WHEREAS by an Act passed in a Session of Parlia-ment held in the seventh and eighth years of Her lateMajesty 's reign (shortly entitled "The Judicial Com-mittee Act, 1844") it was enacted that it should becompetent to Her Majesty by any Order or Orders inCwincil to provide for the admission of Appeals to HerMajesty in Council from any judgments, sentences,decrees or orders of any Court of Justice within anyBritish Colony or Possession abroad, although suchCourt should not be a Court of Errors or Appeal withinsuch Colony or Possession, and to make provision forthe instituting and prosecuting of such Appeals, andfor carrying into effect any such decisions or sentencesas Her Majesty in Council should pronounce thereon :

And whereas by an Order in Council, dated the 11thof October, 1861, provision was made for Appeals fromthe Supreme Court of the Colony of Western Australiato Her Majesty in Council :

And whereas the Colony of Western Australia isnow a State of the Commonwealth of Australia con-stituted by an Act passed in a Session of Parliamentheld in the sixty-third and sixty-fourth years of Herlate Majesty 's reign and entitled " An Act to con-stitute the Commonwealth of Australia ":

And whereas it is expedient, with a view to equalis-ing as far as may be the conditions under which HisMajesty 's subjects in the British Dominions beyond theSeas shall have a right of Appeal to His Majesty inCouncil and to promoting uniformity in the practiceand procedure in all such Appeals, that the said Orderin Council, dated 11th of October, 1861, should be re-voked and new provision made for Appeals from thesaid Supreme Court to His Majesty in Council:

It is hereby ordered by the King 's Most ExcellentMajesty, by and with the advice of His Privy Council,that the said Order in Council be and the same is herebyrevoked, and that instead thereof the Rules hereunderset out shall regulate all Appeals to His Majesty inCouncil from the said State of Western Australia.

1. In these Rules, unless the context otherwise re-quires :

" Appeal" means Appeal to His Majesty in Council :"His Majesty" includes His Majesty 's heirs and

successors;" Judgment " includes decree, order, sentence, or de-

cision;" Court " means either the Full Court or a single

Judge of the Supreme Court of Western Aus-tralia according as the matter in question is onewhich, under the Rules and Practice of theSupreme Court, properly appertains to the FullCourt or to a single Judge ;

" Record " means the aggregate of papers relating toan Appeal (including the pleadings, proceedings,evidence, and judgments) proper to be laid be-fore His Majesty in Council on the hearing ofthe Appeal;

"Registrar " means the Registrar or other properofficer having the custody of the Records in theCourt appealed from;

Month" means calendar month ;

Words in the singular include the plural, and wordsin, the plural include the singular.

2. Subject to the provisions of these Rules, anAppeal shall lie

(a) as of right, from any final judgment of the Court,where the matter in dispute on the Appealamounts to or is of the value of £500 sterlingor upwards, or where the Appeal involves,directly or indirectly, some claim or question toor respecting property or some civil rightamounting to or of the value of £500 sterlingor upwards; and

(b) at the discretion of the Court, front any otherjudgment of the Court, whether final or inter-locutory, if in the opinion of the Court thequestion involved in the Appeal is one which,by reason of its great general or public im-portance, or otherwise, ought to be submittedto His Majesty in Council for decision.

3. Where, in any action or other proceeding, nofinal judgment can be duly given in consequence of a.

difference of opinion between the Judges, the finaljudgment may be entered pro lemmue on the appli-cation of any party to such action or other pro-ceeding according' to the opinion of the Chief J ustice,or, in his absence, of the senior puisne judge of theCourt, but such judgment shall only be deemed final forpurposes of an Appeal therefrom, and not for any otherpurpose.

4. Applications to the Court for leave to appeal shallhe made by motion or petition within twenty-one daysfrom the date of the judgment to be appealed from,and the Applicant shall give the opposite party notice ofhis intended application.

5. Leave to appeal under Rule 2 shall only be grantedby the Court in the first instance:

(a) upon condition of the Appellant, within a periodto be fixed by the Court, but not exceedingthree months front the date of the hearing ofthe application for leave to appeal, enteringinto good and sufficient security, to the satis-faction of the Court, in a sum not exceeding£500, for the due prosecution of the Appeal,and the payment of all such costs as may be-come payable to the Respondent in the eventof the Appellant's not obtaining an.s, ordergranting him final leave to appeal, or of theAppeal being dismissed for non-prosecution, orof His Majesty in Council ordering the Appel-lant to pay the Respondent's costs of theAppeal (as the case may he) ; and

(b) upon such other conditions (if any) as to thetime or times within which the Appellant shalltake the necessary steps for the purpose ofprocuring the preparation of the Record andthe dispatch thereof to England as the Court,having regard to all the circumstance of thecase, may think it reasonable to impose.

6. Where the judgment appealed from requires theAppellant to pay money or perform a duty, the Courtshall have power, when granting leave to appeal, eitherto direct that the said judgment shall be carried intoexecution or that the execution thereof shall be sus-pended pending the Appeal, as to the Court shall seemjust, and in case the Court shall direct the said judg-ment to be carried into execution, the person in whosefavour it was given shall, before the execution thereof,enter into good and sufficient security, to the satis-faction of the Court, for the due performance of suchOrder as His Majesty in Council shall think fit to makethereon.

7. The preparation of the Record shall be subjectto the supervision of the Court, and the parties maysubmit any disputed question arising in connection there-with to the decision of the Court, and the Court shallgive such directions thereon as the justice of the casemay require.

8. The Registrar, as well as the parties and theirlegal Agents, shall endeavour to exclude from the Recordall documents (more particularly such as are merelyformal) that are not relevant to the subject-matter ofthe Appeal, and generally to reduce the bulk of theRecord as far as practicable, taking special care toavoid the duplication of documents and the unnecessaryrepetition of headings and other merely formal parts ofdocuments; but the documents omitted to be copied orprinted shall be enumerated in a list to be placed afterthe index or at the end of the Record.

9. Where in the course of the preparation of aRecord one party objects to the inclusion of a doc.menton the ground that it is unnecessary or irrelevant, andthe other party nevertheless insists upon its being in-cluded, the Record, as finally printed (whether in West-ern Australia or in England), shall, with a \ iew to thesubsequent adjustment of the costs of and incidentalto such document, indicate in the index of papers, orotherwise, the fact that, and the party by whom, theinclusion of the document was objected to.

10. The Record shall be printed in accordance withthe Rules set forth in the Schedule hereto. It may beso printed either in Western Australia or in England.

11. Where the Record is printed in Western Ai s-tralia, the Registrar shall, at the expense of the Appel-lant, transmit to the Registrar of the Privy Council40 copies of such Record, one of which copies lie shallcertify to be correct by signing his name 'on, or initial-ling, every eighth page thereof and by affixing theretothe seal, if any, of the Court.

12. Where the Record is to be printed in England,the Registrar shall, at the expense of the Appellant,transmit to the Registrar of the Privy Council onecertified copy of such Record, together with an indexof all the papers and exhibits in the case. No othercertified copies of the Record shall be transmitted tothe Agents in England by or on behalf of the partiesto the Appeal.

13. Where part of the Record is printed in WesternAustralia and part is to be printed in England, Rules11 and 12 shall, as far as practicable, apply to suchparts as are printed in Western Australia and such asare to be printed in England respectively.

14. The reasons given by the Judge, or any of theJudges, for or against any judgment pronounced in thecourse of the proceedings out of which the Appeal arisesshall by such Judge or Judges be communicated Mwriting to the Registrar, and shall by him be trans-mitted to the Registrar of the Privy Council at the sametime when the Record is transmitted.

15. Where there are two or more applications forleave to appeal arising out of the same matter, and theCourt is of opinion that it would be for the convenienceof the Lords of the Judicial Committee and all partie(concerned that the Appeals should be consolidated, theCourt may direct the Appeals to be consolidated arcgrant leave to appeal by a single order.

16. An Appellant who has obtained an order grant.Mg him conditional leave to appeal may at any tim'prior to the making of an order granting hint final leay.to appeal withdraw his Appeal on such terms as to cost,and otherwise as the Court may direct.

17. Where an Appellant, having obtained an orde.granting him conditional leave to appeal, and havingcomplied with the conditions imposed on him by sucl.order, fails thereafter to apply with due diligence to theCourt for an order granting him final leave to appeal,the Court may, on an application in that behalf madeby the Respondent, rescind the order granting coltditional leave to appeal, notwithstanding the Appellant'scompliance with the conditions imposed by such order,and may give such directions as to the costs of theAppeal and the security entered into by the Appellantas the Court shall think fit, or make such further orother order in the premises as, in the opinion of theCourt, the justice of the case requires.

18. On an application for final leave to appeal, theCourt may inquire whether notice, or sufficient notice,of the application has been given by the Appellant toall parties concerned, and, if not satisfied as to thenotice given, may defer the granting of the final leaveto appeal, or may give such other directions in the mat-ter as in the opinion of the Court the justice of the.case requires.

19. An Appellant who has obtained final leave toappeal shall prosecute his Appeal in accordance withthe Rules for the time being regulating the generalpractice and procedure in Appeals to His Majesty inCouncil.

20. Where an Appellant, having obtained final leaveto appeal, desires, prior to the dispatch of the Recordto England, to withdraw his Appeal, the Court may,upon an application in that behalf made by the Appel-lant, grant him a certificate to the effect that the Appealhas been withdrawn, and the Appeal shall thereuponbe deemed, as from the date of such certificate, to standdismissed without express Order of His Majesty inCouncil, and the costs of the Appeal and the security

entered into by the Appellant shall be dealt with insuch manner as the Court may think fit to direct.

21. Where an Appella nt, having obtained final leaveto :ipteal, fails to show due diligence in taking allimeissary steps for the purpose of procuring the dis-patch of the Record to England, the Respondent may,after giving the Appellant due notice of his intendedapplication, apply to the Court for a certificate thatthe Appeal has not been effectually prosecuted by theAppellant, and if the Court sees fit to grant such acertificate, the Appeal shall he deemed, as from thedate of such certificate, to stand dismissed for non-prosecution without express Order of His Majesty inCouncil, and the costs of the Appeal and the securityentered into by the Appellant shall be dealt with insuch manner as the Court may think fit to direct.

22. Where at any time between the order grantingfinal leave to appeal and the dispatch of the Record toEngland the Record becomes defective by reason of thedeath, or change of status, of a party to the Appeal,the Court may notwithstanding the order granting finalleave to appeal, on an application in that behalf madeby any person interested, grant a certificate showingwho, in the opinion of the Court, is the proper personto he substituted or entered on the Record in place of,or in addition to, the party who has died or undergonea change of status, and the name of such person shallthereupon be deemed to be so substituted or enteredon the Record as aforesaid without express Order ofHis Majesty in Council.

23. Where the Record subsequently to its dispatch toEngland becomes defective by reason of the death, orchange of status, of a party to the Appeal, the Courtshall, upon an application in that behalf made by anyperson interested, cause a certificate to be transmittedto the Registrar of the Privy Council showing who, inthe opinion of the Court, is the proper person to besubstituted, or entered, on the Record, in place of, orin addition to, the party who has died or undergone a.change of status.

24. The Case of each party to the Appeal may beprinted either in Western Australia or in England, andshall, in either event, be printed in accordance with theRules set forth in the Schedule hereto, every tenth linethereof being numbered in the margin, and shall besigned by at least one of the Counsel who attends atthe hearing of the Appeal, or by time party himself ifhe conducts his Appeal in person.

25. The Case shall consist of paragraphs numberedconsecutively, and shall state, as concisely as possible,the circumstances out of winch the Appeal arises, thecontentions to be urged by the party lodging the same,and the reasons of Appeal. PURSUANT to the powers conferred upon me by "TheGovernment Railways Act, 1904," I hereby make theBy-law set forth hereunder, to come into operation onthe first day of July, 1921, and do hereby repeal allRegulations and Instructions in force at the cominginto operation of this By-law, in so far as they are inconflict with any of its provisions.

BY-LAW No. 66.This By-law may be cited and known as the "West

Australian Government. Railways Salaried Staff By-law," and will have application to all Officers who areengaged for the working and maintenance of the WestAustralian Government Railways.2. Interpretation.

(a) "Head of Branch" shall mean the Secretary forRailways, Chief 'Traffic Manager, Chief Mechanical En-gineer, Chief Engineer Way and Works, Chief Ac-countant, Auditor of Receipts, and Comptroller ofStores, or such other Head as may hereafter be ap-pointed.

(b) " Officer" shall mean any person who is in re-ceipt of an annual salary.

(c) " Permanent " shall mean an Officer who hasserved the full period of probation and whose appoint-ment has been confirmed by the Commissioner.

(d) "Temporary" shall mean a person who is en-gaged upon probation or upon work which, in theopinion of the Bead of the Branch, is not likely tonecessitate a permanent appointment, whose term ofemployment shall in all cases be at the discretion ofthe Head of the Branch.3. Appointment to the Service.

(a) Applications for admission to the Service mustbe made on the usual Departmental form.

(b) When Junior Clerks are required, applicationswill be invited by public advertisement.

(c) The form must be filled in in the applicant's ownhandwriting, and addressed to the Chairman of Selec-tion Board.

(d) Each application must be supported with the fol-lowing documentary testimony,

(1) Registrar's Certificate of Birth or, in the eventof such not being obtainable, a duly swornstatutory declaration of date of birth from aparent, guardian, person of good repute, orfrom the candidate should he be over the ageof 21 years.

(2) Educational certificate to the standard deter-mined by the Commissioner for the position ap-plied for.Three satisfactory testimonials of character,one of which must be from the, last employeror, in the event of a candidate just leavingschool, from the head master of the school heor she last attended, or should neither of thesebe obtainable, a satisfactory reason must beforthcoming.

(e) The age of admission shall be:Minimum. Maximum.

(1) For Junior Clerks .. 15 yrs. 17 yrs.(2) For Engineering 16 yrs. 13 yrs.

Cadets(3) For other positions 35 yrs.

(f) Provided always that in special cases to meet therequirements of the Service the Commissioner may ad-mit any person whose age may be beyond the maximum.4. Junior Clerks.

(a) Applicants for the position of Junior Clerk whohave complied with the provisions of paragraph 3 willbe called upon to present themselves before a SelectionBoard appointed by the Commissioner, which Board maymake such tests and arrange for such examinations asit may deem necessary.

(b) The Board will decide which applicants are suit-able for employment and in what order they shall beoffered positions.

(c) In making their selection the Board will be gov-erned by the examinations which the applicants havepassed, their physical appearance, apparent generalcapabilities to discharge the duties which they will berequired to perform, and such other considerations asthey may think it necessary to take into account in in-fluencing their choice.

(0) The approved applicants will be offered positionsin the order in which they are placed by the SelectionBoard, and any applicant who does not accept a posi-

Lion when it is offered will have his or her name removedfrom the list of approved candidates, unless the Com-missioner approves of the name being retained on thelist.

(e) An approved applicant residing outside the Metro-politan Suburban Area may be offered a vacancy at astation adjacent to his place of residence, notwith-standing that lie or she may not be the first on the list.

(f) If approved applicants are not employed withinsix months of their appearance before the SelectionBoard their applications lapse.5. Appointment of Engineering Cadets.

(a) An applicant for appointment as an Engineering.Cadet must not be more than eighteen nor less thansixteen years of age. He will be required to produce amedical certificate from the Railway Medical Officer tothe effect that he is of sound constitution, and notaffected with any physical infirmity which would inter-fere with the proper exercise of his profession. Heshall also produce satisfactory evidence as to hischaracter.

(b) Qualifications.An applicant will be required toproduce evidence of the examinations passed by him.All oilier things being equal, preference will be given toa candidate who has passed the Matriculation Examina-tion of the University of Western Australia in subjectsset down for engineering cadets, vie., English and an-other modern language Mathematics and Applied Mathe-matics, Chemistry, and Geology or Physics.

(c) Competitive Examination.Applications will beinvited by the Commissioner of Railways by advertise-ment, and in the event of more applications being re-ceived than the number of vacancies a competitive ex-amination may be held by the Department in trigono-metrical computations, plotting and plan drawing.

(d) Probation Every cadet shall, in the first in-stance, be appointed on probation for a period of notmore than three months. Before the expiration of theperiod of probation the Permanent Head shall report tothe Commissioner on the manner in which the proba-tioner has performed Ins duties and upon his generalconduct. Upon receipt of such report the Commissionerwill confirm or annul the cadetship. Upon confirmationof a Cadet's appointment he will be articled to the Headof the Branch for the prescribed term of service.

(e) T mu of Service.A Cadet who possesses thequalifications as prescribed in Section (b) will be re-quired to serve for a term of four years, a part of whichwill be spent in the office where he will receive instruc-tion in general engineering drafting, computations,specifications, office methods, etc. The balance of theterm will be in the field on engineering surveys andthe construction of works in the ease of Civil Engin-eering Cadets, in the Workshops and Running Sheds inthe case of Mechanical Engineering- Cadets, and in theWorkshops or On general outside work in the case ofElectrical Engineering Cadets.

(f) 'General. During the term of service a Cadetmust become a Student of the. Institute of Civil Engin-eers, Loudon, and will be expected to attend classes,whenever possible, at the University or Technical School,in his own time for the further study of subjects neces-sary to enable him to pass the examination qualifyingfor a candidate as Associate Member of the Institutionof Civil Engineers, Mechanical Engineers, or ElectricalEngineers, London.

(g) Should a Cadet desire to obtain an engineeringdegree at the 'University of Western Australia, section(f) will not apply. Time will be allowed him to attendthe requisite lectures, such time to be without pay.

(h) When a Cadet has completed one-half of theprescribed term of service, if in the opinion. of the per-manent head of the Department his progress and gen-eral conduct have not been satisfactory, his services maybe dispensed with, on the approval of the Commissionerof Railways.

(i) On the completion of the prescribed term of ser-vice a. Cadet will required to apply to the Institution ofCivil Engineers, the institution of Mechanical Engin-eers, or the Institution of Electrical Engineers, London,for the admission to the examination qualifying forcandidature as an Associate member. The Cadet's termof service shall be extended to cover the period betweenthe completion of his service and the holding of the ex-amination by the Institution at the same remunerationas that received for his last year of service.

(j) When a Cadet takes advantage of Section (g) hemust, on completion of the prescribed term of service,

obtain the degree of Bachelor of Engineering of theUniversity of 'Western Australia..

(k) Should a Cadet fail to pass in either of theseexaminations set forth in Sections (i) and (j) his termof service may be extended for a further period notexceeding two years, at the same remuneration as thatreceived for his last year of service.

(1) Permanent Appointmcnt.A Cadet who has satis-factorily completed his cadetship and passed the ex-alninations required in Sections (i) and (j) shall (shouldhe be so required) serve in the Railway Service of theState for a period of three (3) years at a salary in ac-cordance with the Commissioner's classification of thework upon which he is engaged.6. Probation.

(a) Every person appointed under this By-law shallserve a probation of one year, except where otherwiseprovided.

(b) After the period of probation and upon produc-tion of a certificate of fitness from the Head of theBranch in which the probationer has been employed, hisor her appointment may be confirmed by the Commis-sioner.

(c) Exemption may be granted by the Commissionerin regard to a term of probation in the case of officersof known ability and skill.7. Examinations.

(a) All Officers shall present themselves for medicalexamination and vision and hearing tests when instructedso to do.

(b) All Officers shall qualify and pass examinationsin such subjects as the Commissioner may decide, andthe retention of any Officer in the Service will be con-tingent upon his passing such examinations.8. Duties and Discipine.

(a) All persons employed by the Commissioner mustdevote themselves exclusively to his service, and conformto all the Rules and Regulations of the Commissioner;they must reside at whatever place may be appointed,attend at such hours as may be required, and payprompt obedience to all persons placed in' authority overthem.

(b) No employee shall trade, either directly or in-directly, for himself or others.

(c) Provided that nothing herein contained shall bedeemed to prevent an Officer holding a paid positionin a registered Friendly or Co-operative Society, or inany Society or Union of Railway Officers.

(d) Any Officer shall not use for any other purposethan the discharge of his official duties informationgained by or conveyed to him through his connectionwith the Railway Service.

(e) If the estate of an Offieer shall become seques-trated, either voluntarily or compulsorily, for the bene-fit of his creditors, such Officer shall report the full cir-cumstances, through the Head of his Branch, to theCommissioner, and shall apply, as soon as he may legallydo so, to the Court for a certificate of discharge. Ifsuch Officer does not so report or apply for such certifi-cate of discharge, or if he applies, and it appears fromthe report that such officer has been guilty of fraud,dishonourable conduct, or extravagance, such Officermay be dismissed or otherwise dealt with by the Com-missioner.

(f) If an Officer is, on an indictment, convicted ofany offence, he shall be dismissed the service.9. Retirements.

An Officer who has reached the age of sixty years maybe called upon to retire, and the Commissioner shall de-cide Ivhether any Officer having reached this age shallcontinue in the Department.10. Reductions in Stall.

(a) The Commissioner may, if he thinks it desirable,abolish any office or reduce the number of staff, and insuch eases may dispense with the services of any officersor offer them positions in lower classes as he may deemfit.

(b) Whenever the Commissioner considers it neces-sary to reduce the number of staff, the following shallbe the course adopted with regard to the re-employmentof retrenched Officers, viz.:

(1) The name and address of each Officer shall beregistered. As vacancies occur each shall, inorder of seniority of service, all other thingsbeing equal, have the offer of re-employmentin any position in the Department for whichhe is qualified.

(a) Should an Officer be transferred from anotherBranch of the Government Service to the Railway De-partment, such transfer shall not carry with it anyrights or privileges contrary to, or in conflict with, anyBy-law, Award or Agreement which may be in force atthe time of such transfer.

(b) No Officer, unless authorised, shall incur liabilityor enter into any contract on behalf of the Department,or alter the terms or conditions of any contract.

(e) In the matter of accounts and the collection andremittance and payment of Public Moneys, each Officeris enjoined to conform strictly to "The Audit Act,1904," and such regulations and instructions as may beissued from time to time.

(d) A son of an Officer shall not, without the consentof the Commissioner, be engaged in any office or at anystation under his father after he attains the age of 21.

(e) Tn the event of any questions arising as to themeaning of this By-law or any part thereof, or as toanything done or alleged to have been done thereunto,or contrary thereto, it shall be referred to the Commis-sioner, whose decision shall be final.

(f) Every Officer will hold his appointment condi-tionally upon his being subject to and strictly observingthe By-laws, Rules and Regulations established fromtime to time for his or her guidance.

WHEREAS by the powers conferred by the said Actsthe Councils of the Municipalities of Fremantle and EastFremantle are jointly authorised to carry out certainundertakings and works and to borrow money for suchpurpose, in the proportion of six-sevenths by the Muni-cipality of Fremantle and one-seventh by the Municipal-ity of East Fremantle: Notice is hereby given of theintention of the said Municipalities to borrow, in theaforesaid proportions, the SUM of Twenty-one thousandpounds (£21,000), that is to say, the Municipality of
