Each bidder shall submit one original of the Technical Proposal and oneoriginal of the Financial Proposal and clearly malk each as "ORIGINAL -TECHNICAL PROPOSAL' and'ORIGINAL - FINANCIAL PROPOSAL".In addition, the bidders shall submit 2 copies of the Technical Proposal and theFinancial Proposal, and clearly mark them "COPY NO ....-TECHNICALPROPOSAL" and "COPY NO ... . - FINANCIAL PROPOSAL". In the eventof any discrepancy between the original and the copies, the original shallprevail.

c. Review of Documents to be submitted by the Bidder - Bid Form, Technical andFinancial Proposals:

organizational chart. The Organizational Chart shall reflect the keypersonnel assigned to the contact.List of contractor's personnel (e.g., Project M-ugo, ProjectEngineers, Materials Engineers, and Foremen), to be assigned to thecontract to be bi4 with their complete qualification and experiencedata (Use Form DPWHINFR-14). These personnel must meet therequired minimum years of experience shown in the BDS.List of Contractor's Major Construction and Laboratory EquipmentUnits to be assigned to the Conffact, Supported by Certificates ofAvailability using the prescribed format. To be attached are copies ofsales invoice / Registration Ce,rtificate from LTO for ownedequipment, certifications from the lessors that the equipment unitsunder Leased Equipment shall be available for this contact, andcertifications from the vendors that the equipment rmits underPurchase Agreements shall be available for this contract.

Mosquera reminded the contractors thatmost of the bidders got disqualified because of the non-compliance tothe prescribed fonn ofthe List of Contractor's Major Construction andLaboratory Equipment Units to be assigned to the Confiact as well asthe failwe to include the list of laboratory equipment.

5. Omnibus Sworn Statement in the prescribed form containing nine (9)items

o The Financial Documents shall contain the Bid Form, Bid Prices, DetailedEstimates, Surnnary Sheets indicating construction materials unit prices, laborrates and equipment rental rates and Cash Flow by Quarter.

d. Explanation of Criteria for Eligibility Screening, Preliminmy Exarnination of Bids,Evaluation of Bids, and Post-Qualification:

e To be eligible for the contract, a contractor must meet the following eligibilityrequirement: (a) Filipino citizen or 75% Filipino-ownedpartnership/corporation with license for Size Range Small B, (b) completionof similar contract costing at least 50%o of the ABC and (c) Net FinancialContracting Capacrty (NFCC) at least equal to the ABC.

o Eligibility screening will be conducted electonically by the Distict Office byProcurement Engineer. The office will just be retrieving the contractor's filefrom the CWA. In order to afford sulficient time to update the contractors'records in the CWA, participating contractors shall submit their Class "A"documents and Financial Statements to the DPWH Civil Works Registry atleast seven (7) calendar days and the Technical Docwnents (Completed/On-going projects) at least fifteen (15) days before the deadline for the submissionand/or opening of bids. A bidder may also submit his updated Class "A"doeuments and Financial Staternents together with his bid to be used by theBAC in case he fails in the electronic eligibility screening. The bidder is notrestrained to attach his legal documents in his technical proposal such as hisDTI, SEC registration, Mayor's Permit and Tax Clearance that might haveexpired or not yet updated in the CWA. hnprovement of bid proposal is notallowed.

A bidder may modifii its bid, provided that this is done before the deadline forthe submission and receipt of bids.

The DPWH will use non-discretionary "pass/fail" criteria in the eligibilitycheck, preliminary examination of bids, evaluation of bids, post-qualificationand award.

o The Procuring Entity shall conduct a Post-Qualification of the Bidder ilrat isevaluated to have the Lowest Calculated Bid (LCB). Within frve (5) calendardays from receipt by the Bidder of the notice from the BAC that it submittedthe LCB, the Bidder shall submit the following post qualification documentaryrequirements:(1) Latest income and business tax returns.(2) Other appropriate licenses and permits required by law and stated in theBDs.

Failure of the Bidder declared as LCB to duly submit the requirements shall beground for forfeiture of the bid security and disqualification of the Bidder foraward.

If the BAC detennines that the Bidder with the LCB passes all the criteria forPost-Qualification, it shall declare the said bid as the Lowest CalculatedResponsive Bi{ GCRB) and recommend to the HoPE the award of contractto the said Bidder.

The bidder with the Lowest Calculated Responsive Bid will be required tosubmit to the Procuring Entity, within ten (10) calendar days from his receiptof the Notice of Award, the following documents:

In the case of the failure, refusal or inability of the bidder with the LowestCalculated Responsive Bid, to submit the required documents within theprescribed period, through its own fault, the BAC will be constrained to post-disqualify the said bidder and shall initiate and complete the post-qualificationprocess on flre bidder with the second Lowest Calculated Responsive Bid.

4. Questions and Comments from Bidders and Responses of BAC and Other DPWH Officials:None. There were no interested bidders who came to attend.

5. Other Matters Discussed:The paragraph inserted in the lnvitation to Bid per DO 127 series 2018 wasemphasized. The said paragraph states that "if at the time of the post-qualification procedure, the BAC verifies that any of the deficiencies is due tothe contractor's fault or negligence pursuant to 3a.3@)(ii)(c) of the 2016Revised Implementing Rules and Regulations of Republic Act No. 9184 Q0l6RIRR of RA 9L84), the Procuring Entity shall disqualify the contractor fromthe award without any right to reimburse fees and incidental oost paid for theprocurement of infrasffuctwe contact subject of the Bid".
