to be submitted and non submission of any will render the tender non- responsive.

19.Shelf life of supplied items should be at least 80% of the stipulated total shelf life from the date of manufacturing of that product.

20.Those bidders who will qualify in Technical Bid may be asked for demonstration of items. They will be intimated by email/mobile/ Website. Every sample of the item quoted as per applicability should be tagged with the slip on which the name of the firm, items no. and name should be mentioned but in No CASE ANY RATE / PRICE be mentioned or visible. This will render your tender non-responsive. After finalization of the tender, samples of the unapproved firms must be removed by the firms from the hospital premises within ten days after the date of decision failing which hospital will not be responsible. In case samples cannot be submitted, necessary catalogue, specification, mark, brand etc. may be given.

21.Performance security Deposit is liable to be forfeited if the supply is not in time or the tenderer withdraws or awards or impairs or derogates the bid in any respect. In case firm fails to deliver the item at schedule time, Superintendent reserve the right to procure the item from open market and excess expenditure incurred will have to be borne by firm.

22.In case of loss of potency of active ingredients or premature deterioration of the formulation in store, not meeting specification at any time during the life period of the store, then the supply will be replaced free of cost by the supplier within 30 (Thirty )days failing which the entire supply will be recovered along with risk purchase.

23.Manufacture / Supplier will be fully responsible to observe all rules & regulation of Drugs & Cosmetics Act issue by Govt. from time to time.

24.Tender whether technical or financial, about sample of different categories decision of Purchase committee will be final and cannot be challenged anywhere as all those items are to be used on human beings.

25.Superintendent reserves the right to get inspection analysis of any items from a government or private laboratory as per availability. Supplier will be fully responsible to bear any damages or loss sustained to patient / Government through the use of defective material. He will have to bear the cost of test. He will arrange immediate replacement if product is found of substandard quality.

26.If the items are made availability at the State Procurement Agency BMSCIL, then the items will be procured from BMSICL. Govt. Agency as per need.

27.Superintendent Reserve the Right to amend / delete /add/relax any clause at any stage of tender process without assigning any reason. He may ask to deposit additional performance security deposit.

28.APPROVAL OF TENDER & RATE SHALL NOT BIND THE HOSPITAL TO NECESSARILY PROCURE THE ITEMS / ITEM

29. All disputes or differences arising during the execution of contract shall be resolved by mutual discussion failing which the matter shall be referred for arbitration to Principal Vardhman Institute of Medical Sciences Pawapuri or his nominee.

30.Court at Bihar sharif (Nalanda shall have alone jurisdiction to decide any dispute arising out or a result of contract.

Terms & Condition of supply order:-

1. Delivery of good has to be made to hospital store strictly in accordance with supply order and with the approved specification / sample. For which no extra payment will be made.

2. Supplies have to be made within 30 (thirty) days from the date of the dispatch of the order failing which a penalty of 2% per week up to 10% maximum will be imposed . If there is urgency of the items same may be procured from market and the cost will be adjusted form security Deposit. However in exceptional circumstances e.g riot, strike, natural calamity etc., on written request the extension of the date of supply may be considered at the discretion of superintendent. Earlier supply will be point for supplier.

3. For non –supply:-Performance security Deposit will be forfeited and necessary legal action including black listing/debarring will be initiated.

4. All rejected stocks shall be at the risk of supplier and must be removed immediately.5. All items should be marked/embossed “Bihar Government supply not for sale”.

Payment:- Payment will be made after the receipt of items in good condition as per specification of the order and packing Bill has to be produced in triplicate having all necessary articles like bill no, GST NO., DL no or other(as per applicability)-No advance payment will be mode.-Payment will be mode as per availability of funds under the head of procurement.Exclusive right of Superintendent:- Superintendent Vardhmnan Institute of Medical Sciences, Pawapuri , Nalanda 803115 has the full and exclusive right to accept or reject any or all the tenders without assigning any reasons what so ever.No Enquiries, Verbal or written shall be entertained in respect of acceptance/rejection of the tender.
