]y the Defendant above named, hereby apply for admission into the YouthfulOffendersAlcohol-Education Program (hereinafter''Program ), and hereby representandagree as follows;

L Speedy Trial and Related Rights: 1understand my right to havethecriminal chargesagainstme disposed of ina speedymannerand expresslyagree to waivethat rightwhileapplyingto andparticipating in the Program. Further, I understand thatprosecution of thecharges will be postponed during myapplication toand participationin the Program and that the Commonwealth must be given the right to prosecute me if Iam removed from the Program sometime inthe future In this regard, 1underetand if Iviolateconditions of the Program, theCourtmayremove me from the Program andschedule my case for hearing on the charges.2. Financial Responsibilities; As a condition of the Program, I agree to paythe sum ofThree Hundred Dollars ( 300.00) for Court costs. I acknowledge that failure

to satisfy my financial responsibilities within the time period of my Program admissionshall be grounds for removing me from the Program. I understand that this lump sum Iscomprised of various fees, charges, and costs, including Program educational costs, Iunderstand that money paid by me wili be periodically distributed to various entitlesentitled thereto, and that it would be difficult for the Magisterial District Court to refundany money after distribution had occurred. I agree that I shall have neither a right of

3. P rogr am Conditions: The applicant must;A. Truthfully answerall questions on the application for Program admission,B. Attend and complete twelve 12)hours of classroom instruction asdesignated by theAdams County Department of Probation Services.C. Payall Courtcosts and fees related to the Program as may be designatedand established by Administrative Orderof Courtfrom time to time, Theparticipant shall alsopayany and all restitution as designated at the timeof theapplicant sadmission to the Program. Payment shall bemadebefore the classes begin and, in any event, within the time allotted for theapplicant s participation in the Program and applicant mustprovide areceipt for the same to the Adams CountyDepartment of Probation

Inthis regard, I understand andagree that if any felony or misdemeanor criminal orjuvenilecharges, orany summary charges forconduct occurring afterthe dateof thisapplication, are filed against me the filing of those charges will result inmy removal from the Program, Itis not necessary thatthecharges beconcluded and or result in conviction

E. Remain free from the use of non-prescribed controlledsubstances andalcohol during the course of participation in the Program.4. Length of Program; I understand that I shall beplaced intheProgramfor four 4)months, subject to the program conditions set forth in paragraph 3above. I understand I must complete the required classroom instruction within thefour 4) month period. 1acknowledge thatthe conditions have been explained tome and that 1understand them and that violation of any condition shall constitutegrounds for my removal from the Program.5. Successnil Completion: I understand that the charges against mewill bedismissed if 1successfully complete the Program. Upon successful completion ofthe Program myarrest record will beexpunged. Any license suspension willremain on my PennDot driving record.

Removal from theProgram; I understand thattheAdams CountyDepartment of Probation Services will request my removal from the i^rogram if1do not comply with the terms and conditions as described in this application. Iwaive the right tobepersonally present and agree that a Judge may remove meFrom the Program, inmyabsence. If1am removed from the Program Iunderstand 1will have toappear for a hearing on the charges ata time scheduledby theMagisterial District Judge.7. Suspension ofOperators Privileges: 1understand that IfI am admittedtotheProgram ona charge of underage drinking 18 Pa. C.S.A, § 6308)»misrepresentation ofage tosecure liquor ormalt or brewed beverages 18 Pa.C.S.A, §6307), orpossessing false identification 18 Pa. C.S.A. §6310.3) theneven upon successful completion of the Program my driver s license will besuspended for ninety 90) days pursuant to Pa. C.S.A, §6310.4, However, if1am admitted to the Program on another summary charge, there will be no licensesuspension on successful completion of the Program,8. No Prior Convictions or ARD or Pending riminalCharges: Inconsideration for my admission to the Program, I hereby affirm and acknowledgethat I have no prior criminal record orjuvenile adjudications in theCommonwealth ofPennsylvania or in any other state orfederal jurisdiction; that Ihave never been placed ontheProgram or a similar program forunderagedrinking oralcohol related summary offenses orfor any drug oralcohol offense inthis orany other jurisdiction; that 1have not previously been admitted toA.R.D.ora pre-disposition program similar to the Program in this or in any other stateand that Ido not have any criminal or juvenile charges pending in ihe^Commonwealth ofPennsylvania or in any other state orfederal jurisdiction, Iunderstand thatshould this information be incorrect, thatI may be removed fromthe Program and, further, that Imight be prosecuted subject to the provisions of18 Pa. C,S,A, Section 4904 relating to unsworn falsification to authorities.9t Ball: I understand that oncethe Magisterial DistrictJudgeorders myentry into the Program, bail shall be terminated and any money or other form ofsecurity deposited shall be returned to me in accordance with the rules pertainingt o bai l
