It has been a long road for the Yukon Environmental and Socio-economic Assessment Board (YESAB). After a Yukon wide consultation tour, the approval of the federal regulations, the finalization of Rules, the establishment of seven offices, and the hiring of close to 30 staff, YESAB is open for business.

On November 28, 2005, the Minister of Indian Affairs and Northern Development signed the Yukon Environmental and Socio-economic Assessment Act Regulations, bringing into full force and effect the Yukon Environmental and Socio-economic Assessment Act (YESAA) legislation. Leading up to that historic day our Board and staff worked hard to ensure that the implementation of YESAA would work well for all Yukoners. We worked closely with numerous interest groups, proponents, the public and territorial, federal and First Nations governments to make the transition into YESAA as smooth as possible.

We have committed to being an impartial, effective and efficient organization that will provide quality assistance to all involved in the assessment process. Part of that commitment has been to ensure that all aspects of the YESAA process are accessible to everyone.

To do this, YESAB has established six Designated Offices with publicly accessible computers in various communities throughout the territory. We have also created the YESAB Online Registry (YOR). This web-based registry allows anyone to view any project in Yukon, submit comments about projects, and receive notification about particular project types or projects within a particular area. It can also be used to submit and track project proposals. In addition, a toll-free number (1-866-322-4040) allows for no-charge calling to any office and the YESAB website (www.yesab.ca) has information on YESAB and the YESAA process.

With these various opportunities for public participation, and a legislative guarantee of full and fair consideration to all scientific information, traditional knowledge and other information provided during an assessment, Yukon has adopted one of the most progressive and publicly accessible assessment regimes in the country. Of course, it will be up to the Yukon public to use these new tools and participate.

In general, environmental and socio-economic assessment is a process that strives to identify the potential environmental and socio-economic effects of proposed activities before they are carried out. Once the potential adverse effects are identified, assessors recommend measures to limit or eliminate those effects.

Why do Assessments?Environmental and socio-economic assessments ensure that developments within Yukon are done in a manner that is environmentally sustainable and socio-economically responsible. Generally, assessments ensure that projects are undertaken in a way that results in responsible socio-economic change without undermining the environmental and social systems of individuals and communities. This is done by minimizing or avoiding adverse environmental and socio-economic effects before they occur and by ensuring that sustainability is incorporated in the planning and development of projects.

What is Environmental and

The Benefits of Assessment Environmental and socio-economic assessment offers a number of benefits to Yukoners. The process provides opportunities for the public to get involved in the development of the territory and allows for increased protection of human health, ensures the sustainable use of natural resources and minimizes environmental risks. The Yukon’s assessment process ensures that assessments are done independently by an impartial entity and increases the accountability of decision makers by making all decision documents available to the public. The process is also beneficial to industry and other proponents because it reduces uncertainty by having set timelines at every stage.

Chapter 12 of the Umbrella Final Agreement called for the establishment, by federal legislation, of an assessment process that would apply on all lands of the Yukon: federal, territorial, First Nation and private. The Council of Yukon First Nations (CYFN) and the Yukon Territorial Government agreed to work with the Government of Canada to jointly establish a unique development assessment process for the Yukon. The federal legislation establishing this process (YESAA) has functionally replaced previous regimes and applies to all lands in the Yukon.

The Act’s purposes are to:• Provide a comprehensive, neutrally conducted

assessment process applicable in Yukon.

• Require that, before projects are undertaken, their environmental and socio-economic effects are considered.

• Protect and maintain environmental quality and heritage resources.

• Protect and promote the well-being of Yukon Indian persons, their societies and Yukon residents generally, as well as the interests of other Canadians.

• Ensure that projects are undertaken in accordance with principles that foster beneficial socio-economic change without undermining the ecological and social systems on which communities, their residents, and societies in general, depend.

• Recognize and, to the extent practicable, enhance the traditional economy of Yukon Indian persons and their special relationship with the wilderness environment.

• Guarantee opportunities for the participation of Yukon Indian persons and make use of their knowledge and experience in the assessment process.

YESAB is an independent arms-length entity, responsible for the implementation of the Yukon Environmental and Socio-economic Assessment Act (YESAA) legislation and associated regulations. Specifically, its role is to administer the YESAA assessment process. The organization created its mandate and responsibilities from the Act.

Members of the BoardThe Yukon Environmental and Socio-economic Assessment Board (YESAB) is comprised of a three-person Executive Committee, one of whom is the Chair of YESAB, and four other Board members. All Board members are appointed by the federal Minister of Indian Affairs and Northern Development.

Nominations to the Board Prior to appointments, nominations to the Board are made as specified in the legislation (YESAA). One member of the Executive Committee is nominated by the Council of Yukon First Nations (CYFN) and one member is appointed by the federal minister after consultation with the territorial minister. The third member of the Executive Committee, the Chair, is appointed after the federal minister consults with the other two Executive Committee members. Of the four remaining Board members appointed by the federal minister, two are nominated by CYFN, one is nominated by the territorial government and one is a direct appointment.

Organizational Chart

YESAB is made up of a Head Office located in Whitehorse and six Designated Offices located in Dawson City, Haines Junction, Mayo, Teslin, Watson Lake and Whitehorse.

The Designated Offices (DOs) carry out approximately 98% of the project evaluations under YESAA. Taking guidance from the Act, the associated regulations, the YESAB rules and the operating guidelines, the Designated Offices are independently responsible to carry out evaluations and make recommendations for a wide variety of projects. The DOs are the primary point of contact for many Yukoners and the staff can provide information and assistance to all those involved in the YESAA assessment process.

YESAB’s Head Office houses Board members, senior assessment personnel, corporate administrative staff, and communications personnel. Executive Committee Screenings and Panel Reviews for larger projects are also conducted through the Head Office.

An environmental and socio-economic assessment is required when a development activity is listed in the YESAA regulations and requires a permit or authorization, involves a transfer of land, or if the project utilizes federal funding. The assessment process is initiated when an individual or organization submits a project proposal form to YESAB. Once the proposal is received, YESAB assessors ensure that the proposal contains enough information necessary to conduct an assessment and if so, the assessment begins.

Assessors look at the potential environmental and socio-economic effects of proposed activities by utilizing various guidance and regulatory documents, gathering and analyzing a collection of consultation data from governments, traditional and non-traditional experts, the public and other interest groups as well as conducting any other research required for a complete and thorough assessment.

Once the appropriate information has been collected and considered, the assessor recommends whether the activity should proceed, should proceed with terms and conditions, or not proceed. When assessments are complete, a recommendation with reasons is then forwarded to the relevant decision bodies. Decision bodies can be federal, territorial or First Nation governments.

The decision body (or bodies) will then decide whether to accept, reject or vary the recommendation of YESAB and issue a decision document. Decision documents are placed on the YESAB Online Registry and filed at the YESAB Document Registry. On the following page is a summary of the main stages involved with an environmental and socio-economic assessment in Yukon.

Stage 1 With the help of a government regulator, the proponent or project developer determines if an assessment is required.

Stage 6The Decision Body reviews YESAB’s recommendation and either accepts, rejects or varies it and then they issue a decision document.

Stage 2The proponent fills out a “Project Proposal Form” and submits it to one of YESAB’s Designated Assessment Offices.

Stage 3A YESAB assessor reviews the proposal to ensure that enough information is included.

Stage 4The YESAB assessor then begins the assessment and gathers and reviews information received from the public, governments, interest groups, and traditional and non traditional experts in the field.

Stage 5After considering all relevant information gathered, the assessor determines the project’s potential environmental and socio-economic effects. The YESAB assessor then makes a formal recommendation to the relevant Decision Body(s). (Federal, Territorial, and/or First Nation Governments)

Three Levels of Assessment Depending on the type, size and complexity involved with a proposed project, an assessment can take place at one of three different levels.

• Designated Office: The large majority of assessments, approximately

98 per cent, will be done in one of the six community-based Designated Offices located in Dawson City, Haines Junction, Mayo, Teslin, Watson Lake and Whitehorse.

• Executive Committee: The Executive Committee of the Board will assess

larger projects that come to it directly, or are referred by a Designated Office.

• Panel of the Board: At times, a Panel of the Board will be established

to assess projects which have potential significant adverse effects, are likely to cause significant public concern, or involve the use of controversial technology.

Assessment Districts The territory has been divided into six assessment districts. Each district contains a Designated Office that is responsible for all Designated Office assessments for that district.

Rules Development In order to maintain consistent methods and processes for conducting assessments under YESAA, the Board and staff spent a significant amount of time developing three sets of “Rules” that set out a framework for the conduct of Designated Office Evaluations, Executive Committee Screenings and Reviews by a Panel of the Board. The development of “Rules” is a requirement under the legislation and deals with a number of important issues including:

• Timelines for steps in the assessment process.

• Form and content of proposals.

• Determination of the scope of a project.

• Public participation in assessments.

• Information used in assessments.

• Projects located in two or more assessment districts.

• Joint evaluations by two or more Designated Offices (DOs).

• Different phases & types of DO evaluations.

On November 23, 2005, the Board formally “made” its Rules for Designated Office Evaluations and Executive Committee Screenings and has published them in the Canada Gazette. Rules for Reviews by a Panel of the Board are in final draft and will be published in the Gazette in 2006.

When developing the Rules, the Board garnered input from local governments, public sector practitioners and the public. During an extensive consultation period, Board members and staff visited all Yukon communities, neighbouring communities in the Northwest Territories and gave presentations to First Nations and various other community and interest groups encouraging input from all parties. A review of rules from similar legislation in other jurisdictions was done, and additional opportunities for the public and special interest groups to meet with the Board to better understand the details of the Rules and obtain more information was offered. At the end of the consultation period, all written comments submitted were given full and fair consideration. The draft Rules were then amended, keeping in mind the YESAA legislative framework.

An important task assigned to Board staff was to create guidebooks to support the Rules and to provide instruction, explanation and direction for various audiences. One of the primary purposes of the assessor guidebooks is to ensure assessors are conducting assessments consistently across Yukon. Guidebooks have been made available to the public as they have been completed. Proponent guides have also been produced to assist in making applications for project assessments at the Designated Office and Executive Committee levels. YESAB has worked towards identifying various audiences and informing them through a number of communication initiatives. Since implementation, we have established a notification system that includes: weekly newspaper ads that highlight all projects entering the seeking views and information stage of an assessment; project notification posters that are posted weekly in high traffic areas and offices in all assessment districts; and an automated electronic notification system that works through the YESAB Online Registry.

We have also worked towards informing audiences about the new YESAA process by writing and distributing a number of YESAB related articles to local and national publications, printing YESAB advertisements in local newspapers, monitoring local media and assisting reporters with YESAB related stories, offering interviews to radio, newspaper and television, and continually updating and maintaining our website and all other external communication tools.

We are a new assessment regime in the territory. With that come questions, concerns and curiosity. Therefore, YESAB understands it is very important to provide opportunities for the public, industry and other interested groups to learn about YESAA. Our “Rules Tour”, was a valuable way to talk to people in Yukon communities, First Nations, municipalities and other groups about how YESAA works. We recognize that is not enough and continue to engage the public. To that end, we have attended and/or made presentations at a number of conferences, trade shows and AGMs in and outside of the Yukon, including:

We have held countless meetings, presented to numerous groups and have done our best to explain and introduce our process from a number

YESAB was established under the Yukon Environmental and Socio-economic Assessment Act (YESAA), which came into force May 13, 2003. The Act sets out a process to assess the environmental and socio-economic effects of projects and other activities in the Yukon or that might affect the Yukon. This is a requirement of Chapter 12 of the Umbrella Final Agreement and Yukon First Nations’ Final Agreements. These assessments will be conducted in a manner that is consistent with the purposes of the Act.

The federal government has now finalized the Regulations that accompany the Act and assessments under YESAA are now being conducted. YESAB has developed Rules that set out in detail how the assessment process will work.

YESAB Online RegistryThe YESAB Online Registry is intended to be the main tool used by proponents, First Nations, Decision Bodies, regulators, and members of the public to participate in the assessment process. The two main functions of the Online Registry are to provide public access to assessment-related documents and to help people submit documents into the assessment process. It is also designed so that the public will become aware of new assessments and can track project proposals through the assessment process.

Now that YESAB has established itself, the organization will work towards its mandate as an impartial, arms length entity that strives to implement an assessment process that works well for all Yukoners. We will continue working with proponents, First Nations, interested parties, governments and the public to ensure that all parties are well informed and familiar with the assessment process from start to finish.

Our commitment to work closely with regulators and proponents to ensure that project assessments are conducted in an effective and efficient manner will continue, and our efforts to build awareness and encourage participation from all parties involved will be a focus of our staff and Board. We will build upon the working relationships that we have established and work towards building new ones with future proponents and new stakeholders.

YESAB’s Outlook

The idea of a pipeline delivering natural gas from Alaska to the south is not a new one. In the past the timing, demand for energy, price of natural gas and a host of other factors have not come together in a way to make such an undertaking imminent. There has been an increased interest in this potential project in the past few years. It now looks as if a natural gas pipeline traveling across the Yukon Territory could be a reality sometime in the next decade.

In anticipation of an Alaska Gas Pipeline project proceeding, we have been meeting regularly with an interdepartmental working group representing the five federal departments that are sorting out the regulatory process required for such a large-scale project. No matter what form this project takes, should it occur, it will not require a YESAA panel. Under our legislation, YESAB will be involved in the creation of a joint panel.

A project of this magnitude requires cooperation and understanding between all the agencies involved. We met with the interdepartmental working group in June, July, August, September, November 2005 and January 2006. Discussions have been productive and we will continue to meet and move forward on tasks to be accomplished in the upcoming fiscal year. We have also been invited to be part of a Yukon Regulator’s Group that met once in the 2005/2006 fiscal year and should be meeting more regularly in the future.
