o o NIOBRARA COUNTY COMMISSIONERS' MEETING NIOBRARA COLINTY, WYOMING September 4,2018 The County Commissioners' meeting was called to order on this date at 9:00 a.m. with Chairman Richard A. Ladwig, Commissioners Patrick H. Wade, John Midkiff and County Clerk Becky L. Freeman, present. Commissioner candidate Elaine Griffith was also present. Cody Clark and other landowners who live on Boner Road and in the surrounding area, met with the Commissioners and asked what repairs/improvements were planned for the roads in that arca. The group discussed the condition of Boner and Indian Creek Roads and would like something to be in the works before winter if possible. Mr. Thomas said he would contact the oil company to see what plans they might have for road work. Mr. Ladwig said that the County is trying to get the roads on a plan for winter work. Mr. Wade explained that the County has been doing fall projects and it seems to work well in the winter months. Mr. Wade also noted that while they understand and can appreciate everyone's concerns about their roads, it is the Commissioners' job to prioritize which roads receive repairs first, based in part on mail and school routes, the amount of money available and condition of the road. The Commissioners acknowledged that Boner Road needs work. The question was asked if portions of the road could be done instead of all of it at once and Mr. Ladwig said that could be done. Residents living in the Frontier Reserve voiced concerns about access from Frontier Road to Clark's Road. They said it is very difficult to get out if the road is wet. They also worry about emergency vehicles' ability to get out there. The Commissioners said they appreciated everyone coming in to discuss the roads. Mr. Clark said they appreciated any help that could be offered. Kody Nelson, Hospital Director of Operations, presented a check for $122,482.00 to reimburse the Hospital O & M account which was borrowed against to purchase radiology upgrades. Mr. Nelson gave a brief update on what is happening at the hospital and noted that he is there fulItime. He said that there are two construction projects planned; the first is the tub room which is used for long term patients. The current room isn't patient friendly. They also plan to do roof repairs. He also said the next big ticket item is will be IV pumps. The group also discussed involuntary commitments and past problems that have occurred as far as patient transports. County Attorney- Deputy Attorney Doyle J. Davies met briefly with the Commissioners and discussed the Hanson Well buyout option. He also talked about the abandoned vehicle towing contract. Mr. Thomas asked about the Road Use Agreement with OneOK. Road Crossine Permit- Mr. Wade moved to approve the Road Crossing Permit on Dixon Road for Cheyenne River Resources, LLC. Mr. Midkiff seconded, motion carried. Brown Pit- BLM sent a bill to the Browns for $1,500.00 as a charge for materials taken from the pit. Mr. Thomas said he had contacted BLM and told them we used to get the material free of charge. BLM explained that the State wants $0.30 per ton and they estimated we would extract approximately 5,000 tons over five years, thus the $1,500.00 charge. Mr. Thomas explained that the County had just paid $10,000.00 reclamation bond fee for the pit expansion and asked if they would reconsider the material fee. Mr. Thomas said he was able to negotiate a total fee of $500. o

Danette Welsh, ONEOK Government Resources Director, met briefly with theCommissioners and discussed the construction of the pipeline.

The question of sales tax was discussed and Ms. Welsh said the pipeline being deliveredto Yoder and as she understands it, ONEOK has to pay sales tax to the state and then the statedistributes to money to counties based on amount of product installed in said counties. She saidshe would double check and report back.

Elected Officials and Dept. Heads- James Santistevan, Emergency ManagementCoordinator, Dell Atkinson, Long Term Recovery Manager, Keri Thompson, Treasurer, RickZerbe, Sheriff, Denise E. Smith, UW Extension Coordinator, Kayla Courtright, Clerk of Court,Teri Stephens, Assessor and Becky L. Freeman, County Clerk met with the Commissioners anddiscussed office operations and county business.

Mrs. Stephens said they finished the tax roll and it has been submitted to the Treasurer.They are still inputting information from sufllmer reviews and she is still looking for help.

Mr. Santistevan discussed the regional hazard mitigation plan. He said he needs to pubthe finishing touches on the Emergency Operation Plan and he discussed the THIRA plan.

Mrs. Courtright discussed a meeting she attended for child support collections. She saidthere isn't a lot happening in the office right now.

Mrs. Thompson said that tax notices have been mailed out and they are busy doing monthend.

Mrs. Smith said they are busy wrapping up County Fair and that the kids did well at StateFair.

They have a school to work student that comes in for about 45 minutes a day.Mr. Zerbe said he had a dispatcher quit, the inmate count is 17, and Fisher Roofing is

working on replacing the roof.Johnson Controls will be here this week to start setting up a form for concrete pad for the

air cooling system.He said that the company that is installing the door boards has been in and reviewed the

doors and panels and is in the process of building the components right now.Mr. Wade talked about ONEOK's community funding grant and the pipeline sales tax

matter.Contractor Agreement for Technical Services - Mr. Midkiff moved to approve the

Contractor Agreement between Niobrara County and Community Consulting and Advocacy(CCA). Mr. Midkiff seconded, motion carried. CCA will provide technical support to theCounty Prevention Specialist.

Consent Agenda- Mr. Midkiff moved to approve the consent agenda. Mr. Wadeseconded, motion carried. Items on the consent agenda were the minutes of the August 21,2018meeting.
