    Does Allah have to say the AGE to bring us to using our Aql/Reasoning?

    Another angle to look at and ask does a little girl at 6, 7, 8, or 9 years old have the

    capacity or the experience to really know what is good for her and what the marriage

    institution entails for the rest of her days at that tender child age?

    Hence, can she really enter into a Meethaqan Galezan (solemn covenant) completely at

    her own volition?

    Now according to the Hadith this a form of disguised exploitation and given religious

    legitimacy which really has no true warrant from the Qur'an and get its validation from

    Hadith to implement pedophilia?

    Now the Qur'an literally presents us with the answers....so yes the Qur'an does so tackle

    the issue of maturity please read the Qur'an more carefully.

    The Clear Evidence:

    "And test the orphans until balagh (they reach) nika (marriageable age). Then if

    nastum (you perceive) min'hum (in them) rush'dan (sound judgement), release their

    property to them. And do not consume it excessively and quickly, [anticipating] that

    they will grow up. And whoever, [when acting as guardian], is self-sufficient should

    refrain [from taking a fee]; and whoever is poor - let him take according to what is

    acceptable. Then when you release their property to them, bring witnesses upon them.And sufficient is Allah as Accountant." Sura 4/6

    According to the Qur'an, physical maturity and mental maturity are both as important

    in discerning marriageable age this equals to having sound judgment.

    Now let me break this down a little bit further,

    Allah says,

    And test the orphans until balagh (they reach) nika (marriageable age).

    How do we know when a girl has reached nika (marriageable age)?

    "And test the orphans until balagh (they reach) nika (marriageable age)

    First, the trustee of a property should first test the ability of the grown up orphan to see

    if he or she is capable of managing his or her own affairs well.

    Second, the Qur'an provides guidelines / instructions for the trustee as to the time at

    which the property of the orphans is to be handed over--it is the time when the orphan

    has attained adulthood or marriageable age and that he or she has attained a gooddegree of mental maturity.

    Then if nastum (you perceive) min'hum (in them) rush'dan (soundjudgement),

    release their property to them

    Hence, the Qur'an gives a clear definition / explanation of adulthood or marriageable

    age as one when a man or a woman has attained a good measure of mental maturity.

    So we can ask again a simple question, does a 6- or 9-year old have that level or quality

    of sound judgment?

    The answer of course would be NO.

    The Qur'anic guidelines / instructions laid out for us describes clearly in Sura 4:6 tell

    us that Prophet Muhammad and anyone who is and grown adult / man or woman

    couldnt marry any little girls that is of the age 6 -14.

    There are other ayats that tells us that the marriage bond has been described as 'solemn

    covenant/solid contract---Meethaqan ghaleezan'.2

    And how could you take it while you have gone in unto each other and they have

    taken from you anmthqanghalan (solemn covenant)? Sura 4/21

    Allah conveys to us in Sura 4/21 the same phrase 'mthqanghalan (solemn

    covenant) has been used for husband-wife relationship as for the covenant that Allah

    took from all the prophets including our own prophet in Sura 33/7.

    "And mention when We took from the prophets their covenant and from you and from

    Noah and Abraham and Moses and Isa, the son of Mary; and We took from them an

    mthqanghalan (solemn covenant) That He may question the truthful about their

    truth. And He has prepared for the disbelievers a painful punishment." Sura 33/7-8

    Not only that, the same expression was also used when Allah took covenant from theJews not to violate the Sabbath (4:154).

    And We raised over them the mount for [refusal of] their covenant; and We said to

    them, "Enter the gate bowing humbly", and We said to them, "Do not transgress on the

    sabbath", and We took from them anmthqanghalan (solemn covenant). Sura

    The reality in terms of marriage according to the Qur'an 'tying the knot' is going for a

    "mthqanghalan (solemn covenant) of mutual trust and faithfulness for each

    other. And this type of relationships of marriage that, when developed and nourished

    in time, gives rise to true love, tranquility and mutual feelings of caring which Allah

    says in Sura 30:21

    And of His signs is that He created you from dust; then, suddenly you were human

    beings dispersing. Sura 30/21

    This is what Allah allows to build between us, to the point that our offspring become

    soothing comfort of our eyes as told to us in Sura 25/74.

    And those who say, "Our Lord, grant us from amongazwjin(our wives)

    wadhurriyytin(and offspring) comfort to our eyes and make us an example for the

    righteous." Sura 25/74

    The Arabic word in this verse for descendants, offspring, progeny is Dhurriyyatahu

    There are two words frequently used in the Scripture to denote 'seed' they are:

    Nasl - noun pl. Insaal is progeny, offspring, issue, descendants.

    This word is derived from the root nsala, to beget, procreate,

    Other words derived from this word are:

    1) Insaal- Procreation, generation

    2) Tanaasul- Sexual propagation, procreation, generation, reproduction

    3) Adaaut Tanaasal - Sexual organs, genitals

    4) Da' faut Tanaasal - Sexual impotence

    5) Tanaasuliy - Procreative, propagative, genital, sexual

    6) Mard Tanaasiliy - Venereal disease

    7) Tanaasiliyaat - Sexual organs

    And

    8) Dhurriyah - Progeny, descendants, children, offspring; Dhurriy, Of or pertaining to

    the offspring or progeny

    The word dhurriyyah can be found in its plural form in Al Qur'an Surah 25:74 as

    offspring in Surah 6:88.

    The word dhurriyyatihim is used for descendants. In the Qur'an 2:124, 13:23 as

    offspring, in Surah 29:28 as seed and Surah 37:77 as progeny.

    Anyone with common sense and who uses their Aql / reasoning can ask the question,

    who is honest, can a girl who is of the age of 8 -16 can truly display enough decision,

    understanding and wisdom / judgment to enable her to enter into amthqanghalan

    (solemn covenant) with regards marriage for the rest of her life?

    O mankind! if ye have a doubt about the Resurrection, (consider) that We created you

    out of dust, then out of sperm, then out of a leech-like clot, then out of a morsel of flesh,

    partly formed and partly unformed, in order that We may manifest (our power) to you;

    and We cause whom We will to rest in the wombs for an appointed term, then do We

    bring you out as babes, then foster youlitablugh(that ye may reach) ashuddakum

    (your age of full strength / maturity); and some of you are called to die, and some are

    sent back to the feeblest old age, so that they know nothing after having known (much),

    and (further), thou seest the earth barren and lifeless, but when We pour down rain on

    it, it is stirred (to life), it swells, and it puts forth every kind of beautiful growth (in

    pairs). Sura 22/5

    It is He Who has created you from dust then from a sperm-drop, then from a leech-

    like clot; then does he get you out (into the light) as a child: thenlitablugh(lets you

    reach) ashuddakum (your maturity / full strength); then lets you become old,- though

    of you there are some who die before;- and lets you reach a Term appointed; in order

    that ye may learn wisdom. Sura 40/67

    And come not nigh to the orphan's property, except to improve it, untilyablugha (he

    reaches) ashuddahu (his maturity); give measure and weight with (full) justice;- no

    burden do We place on any soul, but that which it can bear;- whenever ye speak, speak

    justly, even if a near relative is concerned; and fulfil the covenant of Allah: thus doth Hecommand you, that ye may remember. Sura 6/152

    Literally, because sexual relations is vital also in marriage we all know that sexual

    intimacy is intertwined in a marital relationship as this was the case with the

    unfortunate situation with this 8 year old girl who died because of it in Yemen.

    Conclusion:

    A girl around 6 16:

    1) Cant have been an adult woman capable of making her own sound decisions,and,

    2) Cant enter amthqanghalan (solemn covenant) at the age of 6 -16 withgrown man / and elderly men. Hence, this behavior defies all reasons for a

    productive and meaningful union.

    These extreme practices violate and go against the Qur'anic injunctions of Sura 4/6 and

    Sura 4/21.

    Nonetheless, since the charge of pedophilia by Rev. Vines rested solely on some Hadith

    reports and not on any of the Qur'anic verses, the attention is now turned to those

    Hadith accounts as well as other observations related to Pedophilia and how many

    Muslims today are trying to use Hadith to practice it. Let us not be so naive here and

    ask ourselves what do you really think goes through a 40 or 60 year old man who seeks

    a 6, 7, 8 or 9 year old child for marriage.
