W e’ve all heard the warnings before about asbestos, but you might not

know where it could actually be hiding.

Slater and Gordon Asbestos Lawyer, Martin Rogalski, is warning people to check their workplace is asbestos compliant and to record as many details as possible about where they might come into contact with it after one of his clients developed a disease 40 years later from exposure to the fi bres.

Mother of three, Tonya Fenton, has only worked in offi ces, never carried out DIY renovations, washed dusty clothes or handled asbestos-ridden debris.

Last year, Ms Fenton was diagnosed with malignant meso-thelioma after being exposed to dust from the Expo 88 demolition

At one point the dust was so overwhelming, her employer hired a company to provide fresh towels to clean work spaces and even had to have the offi ce plants wiped down every few days.

“I would never have agreed to be anywhere near the demolition site if I’d known it was dangerous, but my employer never raised any concerns,” Ms Fenton said.

“I spent my 30th wedding anniversary undergoing chemo-therapy, after fi nding out I had mesothelioma just one month beforehand.

“My warning to workers and employers everywhere is to take the time to learn the dangers of asbestos, or you may fi nd yourself fi ghting for the time it takes away from you and your loved ones.”

Mr Rogalski has highlighted

six sources of asbestos exposure many people aren’t commonly aware of after hearing Ms Fenton’s story.

Included in the list is proximity to non-compliant demolition and construction sites, factories and asbestos mines; DIY renovations including houses built before the mid-1980s and anything made from bonded asbestos cement; washing clothes worn by people exposed to asbestos; debris from bushfi res, cyclones, fl oods and other natural disasters; rubbish dumps that fail to handle asbestos waste according to requirements; and old and disused parks, espe-cially children’s playgrounds that have fallen into disrepair.

Slater and Gordon has a National Asbestos Register where people can record their potential expo-sure so that information can be accessed in the future if needed.

The importance of a business agreementA n alarming statistic

is that as few as four per cent of businesses currently have a

documented agreement between the owners, this is true over all business structures whether they be company, partnerships or a unit trust.

Most people feel the document exists to solve disputes, which is true, but this is a small yet impor-tant part of the agreement, there are so many other aspects that

business owners should agree and document before they occur.

An important part of the busi-ness agreement revolves around exiting the business, whether it be planned or unplanned.

At some point one or more owners would like to exit the business or are forced to exit due to death or disablement. It is important to agree what happens when these events occur. Under what conditions can an owner/s exit? Are there restrictions/time frames? Does the departing owner have to sell to the existing owners? How is the value deter-mined? How will it be fi nanced? What happens if the remaining partners don’t want to buy?

An unplanned exit by way of death or disablement can be disastrous for the business, and unfortunately I have witnessed this fi rst hand. If one of the owners is no longer part of the business, will the business be able

to function? If not, what actions need to be taken? The estate of the deceased partner is entitled to their share of the business, how do the surviving partners deal with this? Do they buy the share from the estate? How is it funded?

Often unplanned exits such as above use a buy/sell agreement and an insurance policy to cover owners and key people that will ensure the business can carry on in the event of death or disable-ment of a key person whilst ensur-ing the deceased estate will not be disadvantaged.

Another area where issues often arise is around the sale of a busi-ness to an external party, what happens if an off er is tabled and owners can’t agree whether to accept?

The moral of the story is that we all enter business to make money and build an asset, a business agreement protects the value of the business and future income.

The falling Australian dollar is proving a challenge for imported car sales and online shopping, however it’s setting up some of Australia’s favourite holiday destinations for a bumper Christ-mas holiday season, according to leading real estate group Raine & Horne. On the Gold Coast, Raine & Horne Surfers Paradise is reporting that 95 per cent of its holiday apartments on the popular tourist strip, where two-bedroom apartments start from $400 a night during the peak Christmas period from Decem-ber 24 to January 2, have already been booked. “More Australians seem content to holiday at home this Christmas, while the falling dollar is making Australia a more aff ordable vacation destination for overseas travellers,” said Clark Brackenridge, Principal of Raine & Horne Surfers Paradise.

Future cash rate cuts by the

Reserve Bank of Australia (RBA) are likely to be negated by lenders raising interest rates due to issues such as cost of funding, says mortgage broker network 1300HomeLoan.

1300HomeLoan Managing Director John Kolenda said the RBA’s cash rate has stayed at a record low of 2.0 per cent since May this year but there remains expectations of further interest rate relief before the end of the year, and possibly on Melbourne Cup day.

“The RBA has some history in playing a part on Melbourne Cup day and we may see the central bank cut rates once more on the first Tuesday in November or before the end of the year,” he said.

But Mr Kolenda said further rate relief from the central bank may not be passed on in full by lenders, while some borrowers have already been hit with increases to their mortgage rates.

If something is in a certain drawer, make sure it finds its way back to that drawer after you use them. Keep your keys in the one place and train yourself to always put them there, for example.

Rewards: Reward yourself for being organised. For example, if you’ve cooked at home every day for a week and that was your goal, treat yourself to a meal out. If you’ve cleaned the house from top to tail, go shopping!
