MEMORANDUM REGARDINGPUBLIC DISCLOSUREREQUIREMENTS
FROM: Dennis Eagle, Director of Legislative and Political Action
Previous to each session of the Washington State Legislature questions are raisedconcerning the rights of state employees to contact their legislators. This sessionis no exception and, in order to clear up any questions, we have prepared the fol-
lowing statement that outlines the legal rights of employees in such matters:
At the request of several members and staff, we have contacted the PublicDisclosure Commission regarding the obligations of a state employee toreport contact with legislators.
A state employee who writes, phones, or in some way contacts his/her ownlegislators, or other legislators on matters of concern to him/her as a con-stituent and/or citizen is not obligated to report that contact.
The only obligation an employee has to report contact with individual leg-islators may occur when that employee contacts legislators on an ofcial
matter where the state employee is acting on behalf of his/her employingagency and on ofcial agency matters, or where a legislator contacts an
employee under the same circumstances. Where an employee has contactwith legislators under these circumstances the employee should check withhis/her supervisor on any reporting requirements.
It should be clearly understood that a citizen who happens to be employedby the state is free to express his/her right to contact his/her legislators orother legislators, at any level (local/county/state/federal) and express his/
her concerns, comments or opinions on legislative matters.
We remind you that when you contact legislators, you must do it on yourown time and not using any state resources. Phone calls should be from
your personal phone. E-mails should be from home computers.
I hope this is helpful in answering any questions. If you need additional informa-tion, please feel free to give me a call at 1-800-562-6002.

TALKING POINTS
Two years ago, we were in the worst eco-
nomic crisis in 70 years:
State workers took 3% pay cuts and fur-loughs. That was on top of 5% cuts takenby a third of state workers starting in themiddle of 2010. No cost-of-living adjust-ments since 2008.
State workers health premiums rose by25%. Out-of-pocket costs rose 100% - yet
the state cut its share of contributions.
Politicians attacked our pensions. In thepast two years, state employees paid near-ly 18% more for pensions. Thats on top ofthe $300 million in pension funds divertedin 2009.
In 2012, a coalition of senators attempted
to end PERS 2, cut earlier retirement andmake other pension cuts. In the end, theycut early retirement for new state workershired after May 1, 2013. But that coalitionnow has full control of the Senate includ-ing the committees that decide our pen-sions.
Attacks on pensions continue yet publicemployees retire with an average annual
pension just under $20,000.
Vital funding for programs was reduced.Since 2008, some 10,000 employees havebeen cut workloads have skyrocketed. In Corrections, Pine Lodge and AhtanumView closed. In Juvenile Rehabilitation,Maple Lane School was shuttered. In De-velopmental Disabilities, Frances HaddonMorgan Center shut down.
2013 is the year to restore a fair helping of decencyto middle class public servants whove saved the sta
The list goes on and on. But in the past twoyears, state employees gave back more tha$1.5 billion to save the state and taken onmore workload as the workforce declined.
Public servants became Middle Class H

our state:
Fund the new contracts that end the 3%pay cuts in General Government and Comunity Colleges in June 2013, with a posible 1% COLA in 2014.
Do nothing to block those contracts atfour-year higher education institutions winnovative compensation packages.

MIDDLE CLASS VALUES
Hold the line on health care. Let negotia-tions on the new health care agreementproceed with the new administration. Makeno unilateral changes to the current con-tractual agreement where the state pays
85% of premium share and employees pay15%. Make adequate increases in overallstatecontributiontobenets, whichwas
cut last year to $800 per employee permonth.
Fund the new M Step in our negotiatedcontracts that will bring a 2.5% pay boostto most members on July 1, 2013.
Fund the extension of the personal leaveday (in our negotiated General Govern-ment contract) to institutions workers, whopreviously didnt qualify.
Block attacks on pensions. Dont increasepension contribution rates beyond thoserecommended by the Pension FundingCouncil a modest increase in PERS 2
from 4.64% to 4.92% and no increases inthe Public Safety Employees RetirementSystem (PSERS). Support further studystarted by the Select Committee on Pen-sion Policy that should lead to adding high-risk job classes to PSERS.

that saved the state!
It wont be easy. Big Business is already lin-ing up against our modest requests for MiddClass values so they can hold onto their bil-lions in tax giveaways.
Of the nearly $100 billion in tax breaksgiven out every year, corporations guardabout $14 billion of those that could befairly closed. In recent years, the stategave away $3 billion more with 150 newtaxloopholes.Lastyear,weidentied27
cuts that could save the state $2.3 billionalone.
Insteadofsharingthesacriceofstate
workers and taxpayers, corporations rallyaround pro-business think tanks and politcians who want to attack your modest re-quests as a cover against attacks on taxbreaks. Take this recent editorial from theVancouver Columbian:
How,then,couldtherebeadecit,you
ask? Because spending will also be in-
creasing, partly in new caseloads, but alin other areas. And its not hard to identifone major area of cost increases: compesationandbenetsforworkers....Reme
ber, none of those gains can be typicallyexpected by workers in the private sectoSo were back to the same old problem:about $770 million in compensation-relanew costs, backed up against a $900 mi
liondecit.Andthatiswhygettingtoughnegotiations with state-worker unions is important. Its the most logical way to baance the state budget.

MEMBER LOBBYING
Effective member lobbying starts with understanding how
legislators work and think.
Legislators face unique pressures
1. Legislators simply do not have enough time to
do everything they would like to do.
2. Legislators deal with thousands of bills; they
cast votes on hundreds of bills; and they cant
possibly know the details of each one.
3. There are more than 1,000 registered lobbyists,
and countless more citizen lobbyists - all vying
for a Legislators time, attention and vote.
4. Legislators are accountable to thousands of
constituents back home.
Legislators are forced to prioritize and
specialize
1. Legislators only have time to really dig into a
few issues, so they tend to specialize.
2. On their issues they hope their colleagues
will follow their lead and, in turn, they follow
the lead of members they trust that special-
ize in other issues.
3. Its hard for a legislator to go against the spe-
cialist from his or her own caucus.
Legislators face demands from their
eadership
1. The leadership of the majority caucus controls
the calendar and agenda.
2. Individual legislators cant overcome leader-
ship decisions.
3. The hardest thing for a new legislator to adjust
to is that they really dont have a lot of say in
what happens.
Legislators want to be helpful
- its their nature
Legislators want to serve their constituents, bu
there is a limit to what they can do. As membe
lobbyists we can help them by:
Providingaspecicandrealisticrequest.
Heeding their advice on ways that will to pr
mote our issues.
Following up with them and keeping them
the loop.
You can expect legislators to:
Listen.
Offer advice.
Be candid.
Provide insight.

MEMBER LOBBYING
How to communicate effectively with legislators.
Summarize, summarize, summarize
1. You can only expect to meet with your legisla-
tor for 15 minutes or less during the session.
2. Askforaspecicaction.
3. Keep your message focused and positive.
4. Make sure you have time to listen to your leg-
islators thoughts, ideas and concerns.
5. Provide a one-page handout to help your legis-
lator keep track of your issue(s).
Public testimony
1. Prepare before the hearing.
2. Make it real; tell your story.
3. Keep it to three (3) minutes or less.
4. Dont repeat what others have said.
5. Provide staff with a one-page handout.
6. Remember - public testimony is one of the
least effective means of communication with
legislators.
Lobby all year, every year.
1. Invest yourself in campaigns for WFSE/
AFSCME-supported candidates in your area.
2. Interim meetings with legislators are far moreeffective than meetings during session.
3. Invite your legislators to a local meeting or to
your worksite when they are not in session.
4. Be prepared for the long haul; major challeng-
es can take years to pass.
5. To be effective, you must have a sustained
presence.
Forms of communication with legislato
Most effective:
Work on their campaign.
Meet with them during the interim.
Meet with them during the session.
Personal letters and emails.
Messages left for them on the Legislative
Holtine.
Public hearings.
Having a sustained presence - being there
early and often.
Least effective:
Form letters.
Generic post cards.
Petitions.
Spam.
Out-of-district correspondence.
Rallies or other one and done
demonstrations.
