Despite pleas from a group residents, the North Whidbey Park and Recreation Commission is standing by its executive director.

In a marathon meeting that lasted nearly five hours Thursday night, commis-sioner Scott Vogt said the complaints brought against executive director Bill Walker werent enough to warrant removing him from his posi-tion.

I dont see a reason to really do anything against the director right now, Vogt said in front of a group of more than 50 people at the Oak Harbor Senior Center. Thursday nights meeting had

been moved from the pool to the senior center because of the large number of people expected to attend.

A significant group of patrons using the John Vanderzicht Memorial Pool, which is owned and operated by the North Whidbey Park and Recreation District, were stunned by recent decisions to terminate the employment of North Whidbey Aquatic Club Coach Neil Romney and administrative assistant Vikki Robinson. Romney worked as coach for 10 years and Robinson worked for the dis-trict for four years.

In the wake of those ter-minations, a litany of charges against Walker have been made by the former employ-

ees. Vogt lumped those alle-gations into four groups lying on court documents stemming from an order of protection filed against a former employee, the swim clubs checking account and allegations that Walker created a hostile work envi-ronment and discriminated against employees.

Vogt appeared flummoxed about how to respond to some of the charges, especially the lying allegation.

I dont know what to do about these charges, Vogt said.

He noted that the park commission isnt tasked with conducting a criminal inves-tigation but did consult with the park districts attorney

who disagreed with the lying allegation. Such an invention is best done by law enforce-ment, he said.

Vogt said Bill Walker reported to the state auditors office an issue concerning a checking account the swim team had operated outside the districts purview.

If theres any wrongdoing, the state auditor will advise us, Vogt said.

Staff estimates mayor spent $470K in firings

The actual cost of Oak Harbor Mayor Scott Dudleys decision to fire a series of people in admin-istrative positions is still a matter of dispute.

Finance Director Doug Merriman gave a presenta-tion about the costs to the city council last week, at the request of council mem-bers. He put the cost of firing the city administra-tor, fire chief, police chief and two city attorneys at $471,049, which included severance packages, inter-im employees salaries and recruiting efforts.

The report didnt include the costs associated with a lawsuit from the police chief, who claimed he was fired inappropriately. It could potentially be an expensive case.

Dudley, on the other hand, said the cost was negligible to the begin-ning fund balance if sav-ings from unfilled positions, uncollected fees and a fund reserved for severance payouts are factored in. He said the presentation added nothing new and was just meant to embarrass him.

It gave the council mem-bers the ability to get on a soapbox and express their frustration, he said.

Dudley came into office in January after campaign-ing as a reformer and vow-ing to fix problems he saw in city administration. He immediately fired the city administrator, the city attor-ney and the fire chief. He asked Police Chief Rick Wallace to retire in the summer, but later fired the chief after he decided not

to retire. Dudley hired Bill

Hawkins, the former coun-ty prosecutor, as the city attorney and then promptly sacked him.

The majority of council members have been very critical of Dudley over the firings, especially the high cost to the city. Last weeks presentation was the sec-ond time that council mem-bers asked for a report on how much the terminations have cost the city.

Councilman Rick Almberg, a self-described fiscal conservative, has been particularly irked by the costs. In an interview this week, he said Dudley could have changed the administrative staff in a way that was much less expen-sive, less disruptive and more civil.

The mayor could have had his cake and eaten it too, he said.

Almberg said former City Administrator Paul Schmidt and former City Attorney Margery Hite offered to work with Dudley on a tran-sition. The idea was that they would stay on while the mayor looked for replace-ments and they looked for new jobs. If it worked out, they would leave for new jobs, the city wouldnt pay their giant severance pack-ages and new people would be in their positions.

In addition, former Fire Chief Mark Soptich had enough time in the job to retire this fall. Almberg sug-gested that Dudley could have negotiated his exit in a way that cost the city much less, but Dudley simply

Not only is the Poseidon coming to Whidbey Island Naval Air Station, there could be even more of the aircraft stationed here than originally planned.

The Navy is prepar-ing a Supplemental Environmental Impact Statement to address poten-tial environmental impacts of new home-basing alter-natives for the P-8A.

The Navy will study three alternatives to its 2008 Record of Decision, all of which would result in basing more P-8As at NAS Whidbey.

Im never pleased when the Navy decides to open a Record of Decision unless it means its good news for Washington (state), Rep. Rick Larsen said. At minimum, this move will improve the standing of NAS Whidbey.

The current Record of Decision calls for basing

the new Poseidon air-craft at three sites: NAS Jacksonville, Marine Corps Base Hawaii Kaneohe Bay and NAS Whidbey Island. For a time, it looked as though NAS Whidbey could be removed from those plans, but that no longer appears to be the case.

Larsen said this latest move makes the Poseidon look like a sure bet for Whidbey Island.

Ive never been that worried about it anyway, he said. But if folks are still worried after this, I dont know what else to

say.According to Larsen,

the Navy is reconsidering its plans because plans to move several thousand Marines to Guam have changed.

Basically Guams loss is NAS Whidbeys gain, he said. The (Department of Defense) is not able to put as many marines at Guam, so as a result, those Marines will very likely end up at Kaneohe Bay. Therefore, that pushes the P-8A squad-rons allotted to Kaneohe Bay to Jacksonville and Whidbey.

The 2008 ROD calls for four Poseidon squadrons with a total of 24 aircraft, to be based at NAS Whidbey.

Of the three alterna-tives the Navy will study, the first would base seven squadrons with 49 total air-craft at Whidbey; the sec-ond would still call for four squadrons but the number of aircraft would increase to 28; and the third alterna-tive would base six squad-rons at NAS Whidbey with 42 total aircraft.

There are currently four Maritime Patrol Squadrons (VP) based at NAS Whidbey, each with nine P-3C Orion

aircraft and approximately 325 personnel. By contrast, each new P-8A squadron is expected to have seven aircraft and approximately 265 personnel.

Should the Navy decide to base more Poseidon squadrons here, it would

obviously call for expand-ing the facilitys footprint, but just how much can-not be determined until a new Record of Decision is entered.

The Navy would have to follow up with military construction requests to accommodate any chang-es, but I couldnt say what those would be, said Larsen.

According to the Navy, once the Supplemental EIS is complete, the Secretary

of the Navy can decide whether to homebase at two locations or to continue with the ROD as it stands.

There will be a 45-day public comment period fol-lowing the release of the Draft Supplemental EIS, which the Navy anticipates will be in the summer of 2013. Public meetings will be scheduled at that point.

The Secretary of the Navy may reconsider the Navys 2008 Record of Decision regarding bringing the new P-8A Poseidon aircraft to NAS Whidbey Island. The banner encompassed every-thing Dennis Reynolds and his Unitarian Universalist Congregation believed in.

The gold and white sign above the entry to the building in Freeland reads: Standing on the side of love, with love in huge, white let-ters next to a sketched heart. The Unitarian congregation has been on the side of marriage equality for same-sex couples since the early 2000s, and even for the new minis-ter, Washington voters approval of Referendum 74 presented an excit-ing future.

Im looking forward to signing same-sex marriage certificates, Reynolds said.

Voters approved the measure with a simply majority of 53 percent. Nearly 1.5 million people cast their ballots in favor of allowing same-sex couples to marry.

In Island County, there are now two Republican commissioners and long-time State Sen. Mary Margaret Haugen, a Democrat, was voted out of office. Still, the seemingly conser-vative county comprised of Whidbey and Camano islands supported marriage equality with 52-percent approval 21,256 votes.

The vote was divided along geo-

graphic lines. A total of 1,691 votes separated approval from rejec-tion in Island County. The refer-endum was rejected by voters in 29 precincts, anchored by North Whidbey precinct 2 (61 percent no) and approved by only 19. South Whidbeys 10 precincts made the difference in approving Ref. 74, bolstered by large margins of victory in Langley, with 79-percent approval.

The vote was also an approval of a bill passed by the Legislature and signed by Gov. Chris Gregoire in February. At that time, the Unitarian congregation in Freeland celebrated the historic signature with singing and a toast.

Even then, the excitement sup-porters felt was tempered with the anticipation of a referendum. In the weeks leading to election day on Nov. 6, Reynolds said his congrega-tion and others he spoke with in support of approving Ref. 74 were more hopeful than they were ner-vous.

Election results were solidified last week, but Reynolds said no one has requested a marriage cer-emony, which is fine with him.

I hope people will continue to be as heartfelt in their planning as they would have been, Reynolds said. Weve just opened up the list.

Marriage has standing that is legislative and legal, but it also has standing that is sacred.

For all the people who said, Yes, to marriage equality, a total of 1,300,519 nearly half of the states voters and more than half of the state geographically tried to vote down the law.

For Grethe Cammermeyer and Diane Divelbess, partners for 24 years, the right to be lawfully wed by their church was an emotional moment. The Langley couple were married in Oregon years ago before the Supreme Court struck down the law, nullifying their once-legal union. They already had a ceremo-ny with no legal standing at St. Augustines in-the-Woods Episcopal Church in Freeland.

We got as close to a church cer-emony as was allowed, Divelbess said.

Cammermeyer and Divelbess shared their stories before the Legislature this year. Television ads in support of Ref. 74 focused less on marriage equality being a civil rights issue and more about the emotional toll through testimonies and personal stories.

It always helps to have personal stories, Divelbess said. The more people that you meet who have come out and you think, Oh gosh, I

like those people, . . . you see them as workers in the community and nice people, pretty soon you dont care any more whether theyre gay or straight.

On Election Day, Divelbess said she tracked the Ref. 74 results online. As ballots were counted and victory seemed near, she saw online pictures of crowds in Seattle celebrating. Their own joy was tempered with the realization that

nearly half of voters rejected mar-riage equality.

Youre kind of depressed when you see the state map, all those people in all those counties are really disappointed in this election, Divelbess said.

The Langley couple began plan-ning their wedding shortly after Election Day. Cammermeyer already has a date picked in the summer.

Politicians have until Nov. 20 to remove their signs from roadsides in Oak Harbor.

Last Wednesday, the city council unanimously, with a member absent, approved an amendment to the citys code regarding temporary signs in order to correct a First Amendment problem.

The amendment makes a

distinction between political and campaign signs, the lat-ter of which can have more restrictions.

Even so, the amendment deletes a provision that set a limit on the amount of time before an election that a can-didate can put up campaign signs.

It extends the time to two weeks that a candidate has to take down signs after an election.

The issue goes back to when Mayor Scott Dudley was a city councilman run-ning for the mayoral seat.

He was contacted by the citys code enforcement offi-cer for putting up campaign signs earlier than allowed by city code.

But then the city attor-ney warned that the code infringed on free speech, so the citys planning com-mission took up the work of

amending the code.At the meeting,

Councilwoman Tara Hizon made it clear that she feels the signs arent aesthetically pleasing.

I cant wait for those suck-ers to come down, she said.

Hizon said she felt the old code was fair and that the restriction on displays of campaign signs to 60 days before the election was more than enough time.

Still, she wasnt against the amendment.

In answer to questions, Senior Planner Ethan Spoo explained that the amend-ment didnt change the code regarding garage-sale signs. He said they arent allowed on public property, but are theoretically allowed on pri-vate property.

In addition, he explained the amendment specifies that people waving signs on side-

walks or the side of the road, like the dancing pizza people, are allowed.

Spoo said the amendment also switched around the rules regarding businesses placing A-frame signs on sidewalks.

Previously, it was allowed everywhere in the city except the downtown Pioneer Way area.

Now they are only allowed on Pioneer Way.

Mary Jane Boughner

Mary Jane Boughner, of Oak Harbor, died on elec-tion day, Nov. 6, 2012, at Whidbey General Hospital. She would have been 95 years old in January. She had a long, good life, lived to the fullest and had no regrets.

Mary Jane Benjamin was born on Jan. 4, 1918, in Duluth, Minn., to Floyd Shaw Benjamin and Molly Benjamin, nee Higgins. She grew up in Iron River, MI and moved to Kalamazoo, Mich. her senior year of high school. She received a bach-elors degree in 1939 from Western Michigan Teachers College. She was married to Robert W. Boughner on Christmas Eve, Dec. 24, 1941 in Kalamazoo, Mich. They spent the war years in Texas; he was a link trainer instructor in the Army Air Corps. They returned to Michigan after the war with their first two children and settled in Okemos.

Four more children joined the family before they moved to Mason, Mich. in 1958. During these years she was a wife, mother, home-maker, Girl Scout leader and school and community vol-unteer. She then returned to Western Michigan University and earned her masters degree in library science in 1968.

She was a reference librar-ian at the State of Michigan Library in Lansing, Mich. from 1968 to retirement in 1980. After Bobs retire-ment in 1982 they moved to Washington state, resid-ing first in Coupeville before moving to Oak Harbor in 1986.

Following Bobs death in 1987, Mary Jane became active with the Oak Harbor Senior Center, especially the travel committee, and Oak Harbor United Methodist Church. Mary Jane consid-ered as her greatest achieve-ment having raised six com-passionate, caring, giving children. She carried the grief from the loss of mid-dle daughter Sally in 1971 for the rest of her life. Her lifelong interests included traveling, gardening, geneal-ogy, volunteering, reading, books, writing, hiking and swimming.

Her extensive volun-teer work with the United Methodist Women included

the church library, hold-ing various offices, prayer chain, Stephens Ministry, and We Care Committee. She was awarded the United Methodist Women Service Award not only in Michigan but also in Washington state.

Friends enjoyed Mary Janes sense of humor, irrev-erence, tolerance, compas-sion, unconditional support, enjoyment of life and opti-mism. Her children valued her friendship, unconditional love and wise counsel.

She is survived by chil-dren Eric Boughner, of San Diego, Calif.; Sue Willey (Dan), of Redmond; Amy Boughner (Steve Upshaw), of Highlands Ranch, Colo.; Steven Boughner, of Oak Harbor; Mark Boughner (Janet), of Mount Pleasant, Mich.; eight grandchildren and three great-grandchil-dren.

Mary Jane is prede-ceased in death by husband Robert W. Boughner, 1987; daughter Sarah Jane (Sally) Boughner, 1971; brothers Ivan Spaulding Benjamin, 1973 and Floyd Shaw Benjamin Jr., 1969.

Mary Janes faith was the backbone of her life and was always her great comfort. She always felt Gods hand in her life. She believed there are two lasting gifts you can give your children: one is roots, the other wings.

A Celebration of Life was held 3 p.m. Saturday, Nov. 10, at First United Methodist Church in Oak Harbor. Private family interment was held at Sunnyside Cemetery in Coupeville.

fired him.Dudley ended up taking a similar

hard line with Chief Wallace. The chief decided he couldnt be forced into retire-ment because he felt he wasnt an at-will employee. The city council was set to adopt an amendment to the citys employment manual, which would have clearly identified Wallace as a for-cause employee, effectively protecting him from the mayors ax. Dudley fired him just a few days before the council was set to vote on the measure.

Wallace filed suit, claiming wrong-ful termination and breach of contract. While Dudley claims the lawsuit is with-out merit, it could potentially cost the city a lot of money. Wallace asked for $550,000 in lost wages and benefits in his claim for damages.

Interim City Attorney Grant Weed and an attorney for the citys insurance pool are defending the lawsuit together. The citys insurance pool wont cover the breach of contract allegation, which means Weed has to defend the city on that issue. Weed earns $160 an hour. In addition, the city will have to pay if Wallace prevails in the breach of con-

tract argument.In his presentation to the council,

Merriman laid out the costs associated with the terminations of the five admin-istrators. The largest cost, a total of $234,000, was from the legal depart-ment, which included severance pack-ages for the two fired attorneys and $120,000 in fees to Weeds firm for six months of work.

Merriman said the costs were off-set by savings in other areas. He had set aside $244,000 in a special fund to cover the costs of severance packages, though he hadnt anticipated that the five managers would be fired in such a short time.

The mayor kept several positions unfilled an administrative assistant, a

battalion chief in the fire department and a police lieutenant in order to mitigate the costs of the terminations. That saved a total of $72,000.

In addition, Merriman said the mayor instructed him to include as an offset the three years of fees, a total of $140,000, collected this year from the hospital for the fire departments emergency ser-vices. Dudley previously claimed the city overlooked the payments for three years and new fire chief, Ray Merrill, was able to collect the money this year.

If all the offsets are taken into account, the total net costs of the firings was just $16,000, not including the lawsuit expenses, he said.

Several council members, how-ever, didnt agree with this reasoning. Merriman, when pressed by Almberg, said the fees from the hospital had not been overlooked and that the city staff was well aware the contract with the hospital had lapsed. He said negotiations began before Dudley came into office; that the fees would be collected was never in doubt.

Indeed, Almberg argues that the real cost of Dudleys actions is $471,000 in cold, hard cash. The issue of the offsets is meaningless, he said, just because the city had some money set aside doesnt mean the costs werent incurred.

Thats $471,000 that didnt have to be spent, he said.

The Oak Harbor School District board devoted Tuesdays meeting to a work-shop discussing athletics and activities and their role in the upcoming levy.

The board is asking the community to pass a $7.35 million levy in February. Money within the levy would support athletics and activi-ties.

According to a district hand-out distributed at Tuesdays meeting, Impact Aid, the funding source for athletics and activities, has shrunk by $1.5 million over the last five years and is projected to con-tinue shrinking. Oak Harbor is the only school district in

the state that relies solely on Impact Aid for athletics and activities instead of funding them through a local levy.

The board asked those in attendance, about 100 par-ents, students, coaches and advisors, to brainstorm ideas on three topics: 1, What are the benefits of athletics and activities? 2, How would the potential cuts or fee increases affect athletics and activities? and 3, What criterion should be used if cuts are required to downsize athletics and activi-ties?

Superintendent Rick Schulte said the ideas gener-ated through the brainstorm-ing sessions would be placed on the district website (www.ohsd.net) to help explain the

importance of athletics and activities in the academic pro-cess.

We want people to see this information and use it as talking points when discuss-ing the levy, he said.

Board President Corey Johnson said this information will also help clarify athlet-ics and activities place in the levy.

People say we need this levy because we cant afford the stadium, he said. That is totally wrong.

The stadium is being fund-ed by other bonds, Johnson said.

The name droppers are at it again. Its an ancient art of deception akin to that of pro-fane swearing.

I find it amusing that any-one would want to cloak themselves in the memory of William F. Buckley as Commissioner Emerson did in the Sound Off column. Ever notice how people can be resurrected to suit anyones idea of sainthood if enough time has elapsed for the pub-lic to forget the truth? Actor Ronald Reagan is one that gets remade by those who forgot how he started out as a union president but changed for a higher paying script. He cam-paigned on a platform of low-ering taxes, but only did it for his rich buddies while quietly shifting the tax load onto the working class by raising the California sales tax (then the states biggest income source) a whopping 50 percent. He, too, cited William F. Buckley as his wizard-in-chief while castigating those who com-plained about the double-cross by declaring on his weekly radio broadcast that taxes should hurt (as reported by our local newspaper).

How interesting that no one seems to recall that part, probably because he quickly quit saying it when someone got a peek at his income tax statements and leaked that the Gipper didnt pay one red cent of tax for two years on his 1960s yearly income of $2 million (more like $8 million in todays money). As a California state employee at the time, I found Reagans problem solving talents to be like his trickle down econom-ics that didnt. All he did was cut budgets and tell others to solve the problems them-selves. Then he sat back and criticized the pandemonium

he caused while getting his own salary increased to the tune of 30 percent in each of his gubernatorial terms. California had to build him a new governors mansion because Nancy wont live in that old claptrap.

So how about this William F. Buckley guy? I watched a few of his Firing Line TV programs and found him to be the ultimate pretentious snob. As the son of an oil baron, he never had to do a days work in his life and probably didnt. His familiar pose was one of recumbent repose as, with airs of lofty superiority, he drippingly denounced less fortunate people with all the biggest words he could find in the dictionary. He was a smug pseudo-intellectual who loathed anyone less articulate than what he became as the Yale Yeller of the Yale Debate Team which we presume is where his daddy sent him. Daddys money gave him opportunity to hobnob with royalty.

But it was all empty word games from someone who never had to come home tired and worn out from a hard days toil, never knew firsthand how the rubber met the road nor how a shovel dug the dirt. He would claim righteous superi-ority arguing ardent support for Sen. Eugene McCarthy who went on a rampage accus-ing any and everyone who disagreed with him of being a treasonous commie or pinko merely because they had some genuine sensitivities and dared to stand up and say so or worse, sing about it. He argued for white suprem-acy in the southern states, which of course was before he decided to denounce it. I sup-pose one could find a quote of his to support nearly any cause or principle one wants if one just dug deep enough to find it.

Like hypocrisy, name dropping seems to be alive and well. Its an easy way to

pretend to be what one can imagine someone else was. It probably works as long as no one remembers the rest of the story about the names being dropped.

One sure couldnt say any of this about our other com-missioners, Angie Homola or Helen Price Johnson, who have been in the trenches and often behind the scenes as some of the hardest work-ing problem solvers in recent times.

The school levy is not a scam

I find it disconcerting how misinformed Bill Burnett is about the local levy. He con-sistently and constantly mis-leads readers with exaggera-tions and outright lies.

The school district has done a wonderful job in get-ting the message out about the importance of the levy. It is not really necessary to go into great detail, but some facts need to be shared. Compared to surrounding districts our levy dollars are much lower,

especially when you compare it to districts comparable in size as well as military dis-tricts. In fact, it is one of the lowest in the entire state.

State and federal funding continue to decline and if the levy is not passed then even more drastic cuts will have to be made. This is not a threat from the district, but a reality. One of the first things that new residents ask is how the schools are. Now I would place Oak Harbor School District up with any district in the United States, however, we also need local support. We face a potential brain-drain without that support as families opt to live elsewhere and matriculate in neighbor-ing districts, thus harming not only our schools but the economy in Oak Harbor/Whidbey Island as a whole.

I have had the honor of working at Oak Harbor High School for eight years. I love the school and I love the com-munity. I also believe the com-munity to know wild accusa-tions when they read them. Mr. Burnetts falsehoods are almost comical, but they are dangerous too, because

it slanders the district and its hard working denizens wrongfully and distastefully.

He has accused us of teach-ing the students to be marx-ists, like this was the 1950s and he is on his own personal witch hunt. He has accused Oak Harbor Education Association of threatening to boycott businesses. Finally, he has accused teachers of wanting to line their own pocket at the expense of the children that he seemingly cares so much about.

I assure everyone that not one of these accusations has any truth to it. There is no threatened boycott, and as for Burnetts manic mantra about Tri Days, we have one of the lowest in the entire state. Tri Days are not at all what this levy is about, and are used by Burnett as a scare tactic only.

I have offered for Mr. Burnett and anyone else to come to my classroom and observe as well as discuss the local levy. He has refused, and instead uses his bully pulpit to spread further propaganda, as well as to call me and oth-ers names for daring to dis-agree with him. Oak Harbor

citizens have a right to see what is going on in the class-room and to ensure that their children are getting the best education possible. That is why my door is always open, so anyone and everyone can see that their children and our future is in good hands.

This levy is extremely important, as the district needs to remain competitive. Already we have cut athlet-ics, clubs, transportation, elec-tives, instructional assistants, technology, custodians and other integral aspects for the best quality education, and if it fails in February, we will not only lose more of the above including great programs like choir, middle school athletics, AP classes, but also more reli-able technology, textbooks and of course teachers and aids; thereby setting back the quality of education for years to come. I have two kids in the district and a third one nearing school age, and I want to ensure that they continue getting the greatest education possible.
