The meeting was called to order at 7:04 p.m. by the vice-president of the Board of Education, Ms. Dolan. Report from State Monitor – Thomas EganAnnual audit will begin about September 21st and will be done by the end of October. Requested progress reports from auditor for board for the November meeting. They will be doing an examination of outstanding findings. District is in sound financial condition.Amount of legal fees due to a lot of litigation, fees for grievances, contract negotiations with the various groups.

Regular Public Meeting September 19, 2016

Arlene Schor: High school dance program was abolished and tenured teacher let go. Teacher taught dance program for 15 years. Enhanced student achievement. Never appeared on agenda to abolish program or to let go tenured teacher. Attempting to hire someone to do dance club at $39 per hour. Should reconsider procedure.

Michael Sheldon: Questions regarding candidate for staff accountant on agenda. Asking board to table agenda item A7 and research background of candidate.

Michael Mignone: Thanked board for working with the BEA on contract. Summer teachers were not paid appropriate rate. Why was contract violated? (Ms. Dolan: Until contract is signed not a valid contract.) Other bargaining units did not sign their contracts until end of August but they received their benefits. Memorandum of Agreement is a signed contract. (Mr. Egan: Not true.) Why are teachers held to different standards? (Dr. Tomko: Clarified what the issues were – memorandum not a signed contract.)

Vincent Frantantoni: Student representative did very well using the microphone. District has been hiring people from Elmwood Park, usually people are hired that are successful and have proven themselves. Why hire candidate coming from questionable background? Please table A7 - we need qualified people. Need to get back to basics.

Moved by Mr. Kuebler, seconded by Mr. Vellon, to close Public Participation. Motion approved 6-0

Moved by Mr. Kuebler, seconded by Mrs. Torres, to move to a short recess 8:20 p.m.Moved by Mr. Kuebler, seconded by Mr. Vellon, to reconvene meeting 8:28 p.m.

Mr. Vellon: Based on articles presented to board, board does not have all the facts on A7 candidate.

Mr. Kuebler: Staff was restructured. Dance teacher only possessed certification to teach dance a part-time schedule.

Mr. Vellon: Position was not properly posted.

Dr. Tomko: Position was properly posted.

The board then moved into the following Resolutions:

A. PERSONNEL: Moved by Mrs. Torres, seconded by Mrs. Lamparello, the Board passed the following resolutions A1-A6, A9, A11-A16, A19-A23, A25-A30 by a roll call vote of 6-0.

RESOLVED, that the Board of Education, upon the recommendation of Dr. Richard D. Tomko, Superintendent of Schools: 1. Accept the resignation of Cory Koransky, Teacher of Science, Middle School, effective September 12, 2016. (Position Control # 40-11-04/avm, Job Code 2231G)

11. Approve the production of Belleville High School’s Theatre Arts Company, Disney’s The Little Mermaid, for this upcoming spring.

12. Be it resolved, that the Belleville Board of Education hereby ratifies the Memorandum of Agreement and attached salary guides between it and the Belleville Administrators Association covering the period from July 1, 2015 through June 30, 2019, subject to the preparation of final contract language; and

Be it further resolved, that the Board President is authorized and directed to execute the final Collective Bargaining Agreement, consistent with the terms of the Memorandum of Agreement and in a form satisfactory to Board Counsel.

13. Approval of veteran dedication and memorial "stadium seat" in honor of all those citizens who served in the armed forces and those who gave the ultimate sacrifice for the service of our country (portion of funds supported through the senior class and class of 2016).

14. Approve a Dress Down Day for Belleville High School on October 21, 2016 to help defer the cost of the Senior Prom. 15. Approve the New Jersey Department of Education School Self-Assessment for Determining Grades under the Anti-Bullying Bill of Rights Act, July 1, 2015 – June 30, 2016.

D. PURCHASING & BUSINESS SERVICES: Moved by Mr. Kuebler, seconded by Mr. Vellon, the Board passed the following resolution D1 by a roll call vote of 6-0.

RESOLVED, that the Board of Education, upon the recommendation of Dr. Richard D. Tomko, Superintendent of Schools:

1. The following resolution was approved by the State Monitor, Thomas Egan. - Confirm the following Joint Transportation Agreements with the Nutley Board of Education for Nutley to provide transportation for Belleville student from June 27, 2016 to July 30, 2016.

Moved by Mr. Kuebler, seconded by Mr. Vellon, to open Public Participation. Remarks by Citizens – ANY ITEM (Public Participation Session 2):Ryan Kline: Thank you for approving Administrator’s contract. Negotiations were respectful across the board.

Arlene Schor: Read paragraph from previously filed ethics complaint decision. Complaint was dismissed. Urged that students not be used to carry home information about election candidates. (Dr. Tomko: Will make sure district knows everything that is happening.)

Michael Sheldon: Thank you for defeating item #A7. Candidate’s night – will forum run same as last year? Asked that Mr. Ross would reach out to the candidates. Several pieces missing from DOE website on Belleville so Belleville wasn’t ranked higher in NJ Monthly Magazine (ranked 369 out of 398)

Bill Mildon: Domicile investigator, who authorized his use of Ford Explorer? Given permission by administration same as Building & Grounds Supervisor. Vehicles stolen from #8. (Mr. Edelstein: Can’t discuss, under investigation)

BEA: On surface things like good ex. New stem lab. Actually old science books in middle school, offered woodworking course but dropped dance class, don’t have supplies, desks falling apart. Schools are neglected. Money was put into legal fees rather than schools. Challenged election of BEA officers, decision board had no business in. Need to focus on spending on children. Settled fair contract. Sponsored professional development.

(Dr. Tomko: a lot of things happening here – transparency needs to be on both sides. New science books cost $350,000. Supplies have been ordered, some on backorder. Some vendors will not work with us because of past payment practice. Get teachers involved.) Point being – still going down old road wasting money on legal un-necessities! Use on children!!

Celina Revollar: Spoke in favor of the dance program. Helped her become more confident. Teacher was so kind to all her students and always there for them. Breaks her heart that this was cancelled. Over 100 students were signed up to take dance this year, why are students being denied opportunity to participate in beautiful art form.

Vincent Frantantoni: Thanks to board for voting no to #A7. Truck was stolen from School #8 parking lot – gate not locked. Gate is still not locked. (Dr. Tomko: Gate can’t close.) Take care how stipends are given out. Multiple stipends given to same person adds up. Too many half session days for teachers to have in service days. Students should be in school. Thank you Ms. Dolan for being very courteous running the meeting. Stop outrageous legal costs.

Thank you to Administration for presentations. Will hopefully move district forward. Get involved, your children and your town needs you. Asked Dr. Tomko to schedule Building & Grounds Committee meeting.

Mr. Vellon: Thank you to the presenters for their presentations. Follow up on policy meeting- teachers at meeting. Apologized for missing last meeting. Meeting moved because there wasn’t going to be a quorum, quorum is trustees not administration. Administration has made some gestures toward teachers to include them. Can bridge the gap!

Mr. Barrera: Thank you to Ryan Kline for presentation and your hard work. Welcomes opportunity to work with public. Thanks for publics comments.

Mrs. Lamparello: Girls varsity volleyball team 6 and 0. Football team has won two games so far this season. Thanks everyone who has been so supportive of our fall teams.

Mr. Kuebler: Thank you all for coming. Congratulations on current contract. Parents should be working with teachers. Everyone needs to be on the same page. Very important that board members do their homework before meeting.

Ms. Dolan: Congratulations Mr. Henry – wonderful job this summer! Administrator’s negotiations very professional, thank you!

6:00 PM, on Monday, September 19, 2016, at Belleville High School, 100 Passaic Avenue, to discuss matters that may be discussed in private in accordance with Chapter 231, Laws of 1975; more specifically, the discussion of personnel, staff evaluations, pending litigation, and negotiations. The results of these discussions will be acted upon at the next regularly scheduled business meeting of the Board, or as soon as feasible and/or practicable thereafter.
