Your Policy

In this Policy (excluding section 4)

“We”/“Us” - means Allianz (a trading name of Allianz p.l.c.)."You" - means the person named as the Insured or Policyholder in the Schedule and theCertificate of Motor Insurance.“Car” - means any Motor Vehicle;• details of which have been notified to Us and for which a Certificate of Motor

Insurance has been issued and remains in force;• loaned to You by a supplier We have nominated following a claim

under the Policy; • loaned to You, up to 1700cc, for up to 7 days by a garage, motor engineer or

vehicle repairer while the vehicle described on your Policy Schedule is beingserviced or repaired, or having a MOT test.

“Endorsement” - means an alteration to the terms of the Policy.“Excess” - means the amount of any loss or damage to your Car for which You areresponsible.“Schedule” - means the last Schedule which has been issued under the Policy."Audio Equipment" - means audio, telephone, visual navigation equipment, in-carentertainment which are permanently fitted and can only be used in your Car.“Hire and Reward” - means a Public Service Vehicle as defined in Road Traffic Orderlegislation.

We will provide insurance for death, injury, loss or damage as expressed in the Policy,Schedule or Certificate of Motor Insurance happening during the Period of Insuranceanywhere in Northern Ireland, the Republic of Ireland, Great Britain, the Isle of Man, theChannel Islands, any country which is a member of the European Union, Croatia, Iceland,Liechtenstein, Norway and Switzerland.

The Company will also provide the minimum legal insurance required to comply with thelaws relating to the compulsory insurance of motor vehicles in any country in respect ofwhich the Commission of the European Union is satisfied that arrangements have beenmade to meet the requirements of Article 7 (2) of the EC Directive on insurance of civilliabilities arising from the use of motor vehicles (No.72/166/EEC).

The insurance also operates during the course of sea transit (including loading andunloading) between ports within the territories named.

Exception: If a claim arises from an incident involving an uninsured third party driver and the circumstances are such that We decide that the driver or the person in charge ofthe insured Car was not at fault We will not reduce Your No Claim Discount in respect ofthat claim.

You may choose to protect your No Claim Discount. This cover will only apply if You pay anextra premium and the relevant endorsement number is shown on Your policy Schedule.

You cannot transfer Your No Claim Discount to anyone else.

New Car ReplacementIf Your cover is Comprehensive or Thirdparty, fire and theft We will replace YourCar with a new car of the samespecification (subject to availability) if it waspurchased as new by You and within 12months of it first being registered, it is(a) damaged within the meaning of Your

Policy cover to an extent greater than60% of the manufacturer’s lastpublished list price in the UnitedKingdom (inclusive of Value AddedTax)

(b) lost by theft and not recovered within 14 days of the loss being reportedto Us

subject to the agreement of any interestedparties.

Road Fund Licence DutyWe will pay the amount of the unexpiredportion of the Road Fund Licence Duty ifYou are unable to recover a refund from theLicensing Authority following total loss(which is insured under Your Policy) of Your Car.

Emergency TreatmentWe will insure any person using any Car inconnection with which Third PartyInsurance is provided under this Policy topay for Emergency Treatment of injuriescaused by or arising out of the use of such

Car. Cover is restricted to the extentrequired by legislation for compulsoryinsurance of motor vehicles in the countryin which the incident occurred.

A payment made for Emergency Treatmentwill not affect your No Claim Discount.

Vehicles insured for the carriage ofpassengers for Hire and RewardWe will pay for loss or damage to necessaryBusiness Equipment which is defined asand includes the following: Roof sign,Meter, Radio, GPS Satellite NavigationSystem, Receipt printer and Card paymentdevice.

Payment will be up to the value insured asnotified to the Company to a maximum of£1,500 for any Accidental Damage, Fire orTheft claim in the period of insurance.

For Accidental Damage and Fire claims Your Car must also be damaged at thesame time.

Any payment made solely in respect ofsuch loss will not impact Your No ClaimDiscount entitlement and will be free fromany policy excess.

Section 1: Third Party Insurance

We will indemnify the person(s) insuredfor legal liability (and the related costs andexpenses) for damages in respect of death,bodily injury or disease to any person, anddamage to property arising from the useof:• Your Car• A trailer which is attached to

your Car

The maximum We will pay for propertydamage will be limited to £20,000,000 inrespect of any one claim or number ofclaims arising out of any one accidentand/or event.

Person(s) Insured(a) You,(b) Any person permitted to drive as

stated in the Certificate of MotorInsurance except a person in theMotor Trade driving the Car forpurposes necessitated by its overhaul,upkeep and/or repair for You,

(c) Any person using (but not driving)your Car with your permission forsocial, domestic and pleasurepurposes,

(d) At your discretion, any person (otherthan the driver) in your Car, or gettinginto or out of it,

(e) The personal representative of any ofthe above person(s) (following theperson’s death) but only in respect ofthe deceased’s liability.

Costs and ExpensesWe will pay:(a) Costs and expenses recoverable by

any claimant,(b) Other costs and expenses,(c) Solicitor’s fees for representation at a

coroners inquest or fatal inquiry or ina Court of Summary Jurisdiction,

(d) The cost of defence against a chargeof manslaughter or causing death bydangerous driving.(b), (c) and (d) must be incurred withour written agreement.

Section 1: Exceptions to Section 1 - Third Party Insurance

This Section of your Policy does not cover:(a) Damage to property belonging to, or

held in trust by, or in the custody orcontrol of, the person(s) insured,

(b) Damage to any vehicle being drivenor used by a person insured,

(c) Any person other than You who isinsured under another policy,

(d) Death or bodily injury to any personarising out of or in the course of theiremployment except to the extentrequired by legislation forcompulsory insurance of motorvehicles in the country in which theincident occurred but excludingclaims from the driver of the vehiclewhile using or driving the vehicle inthe course of his/her employment,

(e) Any person entitled to indemnityunder any other policy,

(f) Liability, loss, damage, cost orexpense of whatsoever naturedirectly or indirectly caused by,resulting from or in connection withany act of terrorism regardless of anyother cause or event contributingconcurrently or in any othersequence to the loss.

For the purpose of this exception anact of terrorism means an act,including but not limited to the useof force or violence and/or the threatthereof, of any person or group(s) ofpersons, whether acting alone or onbehalf of or in connection with any

organisation(s) or government(s),committed for political, religious,ideological or similar purposesincluding the intention to influenceany government and/or to put thepublic, or any section of the public, infear, and/or any act deemed by thegovernment to be an act ofterrorism, except so far as isnecessary to meet the requirementsof the legislation for compulsoryinsurance of motor vehicles in thecountry in which the incident occurs.

Rights of RecoveryIf any law requires Us to pay a claim whichwould not otherwise be covered by yourPolicy, We reserve the right to recover theamount from You, or the person insuredor any other person concerned.

Section 2: Loss or Damage to your Car byFire or Theft

We will pay for loss of or damage to yourCar and it’s accessories and spare partscaused by fire, lightning, explosion, theft orattempted theft, (theft is deemed toinclude taking your Car without lawfulauthority by a person who has not attainedthe age of 17 years).

Where accessories are other than asprovided for in the manufacturer’sspecification for your Car, We will only payfor the cost of replacing the manufacturer’sstandard items unless You have notified Usof the change.

Cover is only provided in respect of thoseaccessories and spare parts which are inthe Car or on it or in your private garage.Your Car must be missing for 14 days afterWe have been notified before We willconsider it lost by theft.

Cover for Audio Equipment is limited to£500 for any one claim, unless it is part ofthe manufacturer’s specification.

ExcessYou will be responsible for the amount ofthe Excess stated in the Schedule whetheror not You are at fault for the loss ordamage.

Customs DutyIf, whilst your Car is on the Continent ofEurope, You become liable to pay CustomsDuty on it as a direct result of loss ordamage covered by this Policy, We willmeet that liability.

Section 2: Loss or Damage to your Car byFire or Theft (continued)

Replacement Locks, Car Keys, Key Cardsand Lock Transmitters or any devices ofsimilar function for Your Car.

We will pay up to £500 towards the cost of replacement locks where necessary,replacement and / or recoding of car keysor any devices of similar function for YourCar following their theft.1. from Your permanent residence as a

result of forcible violent or unlawfulentry or exit.

2. from any temporary residence whereYou intend spending the nightprovided the theft is as a result offorcible violent or unlawful entry orexit from the premises.

3. arising out of an assault or threat of violence on any authorised keyholder.

A claim payment under this Section of thePolicy will be without application of Excessor impact on Your No Claim Discount.

We will not pay1. if the car keys or any devices of similar

function are stolen by a member ofYour family or visitor.

2. for any loss where the theft is notreported to the Police.

3. where temporary accommodation isin a hotel or guesthouse and the theftis not reported to the manager orowner.

4. for car keys or any devices of similarfunction for Your Car which are stolenby deception or fraud.

5. the additional cost of importing carkeys or any devices of similar functionfor Your Car from outside theEuropean Union.

Section 3: Accidental Loss or Damage toyour Car (other than Fire or Theft)

We will pay for loss of or damage to yourCar, and its accessories and spare partsother than loss or damage described inSection 2.

Where accessories are other than asprovided for in the manufacturer’s specification for your Car, We will only payfor the cost of replacing the manufacturer’sstandard items unless You have notified Usof the change.

Cover is only provided in respect of thoseaccessories and spare parts which are inthe Car or on it or in your private garage.

Cover for Audio Equipment is limited to£500 for any one claim, unless it is part ofthe manufacturer’s specification.

ExcessYou will be responsible for the amount ofthe Excess stated in the Schedule whetheror not You are at fault for the loss ordamage.

The amount is increased by £100 wherethe driver (or person in charge of your Car)other than You, holds a provisional licenceor has held a full licence for a period of lessthan 12 months.

The amount is increased by £150 wherethe driver (or person in charge of your Car)other than You, is aged under 25 years.

Exception: If loss or damage results froman incident involving an uninsured thirdparty driver and the circumstances aresuch that We decide that the driver orperson in charge of the insured Car wasnot at fault, then an excess will not apply toYour claim.

Exceptions to Sections 2 and 3

We will not pay for:(a) Losses You sustain through not being

able to use your Car,(b) The cost of hiring another vehicle,(c) Depreciation whether as a result of

loss of value due to accident or theftor depreciation due to age andnormal wear and tear,

(d) Wear and tear,(e) Repairs or replacements which

improve your Car beyond itscondition before the loss or damage,

(f) Mechanical, electrical or electronic breakdowns, failures or malfunctions,

(g) Damage to tyres caused by applyingthe brakes, road punctures, cuts orbursts,

(h) Loss or damage resulting from anyuse of your Car not permitted by theCertificate of Motor Insurance,

(i) Broken glass in the windscreen,windows or roof of your Car nor forany scratching of bodywork resultingdirectly from such breakage wheresuch damage is the only damagecaused unless otherwise stated inthe Schedule,

(j) Loss or damage arising from theft orany attempted theft whilst theignition keys or any device of similarfunction of your Car have been left inor on your Car,

(k) Theft of a car phone from anunattended vehicle unless locked inthe boot of the Car or locked in theglove compartment.

Sections 2 & 3: What does ”Pay” Mean?

The word “pay” means that We may, atour option, make a payment in cash ofthe amount of loss or damage, or mayrepair, reinstate or replace. If We knowthat your Car is the subject of a HirePurchase or Leasing Agreement, anypayment will be made to the owner tothe extent of their legal entitlement.

In the event of a total loss We will not paymore than the market value of your Carimmediately prior to the loss or damageas assessed by a Motor Engineer.

We will not pay more than themanufacturer’s or supplier’s most recentlist price (plus the reasonable cost offitting) for any part or accessory.

If We settle a claim as a total loss, Wereserve the right to own the salvage.

Repairs, Collection and DeliveryYou may authorise repairs, notexceeding £500, provided an estimate is sent immediately to Us and anydamaged parts which are renewed are retained for inspection.

If your Car is disabled, We will pay thereasonable cost of protection andremoval to the nearest repairers.

If the Car is considered by a Motor Engineer to be beyond economicalrepair We will pay to have it removed to free and secure storage.

After it has been repaired We will pay forthe reasonable cost of delivery of yourCar to your address last advised to Us.

We will only make these payments inconnection with a valid claim for loss ordamage to your Car. The repairer mayrequire You to pay the Excess to himbefore he releases your Car. If You areregistered for Value Added Tax You willbe required to pay the Value Added Taxamount of the account.

Your Schedule will show if this section isinsured by your Policy.

We agree to cover the person named in theSchedule under the terms and conditionsof this Policy as long as the premium hasbeen paid.

The meaning of wordsYouThe person named in the Schedule or any person authorised to drive or be apassenger in your Car.

CarAny Motor Vehicle;• details of which have been notified to Us

and for which a Certificate of MotorInsurance has been issued and remainsin force;

• loaned to You by a supplier We havenominated following a claim under thePolicy;

• loaned to You, up to 1700cc, for up to 7days by a garage, motor engineer orvehicle repairer while the vehicledescribed on your Policy Schedule isbeing serviced or repaired, or having aMOT test.

Territorial LimitNorthern Ireland, the Republic of Ireland,Great Britain, the Isle of Man, the ChannelIslands or the European Union.

Period of InsuranceThe period shown in the Schedule.

We, Us, OurAllianz (a trading name ofAllianz p.l.c.).

ScheduleThe last Schedule which has been issuedunder the Policy.

Legal RepresentativeThe solicitor, barrister or expert appointedunder this Policy to represent You andprotect your interests.

CostsUnder this Policy We will pay the following:• The professional fees and expenses

reasonably and properly charged bythe Legal Representative

• Your opponent’s Costs which You areordered to pay by a court or tribunal

The most We will pay for all claims arisingout of any one road accident is £50,000.

What is coveredWe will pay the Costs of any legal actiontaken by You or on your behalf as a result ofany road traffic accident which causes thefollowing:• Your death or bodily injury while You

are in, or getting into or out of the Car• Damage to the Car• Damage to property which You own or

are legally responsible for and which isin or on the Car

We will provide this cover as long as:• The claim is not covered under any

other insurance policy• The road accident happened within the

Territorial Limit and within the Periodof Insurance

• The claim will be decided by a courtwithin the Territorial Limit

• There is a reasonable chance ofrecovering damages

What is not coveredWe will not provide cover for the following:1 Any claim arising out of a contract You

have with another person ororganisation,

2 A claim for an event which is notcovered under your current motorinsurance Policy,

3 Disputes between You and Us, exceptas dealt with under condition 6,

4 Costs We have not agreed to in writing,5 Costs You have paid directly to the

Legal Representative or any otherperson without Our permission,

6 Any Value Added Tax You can recoverfrom elsewhere,

7 Any Costs covered by any otherinsurance policy or for which any otherparty is liable,

8 Claims arising from war, invasion, riot,revolution or a similar event.

ConditionsIf You do not keep to the conditions, Wemay cancel the Policy and refuse any claimand withdraw from any current claim.

1 You must do the following:(a) Give us written details of your

claim along with any othersupporting information We ask for,

(b) Make your claim within sixmonths of the date of the road accident,

(c) Follow the LegalRepresentative‘s advice andprovide any information he orshe asks for,

(d) Take every step to recover Costsand pay them to Us,

(e) Get Our written permissionbefore making an appeal,

(f) Make sure Your LegalRepresentative keeps tocondition 2 below.

2 Your Legal Representative must dothe following:(a) Get Our written permission

before instructing a barrister orexpert witness,

(b) Tell Us if, at any stage, there isno longer a reasonable chanceof a successful defence,recovering damages or gettingany other remedy,

(c) Tell Us immediately if the otherparty makes a payment intocourt or any offer to settle thematter,

(d) Report the result of the claim toUs when it is finished.

3 We will have the right to do the following:(a) Appoint the Legal

Representative in your nameand on your behalf,

(b) Have any legal bill audited or taxed,

(c) Contact the Legal Representativeat any time, and have access to allstatements opinions and reports,

(d) End your cover if, during thecourse of the claim, We thinkthere is no longer a reasonablechance of success. If Youcontinue the claim and get abetter settlement than We expected, We will pay your reasonable costs which Youcannot recover from anywhereelse,

(e) At the end of the claim, settlethe Costs covered by this Policyif those Costs cannot berecovered from anywhere else.

4 Your agreement with othersWe will not be bound by anyagreement between You and the Legal Representative or You and any other person or organisation.

5 Choosing the Legal RepresentativeWhen You need to start legal proceedings You can choose the Legal Representative but should We already have on record a Legal Representative pursuing or defending proceedings in your name that Legal Representative shall be nominated by You providingthere is no conflict of interest.

6 DisputesIf there is a dispute between You and Us the matter may be referred toan Arbitrator who You and We agree to.

If We cannot agree on an Arbitrator,one will be chosen by the President ofthe Law Society or by the Bar Council.

All costs of the arbitration will be paid by the person the Arbitrator’sdecision goes against. If the decision isnot clearly made against either You or Us, the Arbitrator will decide howYou and We will share the Costs.

General Conditions which apply to your PolicyObservance of ConditionsThe observance by You of the terms,conditions and Endorsements of this Policyas far as they relate to anything to be doneor complied with by You will be a conditionprecedent to any liability of the Company.

MisrepresentationThis policy may be voidable in the event ofmisrepresentation. A misrepresentation iswhere an individual provides inaccurate,misleading or incomplete information.

Change in Information - ContinuingObligation You have a continuing obligation tocontact Us immediately if the answersgiven to any of the questions havechanged since You took out or lastrenewed this policy. Failure to do so maylead to the voidance of your policy.

Looking After Your CarYou must take all reasonable precautions to:

(a) Maintain your Car in a safe androadworthy condition,

(b) Prevent injury, loss or damage.

If You do not do so, We reserve the rightnot to pay a claim or if by law We areobliged to meet a claim then We reservethe right to seek recovery of the paymentfrom You.

Claims ProcedureIn connection with any injury, loss ordamage which may give rise to a claimunder the Policy You must:

• As soon as reasonably possible giveUs written notice and all informationand assistance required

• Send Us immediately any writ orsummons, and as soon as possibleany letter, claim or other documentreceived

• Notify Us immediately in writing ofany impending prosecution, inquestor fatal inquiry

• Not admit liability for or negotiate thesettlement of any claim without thewritten agreement of Allianz

If You do not do so, We reserve the rightnot to pay a claim. We are entitled at anystage during any claim to take over andconduct the defence or settlement of theclaim, and at our discretion to pursue theclaim for our own benefit in the name ofany person insured.

Cancelling Your PolicyYou may cancel your Policy at any time byreturning to Us the Certificate of MotorInsurance. If there has been no claimduring the current Period of Insurance Wewill allow a return premium subject to apremium transaction charge for theunexpired Period of Insurance.

We may cancel the Policy by sendingnotice by recorded delivery letter to you at your last known address. a return of premium for the unexpiredPeriod of Insurance.

Regardless of which Party cancels thePolicy, if there has been a claim during thecurrent Period of Insurance We will returnno premium.

If the Company has agreed to acceptpayment of premium for this Policy bymonthly direct debit payments then in the event of non-payment of any monthlypayment on its due date the Company may cancel this Policy by giving seven days notice by recorded delivery letter tothe last known address of the Insured andfollowing the expiry of this notice the Policy will be automatically cancelled. The Company will be entitled to paymentof the premium proportionate to the Period of Insurance and in the event ofclaim during the current Period ofInsurance the Company will be entitled to the full premium.

Policy Alteration, Additional and ReturnPremiums Where your Policy is altered or cancelledduring any Period of Insurance, We will re-calculate Your premium. This may resultin an additional premium due to Us, or areturn premium due to You.

A Premium Transaction Charge may beapplied to all such alterations, as detailed inYour Schedule.

Where applicable, the Premium TransactionCharge will be added to any additionalpremium due to Us, or deducted from any return premium due to You.

We will only charge or refund a premiumprovided the amount is greater than orequal to the amount detailed in YourSchedule.

Where applicable, an Insurance PremiumTax applies to all premium calculations.

Other InsuranceIf any loss or damage is covered by anyother insurance, We will not pay more thanour rateable proportion. This does notoverride the references to other insurancein page 7.

Arbitration in Respect of Amount (but not Liability)All differences arising out of this Policy shallbe referred to the decision of an Arbitratorwho will be appointed jointly by You and Usin accordance with the relevant law at thetime or if the parties cannot agree upon asingle Arbitrator, to the decision of twoArbitrators, one to be appointed by each ofthe parties within one month after havingbeen requested. The Arbitrators shallappoint an Umpire who shall sit with theArbitrators at their meeting and in the caseof disagreement the Arbitrators shallsubmit to the decision of the Umpire andthe making of an award shall be acondition precedent to any right of actionagainst Us. Claims not referred toarbitration within twelve calendar monthsfrom the date on which We have refused toprovide cover shall be deemed to havebeen abandoned.

You may not take legal action against Usover the dispute before the Arbitrator hasreached a decision.

FraudIf any claim is in any respect fraudulent or ifany fraudulent means including inflation orexaggeration of the claim or submission offorged or falsified documents are used toobtain benefit by the Insured or anyoneacting on the Insured’s behalf all benefitunder this Policy shall be forfeited.

Governing LawThis agreement shall be governed by andconstrued in accordance with the laws ofNorthern Ireland and will be subject to thejurisdiction of the Northern Ireland courts.

General Exceptions

This Policy does not cover

1. Any injury, loss or damage occurringwhile your Car is being:(a) Driven by any other person or

used for any purpose notallowed by the Certificate ofMotor Insurance other thancover for loss of or damage toyour Car arising from “Theft” asdescribed on page 8,

(b) Driven by You, unless You hold alicence to drive it,

(c) Driven with your generalconsent by any person who doesnot hold a licence to drive it.

Exceptions (b) and (c) do not apply if theperson has previously held and is notdisqualified from holding or obtainingsuch a licence.

2. Liability accepted under an agreement,unless the liability would have existedwithout the agreement.

3. Injury, loss or damage arising from:(a) Ionising radiations, or

contamination by radioactivityfrom any irradiated nuclear fuelor from any nuclear waste fromthe combustion of nuclear fuel,

(b) The radioactive, toxic, explosiveor other hazardous properties ofany explosive nuclear assemblyor of its nuclear component.

4. Liability, loss, damage, cost or expenseof whatsoever nature directly orindirectly caused by, resulting from orin connection with any of the followingregardless of any other cause or eventcontributing concurrently or in anyother sequence to the loss:War, invasion, acts of foreign enemies,hostilities or warlike operations(whether war be declared or not), civilwar, rebellion, revolution, insurrection,civil commotion assuming theproportions of or amounting to anuprising, military or usurped power,except so far as is necessary to meet the requirements of the legislation for compulsory insurance of motor vehicles in the country in which the incident occurs.

5. Any injury, loss or damage (except sofar as is necessary to meet therequirements of the legislation forcompulsory insurance of motorvehicles in the country in which theincident occurs) caused by:(a) Earthquake,(b) Riot or civil commotion

elsewhere than in Great Britain,the Isle of Man or the ChannelIslands.

6. Loss or damage to your Car (or itsaccessories or spare parts) caused bypressure waves from aircraft or otheraerial devices travelling at sonic orsupersonic speeds.

7. Any accident, injury, loss, damage orliability when any Car covered by yourPolicy is in an area of an aerodrome,airport, airfield or militaryestablishment that is used for:(a) Take off or landing of aircraft or

movement of aircraft on theground,

(b) Aircraft parking, including theassociated service roads,refuelling areas, groundequipment parking areas,hangers and maintenance areas.

8. Any injury, loss, damage or liabilitycaused by pollution or contaminationunless the pollution or contaminationis caused by a sudden identifiableunintended and unexpected incidentwhich occurs in its entirety at a specifictime and place during the Period ofInsurance. All pollution orcontamination which arises out of oneincident shall be deemed to haveoccurred at the time such incidenttakes place.

9. Liability, loss, damage, cost or expenseof whatsoever nature directly orindirectly caused by, resulting from orin connection with:(a) The loss of, alteration of or

damage to, or(b) A reduction in the functionality

availability or operation of acomputer system, hardware,programme, software, data,information repository,

microchip, integrated circuit orsimilar device in computerequipment or non-computerequipment that results from themalicious or negligent transfer(electronic or otherwise) of acomputer programme thatcontains any malicious ordamaging code including butnot limited to computer virus,worm, logic bomb or Trojanhorse, except so far as isnecessary to meet therequirements of the legislationfor compulsory insurance of motor vehicles in the countryin which the incident occurs.

Endorsement No. 1 - Exclusion of owndamage cover for provisional licenceholdersWe will not pay for loss or damage to yourCar whilst it is being driven by or is in thecharge of a person who holds a provisionallicence.

Endorsement No. 3 - Windscreen damageException (i) on page 11 is hereby deleted.We will pay for broken glass in thewindscreen, windows and roof of your Carand any scratching to the bodyworkresulting directly from such damage wheresuch damage is the only damage causedsubject to the following limits:(a) Broken glass replaced or repaired by

“Autoglass” or “NationalWindscreens” or “Auto Windscreens”- unlimited,

(b) Broken glass repaired or replaced byany other repairer - £200 in total,

(c) Except where the windscreen isrepaired an excess of £50 applies.

Endorsement No. 4 - Driving other carsWe will insure You in respect of legalliability, as provided on pages 6 & 7 of thePolicy, whilst You are driving anotherprivate car or motor cycle, provided suchcar or motor cycle:

(a) Does not belong to You or your employer,

(b) Is not hired or leased to either of theparties described in (a) above under aHire Purchase or Leasing Agreement,

(c) Is not the property of or in thecustody or control of a Motor Tradebusiness of which You are a director,member or employee.

Endorsement No. 5 - Protected No ClaimDiscount - standard protectionYou may incur up to two claims in a threeyear period, costing in total not more than£2,000, without incurring any loss of NoClaim Discount. Claims for windscreenbreakage will not be taken into account forthe purpose of this Endorsement if thiscover is shown in your Schedule.

Endorsement No. 6 - Protected No ClaimDiscount - superior protectionYou may incur up to two claims in a threeyear period, of any value without incurringany loss of No Claim Discount. “Permanent total disablement”means permanent inability to perform orattend to any business, profession oroccupation.

“Temporary total disablement”means temporary inability to perform anypart of usual business, profession oroccupation. Where an injured person hasno remunerative occupation, business orprofession, has retired, is a student or is

unemployed this benefit shall only be paidfor the period the person was detained inhospital and otherwise at the discretion ofthe Company having regard to the medicalevidence produced.

Personal Accident Benefits are not availableto any occupant(s) other than the driverwhen Your Car is being used for hire andreward purposes.

Provided that:(a) In respect of 1 to 4 on page 22,

the total amount payable to any oneperson arising out of any one accidentis £3,000,

(b) No benefit will be paid to any personuntil the total amount has beenascertained and agreed. However,payments on account may be madefor Temporary total disablement after aperiod of 8 weeks has elapsed,

(c) No benefit will be paid to the driver ofthe Car arising out of an accidentwhere he/she was:(i) Convicted or a prosecution is

pending under any Road Trafficlegislation relating to the level,concentration or quantity ofalcohol or drugs in the body,

(ii) Following a post mortemexamination found to have ahigher level, concentration orquantity of alcohol or drugs inhis/her body than is prescribed inthe Road Traffic legislation of theterritory where the accidentoccurred,

(iii) Not a person permitted to drive inthe Certificate of Motor Insurance,

(d) Detailed accounts receipts and otheradequate documentation must befurnished to Us in respect of any claimfor reimbursement under item 6,

(e) Where any other policy(policies) areheld by You or your spousecompensation shall be recoverableunder one policy only.

B. Personal effects and clothingWe will pay You or at your requestsuch other person as may be theowner of the property for loss of ordamage to personal effects andclothing, up to £150, and any wheelchair, child's pushchair, buggy orcarrycot, up to £150, while in or on theCar described in the Schedule by fire,theft, attempted theft or by accidentalmeans provided that:

(a) Our total liability shall be limited to£300 in respect of any one occurrence,

(b) Payment to any person other than Youshall be paid direct to that person whoshall observe fulfil and be subject tothe terms exceptions and conditions ofthis Policy in so far as they can apply,

(c) We shall not pay for loss of or damage to:(i) Money, stamps, tickets,

documents or securities,(ii) Goods or samples carried in

connection with any trade orbusiness,

(iii) Any property unless at the time ofthe loss or damage due to theftsuch property was stored in thelocked boot or closedcompartment and the Car islocked when it is unattended.

(d) Your Car is not being used for hire andreward purposes at the time of the lossor damage.

C. Child seat coverFollowing an accident or damagecaused to your Car by fire or theft wewill contribute up to £100 towards thecost of replacement per child seatfitted in your Car. This applies even ifthere is no apparent damage to thechild seat.

Endorsement No. 8 - Inclusion of loss ordamage cover for trailersWe will pay for loss or damage to anytrailers, details of which have been suppliedto Us. The cover will be as stated on theSchedule applied in the same manner as toyour Car. For this optional additional cover,the cost is £3 for every £100 of trailer valueor part thereof.

Endorsement No. 9 - Satellite Trackerdevice installationWhere a Satellite Tracker device is installedas Our requirement or in exchange for apremium reduction, We will not pay forloss of or damage, theft of, or attemptedtheft damage to your Car, its accessories orspare parts unless the Satellite Trackerdevice is operational and maintained inaccordance with the suppliersrecommendations.

The following terms and conditions applyto Allianz Breakdown Assistance service:

• We will provide assistance for up toand including four callouts in any oneperiod of cover.

• Cover is provided in respect of Yourpermanent Car only.

• Cover is not available for Electric Cars.• The cost of draining or removing

contaminated / incorrect fuel type orlubricant is not covered. However, wewill tow Your Car to the nearestcompetent garage (maximum30M/50KM) for assistance. You willhave to pay for any work carried out.

• You are not entitled to avail ofBreakdown Assistance for incidentswhich are covered under YourComprehensive Motor Policy including:a) assistance for accidentsb) lost or stolen keysc) glass breakaged) fire damagee) attempted theft

• Your Car must be kept in a roadworthycondition and You must ensure that itis maintained in accordance withmanufacturer's requirements.

• We will not be responsible for therepatriation costs in circumstanceswhere the estimated cost ofrepatriation and /or storage exceed thecurrent Irish market value of Your Car.

• The Allianz Breakdown Assistanceservice covers the island of Ireland andGreat Britain.

• Breakdown Assistance does not coverYou for recovery which requiresspecialist equipment.

• The onward travel or delivery ofpassengers or goods that You arecarrying in a commercial capacity, atthe time of breakdown, is not coveredunder the Allianz BreakdownAssistance service.

• The provision of the courtesy Car issubject to availability and if We areunable to provide You with one, Youare entitled to avail of the otherjourney continuation benefits offered

Car SharingThe receipt of contributions as part of a carsharing arrangement for social or othersimilar purposes in respect of the carriageof passengers on a journey in a Car insuredunder this Policy will not be regarded asconstituting the carriage of passengers forhire or reward (or the use of the Car forhiring) provided that:(a) The Car is not constructed or adapted

to carry more than eight passengers(excluding the driver),

(b) The passengers are not being carriedin the course of a business of carryingpassengers,

(c) The total contributions received forthe journey concerned do not involvean element of profit.

What to do if an accident occursNote the registration number(s) of thevehicle(s) involved.

Note the name of the Insurance Companyinsuring any vehicle(s) involved.

Ask for the names and addresses of otherpeople involved and any witnesses.Make a sketch plan of the scene of theaccident and record in writing thecircumstances which caused the accident.Do not admit responsibility or sign anystatement to this effect.

Keep your vehicle at the scene of theaccident for a reasonable time.You must, if required, give:Your name and address.The name and address of the vehicleowner (if not yourself).

The registration number of your vehicle.Evidence of Insurance to a Policeman orPolicewoman or if no Police are present, to anyone who was involved in or affectedby the accident - in any other case theinformation must be given, if requested, to anyone who was present at the time ofthe accident.

Where a person or persons are injured, the accident must be reported at thenearest convenient Police Station if noPolice are present at the scene of theaccident. Also, if an animal is injured, orproperty damaged, and particulars werenot given at the scene of the accident, then You must report the accident at thenearest convenient Police Station.

Getting your Car repairedIf your Car suffers damage that is coveredby your Policy, We recommend that Youtake it to one of our Approved Repairers, or that You arrange for it’s collection by oneof them.

Our Approved Repairers are authorised totake immediate steps to arrange repairs.Every effort will be made to supply Youwith a courtesy car but this is notguaranteed.

If You do not use an Approved Repairer, You should arrange for an estimate ofrepair costs to be sent to Us by yourselected repairer.

Advice to Policyholders Travelling AbroadThis Policy applies in all member countriesof the European Community and Croatia,Iceland, Norway, Switzerland andLiechtenstein. An International Certificateof Motor Insurance or Green Card is notrequired for these countries. Instead,ensure that You take this Policy booklet and

your Certificate of Motor Insurance withYou as evidence of Insurance.
