The agr8em fmt took place 'after the incident of G'h1'i Lobo being rude to the Engineer-in-charge Shri SchmN,l<:. Later, on an entirely dif­ferent -ground -his serviceS' wel'(: terminated. If a ,particular misconduct is alleged agaim;t J, wOl'kel' and he 'is stopped from ,working, and then under an agreement h taken ;back on work, it does not mean that 'wh!k the a.gre(·ment is sub­sisting ihe 'cannot lbe -punished for- any ,other roi.:-.c:onduct com­mitlt.ed :in the -past, or ~s at Hbet.y to commit any other mis­conduct he likes in future 'and hecomes completely immune t-o any kind :of punishment wha-cever.

6. -Shri Nair says, ltJhat if .the f),CtiOll taken by the company subsequent to th-is agreement c.Ulnot be considered as illegal merely :on account of the ex',: tence of the agreement, the company's refusal to imple-mcnt 1l:e agreement by fincL'ng cut anorther pretext for rt:erminatin:_r the services of the worker concerned, even before the cay on which the agreement was to ,be implemented had arrived, deaxly points to ,the company's desh'e to persecute and victimi,3,',~ 8hr1 Lobo. He 8ays, that the management 'appears to have made up its mind, ever since Shrt Lobo started taking ,part -.n the- acti\..-:ities of ,the uni'on, and lin representing ·the grieVl<-DC2;'; -of the wor-kers, to get rid of lhim on some pretext Or 'oth'~l" Sr'-!',i 'Nair' po~nts out, .that even ;before the ~-&th Decerone!' 1963, the day Dr the incident of alleged disorderly behaviour -;ook place, the company knew about the alleged shortage of cement bags. The sub:'3equent enquiry was held merely in 'ord ~:, to find out some other pre­text, for getting rid of Shl'i Lo-'},) wl\o had become a persona nOfl..>-graIta on a:ccount If\f hi'S unh.1 ,activities. In faot Shri Nail' says, -that no regular inquiry wa;,; held thereafter. The entry .on which rests the cha)1ge 'of misappropri-a,tion of the cement bags is dated 14th December W63. How ~s it then that the company did not discover ,un after it haa. signed the -agree­ment? If the company had H1;S';)ccted on account ,of the 'entry that Shri Lobo had -committed mi-sappropl'iaUcn of :the com­pany's .property, it should have investigated the matter before, :or soon a,fter the 114th Decemh:~l' 1963. Even if it learnt laiter than 18th December that Buell misappropriati.on had !taken place, it could n'Ot in any ca"3E! without ?ny regular :inquiry pass an order terminating the services of 8hri Lobo. If the order is not legal on technioal grounds, :it certainly is -illegs.l as 'b:eing ,contrary to the pl'ineiples of natural justice, mala fide, and manifestly 'actua.ted by a desire to victim.ise. Shri Na.ir pOints out that the Conciliation Officer also considered this action art; ,the 'company -as irregular. In ,para 3 page 2 ~of his rep-om, he has rem'arkec1 tlla,t at fJrst the charge 'against the workman was .only of rnisbehaviour wLth his superior. In this _ -charge sheet -there: is no reference to the' -subsequent charge Ibl'1ought against: the worker of misappropriaJtion of the .company's pr«>perty. The present inquiries 'according to :the company were made on 21st and 24th DI.;cember. Even

after these inquiries ,the worker was allowed to resume work 'on 26th December. It is not dear what -other charcres were pending &gainst him, what inquiries were made, and~w!hy the charge :of misappropriation of -cement bags was held proved aga.inst him, ',md h~s services were terminated IOn 14th Ja­nUl.u:y .1964. It is true: t.hat the -company was at fault, in not holdmg a separate and retgwar inquiry in regard ito the cl1arge 'of misappropriation of cement bags afltel' :it. had decided to take him hacle as ,ttm:e-<ke'eper 'o1ll2-6-'li2-1963., The company has also not made it clear in its written stakement how the charge was h'eld prove:d doll investigaUons '}reId after :24.+th t[Jec'ember, and why -a worker who after that date was allowed to resume work subsequently was removed from :service. But merely on the ground of lll'll'egml'a.riiti'es f_iDJ 3J domestic ,inq.ui-ry, :or even tn absence of 'it, :the action -taken ,against :the worker camnot be c'onsidered illegal. It ;is the (lut.y of the Tribunal to investigate and find 'out whether the misconduct ",,"ith which ;the worker has been charged was committed by hi·m. The Supreme Court in Punj-a:b National Bank Ltd. -and their workmen, 1959 H. L. L. J. :po 666, has held that merely because the manage­ment has not held an 1nqu'iry the worker <:annot be 'reinstated and the action of :the- ,company decla;red <iUeg'all. In this 'le~pec:t their L'ord-shi<ps have observed a,<; foHows (se'e'" page &82) :

«There 'is one more point which stUl remains to lie con~ sidered and ,that is the effect of the ban'k's de-Ia.ult in not holding an enquiry :in th-e present case. If the bank has not hehl any enquiry, It \]annot obviously contend before the tribunal that it has bona fide exercised its manage­rial functions B.nd 'authority jn ·passing the 'Orders 'Of dis­missal and that the tribunal should be slow to ,interfere with the said orders. I must consider the. me:,~its of -the impugned order as at la-r-ge before we, and take e'V_ldence, and make 'an inquliTY, and deCide ,the matter myself, and if it js fiJund !On the evidence produced 'hefore me, that -the icharge fQr which the worker was -dli~miss(~d without an inquiry is proved, then in spite of t~e 'absenc~~ of inquiry the management's <action must be UPM -(leld. Hav:~ng this_ decisi'on in mind I ~nvest.igated the mattei' myself, summoned witnesses, and allowed the 'parties to pro­duce their witnes::;es. The first witness 'who was 'exa'l11ined on behalf of the management was Sh:!':' L. A. Correia, Admi­nistration 1{anager. He says 'in hi;:. statement recorded iOn ;:30th June j 9-.64, that he held an !inquiry on 24th December 1963, he produced the ,papers 'of the inquiry and said, that whaJtever is written therein is 1:rue. '8hri Naiir in his questton ,:>uggested that no mquiry was held, all that has Ibeen written down was false, and that only :one questann was put tQ the worker and that was, .why he handed over the 'requisition book to Shri ColaG'o. Lastly Shri Naiir -contends that for a ·chal1ge of mis­approprIation .:irt; should be proV€:d ibhat Ithe ,cement bags were removed from the pl~emises by the person accused and appro· priated to his own use. ]it :appears. from the statement of S'hri Sc:hm:ook himself he says, that nobody could take away the bags of -cemem woithout the watchman knowing it. The watchman was not produced either at the enquiry 01' here .to sl1.ow that ten bags of cement wel'e removed by Shri Lobo.

The -charge ther.efore mU5-t fail. I do not agree. It may be necessary in a criminal change of misappropriati.on to pr.ove Ithis. In .the opr:esent 'case Shri Schmook has made it quite plaan that in fact Shrl Lobo is charged with lha:ving been unable to account for the IITlissing .of 10 bags of -cement ·and this is proved ,by the evidence. He d(les not say that he took away the ;cement bags and rput it !to !}tis :own use. :rt is a serious enough misconduct ,for a rman jn charge of the stores Ito be unable to account for ,the articles missing from -the stOi.·es. It is not necessary for the -company "in order to take :actilon talgainst him to establish H 'criminal charge and plJove his ap­propriating the property to his lnwn use. There is.a. difference between the standard of proof required ,in '8, domestic inquiry for taking action against an employee, and that 'required f.or establishing .a penal offence in a crlm:1rral court. In the latter the offence alleged has :to be ~);~oved to the hilt, beyond any l.,"easOnable doubt by dear and satisf.-actory evidence, and rthe burden, of such proof lItes '(lnitirely o:n ithe prosecution. lin do· mesti'c inquiries such as this, ·if the ,management has ~trong reason to believe that such ul;'j.sconduct has been committed, and ilt has acted in ~ood f.aith, and has not violated 'any prin­oilples of naltural justtce, '8Jlld '.'las not actuated by anY ~mpro­per m.otives its order -cannot be interfered with. As I 'have already pointed out a,bove, his failUre to bring to the notice of his superior the entry of ten bags uninltialled by the -engineer·in-charge -confirms the evidence of Shri Schmook, ithat -theSe :bags were missing, and not ac­counted fOl', 3.nd it must be held that 8h1'1 Lobo -cannot be exhonerated fl'om the chalge of failure to account for .tlle missing of liD bags .of cement from the stores. In" fact there is strong reason to suspect that the entry was madp. deUbera~ tely to -COVf'!' up the misappropdation of these bags either at the instance, or "by {he connivance of Shri Lobo. Inability to account for material Which 'was in his 'Charge 'and is missing, 1S a lSe:rimlS misconduct on a store-keeper. The ma;nagement in such a ca.se is justif~ed in losing .confidence in him and dis· pensJng with his 'services.
