Dear Mr. Weberman:

I refer to you communication of April B, requesting information from the passport file of Winfred Barnes.

The Passport Office has conducted a file search in the identity of Winfred Barnes and we have located several passport applications. A review of the file indicates that this identity is not ficticious.

Therefore, disclosure of the information you request is considered a clearly unwarranted invasion of personal privacy under the Freedom of Information Act, 5 USC 552 (b) (6), and therefore may not be disclosed. Under the Privacy Act of 1974, 5 USC 552a, however, you may obtain the information requested by providing the Department with a subpoena from a court of competent jurisdiction or with the written permission of the individual who is the subject of the file.

If you choose to consider our decision a denial of your request for information, you may appeal our decision to the Council on Classification Policy of the Department of State pursuant to Section 6.8 of Part 6 of Title 22 of the Code of Federal Regulations, a copy of which I enclose for your use. ·

In view of information that LEE HARVEY o·Sl.JALD was reported to be interested in reading to some extent, inquiry -;.;as made at the Miami Public Library, Miami, Florida, on December 3, 1963. Dr. FP~m< B. SES~A, Dir­ector of the Library, caused a check to be made in the true name and aliases of OSWALD, ·and he advi~ed that no record pertaining to OSHALD \vas located among any of~ the various type member~hip cards maintained by the Library.

Caller stated he had read in this mornings paper that LEE HARVEY OSWALD bad crossed the border from Laredo, Texas to Nuevo Laredo, Mexico on 9-26-63. BARNES further stated that be himself had also crossed the border on that same date at at the same place. He said he left from Nuevo Laredo via Mexicana Ailines flight 711. The flight was to Mexico City via Montery. BARNES stated he went only as far as Montery where he had some business to attend to.

BARNES recalled seeing some people while on his trip who might have some connection with OSWALD but he was not sure at this time. He also noted that he would be available for interview if this office felt he might be of some assistance.
