If the company had H1;S';)ccted on account ,of the 'entry that Shri Lobo had -committed mi-sappropl'iaUcn of :the com­pany's .property, it should have investigated the matter before, :or soon a,fter the 114th Decemh:~l' 1963. Even if it learnt laiter than 18th December that Buell misappropriati.on had !taken place, it could n'Ot in any ca"3E! without ?ny regular :inquiry pass an order terminating the services of 8hri Lobo. If the order is not legal on technioal grounds, :it certainly is -illegs.l as 'b:eing ,contrary to the pl'ineiples of natural justice, mala fide, and manifestly 'actua.ted by a desire to victim.ise. Shri Na.ir pOints out that the Conciliation Officer also considered this action art; ,the 'company -as irregular. In ,para 3 page 2 ~of his rep-om, he has rem'arkec1 tlla,t at fJrst the charge 'against the workman was .only of rnisbehaviour wLth his superior. In this _ -charge sheet -there: is no reference to the' -subsequent charge Ibl'1ought against: the worker of misappropriaJtion of the .company's pr«>perty. The present inquiries 'according to :the company were made on 21st and 24th DI.;cember. Even

after these inquiries ,the worker was allowed to resume work 'on 26th December. It is not dear what -other charcres were pending &gainst him, what inquiries were made, and~w!hy the charge :of misappropriation of -cement bags was held proved aga.inst him, ',md h~s services were terminated IOn 14th Ja­nUl.u:y .1964. It is true: t.hat the -company was at fault, in not holdmg a separate and retgwar inquiry in regard ito the cl1arge 'of misappropriation of cement bags afltel' :it. had decided to take him hacle as ,ttm:e-<ke'eper 'o1ll2-6-'li2-1963., The company has also not made it clear in its written stakement how the charge was h'eld prove:d doll investigaUons '}reId after :24.+th t[Jec'ember, and why -a worker who after that date was allowed to resume work subsequently was removed from :service. But merely on the ground of lll'll'egml'a.riiti'es f_iDJ 3J domestic ,inq.ui-ry, :or even tn absence of 'it, :the action -taken ,against :the worker camnot be c'onsidered illegal. It ;is the (lut.y of the Tribunal to investigate and find 'out whether the misconduct ",,"ith which ;the worker has been charged was committed by hi·m. The Supreme Court in Punj-a:b National Bank Ltd. -and their workmen, 1959 H. L. L. J. :po 666, has held that merely because the manage­ment has not held an 1nqu'iry the worker <:annot be 'reinstated and the action of :the- ,company decla;red <iUeg'all. In this 'le~pec:t their L'ord-shi<ps have observed a,<; foHows (se'e'" page &82) :

I must consider the. me:,~its of -the impugned order as at la-r-ge before we, and take e'V_ldence, and make 'an inquliTY, and deCide ,the matter myself, and if it js fiJund !On the evidence produced 'hefore me, that -the icharge fQr which the worker was -dli~miss(~d without an inquiry is proved, then in spite of t~e 'absenc~~ of inquiry the management's <action must be UPM -(leld. Hav:~ng this_ decisi'on in mind I ~nvest.igated the mattei' myself, summoned witnesses, and allowed the 'parties to pro­duce their witnes::;es. The first witness 'who was 'exa'l11ined on behalf of the management was Sh:!':' L. A. Correia, Admi­nistration 1{anager. He says 'in hi;:. statement recorded iOn ;:30th June j 9-.64, that he held an !inquiry on 24th December 1963, he produced the ,papers 'of the inquiry and said, that whaJtever is written therein is 1:rue. In" fact there is strong reason to suspect that the entry was madp. deUbera~ tely to -COVf'!' up the misappropdation of these bags either at the instance, or "by {he connivance of Shri Lobo. Inability to account for material Which 'was in his 'Charge 'and is missing, 1S a lSe:rimlS misconduct on a store-keeper.
