YORK RIVER AI\D WORMLEY CREEK EFFECTM APRrL 6,2015 THROUGH APRrL 27,2015 Pursuant to $28.2-809, $32.1-13,532.1-20 and 52.2-40028.16,and 52.2-4028 of the Code of Virginia, an emergency closure on the York River, near the mouth of Wormley Creek, is hereby established. It shall be unlawful for any person, firm, or corporation to take shellfish from this area for any purpose except by permit granted by the Marine Resources Commission, as provided in Section 28.2-810 of the Code of Virginia. The boundaries of this area are shown on the map titled "York River and Wormley Creek, Condemned Shellfish Area Number 052-006E, Emergency Closure, 6 April 2015" which is a part of this notice. Because the area described below may have been subjected to a sewage spill likely containing pathogenic bacteria and viruses, and because the area is not a safe area from which to take shellfish for direct marketing, and because shellfish exist in this area, an emergency exists and the immediate promulgation of this regulation is needed to protect the public health. 3. The Department of Health will receive, consider and respond to petitions by any interested person at any time with respect to reconsideration or revision of this emergency regulation. BOUNDARIES OF EMERGENCY CLOSURE 052-OO6E The emergency condemned area shall include that portion of the York River located inland of a line drawn between latitude / longitude map coordinate (37"13'4'7.8",-76"29'50.5"), map coordinate (37"14'11.8",-76"28'00.6"), and map coordinate (37'13'00.3",-76"28'26.0"). Pursuant to $28.2-809, $32.1-13,532.1-20 and 52.2-40028.16,and 52.2-4028 of the Codeof Virginia, an emergency closure on the York River, near the mouth of Wormley Creek, ishereby established.
